[ cheers and applause ] >> after a star-studded celebration, the rockefeller center christmas tree is shining bright today on thursday, december 4, 2014. announcer: from nbc news, this is "today" with matt lauer and savannah guthrie live from studio 1a on rockefeller plaza. good morning, love to see the beautiful tree lit, the holiday season officially here. it was a strange night in new york city. >> always nice to be a part of the holiday tradition lighting the tree, but as we did that last night, we were there, there were protests in towns, demonstrations, and those are the top stories this morning. demonstrations not only here in new york city, but across the country in response, as you know, to another controversial

grand jury decision that's tied to the death of a suspect at the hands of the police, talking to garner's widow in a moment, but first, here's the latest. >> reporter: across new york city, including near the iconic rockefeller center christmas tree lighting, bringing traffic to a standstill, shutting down major highways and bridges. in cities across the country, massive protests demanding justice for eric garner after a grand jury did not indict the police officer who put him in the choke hold that led to his death. >> i'm not surprised, but it should have been -- should have been indicted. >> there no justice, no justice. i hope there be peace. >> reporter: in the video from july viewed by millions, police are seen arrested garner for illegally selling cigarettes and

forced him to the ground in a choke hold. he said he's unable to breathe. >> i can't breathe. >> reporter: moments later the father of six was dead. the medical examiner ruled it a homicide due to neck compression or a choke hold. a move ban by the new york city police department. >> i don't know what video they were looking at. evidently, it was not the same one the rest of the world was looking at. >> reporter: t >> the problem that causes suspicion is the secret grand jury proceedings in a case otherwise that's very, very public. >> reporter: new york city's mayor spoke out shortly after the decision. >> our history sadly requires us to say that black lives matter. >> reporter: in a statement the officer accused of applying the choke hold said i became a police officer to help people and protect those who can't protect themselves. it is never my intention to harm anyone, and i feel very bad

about the death of mr. garner. while in washington, president obama once again called for action to repair law enforcement in communities nationwide. >> right now, unfortunately, we are seeing too many instances where people just do not have confidence that folks are being treated fairly. >> thank you so much. eric garner's widow with us now with reverend al sharpton from the national action network, host of msnbc' "politics nation," good morning to you both. we offer our sympathies to the loss of your husband. >> thank you. >> this could not have been an easy time for you. take me back to the moment yesterday when you heard that the grand jury did not indict. >> i just dropped my phone and just bawling. i started crying. it's not fair. it's not fair. what do they not see? how could they possibly not indict? i felt hopeless.

i felt like there was not another corner to turn, like, there was nothing left for me to fight for, but, you know, then i got so many coverage, phone calls, and the support of reverend sharpton and national action network, now i feel we have a hope, a justice to be done for my husband. >> this is one of the rare instances where this was caught on camera, all on video. knowing that, having looked at thatt evideo, how do you explai what the grand jury did? what do you think happened here? >> honestly, i think from the beginning i had no faith in s n stanten island prosecuting anybody from stanten island. i just didn't have any type of encourage. . i felt no remorse. i felt no compassion, no

anything from stanten island besides the people on stanten island, but as far as, like, the police, the d.a., there was no sincerity in his eyes from day one. >> let me ask you about that. the officer released a statement yesterday saying he felt, quote, very bad about the death of your husband and hope you accept his personal con adolescences, do you? >> not at all. >> do you consider that an apology? >> no. no apology, that remorse would have been when he couldn't breathe. >> let me ask the other side of it. i heard a law enforcement person on a show this morning say, you know, when you resist arrest, bad things happen. there's some people watching, and that's how they look at it. >> over my years living in new york, i know a lot of people that resisted arrest and they were able to walk away from it, either in jail, out of jail,

whatever the case may be, not death. >> how do you say when someone's laying on the ground held down by other officers, and you're still choking him that he's resisting. he said 11 times on that tape, i can't breathe, they still holding him. you can't make the claim of resisting arrest when he's been apprehended. i think the problem you have here, the reason that we call the national march next week, you have fegson, stanten island, a 12-year-old kid killed by the police, funeral yesterday, another case in new york, all within three months, so the federal government now has to come in and say, bad cop -- not all cops are bad -- most are not, but bad cops have to be adjudicated outside of local prosecution. >> because of the cases, you have national attention on the

issue. the president the other day saying, this time it's different because the president is focused on this. >> i was in the meeting with the president. >> do you think he's focused enough? >> he seemed very focused, but we need that focus to need to change. i've been in meetings with president bush and president clinton on the same issues. the difference this time is there has to be right after one another, and they were videotaped. people are looking and saying, wait a minute, the guy's on the ground saying, i can't breathe, and even if -- where is your humanity, choking a man, he candidate breathe, and you won't let him go. >> thanks for being here this morning, appreciate your time. >> thank you so much for having me. >> thank you. over to you, matt. >> thank you very much. nasa will try again tomorrow to make history. all morning long today, they tried to launch a test flight of a brand new spaceship designed to carry humans in deep space,

perhaps even to mars, but mother nature did not cooperate. we are at the kennedy space center in florida, tom, good morning to you. >> reporter: matt, a beautiful day in florida, but the winds are a problem throughout the day. that was problem number one, and then we had a problem with essentially a valve on a fuel tank. as a result of that, they scrubbed. we'll try tomorrow at 4:05 pacific time. that said, this is a very important mission for nasa. picture, if you will, not the space shuttle mission that we've seen for the past 30 years lifting off from here at the kennedy space secenter, but harkening back to the glory days of the moon mission. on launch pad 37b this morning, the spaceship nasa hopes will carry people where no one has gone before, sitting atop a delta 4 rocket, the vehicle that roars after the pad, accelerate to 17,000 miles per hour for a four and a half hour trip.

once in space, had rides the booster rocket and on the the earth twice, traveling 3600 miles out, and borrowing a page from apollo, a long drop through the clouds, fiery reentry, and splash down in the pacific ocean. >> we need to make sure it works right before putting people in it. working on the systems, heat shields, parachutes, other things to do just that. >> reporter: liftoff, the final liftoff of atlantis. it's been three years since the last space shuttle flight, and since then, the u.s. paid russia $71 million a ride to carry american astronauts to the space station. boeing and spacex are poised to take over the job. with o'ryan, nasa hopes to carry four astronauts to the moon, an asteroid, and even mars. >> this remits the beginning, if you will, the first flight in the next era of human exploration for the nation and the world.

>> reporter: when an asteroid or mars mission takes time, the first manned test flight will not be for another eight years, and a mars mission could be 20 years way. >> they'll try tomorrow on the unmanned task. the variable -- again, tomorrow, this could be the weather. we expect, again, high winds and clouds. to give you per special circumstancetive -- perspective. this went 250 miles up, and this mission, again, 3,600 miles up into space. back to you. >> tom, thank you very much. savannah? breaking news from the middle east this morning where an arrest has been made in the brutal murder of an american teacher in abu dhabi. we have more on the story, richard, good morning. >> good morning. it seems that police officials and intelligence officials in the united arab emirates were effective in the police work saying they have a female suspect in custody, a local woman, that they believe was

responsible for killing this american woman and also was plotting to kill an american man and potentially his family as well. >> reporter: a female suspect in police custody this morning for the brutal stabbing death of american ryan inside this mall. the police released it this video showing a person wearing a traditional all cover, and she boarded an elevator and went to the women's restroom. 90 minutes later, there's the suspect and people running from the restroom where they heard shouting. one appears to confront the suspect who leaves the mall. in a new video release by police this morning, we can see the suspect later that same day wheeling a suitcase allegedly carrying a bomb. in a press conference today, the minister of interior for the united arab emirates says the

bomb was planted outside an american doctor's home where it was later discovered. within 24 hours, they tracked down the suspect to a home where they found bomb making materials. the suspect was arrested and taken into custody. ryan was a 47-year-old teacher who moved from colorado to the united arab emirates with her twin 11-year-old boys a year ago recruited by footprints to teach in the persian gulf and wrote, i wanted to experience the arab world, sharing my life and learning about theirs. it is an amazing experience. they call ryan's murder a troubling sign for americans living in the persian gulf. >> traditionally up to this moment, americans have been relatively safe in the gulf countries. this is a warning sign. people have to be careful. >> this woman planned to go on a killing spree. she murdered the woman or allegedly murdered the woman in

the shopping mall, went, placed a crude home made bomb in front of the door of an egyptian-american doctor, and his son actually found the bomb, opened the door and saw this jar with nails and explosives attached to it. they called the police, remove the suspicious device and track down the suspect. >> i just go back to abu dhabi, considered one of the safest capitals in the middle east. >> one of the richest capitals, safest capitals, one of the placest with the tightest intelligence, which as we saw today, took less than 24 hours to track the woman down of the it is troubling. it is not the place you normally see acts of terrorism. generally, the crime rate there is lower than it is in almost any american city, so it is a troubling sign. >> disturbing. richard, good to see you. thank you so much. >> you're welcome. >> natalie has a story from the middle east getting attention. >> that is right certainly. offshoot of al qaeda threatening

to kill an american in yemen three days from now. luke somers was kidnapped over a year ago, an american citizen, photo journalist, born in britain. in a video released by the kidnappers, he was shown pleading for help. they are criticizing u.s. crimes against the muslim worm. a secret rescue mission at one location sought to free him last month, but he was not there. a warning from federal health officials that this year's flu vaccine does not provide good protection against the most common strain. the cdc says the h3n2 strain mutated and half of this year's cases match the vaccine, still, the cdc says the vaccine provides cross protection which might reduce likelihood of severe outcomes like hospitalization and death. family and friends gathered wednesday to remember tamir rice, the 12-year-old cleveland boy shot to death by a police

officer. more than a hundred people attended the service. rice was shot two weeks ago by an officer responding to a call about a person with a gun. it was an air soft gun, a grand jury will consider now whether to bring charges against that police officer. baltimore ravens' officials deny claims they suggested to janay rice she apologize for her involvement in the february incident in which ray rice punched her in an elevator. that apology came in the joint news conference in may. in an interview this week on "today," janay rice told matt she was ready to do anything to help the situation. >> did anyone at the ravens say, janay, it would be really good if you issued an apology? >> they suggestsed it, yes. >> did they come up with the wording? >> no, not specifically. they basically gave us the general script. >> meanwhile, team officials said in a statement wednesday that the team provided talking

points to ray, but not to janay. rice won the appeal of his suspension last week and has been reinstated to the nfl. a driver and 38 children escaped a burning school bus in central florida, quite a frightening incident in polk county florida wednesday. the bus started smoking on the way to school, so the driver had the good sense to pull over the bus, everyone got out safely, although the bus was then soon fully engulfed in flames. just in the nick of time there. and as you saw the holiday season now officially underway here in new york city. >> five, four, three, two, one! >> this year, they trusted us to press the button with the help of several other performers there as well like tony bennett, lady gaga, among others.

the tree was topped by a beautiful crystal star and covered with 45,000 l.e.d. lights, and thousands of people on hand to kick off the celebration here with mariah carrey's number one hit song, "all i want for christmas" is you. it was fun. >> except when matt showed up in the same outfit as la di ga ga. >> wow, that was unbelievable. >> yeah. >> savannah just made the tree lighting because she was in the sushi bar, and i have the pictures to show it. >> you were right there with her. >> that's right. mr. roker, how about a check of the weather? >> raining like crazy, telling folks in california. look at the video we have to show you. it pretty much tells the tale. this is in california. you can see all the rain we're talking about. i mean, folks -- this is what we tell you, turn around, don't drown, down push through high water. you'll get stuck.

look at the water from the bay, and there's massive sink holes in the area. this is going to be a real mess. they will be feeling the ripple effects over the next days and weeks ahead even though the rain is less ping. how much rain? these are the amounts, folks, so far. first three days of december, all of san francisco last year got 3.38, and so far, they have 3.5 inches. los angeles, an inch and a third. the rainfall amounts are strong. that same heavy rain in southern california yesterday is moving into the southwest. a lot of rain in phoenix today into the afternoon hours much watching that. that slug of moisture keeps moving east so by thursday afternoon, it's into nebraska, and by friday, it's in the midwest, and it pushes into the upper mississippi river valley, and, in fact, next 24 hours through the southwest, we're looking at anywhere from 1 to 3 inches of rain. western weather today, the heavy rain moves up into the pacific northwe

jungle because of waste polluting coyote creek, which dumps out to the san francisco bay. the shut down has been in the works for 18 months now and some 130 people have already left but about another 150 people remain and will be evicted in they don't leave in 30 minutes. now, police are on hand here because perhaps they are anticipating trouble will start, they'll have some resistance, but we'll be here to keep an eye on things. we'll have another report for you a the 11:00. live from san jose, nanette miranda, "today in the bay." >> let's check the forecast with christina. >> nobody out there with umbrellas this morning. the good news is you can get outside without dodging the heavy rainfall all across the board. the only rain we're getting right now is over the santa cruz mountain. you can see it's a little murky out there. we'll see the spotty activity as we head throughout your day today. as we head through tomorrow, that heavy rain returns, mostly for tomorrow night and then by

declined to indict a police officer in the alleged check hold death of the 43-year-old eric garner. dmemonstrations held throughout the city last nights blocking streets and snarling traffic. >> a woman arrested after murdering an american woman in abu dhabi. she was stabbed in a public restroom at a mall. health officials warn people this year's flu shot may not be a good match for this year's strain of the virus. the virus mutated and only half the cases they've seen match the vaccine. coming up, should bill cosby waive his statute of limitations and let women who accuse him of sexual assault sue? the unusual request as three new accusers came forward. beginning this half hour, though, with the week old search for the missing college student in philadelphia. shane montgomery has not been

seen since the early hours of thank giving morning, and police have few clues to go on. talking with his parents in a moment, but we have more on the case, erick, good morning to you. >> reporter: the fbi says it's unusual to have so few leads. they remain hopeful. on the college campus, an outpouring of support is offering hope to a family desperate for answers. ♪ we all need somebody to lean on ♪ >> reporter: on the campus of westchester university last night, a singular focus, to find shane montgomery and bring the 21-year-old home. >> just keep looking, keep doing what they can. >> i want shane to come back, and i want their hearts to be whole again. >> show our support. >> reporter: the turn out offering some comfort for this tight-knit family. >> what's it mean for you to see

these people turn out for your cousin? >> overwhelming, gives me hope. >> reporter: a week into the search, few new clues. officials say shane made a call at 1:30 a.m. thanksgiving morning, but no records or texts from the cell phone after that. he was asked to leave this bar just before 2:00 a.m. witnesses say he was cooperative and did not appear intoxicated. the fbi tells nbc news it is reviewing all surveillance video for any trace of shane and reinterviewing witnesses. >> i believe that somebody knows where shane is and somebody knows what happened to shane. it was closing time. somebody had to see something. >> reporter: the last signal from shane's foam was at 2:38 a.m., a mile from the bar. >> shane would never not call or text or -- he used other people's phones before to get in touch with someone. >> reporter: hundreds of volunteers scouring the area over the holiday weekend as the police and fbi search from the

sky and in the waters. fliers pasted in the city of philadelphia while back on campus, a community is determined to bring their classmate home. >> it's encouraging to see so many people care. >> reporter: it is important to note the fbi was not brought into the case because of any particular fact, but because in the city of philadelphia, the task force here tends to work very closely with the police department, and as said last night, the more people involved in the case, the better. >> all right, thank you very much. shane's parents, kevin and karen, are joining us now. good morning to both of you, and thanks for being with us. >> thank you for having us. >> you both have been complimentary of the local law enforcement and fbi for their efforts. have they been able to tell you anything, any tip that gives you some encouragement? >> matt, they -- they are working very hard on this case.

it's -- it's -- these are the top people in the nation on the case, and all we need is a little point, a little direction, somewhere to get us focused, but i can't tell you enough about how appreciative we are of all the help and support from the church down to all -- every and all law enforcement. >> you know i -- it seems random. there was no fight. there was no bad blood. he had no known enemies, and t yet, and disappeared seven days ago. you asked yourself the question several times, what do you think happened? >> i think that because it -- the thanksgiving eve is a very, very busy night for college aged kids coming home, and celebrating, meeting up with old friends, whatever, somebody had to see something about what happened to shane. people have to come forward and

call the proper authorities. i think there are so many surveillance cameras down on main street and so many bars and restaurants down on main street, many where shane was, that they are combing every inch and every frame of every video they have had opportunity to do. that takes time. shane is a typical college aged 21-year-old kid, 5'11", a thin build. he had a gray sweatshirt on and a pair of blue jeans. i'm sure that on main street, many out there, there's probably a hundred or more kids that looked exactly the same as shane, so -- >> i was just going to say, last scene was a $17 bill, no record of him drinking excessively. i know he was -- he is a very considerate young man. he never would worry you when he would come home and go out at

night, he would always come into your room and wave you or squeeze your foot letting you know he was home. >> every time he came home, i asked him to just let me know he was here, and every time he went out, if he was not home or got locked out, he would text me. i use my phone as my alarm, and i would come down to let him in. there's no way he just walked away and left me and kevin and my family worried about him. there's no way. i always knew that shane was a very special kid, but your kids are always very special to you. i never saw unwaivering support from my son. i received a letter last night from his creative writing class, and i realized what a special young man he is, and i -- i'm kind of always questioned my parenting skills, and i have come to the conclusion that i

but was later arrested. the other suspect gunned the car and hit the officer. that person did get away. police apparently fired at least one round at the fleeing driver. repairs continue in san francisco today on a big sinkhole, massive sinkhole, that formed in the richmond district. this is during yesterday's storms. it happened on lake street and sixth avenue. that sink hole is about the size of a small swimming pool, about 30 feet wide. investigators say it was caused by a ruptured sewage pipe, indicative of infrastructure problems that plagued the city of san francisco. a look at weather and traffic after this break.
