i'm sam brock. >> and i'm laura garcia-cannon. we begin with decision 2014. it looks like change is in the air this morning in the race for oakland mayor. an official winner has not been declared, but one candidate is declaring herself the mayor, and it's not current mayor jean quan. nannette miranda has the latest for us. good morning, nannette. >> reporter: good morning, laura. rank choice voting can certainly throw a curveball, but it's starting to look like voters are rejecting the idea of giving oakland mayor jean quan a second term and instead giving city councilwoman libby schaaf a chance. here's the latest results. schaaf is leading at 28%, jean quan in second place at 15%, and rebecca kaplan running in third place. things start the to turn around for schaaf when governor jerry brown endorsed her about a month before the election.

schaaf was once brown's special assistant when he was oakland mayor. schaaf is known to be a budget watch dog and good government advocate since being elected to the city council in 2010. current mayor jean quan never really recovered from her handling of occupy oakland. the public's dissatisfaction with that put her job in jeopardy. quan is on track to becoming the first oakland mayor since 1990 to lose re-election. her pitch to voters highlighted a decrease in crime and a rise in development, but they apparently disagreed. while schaaf has claimed victory, oakland does have rank choice voting, which means that the top vote getter doesn't always win, but officials are still working on the final count. live in oakland, nannette miranda for today in the bay. >> thank you very much. in the south bay, san jose's mayor could come down to the wire, couple thousand votes out there. bob redell live with the latest.

bob, we do understand 100% of precincts have reported. good morning. >> reporter: it is, but we're waiting for mail-in ballots to be counted. good morning to you, sam. this is a close race, but it does appear san jose city councilman sam liccardo will be taking over here at city hall. here are the latest numbers with all precincts reporting in the race for mayor. liccardo leads his opponent, santa clara county board supervisor dave cortese by two percentage points. you can see 51% to 49%. it's been a very tight race. there are only about 2,200 votes left that separate the two men, and as i mention, still mail-in ballots that need to be counted. it's not clear whether there are enough of those ballots to make a difference in this race. so far liccardo has not declared victory and cortese has not conceded defeat, but both men express confidence in their campaigns before supporters last night. >> we know this journey began

over a year ago. and in that time, taken us through virtually every san jose neighborhood, seemingly every street of this city. we started this journey when a lot of folks didn't think we had much of a chance, except for an awful lot of people in this room who knew we did. >> you know, for most of our lives, you know, i just tried to be a good public servant, really, and, you know, that's all i need out of this. but people have worked so hard, they deserve to celebrate. they got to have something to cheer. if they want to cheer me tonight, that's fine, but they should be cheering themselves. >> reporter: the race for san jose mayor has focused primarily on two issues, pensions and public safety and how to rebuild the san jose police department. you're well aware the last few years that department has been losing officers, many upset with the reduced pensions. you might recall voters

overwhelmingly passed measure b. in 2012. that was a law that reduced pensions for city employees here in the city of san jose and in order to get the budget deficit under control. that's a measure that liccardo supported. cortese was against, hence the reason cortese did receive the backing of the police union during this mayoral race. again, 100% of the precincts reporting, showing that liccardo right now leads cortese 51% to 49%. still need to get the full count of all those mail-in ballots not been counted as of yet. reporting live, bob redell, today in the bay. >> as soon as we have finality in the race we'll report the results to you, thank you very much, bob. the closest bay area congressional race is pitting mike honda against ro khanna. here's the latest on that race for district 17's house seat. here you see honda holding a slim lead, 52% to ro khanna's

48%. the voters in two bay area cities overwhelmingly decided to raise the minimum wage. in san francisco, proposition j. passed. it will gradually raise the city's minimum wage to $15 an hour. you see the results there, an overwhelming outcome, 77% to 23%. just a few percentage points of precincts still to report. san francisco is the second city in the nation, behind seattle, to raise the minimum wage to $15 an hour. over in oakland, measure f.f. passed, as well, that measure will gradually raise the minimum wage from $9 to $12.25 in march. san bernardino county workers have spoken their mind about fracking. voters approved measure j. 57% to 42%.

it puts a moratorium on fracking, even though fracking isn't currently going on there. santa clara county voters also shot it down. oregon, alaska, washington, d.c. have all voted now to legalize recreational marijuana. oregon and alaska will join colorado and washington state, as for washington, d.c., congress has the power to overrule that move, since it's not a state. voters in florida rejected a proposal to legalize medical marijuana. we'll have continuing coverage of this year's midterm elections all morning long. the results will be scrolling at the bottom of the screen in a couple minutes, also get the results at our website, nbcbayarea.com. let's check the forecast now with meteorologist christina lor loren. >> let's do that. good morning, christina. >> let's do it. temperatures in the 40s and 50s right now. it's chilly out there. good morning to you, my friends. i really want to draw your attention to this beautiful

temperature, 27 degrees. that is cold enough for snow making and they are steadily doing so up in the higher elevations of tahoe as we speak, hoping for some of the ski resorts to get to open up after next week, when we get several storm systems. right now, the best chance looks like late november, that's when a lot of resorts are slated to open up, but that could change if this next storm system provides enough moisture. we're not going to see that moisture for several days. first we've got high pressure firmly in control. let's kind of talk about what's going on out there. you can see we have the area clearing over the bay area. that has to do with the big ridge. storms just to our north not letting any of that precipitation in. in fact, we're going to bring temperatures up by a good five to ten degrees. that translates to 80 degrees here in the south bay. 77 degrees on the peninsula. you'll hit 74 on the east shore, and san francisco checking in with a gorgeous temperature, 74 degrees. warm out there in the

tri-valley. 84 degrees. good news is, just as rapidly as we brought the numbers up, we're going to bring them right back down. you know what, mike, looks clear through oakland, but just like yesterday, we are expecting the fog to develop and settle in over the next couple hours. right now, things are looking good here. you know more about that than i do. what are you working with? >> typically shows oakland, but i think there was a switch in the back room, that was fremont. they are both 880 and both on the east bay, all moving close, this is the problem on that side of the bay, west 580 approaching the dublin interchange. slow drive, look at that in the distance. i've seen traffic start to build that might mean what's going on in the map here started to shift, as well. road crews sustaining later than they typically do, although they've been approved until 5:00 and backup forming through our camera shot. now on the approach coming out of livermore, build starting as the commute starts to come over.

we'll watch to see if they merge or if this clears in time for folks to get their commute undisturbed. rest of the freeway undisturbed across the bay, the bay bridge toll plaza, no backups. all the cash lanes are open. back to you. >> that is a beautiful sight. thank you very much, mike. it is 5:10 right now. san jose police are looking for a gunman behind a double shooting at an apartment complex. kris sanchez joins us live. one of the victims is a teenager. >> reporter: well, yes, laura, that victim will survive, but it's plausible the person who was shot and killed in this shooting and the person who pulled the trigger may have known each other. that's because it happened inside an apartment along almadon road, a densely populated neighborhood. lots of apartments out here. san jose place say they were called to the scene about a quarter after 5:00 yesterday evening, and that's when they found a man shot to death, a

16-year-old boy was also shot in this incident. he was transported to the hospital, his injuries are not threatening his life. it appears he is going to survive. san jose police have not yet released a suspect description to us, nor what the motive in this shooting might have been. the coroner will not release the victim's identity until his family is properly notified, but we can tell you this man is the city's 31st homicide victim of this year, and the second homicide victim in the city of san jose this week alone. in san jose, kris sanchez, today in the bay. >> thank you. 5:11 right now on your wednesday morning. a big hearing today for the nfl. ray rice fighting to get back in the league. details next. plus, the grateful dead will be the center of a conference at one bay area university. we'll have details next. we'll look at the stock market post-election, and why google glass may not let you see as much as you would hope.

to help take our party forward, and i want you to know this, i'm just getting warmed up. >> neel kashkari down, but not out, promising to move forward from here. kashkari losing to incumbent governor jerry brown, taking a look where the 100% precincts reporting. jerry brown, 59% to 41%. in the meantime, harris cruising to a win in the attorney general's race, taking it 56% to 44% over ronald gold. tom torlakson hold on to his position as superintendent of public instruction, with nearly 100% of precincts reporting there, as well. there you see tom torlakson 52% over marshall tuck, another familiar name, at 48%. let's talk about john chung. he's won the election for california's treasurer. the former comptroller taking it

for the 58% to greg conlon's 42%. 100% of precincts reporting there. let's move on to something else, kind of. low oil prices could go even lower, thanks to the election. republicans generally thought of as pro energy here. >> pro fossil fuels, pro oil. with the republicans now in the majority on both sides of the house, we may see a push for more drilling, more pipelines, lower gas taxes. it's just one of the ways we may see the midterm election affect the economy. we're going to talk more about the economy and the election coming up in just a bit. in the meantime, let's talk about the stock market, because remember, the stock market and the economy are two different things. for that and the rest of the news, morgan brennan is live at cnbc world headquarters. good morning. >> good morning, scott. futures are higher after stocks ended mostly lower tuesday after another drop in oil prices that weighed on the markets. crude is trading at a three-year

never, never me. over here, no real slowing. we'll give you a live look at the san mateo bridge itself. westbound, across towards the peninsula, no delays over there. 101 through san rafael, take a look, getting more company for these folks, that's good news. better news, limit down to the golden gate bridge. back to you. >> thank you very much. 5:21. lawyers for ray rice will argue his case today in hopes of getting his nfl suspension lifted. rice was suspended in definitely, and cut by the baltimore ravens after video surfaced of him punching his then-fiance janay palmer. rice's argument is the nfl knew about the incident before it became public and already punished him for it. goodell insists no one at the nfl has seen the video. a man convicted of killing a millionaire during a home invasion robbery will be spending the rest of his life behind bars. he was convicted of first-degree

murder with a gang enhancement yesterday. that conviction requires a life sentence without the possibility for parole. investigators say drummer broke into the millionaire's home two years ago and gagged the man with duct tape. investigators say he choked to death while drummer made off with crash, jewelry, and other valuables. >> 5:22. redwood shores hotel has closed its kitchen after dozens of people got sick at last month's naacp convention. the outbreak was first reported last week when several people were taken to the hospital after getting severely sick. now more people became ill at other events at the hotel, causing the hotel to just close the kitchen. county health officials do not know exactly what made people sick and they hope to get lab results back this week. deadheads right now are trucking to the south bay this morning, making the long strange trip not for a concert, actually for a symposium. a four-day grateful dead

grip in the house of representatives. that means more political problems for president obama, but what does it mean for our economy in general, and your money, more specifically? scott mcgrew joining us now. it's possible the republicans could push more budget cuts. what's that mean? >> one of the things we've seen in the past with this is the budget cuts and the sequestration, as well. means that there was a real hit to the economy and to the gdp. we saw this the last time, what, twice, right, where they got into fights over the debt ceiling. this could happen again. whether or not you believe this is a good thing or a bad thing for america in general, we can say that fight was really bad for the economy last time. >> certainly a shutdown would not help the economy either. >> defense costs, spending, real gdp. we could measure it, we could see it. >> you certainly hope for more cooperation this time around, maybe both parties with more of a stake in the game right now. also what about the stock

market? >> stock market's interesting. historically, no matter what happens, when the republicans are in congress and there's a democratic president, you see an increase in the stock market. now, got to admit that bill clinton and his leadership during the biggest boom since the second world war certainly is going to influence that statistic, and, in fact, history shows a bullish biased post midterm no matter what. look back since the depression, stock market makes more gains post midterm election than the two years leading up to that election. politicians generally can't affect gas prices as much as they'd like, they say they can, they really can't, but particularly the keystone pipeline gas taxes, offshore drilling, those tend to be republican issues. with them in charge of the congress, you may see more progress. >> sounds like a bargaining chip, as well. the keystone pipeline, if we look at some of the carbon tax implements, maybe we can move along the keystone pipeline according to republicans.

>> well, if we can all just get along. >> that, too. good luck there. well, we still have a democrat leading our great state. governor jerry brown won re-election pretty easily. also got overwhelming support for two state measures he supported. proposition 1 easily passed, creating a $7.5 billion water bond to fund new water recycling and storage systems. you see it there on your screen. 69% voting in favor of it, with 100% of precincts in. voters also approving proposition 2. that's the rainy day fund setting aside money every year to help offset future budget downfalls. taking it wholeheartedly at 69%. now proposition 45, it did not pass. it would have given the state insurance commissioner the power to approve or reject health insurance rate changes. 60% of voters voting against it. the controversial proposition 46

also blanked out. it was to increase medical malpractice suits and drug testing physicians. that one at 67% voting against it, and 33% were in favor. proposition 47 passed, which reduces some prison sentences for minor drug and property crimes, taking them from felonies now making them misdemeanors. 58% voting in favor of that. finally the proposition 48 casino measure rolled snake eyes, failing to pass. that outcome will likely kill a casino expansion plan, to a practice critics call reservation shopping, using more accessible land to build new gaming casinos. a lot to watch, sam. >> indeed, thank you very much, laura. history made overnight in the bay area. voters in berkley have become the first in the country to pass a tax on sugary drinks, including soda. one cent per ounce. the measure only needed a simple majority to pass, it won out

that season and expecting the snow season and ski season to kick off as we head through the latter portion of this month, which is fantastic news. after all, last year was so grim because of the drought and we already have snow up there. they are making it, as well, because it's nice and cold. what you'll notice on your satellite imagery is this broad area of clearing right on top of the bay area. with a storm system just to our north, so what's going on is we have a big ridge of high pressure firmly in control and for today it is going to peak in terms of energy, and for us that means temperatures will climb into the 80s. a brief taste of summer-like weather in the fall. 80 degrees in the south bay today, 77 on the peninsula, comfortable day coming your way in san francisco in the upper 60s, and your weather headlines really tell the story as we get into today, beautiful conditions. temperatures drop off, but still comfortable into your weekend, then the rain returns by next week. we'll talk about that, plus i'll show you the best places to check out that fall color coming

up in my next report. right now, a check on your drive. >> i was very impressed how good that circle was that you drew. that was a perfect circle. outstanding. over here, a regular lineup, i guess, for the cash lanes, moving slowly, we'll see the lights turn on shortly at the bay bridge, but the approach, we have no problems, just a little build off 880 northbound. that should start back out to the speed limit, north bay, upper east shore, concord, walnut creek, moving smoothly, as well. interchange on the approach, south bay and peninsula are not the problem, it's the tri-valley with the slowing we had due to a later pickup for a construction crew. that started to clear up, but blended in with the early commute. now this over here, show you traffic starting to stack up and not a big concern, but it is a good volume now. back to you. >> all right, thank you very much, mike. it is 5:37. san jose police are investigating a deadly double shooting at an apartment

complex. one person killed, a teenager recovering at a hospital. today in the bay's kris sanchez joins us this morning. we understand, kris, the gunman still on the run? >> reporter: well, police are not revealing much about the suspected gunman, but we do know that it is possible that that gunman and the victims may have known each other, because it did happen inside an apartment. that apartment along almadon road, right along the almadon expressway. the other side is a densely populated area with lots of apartments. san jose police were called to the scene about a quarter after 5:00 yesterday evening, when they found the adult man shot to death. a 16 year old also shot in this incident, was transported to the hospital, and he will survive his injuries. san jose police have not yet released a suspect description to us, nor what they believe the motive might have been in this shooting, and the coroner will not release the victim's identity until his family is appropriately notified.

congressional leaders this morning will head to the white house on friday after sweeping last night's elections. they'll be meeting with president obama to lay out what they can get done in the next two years. tracie potts has reaction to last night's vote and a look ahead where republicans would like to take the country. congress hasn't gotten much done the last couple of years, so it's an opportunity for new beginnings. >> reporter: it's a chance.

we'll see today when president obama holds a news conference this afternoon how he plans to work with this now fully republican congress. not only did they solidify the republican seats in the house, more now than any time since the truman era, but also they picked up the seven seats in the senate, so democrats are no longer in control there. the bay area's nancy pelosi said it was a difficult night for democrats, but they will still have some power in terms of not bringing things to the floor for a vote. as you can see, lots of republican victories, not only in the house and senate, but also in gubernatorial races around the country. really big night for the party and they argue a repudiation of president obama's policies. a lot of people that we talked to in exit polling seeming to suggest that people are fed up with congress and fed up with the white house, as well. >> now, tracy, we know voter i.d. laws were a big concern going into the election. did you see any problems on that

front? >> reporter: they are still counting up votes and those concerns, as well. just this morning i was talking to folks from election protection. they got 18,000 calls, they tell us, at least 2,100 calls came from california. i was just looking at their preliminary list, as i said, they are still counting it up. california had more calls about voting concerns than any other state. obviously, it's the largest state also, but there were a lot of concerns out of california and they are still trying to figure out what those issues were. >> that is very interesting. sounds like our investigative unit will be busy looking into those. thank you very much. over to you. >> thank you very much. let's move on to the state races, where california will see jerry brown returning as governor. >> this fourth term, no one's ever had it, no one's ever going to have it again, and i take the responsibility and opportunity very seriously, and every part of my mind, my body, my imagination, i'm going to throw into this next four years and for whatever reason i get up

lanes look like they are starting to back up. the pattern looks like it must have been turned on a minute and a half ago. that would be right on schedule for wednesday. looking towards san francisco, we'll look at the span, as well, flow on the span is a big concern and it's moving nicely over towards the beautiful new tower and the san francisco side. no delays in either direction and you can clearly see the city lights sparkling. that's a clear view here. same for the san mateo bridge traveling east to west over there. to the peninsula side, little more company, but you're at the speed limit across that bridge over to the peninsula with no delays. look at that, 101, 280, no problems. dunbarton bridge, as well as the san mateo bridge at speed. the bigger issue is the tri-valley, where volume continues to build. we had early slowing that sorted itself out and now it's back to your typical commute through the tri-valley, usual slowing for west of 84. typical. back to you. >> thank you very much, mike. breaking news to tell you about this morning.

investigators trying to track down the driver of a fuel tanker that hit and killed a man in san francisco's tenderloin area last night on turk street near mason and market. a tanker ran over a man walking in the road and the tanker continued to drive. police do not know if the driver left the scene to avoid getting in trouble or if the driver knew someone had been struck. critics will be protesting in hopes of dissolving between the organization and district. the sex ed classes are taught by educators from planned parenthood. protesters say the partnership with the pro abortion rights organization funnel students to the program as future patients, but school officials say the class exercises abstinence and is age appropriate. officials also say the partnership between planned parenthood and the district have been a part of their curriculum for about ten years. san jose's newest pot shop restrictions could be repealed. yesterday the city council

decided to let san jose voters decide whether to keep the restrictions on medical marijuana clubs. they include distance requirements from schools, day cares, and community centers, which actually forced dozens of dispensaries to close this past summer. initiatives will appear on the june 2016 ballot. really can't blame berkley soda tax supporters if they are bubbling over today. for the first time in the country a soda tax measure has passed. for soda lovers and sellers in berkley, now what? today in the bay's nannette miranda outside in oakland to explain. made some history this time. >> reporter: very historic, sugary drinks will now cost more in berkley, thanks to the passage of measure d. think of all the cal students now that will have to budget for this. berkley's measure d measures a tax on things like sodas, sports drinks, and sweetened iced tea.

a typical can of soda is 12 cents extra, to battle rising obesity rates. going into this election, the chances look good for passage, though no other city has been successful at this at the voter level. berkley is very liberal politically and its residents are open to the idea of taxing to change behavior. it also helps only a majority was needed for voter approval. supporters hope this kick starts a national movement. >> this is the first win in berkley, this is the first time that public health has been able to overcome the money, the deep pockets of the beverage industry. >> reporter: proposition e, san francisco's soda tax, went down in defeat. there, a two-thirds vote was needed. for a much tougher threshold to achieve, plus the soda industry spent $10 of the $11 million war chest fighting the san francisco

measure. here's a look at the latest numbers with 100% of the precincts reporting. berkley measure d has 75% voting yes and 25% voting no. here's a look at the san francisco numbers, the san francisco results for proposition e shows, yes, 54% voted yes, 54.5%, rather, and 45% voted no. remember, it looks like proposition e won in san francisco, but that's only if it had a majority vote. it needed roughly 66%, 67% for that to pass, so it did not reach the two-thirds vote. live in oakland, nannette miranda, today in the bay. >> all right. history in berkley. thanks a lot, nannette. the closest bay area congressional race is the one pitting mike honda against ro khanna, still not decided yet, but here's the latest on that race for district 17's house seat. honda right now clinging to a rather slim lead. 52% to 48%.

bob, liccardo has a slim lead, but there are still plenty of ballots to be counted. >> reporter: you are correct. good morning to you, laura. the polls were right, the race for the top job at city hall was going to be a tight race and it proves to be true. here are the latest numbers with all 100% precincts reporting. you can see sam liccardo leading dave cortese, the santa clara county board of supervisors, leading him 51 to 49%. that's 2% difference, roughly, 2,200 votes separate the two men. as you mention, there are still mail-in ballots that need to be counted. not clear whether there will be enough to swing the race one way or another. we'll hear from both men coming up in about ten minutes. neither has declared victory or conceded defeat yet. reporting live here outside san jose city hall, bob redell, today in the bay.
