on this tuesday, november 4th but it's clear, get out there and vote. this is "today in the bay." >> and a very good morning to you. thanks so much for joining us. i'm laura garcia-cannon. >> and i'm sam brock. we're going to begin today with decision 2014. all eyes on the congressional race in the 17th district between a veteran and relative political newcomer. bob redell is live in downtown this morning. ro khanna could be edging out his challenger. >> reporter: it's incredible when you consider congressman mike honda had roughly a 20-point lead over ro khanna. here we are, the polls show the two pretty much in a dead heat.

honda who is 67, khanna, 38, used to work in president obama's congress. both men are democrats who came in first and second in june's primary to qualify for today's runoff. but honda has tried to paint khanna as a conservative, which khanna denies calling that charge a sign of desperation. khanna's team has criticized honda for sponsoring only one bill during his 14 years, a bill to name a post office. honda has the backing of president obama, governor jerry brown. khanna has the backing of many big names in silicon valley, like marissa meyer and san jose mayor chuck reed. two men are vying for chuck reed's job, dave cortese and sam

liccardo. we'll have the details on that race coming up within the next half hour. reporting live here in downtown san jose, bob redell, "today in the bay." >> it will be a good pulse of bay area voters. thank you very much. >> in two cities, they may the first anywhere to tax taxes tore soda or sugary drinks. if that sound familiar, it's been attempted some 30 times before in other cities and it's always failed. nanette miranda is live in one of the cities now diving into the soda tax waters. >> reporter: good morning. in berkeley it's called measure d. in san francisco it's called proposition e. if either passes, it would be the first in the country to do so. both would tax sugary drinks between 1 and 2 cents per ounce depending on the city.

there are some exception for low calorie drinks. the beverage industry has poured $11 million into making sure both measures lose. supporters say this extra tax is needed to fight the obesity epidem epidemic, to get people to think twice before reaching for the soda or sweetened iced tea. they say it hits lower income people the hardest. >> it's not their place for them to decide for us as consumers what's best to put into our body. >> a last-minute push last night to get people to support the soda tax. some political watchers say if you can't pass a soda tax in liberal san jose or berkeley,

you can't pass one anywhere. all previous attempts to pass a soda law have failed so all eyes are on the two measures. >> we'll see how it all shakes out. thank you, nanette. in oakland, the mayor's seat up for grabs there. a lot of options, a lot. 15 candidates on the ballot. oakland uses rank choice voting. it also manse the person who gets fewer first place votes may still become mayor if he or she has enough second or third place ones. that is how major gene quan was elected four years ago. it's a tight race at the top so it's anyone's guess who will be winning. >> well, maybe the first litmus test for fracking in california.

san benito county voters will decide on measure j which would outlaw fracking. just click on the decision 2014 button at the top of the page. the wb site will also keep you up to date on all the election results happening tonight. that's nbcbayarea.com. >> parents want to know who passed out drugs on halloween. >> kris sanchez has more on this disturbing discovery. a father just going through his kids' candy? >> reporter: yeah. whether it was some kind of sick trick, police won't know.

police say the father was looking in his child's halloween candy on friday night and found that little pink bag of meth. a tenth of an ounce of meth is enough for someone to be charged with a felony. >> he had been checking his child's halloween candy after initially putting it up away in the cabinet on halloween night. and while checking the candy, he found the baggy and suspected it to be illegal drugs and wanted to report he had found that. >> police say this is the only reported case they have gotten so far in that promenade neighborhood of hercules, a pretty family-friendly place. but for folks who live in that neighborhood, one is enough. one young woman told us that when her mom hearse about that story, all of her little brother's candy is going straight in the garbage.

we have showers coming down just to our north but a big ridge of high pressure is going to keep those showers from moving into the bay area, as we have this beautiful, beautiful day shaping up. you'll see old glory getting some good pick up for the wind. you got to wait for this cold air to kind of mix out and that's going to take about 10:00 to noon. highs come in at 2:00 with the time change. san francisco getting a taste of the 70s again. out on the east shore, 70 degrees for you as well. so spectacular conditions today, some changes coming your way as of tomorrow these numbers spike and then we still have rain in the forecast. we'll talk about that coming up. first i want to check your drive. it's a pretty big day obviously because of the elections but

also the kids have to get out there, they got to get to school. and with that time change, we're getting a little bit more sunlight early but it gets dark earlier and that can be kind of tough for the drivers. >> you're absolutely right. the evening commute should be tougher, being tuesday, a darker kmoot means people skid addle out of the office closer to 5:00. all cash lanes are now open and no problems out of the maze, the east shore freeway moves nicely as well. we have traffic starting to build a bit for your upper shore east freeway. the earlier slowing we saw for the venetia bridge looks good.

in virginia, a flurry of last-minute stops yesterday, fighting to succeed former house majority leader kantor. and mish mcconnell is fighting to hold on to his seat in kentucky. the republican easily beat out a tea party challenger in the primary and now he's in a heated batty with kentucky secretary of state alison grimes. grimes is backed by president clinton. >> people in alaska and oregon will vote on legalizing pot while voters in maine will vote on loosening restrictions. some people in arkansas finally ready for prohibition to end. there are 37 dry counties in that state but a ballot initiative would legalize the making and selling of alcohol statewide.

a september poll found 54% of voters are likely to vote against that initiative. interesting, sam. >> very much so. thank you, laura. 5:14. what is the last thing you would expect the saudis to do in the face of low oil prices? scott, you're trying to fool us? >> lower prices. really? lower prices? this is exactly what happened and why you're right on, sam. not only is gas going to get even cheaper now that the saudis have lowered prices, we need to start thinking about how this is going to affect all kind of things. for instance, it's now going to be much cheaper to import oil than to produce oil from the shale in north dakota. if the saudi announcement startled wall street, we certainly think it did. let's turn to jackie deangelis.

>> futures pointing to a lower open on wall street after a mixed day for the markets. as you said, a big drop in oil prices, weighing down stocks like chevron and exxon mobil. crude trading at the $76 level. that's a four-year low. and also look for data on the trade deficit and factory orders. the dow falling 24 points to finish at 17,366. the nasdaq closing up 38 points. >> thank you. good news if you're from a nontraditional family, meaning you have both apple and android. apple says you'll be able to download it on one and play it on another. the latest version of "call to duty", the latest video hits stores today. it is hard to get your head

tri-valley as we head through 2:00. the polls open at 7:00 a.m., right after "today in the bay," and they'll remain open until 8:00. so, yeah, you want to get out there. today is the last day to rock the vote. now, getting into the next couple days, we've got changes coming your way. the heat is on by tomorrow. we'll bring your numbers up to about 80 degrees. in san jose, we'll talk about 84, maybe 85 degrees out in the tri-valley. meanwhile, look at san francisco tomorrow. 77 degrees, abundant sunshine coming your way. temperatures will slowly start to fall as the jet stream returns to us thursday through saturday but not expecting any storm system to ride that jet until we get into the next week. take a look at what's developing. as of tuesday of next week, rain back in the forecast. what's really great about this system is it looks like we'll hit that subtropical moisture tap yet again and hopefully get

some generous totals upwards of a half an inch. coming up, i've got a sneak preview of the heat coming in tomorrow. the north bay will see the highest temperatures. here's mike inouye and your morning drive. >> if i vote for rain in the next week, i might get that vote. with a lower voter turnout we're expecting, your vote counts more. as we look at our maps, the speeds are commensurate with that. a little slowing down into liver more and closer to that dublin interchange right there there, as the gathering starts approaching 680. no delays in the tri-valley out of the ordinary, just that gentle build for the traffic flow. this over here, highway 9 was closed between 35 and sanborn because of an overnight crash. it has reopened, though. chp tells us it's open for the

morning and you head out of saratoga and in toward 17. the rest of the bay moves very smoothly. let's give you a look because getting out of san francisco, we had a slower drive showing um on the lower deck. i see it moving smoothly here. back to you. >> thank you very much, mike. at 5:21, a follow up to an investigative exclusive. it is one of the most polarizing questions nationally. what do we do with people crossing over the border, some of them children? >> the federal government's statistics has shown this has already become a humanitarian crisis. a quarter of a million people who are not from mexico have been picked up by the u.s.

border patrol at the border. they are fleeing places where drug gangs and death squads have taken over entire cities. so many people have fled those scenes in central america that here in the u.s. there's no room in court or in holding facilities anymore. now after picking up these immigrants from the border, federal agents are rereleasing them back into the united states if these refugees have relative already living here who can pay for a bus ticket. ice just drops them off at the local bus station. in fact, we rode the bus with some of these migrants just to get to know them better. they all say they fear for their safety and say they will be killed if they go back. this has called for even president obama to call for a chang in the immigration laws. secretary jay johnson said the number of re jis has slowed but

"today in the bay"'s bob redell with more on the race. >> reporter: good morning. the main issue this time around for the san jose mayor race is how to fix the san jose police department, which has gone through drastic cuts in recent years. this race does pit two men who are very familiar to south bay voters, one of them being sam liccardo, who currently sits on the san jose city council. he'll be going against dave cortes, a santa clara former supervisor himself.

cortese, who has the backing of the police association said he'll add 140 officers if elected. liccardo said he and mayor chuck reed have already put a plan into place to hire 200 officers over the next four years and this was starting bac2013. whoever wins this race could have a major impact on how the city of san jose goes forward with pension reform. in 2012 voters overwhelmingly passed measure b to rooen in pension costs to help with the city's budget deficit. many blame measure b for contributing to low morale in the police department, a measure that liccardo supported and cortese didn't. the union did get a judge to rule parts of measure b illegal. the city is trying to appeal that ruling. now, south bay voters are also trying to choose their next

congressman. reporting live here in downtown san jose, bob redell, "today in the bay." >> some big races in the sou bay. thanks a lot. >> there's a lot of action on that ticket today. the position of head of state is actually up for grabs, though it appears jerry brown will remain governor. polls show he has a canyon-wide lead over neel kashkari. and prop 46, it looks to hold doctors and physicians accountable through drug screening and higher malpractice limits, about but critics laenl the measure is geared as much to trial lawyers as it is to doctors. in less than ten minutes, we'll go live to washington where the selection is going to have a major impact throughout the country as all of the house seats as they are every two

years are up for grabs. as well as a third of the senate. that could change party control. >> at 5:32, firefighters had to work quickly to put out flames at a construction site in pleasanton. crews were able to knock it down within minutes. no one was hurt. several homes were being built at the construction site. two of them were destroyed. investigators are looking for a cause. >> very saddening and scary news this morning for those thinking we need more regulation for ride sharing services. new details about a deadly crash involving the ride share service lyft. shane holland and his friend left a halloween party saturday morning when the car they were in spun out of control, crashed into a tree and took holland's life. his father said his son will be missed by a lot of people. >> all the friend that have sent

high-profile child abuse case is expected back in court this morning. adrian petersen was indicted after authorities say who hit he is. an agreement could come as early as today. peterson was deactivated by the vikings, has been placed on the commissioner's exempt case until his case is resolved. >> and the ntsb now believes that the pilot prematurely unlocked the pivoting tail section of the shift when it crashed over the mojave desert. the co-pilot somehow managed to parachute to safety. they want to know hough he survived the descent from the

5:40 right now. it is election today and your vote could lead to a shift in power on capitol hill. polls here in the bay area open in about an hour but voting already under way across the country. tracie potts following it all live from capitol hill this morning. even democrats don't think they can take control away from the republicans. >> well, they seem to have as one lawmaker put it the wind at their backs. the polls are showing they've got an advantage going into election day but do the math and it's not necessarily a given that they're going to take over the senate. that's the key here. there are eight races out of the 36 senate races that are too close to call at this point. we're watching them very closely, and they're all over from north carolina to new hampshire to alaska. if republicans can pick up six seats, they can take control of the senate. we're also watching all 435 house races and 36 gubernatorial races around the country. the justice department is watching what's going on at the polls. they've got people fanning out

to more than two dozen districts around the country where they fear there may be problems with voter i.d. laura. >> in the most recent nbc/wall street journal poll shows voters most concerned about the economy and what effect this may have on the election front. >> well, exactly. that does seem to be the number one issue in our latest polls. if republicans take over congress and dealing with a democratic president for two years, maybe nothing gets done. or as some analysts have said, maybe they carve out a couple of areas where they can find success, things they think the president won't veto. >> tracie potts, thank you very much. >> avoiding another government shutdown would be nice. the bay area is killed with key races but voters in two cities may be the first anywhere to green light attacks on the soda industry. nanette miranda is joining us live in san francisco.

municipalities have tried this before, we've been down this road unsuccessfully. good morning. >> reporter: good morning, sam, you're right. 30 attempts across the country and none of them have ever been successfully passed to implement a soda tax. it will be interesting to see what $11 million will buy the soda industry. that's how much it has poured into this bay area race, which is called measure d in berkeley and prop e in san francisco. the soda industry knows what a tax is levied on sugary drinks in one city, it won't be along before other cities will follow. supporters have found it tough to battle the multi-million dollar war chest. they would tax sodas, soft drinks and iced tea, a penny to two pennies an ounce, some diet

drinks have been exempted. the berkeley measure only needs a majority vote, san francisco's needs a two-thirds vote because it's a special tax earmarked for specific programs. now, keep in mind even in progressive san francisco, voters tend to vote down one in three tax measures. so it's very difficult to get to that two-thirds threshold. live in san francisco, nanette miranda, "today in the bay." >> no question the bar is very high on that. the investigative unit will be looking out for any voting day troubles. if you have troubles at a poll, call our tip line or notify our investigative unit. >> a woman will cast her vote for the first time after 102

our north. they will not make it into the bay area. and that's because we have this big ridge of high pressure keeping things nice and clear and dry for us. and as these showers collide with that ridge, you can see what happens. they just kind of fall apart. so as we head throughout the day today, temperatures are actually going to end up a touch warmer than yesterday with high pressure firmly in control and wine country is going to be spectacular, great conditions all across the bay area, 3 to 5 degree climb today and then we'll peak as we get into your wednesday. but for today, not bad at all. the peninsula at 72 and 70 degrees straight up for the east shore. getting into tomorrow, 80 degrees, it will be a little bit on the warm side. but just as quickly as we climb, we're going to bring those numbers right back down. and then we're looking at our rain chances coming in next as we head throughout tuesday at about 3:00 a.m., i'm so happy to show you the latest model runs because they're actually keeping this thing together before it comes in the bay area, which

means we could hit that subtropical moisture tap and get generous rainfall totals which we desperately need. that's good news. we'll keep you updated as that storm system gets closer to our area. right now it's a traffic tuesday. >> good morning, east shore freeway, we head eastbound with that traffic. i wanted to put the camera here one more time and show you how quickly traffic occurs. eastbound is countercommute, toward the bay bridge toll plaza, you'll see that all those lanes are backed up because the metering lights were just turned on a couple of minutes ago. that's a little later than we expected for a tuesday. we'll talk about the time change that happened over the weekend. we do have a change to the flow of traffic, folks just adjusting to that new time and the morning schedule might be affected slightly for that. you see slowing right now past golden gate fields for your westbound commute. we'll see more traffic heading

toward the bay bridge. as we look at the rest of the bay, we're talking about the even commute being impacted with darkness earlier and it will cause traffic to slow down as it did yesterday. here's the southbound with northbound 101. over there at tri-valley, easy drive. a look at the san mateo bridge. the live shot shows you a volume of traffic, building up westbound over the high rise. you do see we had a stalled vehicle right here getting off. it looks like they have cleared that from the roadway and that will increase traffic heading toward san mateo. >> thank you very much, mike. heads up for driver in san mateo county. as you mentioned, new on-ramp meters will be on along highway 101. the north meters will be activated on highway 102, they'll begin cycling through red and green during the afternoon commute and the

morning commute the week after that. >> investigators in one bay area city trying to figure out who gave out drugs to a kid on halloween. kris, so far drugs were only found in one child's trick-or-treat bag but there's fear this could be more on the way. good morning. >> all of us have sorted out the candy, but do make sure there wasn't anything untoward in there. police don't know whether the drugs were meant to be a trick or whether they fell into that bag by accident. they were in the promenade neighborhood of hercules when someone put this into a child's halloween candy basket on friday night. that tiny baggy of white powder tested positive for methamphetamine, enough to constitute a felony. we talked with two teen-agers who were out on halloween themselves. they say they were surprised. one young woman says he doesn't think her younger sibling will

get any more candy. >> my mom will probably toss it now. >> it is surprising. now it makes you wonder like why is something like this going on in your neighborhood. >> hercules police say they would like to track down the person that those drugs belong to so they can determine whether this was done on purpose or whether it was some sort of accident. police are urging parents to go through the candy one more time, throw it out october dining room table, sort it out and report anything that could be a drug. >> we're hoping this is just an anomaly and something not happening anywhere else. thank you very much, kris. >> a man accused of groping two young girls in separate east bay stores is expected to appear before a judge today. police last month arrested christopher german a few days after the incident. surveillance video placed him at the scene of each attack. the cases happened within moments of each other, one inside a walmart and the other inside a target store. in each case the girl's parents

were in nearby aisles. >> the reecent discovery of a man's body near a busy bay area street has turned into a homicide investigation. the discovery closed the area near gate way boulevard and willow street. the victim is 24-year-old fernando garrow. police are looking for a motive and suspect. >> the counsel will vote on an initiative submitted by supporters of medical marijuana to repeal many of the regulations the city put back in place back in july. those restrictions forced dozens of pot shops to close this past summer. the initiatives would do away with distance requirements from school, day cares and community centers. the council can either adopt the initiative as it or submit it to voters. also on the agenda, the san jose
