of the forecast. my car's in the shop. i'm driving a loaner and yesterday this alert comes on. same thing happens today. i take a close look at the dashboard. >> the frost. >> it's telling me it's 37 degrees. even the cars get cold. >> yesterday we had potential this morning. you should be all clear. it's going to be cold as you're taking a look from san jose. temperatures not freezing. many of us above freezing. you don't have to worry about the frost and black ice this morning. the poor air quality will continue for the rest of the weekend and tomorrow as well. it will warm us back into the 70s by tuesday. hang on. many of us in the 30s and 40s. 34 up in santa rosa.

you'll notice the cloeud cover s very widespread. not going to bring any rain today. it will be dry but a good mix of sun and clouds. 61 for the north bay. 68 for san francisco. hazy sunshine for everybody down in the south bay where the worst air quality is expected. we'll talk more about the 70s headed our way, the poor air quality and next chance of rain in my next report. >> looking forward to it. let's get to some news. thousands of police officers from across the country are in new york to attend the funeral of wenjian liu this morning. this is a live look outside the ceremony in brooklyn. it's expected to begin in about an hour at 8:00 a.m. our time. he was gunned down last month while sitting in his patrol car. last week a funeral was held for officer ramos. yesterday thousands of officers

attended liu's wakes. he asked officer to show respects and said quote, a hero's funeral is about grieving not grievance. last week hundreds of officers turned their back to the mayor at ramos' funeral. >> doesn't matter if you're in the southwest midwest, show respect for the officers that we lost here. >> san jose police department has two officers attending the services. eight other officers from san francisco pd are also there. to a developing story on the air asia plane crash. crews are hoping that break in the bad weather at the crash site will give them a better chance to find the plane's black box and recover the bodies of more victims. officials believe they are close to major breakthrough after finding four large objects in about 90 feet of water yesterday. the biggest piece is about 59 feet long and 18 feet wide.

it appears to be part of the jet's body. the head of the search and rescue operations said he's confident it's from the wreckage of air asia flight 8501. the key now tracking down the black boxes and recovering more victims. >> it's important for investigators to understand the condition of each of the victims as they are recovered. that could shed light on how much impact forces were sustained by the aircraft in each of the victims. >> earlier this morning a u.s. helicopters recovered three bodies of passengers believed to have died last week. so far only 31 people have been recovered. officials believe many of the remaining 131 passengers and crew are strapped to their seats. flights have been grounded indefinitely to determine whether the airline filed the

proper paper work. the first quake happened around 7:00 a.m. about 20 minutes later a 4.2 earthquake hit the same area. people as far as south as long beach and far north as bakersfield reported feeling shaking from the second quake. the owners of one market said all the bottles on her shelves began rattling and she heard a big boom. so far no serious damage or injuries have been reported. after decades of debate, thousands of undocumented immigrants in the bay area have begun the process of getting california driver's license's. the licenses are available after governor jerry brown signed ad-60 last year. more than 900 people poured into the dmv in san jose yesterday. >> did have a line wrapped around the building this morning just as we head yesterday. i think we had more people this

morning because of the news coverage that occurred yesterday and word got out. i think for this particular driving license processing center in san jose is unique because it's accepting walk in appointments. >> after having their paper work approved applicants walked out with a driver's permit. they have to have documents to verify their identity and prove they live in california. a follow up now to flooding damage on the peninsula last month. people living in san mateo county can apply for low interest disaster loans. some of the worst damage was in redwood city where two mobile home parks were destroyed. people affected by the storm in december can file applications for their disaster loans starting this wednesday. a man suspected of starting a string of fires in the south

bay is behind bars this morning. the san jose mercury news is reporting that jason gilloan was arrested in connection to three car fires. he may face charges for five other fires. no one was hurt in any of the fires but they did cause a lot of damage. he was arrested back in july of 2012 on suspicion of having materials to start fires. firefighters are warning people to throw out their christmas trees. this is after a family's tree caught fire this weekend in antioch. the house was nearly engulfed by the time they arrived on the scene. they say dried out christmas trees can become a very dangerous hazard. >> it's a good reminder that when christmas trees are starting to dry out get them out of the house quickly. >> everyone was able to get out safetily. much more ahead.

good morning. we want to give you a live look outside at the sap center in san jose. a little hazy as the sun starts to peek out on this first sunday of 2015. new details about an unthinkable tragedy. a 7-year-old girl the only survivor of a small plane crash. this morning we hear from the first person she spoke with

after she walked nearly a mile to find help. >> reporter: it was the first sign anything was wrong, a knock at larry wilkins door friday evening. >> the little girl, 7 or 8 years old standing there bleeding legs and all scratched up, arms scratched up and said her mom and dad were dead. she had been in plane crash. . >> reporter: 7-year-old sailor survived the crash and walked three quarters of a mile through cold, dark woods looking for help for her family. >> a 7-year-old has come out of woods alone. >> reporter: police rushed in but it took more than two hours to locate the plane killed in crash her parents, marty and kimberly, her 9-year-old sister, piper and her 14-year-old cousin sierra wilder. >> it's a miracle she survived and she didn't succomb to exposure. >> reporter: the plane took off

from key west flori, florida an stopped to refuel in tallahassee. it lost contact after reporting engine trouble. marty was a pilot for 30 years. the family's hometown of nashville, illinois there's sadness. >> this is a devastating loss to our community. we lift up this family in our prayers. >> reporter: ntsb investigators are trying to determine what went wrong. >> sderdeserves a lot of story. >> reporter: a little girl who is with family as they work to heal from an unimaginable loss. one of lake tahoe's most popular attractions is shut down until further notice. it won't be leaving its docks under orders from the coast guard. it was stranded about 200 yards from the dock and the captain couldn't tell if it hit the ground or stalled by high winds.

about 200 people were stuck on the boat for two hours in sub freezing temperatures. the coast guard noticed it has a broken hydraulic. more news and weather straight ahead. changes may be coming to a south bay landmark. t why neighbors aren't excited about it. this morning we're waking up to another hazy start from the north bay down to the south bay. san jose completely shrouded in with another hazy day. we don't have fog but lots of haze.

lemonade this morning. it is spare the air day which is why there's that haze playing tricks on the colors from the sunlight. anthony will be along to explain what's coming in weather. the winchester mystery house is raising eyebrows in the neighborhood. robert honda tells us how neighbors have brought the big plans to a screeching halt but the battle may have just begun. >> reporter: the legend of the winchester mystery house is sarah winchester kept adding rooms to accommodate ghost spirits. the mystery house wanted to expand its license through the department of alcohol beverage control, abc, with plans that included out door special vent music with sales of all types of alcoholic drinks and to run

until midnight. about 150 residents of the neighboring winchester ranch mobile home park sent a collective letter of protest. >> who will come to these events. it has a potential to get really rowdy and really start causing issues in the neighborhood in general. >> i don't think i would be concerned if they were doing it in their buildings but out doors in the summer sounds so easy over that fence. >> reporter: the abc ejected that application. the mobile home group has pointed out it's cooperating before and were disappointed they weren't contacted before. >> 25% of the people live here are in their 80s and 90s and two-thirds are over 70. when you have something that goes on until midnight, not good. >> reporter: the rejection is for the informal application process. they can still submit a new formal application. we did not hear back from winchester mystery house on whether it wants to resume its

plans. the residents are ready if or when it happens. robert honda, bay area news. we have anthony slaughter with a look at the weekend forecast. we have some changes in store, which people are happy to hear about. >> it's another cold day. temperatures not going to warm up a whole lot. still this afternoon we'll get into the 60s for some of us. that's chilly. 36 in san jose. 35 in livermore. not too bad in san francisco. 36 in santa rosa. it's still gocold but not bittey cold. the current temperature shows that. these are high thin clouds. they will not shroud it all together.

you get the blow off of cloud cover. we got below all of that. because we have on shore winds at the surface or offshore winds at the surface and on shore winds aloft. it's still going to be another spare the air day. you'll notice from our sky camera network a beautiful sunrise. every single location you look this morning from the north bay to san francisco, east shore you have the beautiful colors because of all the fine part particulate matter. the raies hit and cast that pinkish look. look at these temperatures. we're finally back in the 60s. 62 for the south bay. same for the peninsula. 68 for the east shore in san francisco and north bay topping out at 61. another spare the air day. for tomorrow the air quality

does not look to improve. i think we'll be actually finding that we'll have another spare the air for tomorrow as well. it just means you can't burn any wood. to show you what's happening on our future cast it's going to be a storm system that we'll follow this upcoming week. it's a very week system. the same one i showed you that's headed to our north. the problem is we're just going to get the trail end of that cold front and we're not going to see a whole bunch of rain. we may get a .1 at most. it moves through thursday night into friday. it falls apart. friday morning it's a little area of drizzle and fog. i don't think it will be a huge storm system for us. we have some storms move through. by monday and tuesday is when we'll start to warm up in the south bay. 71 by tuesday. even 70 for wednesday. walnut creek off in the east bay

you'll notice a good mix of sun and clouds as we head toward this week. you'll notice on thursday clouds for the south bay. san francisco, take a look at this, you'll notice the temperatures do climb into the 60s by tuesday but just as quick as they climb they fall and here comes the next chance of rain by thursday. everybody's not going to see this rain as we move toward the week. if you live in the coastline, san francisco by thursday and north bay is the best chance of shower activity. south bay a few 70s and some clouds by thursday. back to you. >> we joked we had too much rain and now we're taking too much cold so the rain will warm things up. it's a welcome coming back after that drought. >> one extreme to the next. still ahead, it's known as san francisco's version of the titanic. up next, the new story rising from the wreckage just outside the golden gate.

her grandfather. her grandmother didn't talk about him much. >> i guess having remarried my grandmother didn't want to rock the boat. >> reporter: the details of his like trickled down. she learned he was aboard the 350 foot steamer when it attempted to enter san francisco on a foggy morning. >> he kept the lights going. >> reporter: under his helm the ships smashed into the rocks. >> i heard the story that my grandfather went to get the log and that's when the ship went down. >> reporter: 128 people died, mostly chinese and japanese immigrants. >> the captain died with the ship and so did my grandfather.

we're tired of the cold. 70s in the near future. >> by tuesday we'll see 70s. hang on. i know it's cold now. everybody has been complaining about how frigid it is. we're headed in the right direction. it's another cold morning. you can see from our sky cam you can barely make out the mountains in the background. everybody is expected to see the worst air quality. 60s and then 70s by tuesday. we'll be talking about a few 70s. everybody else right now waking up to very cold air. 35 in livermore. 36 in san jose. we have clouds drifting in across the area this morning. a little green on the map is mid level moisture. it's not reaching the ground. it's up in the atmosphere. you can see it from our sky cam

stations selling gas for less than $2. for analysts it's unchartered territory. >> gas prices plunging even as the economy is still chugging. >> reporter: what stunned the market is saudi aarabia's decision. >> this seems to be the beginning of the end of opec. the weaker members want saudia a arabia to turn off the spicket. >> reporter: in florida up fraction of a penny. up a penny in north carolina. nearly three cents in maryland. >> i don't like it. i think i'm paying virginia enough taxes. >> if it helps, fine.

>> i don't think it's a big deal for me. i think the lower gas prices have been great this year. >> if we were paying $4 for gas now and there's a five cents, it's huge. if you're paying two in change it's a big difference. >> reporter: the big drop should mean big savings for families in 2015. 500 to $700 per vehicle. >> here in the bay area gas prices have dropped in recent weeks. the average price of gas in san jose is 2.67. san francisco is at 2.82 a gallon. prices are going back up because of california's cap and trade law that went into affect january 1st. it's a regulation for gas lease and diesel producers to reduce greenhouse gases which means people will be paying for this extra tax at the pump. prices will go up about ten cents a gallon. a pacific coast town hopes

to have a controversial project up and running by the end of this month. a plant turns waste water or salt water into stuff that's safe to drink. they announced plan to build the plant in may. the city pushed the project through without public hearings or environmental reviews. city leaders say the rush was backed by the governor's emergency drought declaration. plants are harmful to the environment. after decades of debate, thousands of undocumented immigrants in the bay area have begun the process of getting california driver's licenses. the licenses are available after governor jerry brown signed ad-60 last year. more than 900 people poured into the dmv office yesterday. it was one of few processing centers open on saturday. >> did have a line wrapped around the building this morning just as yesterday. i think we had more people this morning because of the news

company's driver. it's over text messages sent to customers. a federal lawsuit filed on wednesday claims the ride sharing company has bombarded people with unwanted texts urging them to sign up as drivers. some claim they received nearly 20 texts in the last two months. the lawsuit asks for more than $5 million in damages. the judge will decide if this becomes a class action lawsuit. today in the bay is back in two minutes. we'll see who is advancing to the nfl's divisional round next weekend. the sharks took the ice without one of their best players for first time in four years. find out how they did, next. ho ho ho... we'll all have hot cocoa! ma'am, need a strong pot of joe. the all new keurig 2.0.

scott dies this morning. he became one of espn's most recognized personalities during his 21 years after the sports network where he hosted sportscenter and other shows. he was 49 years old. to home ice now. the sharks were facing a challenge they hasn't faced in more than four years. he was forced to sit out last night's game with an upper 49 injury. san jose hosting the st. louis blues. it wasn't pretty. the sharks jumped out to an early 2-1 lead. it got ugly after that. the blues went onto score six unanswered goals. st. louis cruises to a 7-2 victory. to the gridiron now. jim harbaugh supporting his brother. the support was worth. the ravens made it look easy.

good morning. >> good morning. >> anything to understand whmakg it easier has to be great. >> on the one hand they enjoy near universal approval. 81% has indicated as much in a poll. on the other hand initiatives have another issue to deal with. the ppic, the polling agency, found that 83% of all californians find initiatives too complex and confusing. voters are in the dark about the big money supporting and opposing signature gathering efforts to place initiatives on the ballot. you put it all together and that disconnect as led a bipartisan. when have i last heard that. a bipartisan majority of the legislature to pass a new law. it's called senate bill 1253. it's designed to make the initiative process just a little bit more manageable. >> what are the changes in this

law and how are they going to help voters? >> a couple of things to think about. here are the major elements. when proponents secure 25% of the signatures required for qualification, the legislature must set aside a 30-day period for hearings and public input on the proposal. proponents may modify the proposal. they may drop the idea if they sense a significant uphill fight. the second thing is the state will be required to list the top ten donors that support and oppose the proposed initiative. that new level of transparency will enable voters to see who's behind the proposal. since many of us rely on groups that we just to guides as our own decision. it's important to note here that the new process doesn't add, doesn't take away power from the legislature. it does offer a new way for

people to see what is going on and for propoennents and oppones to see if things get too difficult and maybe remover some of the clutter in advance. >> that's interesting. this could be a process where if things aren't going early, people may abandon the proposition. it's not going to bet get on the ballot, we're not going to have to read it and be confused about yes or no on this initiative. >> yes. >> when you add a new law there's some confusion. it's not going to end it all. >> it's not going to end it all. that's for sure. it's going to help. some say it doesn't go far enough. clearly given the sponsors and opponents spent hundreds of millions of dollars collectiv y ly come campaigning initiatives. there's a new opportunity for

people to learn early. to learn early the issues and who is on what side. opponents say the signature gathering threshold of just 5% those thresholds are too low allowing special interest to easily get just about any measure they want on the ballot. it doesn't change on that side. those last minute infusions of massive campaign come tntributi that aren't reported that's a concern. we never know what's going to go on. so much money comes in at the very end. there are some concerns here. here is the final one. it fails to deal with, i don't know about you, but the language of these things. four or five negatives in a sentence. none of that's going to change. still, okay, we pulled it apart

and talked about the problems, it's still a step. it's a small step. a bill that will shed a bit more light on the initiative process. given the difficulties faced by the voters, it can only help. >> i think listing the top ten donors is a step in the right direction. i know what you mean about the language being so confusing. you wonder who wrote these things. sometimes it's helpful to read the oppositional remarks because it's more concise and get right to the point. >> i've been doing this my entire adult life. i get these things in front of me and i want to do anything but read them. >> i can't tell you how happy that makes me that you get confused. >> this is a step. >> thanks again for your time. stay with us. coming up, a driverer picks up an unexpected passenger on his way to dinner.

welcome back. i want to start you off with your forecast here on your sunday. it's still another chilly morning. 36 in santa rosa. mountain view at 39. it's still very cold across the bay area. we're talking and that lasted. we're headed in the right direction. temperatures will start to warm up. even today we're talking about 60s for daytime high. we have a lot of clover that's making its way through the bay area. this is high and mid level cloud cover. it's not reaching the ground. as you step outside this morning you'll notice a good mix of sun

and clouds. here's the thing. we have an area of low pressure to our west. that's what's responsible for the cloud cover and the blow offer we're getting from that. we have the air. you can see the haze in the sky even the high mid level clouds from the east shore and the peninsula. down in the south bay that's where we're expecting is worth air quality today. 62 expected for your high. 60 in the peninsula. even in the north bay expecting 61 degrees with a good mix of sun and clouds. another spare the air day for today. you'll notice everybody in this category expecting moderate to unhealthy levels of air. the only exception the east bay. by tomorrow that will go up as well. i think there will be another spare the air alert for tomorrow. keep in mind no wood burning for

today unless it's your only source of heat. tomorrow there will be another dry day across the bay area. by tuesday you'll find plenty of sunshine. this thing out to our west, this system will take its sweet old time getting here. it's going to arrive until thursday afternoon. once it moves through it really weakens. we're not thinking everybody will see rain this go around. more cloud cover than anything else. most of the rain will stay across portions of the north bay and at the coastline. really a big warm up expected the next couple of days. tuesday and wednesday will be our warmest days with 70s in the south bay. you're expecting to stay back into the mid-60s. in san francisco that chance of rain is expected to move in by thursday. you'll notice today 58 but by tuesday, 65. just as quick as we warm you up we're talking about temperatures cooling back to the 50s by thursday and friday. it won't be all that bad because everybody's not going to see the
