thanksgiving as we take a live look outside from the san bruno mountains, the city by the bay. it's wednesday, november 12th. you are watching "today in the bay." >> announcer: from nbc bay area, this is "today in the bay." >> very good wednesday morning. thank you for joining us i'm sam brock. >> i'm laura garcia-cannon. this morning, a stuffed animal, candles marking the spot where a 14-year-old boy hit and killed trying to cross a street in san leandro. the boy in a crosswalk when hit by a driver trying to get away from deputies. it happened last night near ashland and east 14th stroet in the unincorporated area of the city. stephanie chuang, the witnesses say the boy thrown several feet. just tragic. >> reporter: absolutely tragic. good morning. we spoke with a man who says he lives in the neighborhood, who saw the high-speed chase himself and that the car was a red or burgundy sedan going 50 miles an

hour in the 30 mile an hour zone. happened at 6:30. the victim halfway across the crosswalk there when he was hit. impact so great, he flew maybe 40 feet to where you see the bus stop and memorial, the stuffed animal, candles and the latest, a teddy bear on the pole. investigators are spent hours in the ashland area taking away evidence like the scooter that the 14-year-old had with him. this began when police first saw a reckless driver south of ashland. when the driver refused to pull over they began a pursuit. omar saw the chase and his wife stood in the middle of the street to get help from police. he felt compelled to pay respects as a fair father of five. >> for the family that has to deal with this, for the kids, just the person who did this, turn himself in because it's not

right for you to live out there a happy life and the person you hit, their family has to live in sorrow. >> reporter: friends of the victim, a couple of the friends headed to the park at the time. the chp is investigating the collision while the alameda county sheriff's office is conducting the criminal investigation. investigators looking for surveillance footage to get more details as well as the driver and if there were any other people in that vehicle. counselors, grief counselors, at san lorenzo high school for the students who need that help. stephanie chuang, "today in the bay." >> thoughts go to the family as well. thank you, steph. moving on to another instance of deadly driving, san jose a drive who hit and killed an elderly woman facing dui charge mz the 74-year-old on her way to a nearby laundromat when hit in the crosswalk. the driver stayed on scene but taken to the hospital when complained of chest pains.

police told us he was arrested for dui. the area in east san jose was shut down during that investigation. happening now, a small spacecraft the size of a washing machine headed towards a comet gearing up to make historic landing. if all goes as planned the probe will attach itself after 7:30 this morning. >> bob redell joining us from the space and science center. a glitch could make this test trickier than it already sounds. good morning. >> reporter: it is. good morning, sam and laura. at any moment they'll have 100 people, astronomers, seen tests, guests, coming to the planetarium here, watching a live feed from germany of the european space agency mission control running the rosetta mission. a lander called fila making descend down, to your right, look at that image on the screen, that's 67-p, 2 1/2 mile

wide comet over 300 million miles away from us. the lander left the rosetta, the mother ship, left rosetta around midnight our time. there has been a hiccup. part of the active descent system has failed. that's the thruster that's supposed to push it into the comet and keep it from bouncing. now a harpoon and ice screws to keep it from becoming detached. you have one large object moving very fast, a small one trying to get on top. the problem if it were to land on a boulder or slope. an astronomer here is plan b will work and it will be able to land on the comet and gather data the surface of the ball of ice and dust. >> a great chance to study the composition of our solar system like when first forming. >> reporter: for you as an astronomer? >> it's great.

you see comets periodically, we've had a couple of opportunities to fly by them, but this is the first time we can land on it and do an in-depth analysis of what it's composed of and how it works. >> reporter: what's happening now on the comet, over 300 million miles away, out of the hands of us earthlings. it takes over 28 minutes to get a signal and to rosetta. it's on its own. the thought it's going to hit the surface, land on the surface of the comet in an hour and a half, around 7:30. wouldn't get confirmation around 8:00 our time. hoping the confirmation will be some image that they'll be beaming on the live feed that will be shown here at the planetarium where we're having a gathering, viewing party starting any moment now. live here oakland hills, bob

making you're way out and about grab a jacket. waking up in the north bay and extra cautious, maybe wearing something nice, maybe something designer, bring an umbrella with you because we are expecting showers to arrive between 4:00 and 6:00 especially at the coast, north bay. activity will slide to the south through overnight hours. we'll get a dry day. if you have things outdoors that could get damaged, bring them in because this will start to impact us tonight across the bay area. it's not just going to be a north bay only event. so here's what's happening out there. you see that very well defined area of low pressure, counterclockwise rotation, rams horn looking good. watching a subtropical moisture tap formation. right now it does look like we're going to hit that tap for a couple of hours and that's going to provide decent rainfall totals in the south bay as we meet back tomorrow morning. we'll see a nice dry day before

those showers move in. 64 in san francisco, 66, on the cool side for the east shore, compare your temperature to average. overcast out there as well as that storm continues to barrel closer to the bay area. i'm going to show you the time line. a sneak peek, this is a good-looking system. not just talking about the light green. we're talking about the deep green, even yellow and orange as we head throughout the next 12 to 24 hours. so keep in mind this is the first of a series of storm systems. we'll talk about the next two in my next report. but first, check on that drive. it's been rough, unexpected, fowl play. >> exactly. fowl work. specific spot, illustrated by chopper overhead, lit up by the crew that just arrived there with the work lights. we also have fire crews on scene. a fuel spill, overturned truck, about 40 gallons of diesel and

the truck overturned has 25,000 pounds of frozen turkey. using a ladder to get on the side of the truck which is the top, trying to figure out how to right the rig. also in the right side of the screen, pallet of stuff there. looks like starting to offload turkeys and thinking there there's a better way. alcosta boulevard off-ramp from southbound 680, that is closed. more trucks arriving. south bound 680 closed alcosta. the freeway moves smoothly. use bollinger canyon as off-ramp until 10:00 a.m. when they hope to have it reopened by then. slow drive developing through pleasanton. some folks taking 680 south towards stone ridge and looping back how to get to alcosta. build on for the tri-valley and hayward, 880. no big surprises. metering lights on at bay bridge. south bay has north bound routes 101 and 87 starting to build. bay bridge approach, fender

he had just come from west africa. friends of a tech worker missing since halloween plan to hold a prayer vigil for his safe return. last seen a week and a half ago, leaving his apartment. san jose police department holding a public meeting today, is holding a meeting, to tell people how it plans to use a new drone that they didn't tell them they bought. the police department, widespread criticism after it purchased the drone without telling the public. a judge may set a trial date for the man accused of killing sierra lamar. torres has pleaded not guilty to charge his kidnapped and killed the 15-year-old in 2012. a hearing to set the trial date in september postponed until today. lamar's hair found on a rope inside the trunk of torres' car and his dna found on her clothing. her body has not been found. >> the case against suspend

state senator leland yee could be moving forward. back in court as lawyers and a judge work to separate his case from a long list of other defendants who are also arrested in an fbi raid. yee faces various charges including corruption, brainry, gun trafficking. he was arrested in march with chinatown gang remember raymond chow, former san francisco school board president keith jackson and 26 other people. walmart will spread out black friday sales this year. >> that equates, scott mcgrew, to not all of the stuff on sale at the same time. good morning. >> not everyone, sam, rushing the store at the same time. walmart wants to make black friday a five-day event. not this. things will kick off early, walmart, one of the stores that's open on thanksgiving, going to roll out sales, starting with i toys and tvs, et cetera so not everything happens at once. walmart's been reporting slow sales over the last few months. this could help. also says it's going expand its

online sales. online is growing and growing with instant delivery. if you turn christmas shopping on its head and think of online shopping with free shipping which young people do, stores are christmas shopping but you have to get the item yourself, and spend money on gas. new developments in the president's push to reclassify the internet as a utility. that decision is up to the fcc and head of the fcc is saying publicly, he may not go along with the president's wishes, which is his right, it's an independent agency, not a cabinet position and the president can't tell him what to do. but the public can put on a lot of pressure. protest planned for thursday, calling it party at the fcc, to show the federal communications commission how people feel. here's the poster, save the internet, it says, fight for your right for free speech. i'm not going to tell you which side to agree with, that's not my job, but i'm going to say the

60 degrees in san francisco. current temperatures. notice a difference between the north bay and san francisco. we're at 60 here. 44 degrees out in santa rosa. it has everything to do with that blanket of clouds that you'll start to see. waking up clear this morning. in the north bay, temperatures mile for today but not bad. 68 degrees, two shy of 70, not a bad day in the south bay. 65 degrees in the north bay with rain arriving by tonight. so let me walk you through the next five days and then i'll show you next week. looking pretty good for us when it comes to the drought situation. today dry, showers widespread tomorrow. clear for the second half of the day. as we head throughout your friday, residual activity friday morning, not expecting much. saturday into sunday, a little bit of a break before we get a series of storms here in the bay area. and you know what? when we meet back here next

week, this is going to be the talk of the bay area. it's looking really good for us to hit that subtropical moisture tap potentially three to six hours. not from the first one, but the first one looks good. move you forward in time. stop that clock at 2:00 a.m. tomorrow, widespread rainfall, clears out by tomorrow afternoon. a nice weekend. by monday, next round of rain started to move in. let me stop the clock and show you next tuesday into wednesday and that is not it, my friends, we've got more rain on the way thursday into friday of next week as well. so it looks like the pattern that we need to really take a clunk out of the deficit that we're running. that's the good news. something you don't need, slower than normal drive because of turkeys. traffic flow than yesterday. this should have nothing to do with the closure for alcosta. here's your slower drive through pleasanton for south bound 680. talking about the turkeys right there, alcosta boulevard. chopper's over the scene. there's a truck with a light, fire crew on scene because there's a fuel spill. this overturned rig and 25,000 pounds of turkey minus a few hundred pounds on the pallet. they have yet to clear that out of the truck and right that rig. my guess they have to offload that until they pull that up on to its wheels and clear the area. talking 10:00 a.m. until the off-ramp open from southbound 68 on back to the maps, bollinger canyon road alternate to get you on surface streets. san ramon valley boulevard into the alcosta area, or loop back through 680 northbound. look you have to travel past e dublin interchange, a lot of congestion. southbound and hayward union city. north 101 start the bill. no big surprises.

6:25. crews will pump poison into a san francisco lake in hopes of killing off several species of invasive fish. talking about mountain lake in proceed yo. four-acre upon people have dumped former goal fish, bass and sturgeon. they've done everything they could to get rid of the fish humanely but nothing has work so they plan to drop 47 gallons of a cocktail of poisons into the lake. the poisons should dissolve within a couple of days but the area will be fenced off and guard for three weeks as a precaution. 6:26. breaking up is hard to do, so the song goes. one man wanted to make sure is ex new there were plenty of other chicks out there. he backed that statement up with a box of chicks. he mailed one-day old chicks to her home in washington, d.c., with a note saying there are lots other chicks out there,

greenhouse gas emissions. they also announced new military and trade agreements that will boost cooperation between those two powers. >> back here at home, congress returns to work following midterm elections. this, as the senate committee is set to discuss a $6 billion request from the president to fight the ebola crisis in west africa. "today in the bay's" tracie potts live on capitol hill. finding a middle ground on major issues could be difficult before the new congress takes over. >> yes, especially since they don't have a lot of time. you mentioned ebola, isis another funding issue they need to deal with. we have an attorney general spot that's open democrats want to get that taken care of soon. and they've got to take a close look at the budget. >> reporter: topping today's agenda, $1 trillion to keep the government running past december 11th. negotiations are under way. >> let me make it clear, no government shutdowns and no default on the national debt. >> reporter: congress needs to approve more than $6 billion to

fight ebola, just over $3.5 billion to deal with immigrant children, and $5 billion to fight isis. authorization to arm and train rebels runs out next month. president obama wants to send 1500 more troops to iraq. >> i don't think the republicans want to play politics with the question of deployment of forces against isis. this is a real-time crisis so we can't wait until january. >> reporter: the senate's got a ton of nominations to consider, including loretta lynch for attorney general. democrats will likely push those through before republicans take over in january. >> hearing some republicans say, i'm going to vote no on everything because we're about to take over majority. >> reporter: republicans are eager to approve the keystone xl oil pipeline but democrats may vote on that first to help their colleague, mary landrieu. she's in charge of the energy committee and faces a run-off next month. hold on to your taxes, we've got tax breaks expiring at the end of the year.

so there's science behind what we're looking at. we'll dive into that coming up. 60 in san francisco. good morning, san carlos, you're at 59. 54 here in downtown san jose. it's cold out in san martin south to gilroy. 40s to low 50s, as lows, as temperatures are starting to reflect our shorter days. these are numbers later on with a gray sky by 3:00. 68 degrees for the south bay. 66 degrees on the peninsula, and about 66 on the east shore. with rain moving into the north bay first, as we head through tonight. we'll talk about the timing and the science in my next report, but first, an alert for commuters. it wasn't that bad until just about now, as more people are starting to hit the highway. that backup, mike, good thing you're here with us. >> hi. folks, commuters know to expect a build, kicking in after 6:00. 6:30 really in earnest in many spots.

talking been an unusual problem in the tri-valley. this is the off-ramp where is what left of the off-ramp availability, none. southbound to 680 alcosta boulevard you can't use that bauld because of the overturned big rig. sand used to soak up the spill. box in the middle of the shot, boxes of turkeys on their way to costco in that rig which has to be offloaded and loaded on to the other rig at the bomb tof the screen. that has to continue to get it light enough to right the rig itself without tearing the sides off the back trailer. that's the big concern. no major injuries as a result of the crash. on-ramp, southbound 680, two lanes are open imfact of the freeway, negligible for 680 south, use bollinger canyon road as off ramp. if you don't use the off ramp, folks into 680 and the sunol area because you have to loop back around at stone ridge which will take you through the slower drive. use bollinger canyon to the north and surface streets to

alcosta. tri-valley, heavier flow of traffic than yesterday. same thing approaching walnut creek interchange. no surprises there. around the rest of the bias far as flow of traffic, build on for the south bay. a live shot over oakland, show you the volume of traffic start to to bill at coliseum towards toll plaza where metering lights are on. i think that's the last of the live shot. one more? san mateo bridge, smoothly westbound. we had a good burst of traffic but it sorted itself out. build will start on the peninsula as folks reach 101. >> could take until 10:00 for the truck. >> if they have complications -- >> that's at 680, turkeys. >> yes, alcosta, not the san mateo. >> sorry. did not mean to confuse you. >> remaining closed until 10:00, that's the estimate right now. it's 6:36. the markets have been at record levels of late. can they keep it up? checking numbers now, scott mcgrew. >> good morning. the dow's lower, after hitting

records yesterday. concern over europe. we get europe's gdp numbers essentially coming up later this week. we saw stuff out of england that was a bit discouraging. dow industrials down 75 points. want to take you back to the open at nyse. jeff gordon there, the smaller of two guy there's in the front, his net worth is about $200 million but axalta which used to be dupont which sponsors his car, ipo'd, almost $1 billion. one wonders if he got stock options because that would make him go from $200 million race car driver to more than that. >> boy, yes. small in stature but big in other areas. >> cash of -- stack of cash. >> a man trapped inside a wall for days could soon face charges. we'll tell you why, next.

>> announcer: you're watching "today in the bay." the stakes getting higher, thousands of nurses across the country joining nurses around the bay on the second day of a two-day strike. thousands of nurses walks off the job yesterday at 21 northern california hospitals and 35 different clinics. the nurse say kaiser is taking insufficient ebola precautions. today more nurses all over california and 14 other states

will picket to support those claims. kaiser calls it a tactic in its ongoing contract negotiations. biggest rallies planned for downtown oakland. kaiser saying facilities will remain opened but elective procedures have had to be rescheduled. a colorado man could face trespassing charges after he needed to be rescued from inside a department store wall. the man was trapped inside the wall of a marshall's for two, maybe three days. employees hear the yelling but didn't know where it was coming from. fire crews located the sound and broke through the outside of the store. they found a man squished in a crawl space. they believe he fell 20 feet from an access base on the roof. officials say the man was doing fine but extremely cold. as it was just 15 degrees in that area of colorado yesterday. >> that would do it. that would be arctic almost.

street. the boy in the crosswalk when struck by a driver trying to get away near deputies. this happening in unincorporated area of the city. that is where "today in the bay's" stephanie chuang joins us. witnesses say the boy was thrown several feet when this happened. good morning. >> reporter: good morning to you, sam. we spoke with a couple of different people here witnessing the aftermath. one man saying the red or burgundy speeding car going 50 miles an hour in the 35 mile an hour zone and another woman telling us that the sh14-year-old walking through the crosswalk halfway there, had the light when struck and hit so hard he flew 40 feet all the way to where you see the growing memorial this morning of mostly stuffed animals and candles lit here. investigators spending hours here in the ashland area taking away evidence like the scooter the 14-year-old had with him. police saw a reckless driver

as we get into the afternoon, temperatures will going to stay comfortable. and then our next weathermaker arrives and this is where i get excited. there's a scientific component to this, and it's something the models aren't picking up on just yet. we're seeing more and more of this in the models, what they're reflecting. we've got this constant plume of moisture from the hawaiian islands all wait to the california coastline. as we get this storm system, it's going to tap into that moisture and for us, that means we're going to get decent rainfall here in the bay area. now we're going to tap into it for one to two hours this time. but as we head throughout next week it looks very promising for us hit that tap potentially for 12 to maybe 16 hours, and that could bring totals way up. i'll show you that in a moment. let's focus on the weather story of the day. that's a cloudy sky. temperatures are cool but not too bad. 68 for example in the south bay.

>> reporter: it does. we talked to an astronomer, they're confident the mission should succeed in the next 40 minutes. you've got 100 astronomers, scientists start watching the live feed from the europe. space agency. a mockup of the comet, 67-p. there's a probe descending on top of it. give you a sense of the size of the comet, 2 1/2 miles wide. to put it over oakland it would take up that much space april large object. not as big as the planet but large objects in space, very big. this started around mid night our time, the larger spacecraft started to release the lanyard, now, ideally what would happen, when it gets closer to the surface it would activate the thrusters keep the lander from bouncing off the comet. that system has failed so they have a plan b, going to be

activating harpoons that would go into the comet and ice screws keep the lander on to the comet. they don't want it to bounce off. if that does work, then it will be a success. and then within the next month or two, it would be able to collect data from the comet and get important information from an object we never have been able to study before. >> a great chance to study what the composition of our solar system was like when it was first forming. >> reporter: for you as an astronomer? >> oh, it's great. we see comets periodically, we've had a couple of opportunities to fly buy them, but this the first time we can land on it and do an in-depth analysis of what it's composed of, how it works. >> reporter: what's happening with it, it's autopilot, us earthlings have no say, the comet's over 300 million miles away. takes a long time to get i

anyone they bought it in the first place. good morning. >> reporter: the department said, boy we wish we would have been more transparent about buying that drone in the first place. tonight when the assistant chief answers questions about how that drone could be deployed in crime fighting, he will probably also get a lot of questions about why the department didn't tell the community or the city council when it was looking for those federal funds to buy the drone in the first place. neighborhood commission meeting is part of the outreach of the department promised in its apology for that in august. the department used a federal grant to buy that $7,000 unmanned flying machine which it claims will be a valuable asset in situations like a bomb threat for areas that are too dangerous for officers to go in blind. additionally, because that drone but was bought with federal dollars it could be a resource available to other bay area law enforcement agencies. the american civil liberties union has said the drone could readily be abused, providing surveillance and citizens
