an evening workout ends in homicide. police have arrested a san francisco man who they say used a local gym's equipment to beat a man to death. today in the bay's stephanie chuang is outside the gym this morning. i understand this happened inside the gym while people were around. >> reporter: that's right. it's hard to imagine. dozens of people in the gym. tough to think there was such a vicious attack in this building just 30 hours ago, an attack using a solid bar used to lift weights. police arrested 46-year-old kenneth osoko yesterday. they say he got into a confrontation at the gym wednesday night and they attacked the man, striking him

in the head over and over again before taking off. the man died at the san francisco hospital. patrons of the gym say they had to find out about this on their own. >> yesterday morning, i didn't even know what happens. the trainer, the person who opens up at 5:00 acted like nothing had happened. i just learned this yesterday late afternoon from my brother. he told me he heard from other customers and people that work there. >> reporter: now this morning i did ask for a comment from management but was told that no one could talk to me until after at least 8:00 this morning. we still don't know the identity of the victim but we do know the suspect is behind bars this morning at san mateo county jail booked on the charge of murder. >> i can't believe it. those bars are kind of heavy,

about 45 pound, right? >> reporter: yeah. most people said they hadn't heard about it. the one gentleman said he had to hear about it from his brother. people are back to normal here. routine for them this morning. >> thank you very much for the latest on that case. this morning we have new details raising new questions about 49ers player ray mcdonald and his fiancee. in august he was arrested at his home on domestic violence charges. now the san jose police department has released a report about an incident at that same home back in may when someone called 911 and reported a woman at the home was holding a gun during an argument. it's believed the two people involved in that case were mcdonald and his fiancee. investigators say the woman set the gun down and let the home after the man threatened to call 911. no charges were filed in that case. >> legal analyst stephen clark

said this old report could shed new light on the case. >> if mr. mcdonald can show on past occasion he was the one who felt threatened because his fiancee picked up a gun that, could explain his conduct in august if he grabbed her. it gives credibility to a potential self-defense case. >> mcdonald has not commented on the may incident. the defensive lineman has not yet been formally charged by the d.a. and continues to play for the 49ers. team officials say they will let due process run its course before making any decision on his future in the league. it's important to note we have repeatedly asked police for the report regarding the august incident that led to mcdonald's arrest. the department said it will not release that report. >> now to developing news on the biggest fire burning in california. 12,000 homes still at risk of burning down as the king fire continues to grow. in fact, the state estimates it's now spending $5 million a

day to fight those flames. more than 73,000 acres have burned and thousands of residents in the area of pollock pines are been evacuated. investigators believe that fire was intentionally set. today the man accused of starting the fire will make his first court appearance. officers arrested wayne huntsman yesterday. they say he's a local with a criminal history. he's previously lived in aptos and santa cruz. yesterday his sister, who didn't want her face shown on camera, said she didn't believe he set the fire. >> i'm devastated, in shock. i can't believe he would ever have anything to do with something like that or do anything intentionally like that or be part of it. to me he would be on the other end trying to help people and put it out and do what we could to be of assistance. >> the highway has shut down part of highway 50. crews battling another destructive wildfire during the

oregon border continue to make progress. that fire destroyed more than 150 homes in the town of weed. evacuation orders are still in effect but the fire is now 85% contained. >> a few san jose employees have been buying expense of tablets, renting bmws and picking up tabs for hundreds of dollars for fine wines. just one issue, they did it with your money. in one case, an employee who totalled his car used his city credit card to rent a new bmw for more than two weeks. another treated city staff to dinner at a downtown restaurant spending more than $700.

>> a health warning for parents. the same virus that has sent hundreds of children to emergency rooms in the midwest is now reaching california. cases have been reported in southern california. concern over the virus has led to crowded waiting rooms across the state. of the four cases here, three are in san diego county, one in ventura county, all of them children. the virus, which has actually been around for decades spreads like common colts. doctors say children with asthma are more susceptible to the virus. >> if they're wheezing, in distress or using the muscles in their rib cage to breathe, you should take them to the

morning san jose, 64 in sant martin and happy friday by the way. in concord, this is what we're working with for today. a lot of moisture out there white now but we'll see a strong onshore flow pick up as we head throughout the day. what that means is all of those westerly clouds will start to move onshore, the fog we're so accustomed to. i also want to show you what's happening in the area of pollock pines right now because they have some really great humidity recoveries overnight and the wind right now is not that bad. they're under 10 miles per hour. openfully firefighters are able to gain some ground on that fire, which we should be getting an update for you for in just about half hour, maybe 45 minutes. sunrise, 6:56 this morning. your days are getting shorter. we got great air quality out there, plenty of sunshine today.

it is good news for thousands of muni riders. the contract was approved by the board of supervisors last week to help muni expand and reduce crowding and maintenance problems on current light rail cars. the trains will be produced by simmons industry in sacramento and will cost the city $648 million. >> three idaho teen-agers are lucky to be alive after a childish prank led to a major car accidents. deputies say this vehicle crashed early sunday when a passenger used a lighter to set the driver's armpit hair on fire. none of the teens were wearing a seat belt and all three were injured in the crash. deputies say the driver was also cited for inattentive drivingly the crash. the passenger with the lighter was also ticketed. >> just ahead, early morning

leaving us with abundant sunshine. and out in the tri-valley, not too hot today. you'll end up in the mid 80s. let's check your drive. here's mike. >> we have a slowdown really kicking in for san jose and another incident maybe coming into the downtown. 680 is where we typically see slowdowns happening this time of day but a little stronger than we typically see this time. we'll show you the maps. you dip in speed a bit around story road past our camera and up toward the airport where there was some debris reported in lanes. and approaching that same area, north 87 coming toward 280, we have maybe a disabled vehicle reported. i see some slowing just north of alma. now south 101 at cesar chavez, we had an earlier crash.
