good morning. it's 7:00 on this saturday morning. a beautiful look at san jose airport where we are seeing a little bit of drizzle this morning. thank you for joining us. i'm kira klapper. meteorologist christina loren is here for anthony slaughter. our first time working together. we are having a lot of fun. it's ladies' morning.

you have wet weather, then a nice break. >> a nice break. it's been hard times for a lot of people with the flooding up in the north bay. everybody trying to get their holiday shopping done through this wet weather. you want to keep your umbrella with you, but the sun will come out by lunchtime. you can get outdoors without dodging showers. we have more rain in the forecast potentially for christmas day. we'll talk more about that. after that dry stretch we could get hit by another series of storms. good for the drought, hard for the people dealing with the flooding. more on that coming up. >> thanks, christina. all those people hit by the storms, a state of emergency has been declared in san mateo county after the recent storms caused severe damage. the board of supervisors voted

last night. this comes after several mobile home parks flooded forcing dozens of people to move into shelters. community members aren't waiting for state and federal help. they are coming together raising money for the flood victims. they raised more than $30,000. last night they delivered gift cards. >> joy in my heart because it feels like everyone cares around each other. >> heavy rain cut those special deliveries short last night. they will be back at it on monday. yesterday this driver had to be refshged by firefighters after getting stuck in three feet of water. don't drive into standing water.

it's hard to tell how deep it is. for latest conditions on the road and weather, download our nbc bay area app. a san francisco deputy is under arrest after being accused of attacking a person and lying about it. the deputy was arrested yesterday after investigators saw video of the attack. the attack happened last month inside sf general hospital's emergency room waiting area. it reportedly shows the deputy grabbing and choking a man who needed a cane to walk. they said the deputy initially filed a report saying that man attacked him with his cane. the video proves otherwise. now to damage control from chevron after a massive flaring at the refinery in richmond thursday night. flaring is a routine safety measure but it caused a lot of alarms. it could be seen from miles.

it was an erie reminder of that fiery accident back in 2012 that sent thousands of people to the hospital. chevron says they looked into the cause of the flare and say it appears blocked pipes forced the need to depressurize by burning excess fuel. we'll take you live outside to the golden gate bridge. a new safety feature will change the look of the iconic bridge. this means shutting down the span for two days next month. crews will install a movable median to protect drivers. thousands of pieces of the concrete barrier right now are stacked by the bridge ready for assembly. that barrier will replace yellow cones that currently separate drivers from oncoming traffic. the bridge district says the new median will prevent head-on collisions. drivers tha think it's a good investment.

>> it's much safer. i get scared when i'm too close to the cones. >> crews are installing blue dots on the span that will serve as a guide for the median. rain made that part of the job hard to complete. the work is expected to continue tonight which means fewer lanes for drivers on the golden gate bridge. the bridge will be closed january 10th and 11th for all traffic except for buses. a suspicious death. thursday deputies found a body inside the home on sky oak's way a man reported the death to 911 telling authorities he returned home and just found his roommate dead. homicide detectives are waiting for the cause of death results from the coroner. in san jose, police continue to search for a gunman who forced the lockdown of several schools yesterday. it began around 5:00 a.m. when officers found a shooting victim

on southwest expressway near lee avenue. police spotted a man running away. they put the neighborhood on lockdown for a house-to-house search. delmar high and two elementary schools were part of the lockdown which lasted seven hours until noon. the shooting victim, a man, is expected to recover. oakland police are asking for help in finding several men caught on camera committing crimes during protests last month. the photos were taken on november 24th during one of the protests that turned violent in downtown oakland. investigators say the men broke the windows of metro pcs on broadway. once inside, they stole and damaged the store. we have a look at the damage downtown the next day. several other businesses were vandalized, as well. >> if you're headed out of town this week, you won't be alone. holiday travel is set to break records this year.

welcome back. it's just shy of 7:10 on a saturday morning. looking at san jose where we see rain and drizzle this morning. clear skies are ahead. >> to sfo with flight delays are happening this morning. christina loren will be along with your forecast in a little bit. >> an incredible fire rescue in the east bay. a police officer was wearing a body camera as he ran into a burning apartment early yesterday morning. the officer helped a woman who was stuck on the second floor escape. paramedics drove her and another resident to the hospital with nonlife-threatening injuries. four officers were treated for smoke inhalation injuries. the cause of that fire is still under investigation. sony picture is is on the defensive after president obama criticized the movie house for pulling the film "the interview" from its christmas day release

after a cyber attack. today in the bay talked to movie-goers unhappy the movie was yanked. >> hello, north korea. >> the ceo of sony is doing damage control in an exclusive interview with cnn. he says the motion picture giant didn't have a choice but to pull the movie after most national theater chains refused to show it. >> we have not caved. we have not given in. we have persevered and have not back down. >> referee: his comments come down hours after president obama criticized sony for pulling the interview, a commie that stars seth rogen and james franco who are set to assassinate kim jung-un. >> we con not have a society

welcome back. thanks for joining us. this is a live look at the golden gate bridge. a foggy and drizzly morning should give way to a sunny day this afternoon. a live look at san jose manetta airport where folks are headed out of town the week of christmas. >> did you know your cell phone is becoming more vulnerable to hackers? german researchers have discovered security flaws that could let criminals listen to your calls and intercept text messages on a wide scale. even more discouraging?

the most advanced encryption available doesn't solve that privacy problem. experts say it stems from the global cellular network designed in the 1980s. if you have a sweet tooth listen up. there is a new health warning linked to pre-packaged caramel apples. at least five deaths have been tied to the food poisoning. there have been more than 24 illnesses reported in ten states including california. there is a cdc investigation to determine the specific brands. people are advised not to consume prepackaged caramel apples until more findings are released. we are seeing signs this could be another severe flu season. it appears worse than last year. at this time one year ago, the flu was widespread in just four states. now 13 states are showing high infection rates. 11 children have already died from the flu. pregnant women and elderly are

especially vulnerable. this year, one of the main flu virus strains mutated. that makes the vaccine less effective. still infectious disease experts say it's worth getting the flu shot. it's just about 7:17. let's check in with christina loren. i am paying very close attention because i'm going to the 49ers game. i want the weather to be good. >> as a raiders' fan, i have to tell you the truth, no matter what i have to say it's going to be very nice for you later on today. i'm sorry. if you are not a raiders' fan like you, you should be sorry for my whole last three years. >> we can commiserate on so many levels. >> we are a couple of california girls. we are going to get a california christmas. really nice conditions. here's the thing though. warm all the way through wednesday of next week. that's christmas eve. i can tell you though by

christmas day things start to change. we've got this area of low pressure. it wants to hit the bay area. i think it's only going to impact the north bay with light shower activity. our temperatures are going to drop. overall, looking great. if you want to hit a white christmas, about a 2 1/2, maybe 3 hour drive up to tahoe. bring your chains today. you can leave them home tomorrow. that's when the dry period begins for the entire state of california. we had a lot of success throughout december. it doesn't look like that storm window will shut for good after we get this final round of rain today. san francisco, the golden gate bridge looking good. it's foggy as per usual. if you're trying to fly out of town, we have no flight delays out of any other major airport across the nation except for sfo. up 44 minutes. trying to travel by car because gas prices are so low right now. we are looking good across the state. watch out for fog as you get

into bakersfield and over the grapevine. 50s and 60s but clearing as we head throughout the day. this is our final day of fall. we haven't hit wintertime yet. we will do so tomorrow. the shortest day and longest night of the year. if you want to know about our climatelogical, december we had great success. we might do the same thing in january. this what is we need to focus in on. shower activity. afternoon clearing. sunny and mild sunday. maybe shower activity for christmas day. we will stay drive through christmas eve. the next couple of days that, warming trend kicks in. up to 69 by tuesday. cooler as that system that wants to tomorrow in for christmas starts to drop in. we'll be in the 60s for christmas day with a little bit

this whole celebration began a decade ago as a way to thank them or at least try to. >> those words don't apply. there is not a word that does apply. even to this day they don't know what they've done for us. >> referee: in 2004 their son died in an atv accident. through organ donation, his pancreas ended up saving the life of jake. the two families connected and formed a special bond. one that considering what happened earlier this year, you can now call unique. >> i would think someone made this story up. >> and almost unbelievable. >> it sounds like a made up story. >> it's very close to my heart. >> referee: earlier this year with bill's kidneys failing, janice donated one of hers to

christina loren is here for anthony slaughter. you're busy this morning. >> not as busy as i was during the week. happy to see it finally. >> you can ditch umbrellas in the south bay. that will continue to be the trend as we head throughout the day. you can see from the radar there is moisture around. fog, drizzle, you want to make sure it's slick out there. that will be the case for the next several hours. by lunch time a mostly dry bay area. highs will be cool today. upper 60s to low 60s. then closer to 70 by tuesday. we'll talk more about that warming trend. maybe some showers on christmas.

enough to spark a boycott by three council members. today in the bay we report from city hall where mayor-elect it responding to his critics. >> former san jose council member margie matthews has long been the front-runner to replace councilman shu after being recommended. several council members boycotted the replacement process calling it a rushed power grab to get more supporters on the council. >> by pushing through an appointment, he may feel that is a sign of strength. the's actually a very distinct sign of weakness. >> police and firefighter unions say they feel betrayed by the new mayor and see a long, drawnout fight over pension reform. >> it may be unavoidable. that's too bad. it's sad for the troops, city hall and the citizens. especially district four. >> he shrugged at the criticism

calling out he pushed for a public hearing on this appointment several weeks ago and said matthews is a good choice and promised not to run in the april special election. >> i'm confident margie matthews has the intelligence and independence to represent that district very well. so i don't think margie will have any problem. >> with matthews in place, another controversial appointment needs to be made. city council will meet on december 30th to pick a replacement for the departing city manager. robert honda. this morning the first family is in hawaii for their annual holiday vacation. air force one touched down in honolulu. president obama, first lady michelle obama and their daughters and their two dogs were onboard. they will stay on the island for nearly two weeks. vacation in hawaii as you may know where the president was born, has been an annual tradition for the family. the obamas are scheduled to

return to washington on january 4th. a warning to the most decorated olympian ever. skip the booze. michael phelps avoided jail time pleading guilty to drunk driving charges. a baltimore judge sentenced phelps to 18 months probation. warning him another mistake may send him to prison. officers arrested phelps in september as he sped away from a baltimore casino. he failed a blood alcohol test. the 18-time gold medal winner was arrested in dui in 2004. phelps just completed a drug and alcohol treatment program. >> finding out a lot about myself. for this day, i'm happy to be moving forward. i will continue to grow from this and continue on my path to recovery. >> phelps is training for the 2016 summer olympics in rio de

janei janeiro. he is suspended participating in the world championships next summer. google is looking to partner with automakers to bring a fleet of its self-driving cars to the streets. google debuted a stripped-down version of its high-tech car last spring and has been working with auto suppliers to build a new model. it is looking to take the next step in large-scale production. they need an established automaker. industry executives are cautious of the idea and say for now they plan to push ahead with their own automated features. a bay area ride share service is stepping up to help female passengers feel safe. sidecar announced it is letting customers select the gender of their drivers. the san francisco company has been letting users customize rides since february. gender selection is the latest option. this comes as uber faces increasing criticism about its

welcome back. we are taking a live look outside to a foggy san jose. skies should clear up. we won't see any rain for the next few days until christmas. >> as the 49ers prepare to take on the san diego chargers today, jim harbaugh's future continues to grab the headlines. according to an espn report, the coach is torn between staying in the nfl and moving to another team or taking the reported offer of six years and $48 million from the university of

michigan where his friends and family are encouraging him to go. after a quiet start to the offseason, giants are finally making some waves with a couple of moves. the orange and black have traded for third baseman mcgee. the g-men will reportedly send a minor league pitcher to the florida marlins. he had 74 rbis last season. jake peavy will return to the giants for a two-year $24 million deal. at 33, peavy went 6-4 in 12 starts last season after coming over from the red sox. >> he's slightly fired up. >> i couldn't be any more excited. who wants to leave the world champions? that's such a great run and i'm so fortunate to be a part of it last year. this city, the fan base, my teammates, coach, staff, front office, everything grew on me.

welcome back now. good saturday morning. i'm meteorologist christina loren tracking light shower activity. a lot of this has been coming down overnight. your highways are nice and slick. we are going to enter into a prolonged period of dry weather. i think a lot of people are happy about. before you start feeling guilty about our drought situation, i can tell that you storm track

looks like it will be returning as of the 30th of this month. our futurecast agrees. happy saturday. count on afternoon clearing. if you are trying to find a spot and get into the mall, you might want to bring an umbrella the first part of the day. sunny and mild by sunday, which is the first official day of winter. then will stay nice and dry, most of us, through christmas eve. a little drizzle returning to the forecast for christmas day. right now i think that is going to stay up in the north bay. this morning, showing you san francisco, the golden gate bridge, a little bit of fog out there. really shaping up for a nice finish to the day. if you want to get out to union square and check out that brutal christmas tree, will be nice out there to do so today. temperatures in the 50s. 60s and mid 50s with showers clearing by noon. christmas looking okay by thursday.

temperatures are going to be cool similar to what we are experiencing today with a little bit of shower activity only up in the north bay. we got a nice dry stretch. it's going to be really nice here. a warming trend coming your way. then those numbers fall by christmas day. then watch what happens. i want to show you the storm track. high pressure will stay firmly in control all the way through about christmas eve. then those showers try to sneak in for christmas day. we are not going to see much activity until we get into the 29th and 30th of this month. watch what happens. i set this out as far as i could. we are looking at the 29th into the 30th. you can see all this ample moisture available out here in the pacific. looks like a series of storms is lining up out here. as we all enjoy christmas break, that nice week of dry weather, i do have to tell you when we come back for the first week of january, it looks active. this could be to the tune of what we experienced over the past couple of weeks.

they are paid to serve, protect and show up in court. we uncovered more problems with local police officers who are skipping out of their courtroom duties. chief investigative reporter has the exclusive details. >> all rise. soupor court is now in session. >> it's time for the ticket rider and ticket holder to make their cases. >> call the first case number one on the calendar. >> it's showtime in santa clara traffic court. as court records confirm in our investigation, in many cases it was no showtime. >> he had forgotten there was traffic court appearance today. >> referee: we found law enforcement officers failing to appear in court, costing the court, county and cities time and money. >> forgetting is not good cause. motion to dismiss granted. your tv spot, your investigative

reporting resulted in some of these agencies being made aware of the fact there is a problem here. >> referee: our analysis of traffic court records found the biggest problems with the redwood city chp division, san jose police department and the san jose division of the chp. all failing to appear for traffic tickets more than 15% of the time. >> your agency here in san jose is one of the highest failing to appear. will you share that with your patrolmen? >> oh most certainly. that is an easy question. yes. >> definitely is the message going to be stronger? >> i think all they have to do is turn the television on. >> referee: these numbers a bit of a wake-up call? >> for us, when we look at the numbers provided us to, we recognize the fact we need to do a better job. >> both the chp and san jose police promised changes including tracking and

monitoring court appearances. >> this matter will be dismissed. >> referee: now five post offices later records show those changes have made a difference. >> there is a significant drop in no-show rate. >> referee: the court commissioner is referring to these numbers. since our first investigation back in june, san jose police dropped its no-show rate by 4%. san jose chp dropped by 7%. redwood city chp went from 20% no-show rate down to 8%. a 12% improvement. what's that say? >> that says, number one, they listened to what you all had to say and made the corrections. it tells me they want to do the right thing. they did the right thing. >> referee: our latest review of recent court records found not everyone got that message. >> the officer is not present. >> referee: on this day a santa

clara deputy failed to appear. >> this matter will be dismissed. lack of prosecution. >> referee: our review of court records for the past five months found sainta clara sheriff's deputies missing court 20% of the time, a 6% increase from last year's numbers. the largest no-show rate of any major agency. >> that number is a little higher than i expected. that's the reason i was surprised when you presented me with the data. >> referee: the captain responded to the numbers saying the santa clara's sheriff's office will focus on tracking deputies' appearance in court. what is the message you are taking to your deputies from this data? >> take care of your business. this is what we have to do as government entity. you come to us with a problem and you are looking for a solution and we are here to provide that solution.

adopted. the main point i wanted to make this morning is these are puppies and kittens we love to have in foster family situations if we can. healthier situation for them to be out in homes dealing with public, dealing with socialized with other dogs and cats and little kids and such. >> instead of being in the shelter facility. they can be healthier in a foster home. if you are not ready to commit to bringing this dog home, how could you not, look at that face. there is the option to help out and foster. you have a deal for people who are willing to adopt. >> we do. this entire month we are waiving our adoption fees. we are asking for donations to pets in need. no minimum, no maximum. just looking for some kind of donation for everyone who adopted a dog or cat us from. >> you'll be out today if people want to go see you.
