good morning to you on this election tuesday. it's 4:30. i'm sam brock. and i'm laura garcia-cannon. let's check our forecast with meteorologist christina loren. good morning. >> hey, good morning. it is a big day. it is going to be spectacular all across the bay area for this election tuesday. i can tell you, though, it's chilly out there. grab your heavy coat because temperatures have fat i don't know -- fallen into the 40s and you're going to need it. temperatures are going to be really nice this afternoon but it will be cold, at least until

we get into about 10:00, 11:00. we'll keep you updated. right now here's mike with your drive. >> we're starting with south bay. we have the usual overnight construction on the south routes. highway 9, saratoga, a car went down off a steep hill there. the people injured have been taken from the scene, as i understand it. anywhere toward highway 17 you can still access the highway 9 area in the eastbound direction. but if you're east or west of there you have to use 35 and use that big reroute. they're saying at least until 5:00, i'm saying until sunlight when they can do the work to remove the car. >> at 4:31, turning to decision

2014, soda tax proposals. the san francisco needs two-thirds majority while in berkeley, a simple majority is required to pass their tax. >> in san francisco, about one in three measures gets the two-thirds vote. it's hard to raise that bar. >> it's going to change how the city, states look at these products. >> it's not right for the government to decide what's best for us to be putting into our bodies. >> if either measure passes, it will be the first soda tax in the country. >> here are some of the other large races that could have an impact on this election day.

on the south barys, all eyes on the 17th district court, khanna has closed most if not all. ground on the seven-term congressman. voters will also decide on a new mayor, liccardo is in a runoff with cortese. and statewide it appears incumbent jerry brown will remain governor. he has a nice wide lead over challenger neal kashkari. another high-profile and controversial measure is proposition 46. that looks to hold doctors and physicians more accountable through drug screening and higher malpractice limits. critics say the measure is geared as much to trial lawyers as it is to doctors.

if you encounter a problem at the polls, please contact our tipline. >> investigators in the east bay are trying to figure out who gave a child a bag of methamphetamine on halloween. the 8-year-old had been trick or treating in the promenade area friday night. police say parents found a bag with white powder in the child's candy bag yesterday. >> he had been checking he is child's halloween candy after initially putting it up away in the cabinet on halloween night. while checking the candy, he found the baggy and suspected it to be illegal drugs and wanted to report he had found that. >> the powder tested positive for a tenth of a gram of methamphetamine. police say it's a good reminder to check your children's halloween candy. >> police last month arrested

christopher german. a surveillance video placed him at the attacks. in each case the girls' parents were in nearby aisles. he faces two felony counts of lewd and lascivious acts with a child. >> a gruesome discovery closed thornton avenue last monday. police have now identified the victim as 24-year-old fernando of san lorenzo. they say he was shot and killed. >> for those calling for tighter regulations of ride sharing services, interesting and disturbing information. we're learning new details involving the ride share service lyft. shane holland and his friend left a halloween party when the

car spun out of control, crashed into a tree killing holland. holland says his son will be missed by a lot of people. >> all the friends that have sent me condolences on facebook and they all say he was great, some of them had problems and he helped talk them through them or worked with them on their problems and he really felt grateful for them for being a good friend. >> shane's friend and the driver also suffered injuries. >> it was certainly cold when i walked out the door this morning. >> there is a briskness in the air christina. but maybe that will give way to a nice day. >> it will. everybody at home, happy election day and the weather for today could not be better for outdoor activities, like voting,

for example. 45 degrees to kick off the day in san martin. basically a repeat performance from what we saw yesterday. temperatures are going to be about 3 to 5 degrees warmer. you'll notice more of a breeze as you head throughout this afternoon. temperatures really looking good. highs coming in about 2:00 with the time change. the peninsula 73, 70 straight up in san francisco, mid 70s for the east bay and the tri-valley. meanwhile the north bay, some gorgeous conditions but we're getting that peak foliage. i'm going to show you where and when you can check out the prettiest color. you know what, mike? it gets dark so early. certainly caught me offguard. it looked like the drive last night, too. >> christinchristina, i warned y in the bay area that listens to me. that's not my kids but everybody

else, i warned them. it's not big deal as you head over to the toll plaza. the bays itself move smoothly. coming off the carquinez and venetia bridges, the rest of your bay looks pretty good. typical overnight road crews in san leandro, we talked about 280 and 880. a highway between 35 on eastbound highway 9. a car went over cliffside, however whoever was injured in that has been taken out.

an easy light flow of traffic from willow avenue all the way into san mateo. ooh, laura, you have some information for san mateo. >> new on-ramp meters will be on between northbound 101 and candlestick point. lights will be set for solid gro green, that's nice. then they'll begin cycling through red and green in the afternoon and then in the morning. >> see what kind of impact that has on drivers and congestion. >> plus how disney got apple and google to work together. >> and the former vikings running back in court. the reported deal that could get him back on the field soon.

you're watching "today in the bay." >> the san jose city council will decide today whether to roll back new medical marijuana restrictions. the council will vote on an initiative submitted by supporters of medical marijuana to repeal many of the regulations the city put in place in july. that restrictions forced dozens

of pot shops to close this summer. the initiatives would do away with distance requirements from schools, day cares and community centers. >> also on the agenda, the san jose city council will vote to extend talks for a new proposal for a stadium at the a's. the a's have signed a contract to stay at the stadium for ten years but it includes an out clause in case the a's can get a new stadium. >> apple says their smart watch kicks off at $350. honda under investigation for faulty air bags that have led to

spread between coastal cities and what we're expecting today. we still have cool air trailing behind the front that came through on friday. it's going to take one more day to mix out and then we'll warm you up. look at the difference between today and tomorrow you, up to 80 degrees in the south bay. then we'll slowly take your temperatures down getting into the weekend. we're still counting on that next rain chance into next tuesday. >> thank you very much. an nfl player involved in a high profile child abuse case expected back in court this morning. adrian peterson was indicted in september after authorities say he hit his son with a switch. the minnesota vikings running back is reportedly considering a plea deal. that agreement could come as early as today. peterson was deactivated on the vikings and is on the commissioner's exempt list until the case is involved. >> investigators looking closer at some of the human factors

and welcome back, as we give you a live look right now of a very empty but very content at&t ballpark on this tuesday, election morning. madison bumgarner received a truck after he was given the mvp award but he doesn't know exactly where that truck is. he replied it's been so busy the last few days, i was just talking to my agent about tracking that thing down and see if we could have some fun with it. that truck was recalled because

well past 5:00. but we do have that roadway reopened, highway 9 between 35 and sanborn, the car went down the hillside, they pulled it out of the area and cleared all equipment out of that area as well. it's a clear drive right now through saratoga. the bay bridge toll plaza is also clear. two of your cash tollings are not yet open. that should change in five minutes. and the golden gate bridge, they have not yet moved the cones for the morning commute. they will be there shortly. no big concern when they are there. just flashing lights. we're expecting them. the north bay, you do see there are headlights where we don't see any taillights.
