>> announcer: from nbc bay ago, this is "today in the bay." cell phone video captures the moment people protesting use of police force break into an em emeryville store and take what they want. i'm laura garcia-cannon. >> i'm sam brock on this wednesday. much more in the east bay. we'll begin with a look at your microclimate forecast and meteorologist christina loren. >> good morning to you sam, laura, everybody at home. we're getting into that very, very small window of time where we still have good weather. and as i can tell you right now, that high wind warning -- it was a watch yesterday -- that's going into effect as of tonight. i can tell you, we've got a lot of rain and a lot of wind. like some of us have never experienced before on the way to the bay area. stick around.

first, it's calm out there for now. fog. check your drive. here's mike. >> beautiful look at downtown san jose. you showed that tech museum in the foreground. here not clear view but beautiful flow of traffic for 580. this is from dublin. widen out the camera, lights appearing out of the low clouds and fog through that area out of livermore. another live look at san mateo bridge. traffics a running smoothly. flat section visible. tougher to see the lights in the clouds. you can barely make them out midstream. golden gate bridge, fog creeping through as well. the view offal golden gate bridge looks clear. just a few cars traveling across. farther north we have clouds drifting through our shot. we'll track that and the impending storm system. more on the commute coming up. awaiting major changes in our weather patterns. but first, no change here. more protesting. new video this morning, protesters directing their

attention to a safeway store in the east bay, upset over the decision involving deaths of michael brown and eric garner. in the video, you can see numerous people jumping through a smashed glass door of a safeway pack and save market in emeryvilling this happened here 40th and san pablo streets. many came running out with food, drinks and items they just grabbed. after the protesters scattered workers were left to pick up smashed merchandise and sweep up broken glass. a liquor store also damaged and looted. cvs down the street incurred the same sort of incident. >> earlier hundreds of protesters took to a freeway and blocked traffic for a third straight night. protesters took over highway 24 near 40th in berkeley around 9:00 last night. they were able to stop cars for 30 minutes before the chp cleared them out. there were tense moments between protesters and police, as officers on motorcycles faced off with the crowd. before that, berkeley city

leaders canceled a council meeting for fear the protest could get out of hand. the mayor said the city didn't have enough time to prepare for the crowd. two council members disagreed and made themselves available on the steps of city hall. >> union leaders, religious leaders who have all reported they've been attacked with a baton or tear gas, mistakes were made by the berkeley police department. >> we've had 20 of our officers injured, 2 have gone to the hospital, one had a sandbag, they've had everything from rocks and ice picks to stones to, you know, hammers that are in the crowd. it's a dangerous situation. >> police showed up in riot gear. protests through berkeley streets remained peaceful. >> chopper also got a video of the chp placing some of those protesters under arrest from all of the overnight incidents, talking about the chp arresting 13 people, including folks who were blocking the roads, throwing rocks, and reportedly

sandbag giveaway in san carlos. all of the sand was gone by 8:00 last night. menlo park, residents are worried about old, dead, trees in the neighborhood. >> i'm afraid of people dying. when this tree falls, it doesn't matter where it's going to fall, it's so heavy and big, it will kill people, not to mention property damage. >> trees can take down power lines. experts want to remind you, if you see downed power lines, treat them as if they're live, and stay away. >> good advice there. the same story in the north bay, too. people rushing to get ready for what could be another damaging storm to this region. all of this after tiburon business owners at the shopping center are drying out from last week's flooding. a pump failed during heavy rain. flooding the parking lots and several store there's. most of them have reopened since and are preparing for, well, another bout of rain. >> i'm going to put sandbags up and keep my eye on it. everything will be off the

floor. >> the chp says several roads flooded last week in marin county, notorious image of a car floating in a pool of water. that is when rain hit during high tide. officers warn the same dangerous conditions may happen this week. keep your eyes out. >> rain is expected to knock out power in the area. pg&e will be packing up their truck and standing by. crews will be loading trucks with equipment to be ready for potential outages. that equipment will be sent throughout northern and central california to help repair lines and neighborhoods where power goes out during the storm. >> it's going to be a hectic next couple of days. christina closely watching the conditions. when do you expect things to start get going? >> tonight is the night especially in the north bay. wind is going to impact the bay area. as of this afternoon. but the real wind doesn't even get going until tomorrow i've

got to tell you a lot of times with the storm systems they look big and you keep watching them, you keep watching them, and they'll either get weaker or stronger. this has only gotten stronger every single time i check. i have to tell you, we're talking about blizzard warnings. talking about a high wind warning here in the bay area. and that is very, very unusual. coupled with downpours. it's going to get very active here. 57 degrees to start. not just yet. still nice and calm. temperatures are going to be comfortab comfortable, 60s. but a lot of rain on the way, over a very short duration of time. you want to keep that in mind. heavy rain on the way to the bay area. here's the deal for today. turning cloudy and windy, through tomorrow, it's going to be very, very active. tomorrow will be the worst of it. high winds, downpours and lightning out there. a brief break over the weekend and rain returns to the forecast as early as next week. i'm talking monday and tuesday. more on that coming up.

the nbc bay area app. >> 4:39 now. former uber driver involved in a san francisco crash that killed a 6-year-old girl last year will be formally charged in court today. accused of hitting and killing sophia lu in a crosswalk with her mother last new year's eve. he was in between uber fares at the time. he's been charged with misdemeanor vehicular manslaughter. the family thinks the company should share the blame. >> she's a happy girl, now it ruin our family. the company, very, very bad. the system so bad, driver, at the same time looking at the phone. >> uber says it should not be held liable because the driver wasn't carrying a passenger at the time of the crash. >> very sad. fallout from the cia's torture report continues this morning. coming up, what the report has

>> welcome back. >>. falling gas prices may continue to drop next year. the energy department says the national average could be $2.60 a gallon next year, the lowest full year average in five years. the drop is due to a fall in crude oil prices. the second time in two months the department has slashed its predictions by more than 30 cents a gallon. >> 4.44 right now. survey finding alarming number of people expect to be in debt forever. for them the rest of the news before the bell, we turn to landon dowdy, that is not encouraging news. good morning. >> no, it's not. good morning to you, sam. survey finds one in five people expect to be in debt for the rest of their lives. credit cards.com says that's double the numbers of those who said so last year. millennials aren't as concerned about it, though many are saddled down with student loans. people over 65 expect to be in

debt forever. this may be because they're assuming responsibility for their children's student loans. detroit set to exit bankruptcy as the city's restructuring plan takes effect. detroit filed for the largest municipal bankruptcy in u.s. history last year. it won approving last month to sed shed $7 billion of its $18 billion in debt. >> thank you. the u.s. house approved a controversial bill that would take water from rivers and reservoirs from north california and send it south. they voted on the bill but it's likely the senate won't have time to take it up this year. the bill's designed to help farmers. but those who support the bill say environmental protections for fish have heightened the water shortage in the central valley. >> water at such a premium these days in the midst of the drought. we'll be seeing plenty of in the

next couple of days. trying to fill that bucket up a bit. good morning. >> good morning. definitely the optimistic look at this. the fact that we need the rain. it's going to come in quickly. i want to make sure you and your family are safe. getting to work tomorrow, though heavy stuff isn't anticipated until 10:00 a.m. in the south bay. getting to work tomorrow at this time, we'll have fierce wind to deal with. if you live in a wooded area you want to be on high alert throughout the storm. it is going to pack a lot of wind and a lot of rain. and it is a powerful system. temperatures for today, though, going to be in the 60s. one more day of mostly dry conditions. everything starts to change as of tonight. so that time frame for you to get out and get your storm drains cleaned is kind of closing in on you. we'll turn cloudy and inwindy with showers in the north bay 6:00. high winds and downpours on the way for your thursday. expecting power outages because the wind is going to be strong.

national weather service yesterday up to the actual wind speed. we are expecting those gusts now at 80 miles per hour through mountain passes. 74 miles per hour we start a category i hurricane. talking hurricane force wind gusts in the beautiful bay area. a brief break over the weekend and rain returns through monday and tuesday. two more systems on the way for next week. let me get you through this one first. stop the clock for you. as we meet back here tomorrow morning, like i said, we're going to have a lot of wind. but the rain is mostly up in the north bay. i continue to move you forward in time. heavy stuff pushes over the golden gate bridge and east shore, draped across the greater bay area by 1:00 tomorrow. heavy stuff moves into the south bay between 1:00 and 4:00, and we're in the thick of it until 7:00. this is going to impact your morning drive tomorrow and evening drive as well. you want to keep that in mind especially if you're picking up kids from school.

through thursday, it's going to be dangerous out there. friday, thunderstorms over the morning hours. things are going to clear out by friday night. pretty good looking weekend. rain returns. more on that and more on this storm system. got you covered from every single angle. >> thank you. growing fallout from the u.s. senate report on cia interrogation tactics, torture. the report issued yesterday talks not only about the harsh methods the cia was using to on take information from detainees but those tactics were more severe than congress or public ever led to believe, included keeping terror suspects in dark dungeons for day, slamming them against walls, sleep deprivation and waterboarding. the cia is defending its methods but a former guantanamo bay inmate says the report scratches the surface of what's going on. >> there's more to uncover. if we want to be honest, to get a proper honest, there has to be

prosecutions. >> another surprising finding here, the report suggests that cia officials secretly told lawmakers are its harsh interrogation methods led to finding and killing bin laden. that assertion later reiterated by leon panetta. but the report concludes claims are actually unfounded. 4:49. new this morning, south african judge will allow prosecutors to appeal the sentence handed down to olympic sprinter oscar pistorius. in october, pistorius was convicted of culpable homicide and sentenced to five years in jail for killing his girlfriend reeva steenkamp. prosecutors say the sentence is shockingly light and inappropriate. after serving ten months in prison, pistorius can ask to serve the rest of his time under house arrest. ohio man who spent 28 years in prison for a crime he didn't commit, waking up with a clear criminal record this morning. 56-year-old was last of three men exonerated for 1975 robbery

and murder of a cleveland area salesman. he completed his sentence and released in prison back in 2003. he along with his brother and another man were teenagers when convicted, based solely on the testimony of a 12-year-old witness. now grown up that witness has recanted his testimony, saying he was coerced by detectives at the time. the two other were released from prison last month. he was originally sentenced to death but that sentence was vacated because of paperwork error. the three men are seeking more than $4 million in total compensation. just in to the newsroom, the courageous work of ebola fighters earned them "time's" person of the year award. honoring those who brave conditions to try to halt the ebola virus. "time" focuses on five health care workers, including three who survived ebola, including dr. kent brantly.

>> announcer: you're watching "today in the bay." if you fly with any kind of regularity, no doubt there's a certain type of passenger who might get under your skin a little bit. you're not alone. expedia commissioned its second annual airplane etiquette study, asked 1,000 americans to rank the most annoying on board behaviors of passengers. the rear seat kicker, followed by the inattentive parents and aromatic passenger, putting it nicely. for perspective in last year's study, inattentive parents voted most annoying attribute. do not kick the seat. >> you going to eat those peanuts? flight leaving san francisco ended up with one more passenger

after take-off. the flight left sfo heading to phoenix but not long after the take-off one of its passengers went into labor. luckily for the mom, a doctor and emergency room nurse were on board to help deliver the baby. >> it was amazing. it was -- everybody was -- all of the passengers were awesome. >> everybody was clapping. >> can't think anything will top that, at least not for a while. >> the flight made an emergency landing in los angeles, where we're told both mother and baby are doing okay. >> calm and excited about it now. i can't imagine what it was like in the moment. >> can you imagine? >> no, i can't. 4:55. >> you know what? a woman -- not on the morning commute but the freeway when traffic was stopped by all of the protesters had a baby, too did you know about that? >> i did not know. >> it's true. >> the one on the shoulder, we had follow-up during midday we had a picture. >> emergency crews had to come
