and that does mean another spare the air day. christina, warmer than normal temperatures expected. >> you get a little bit of the good and bad in the forecast for today. if you can take the bad air quality, temperatures are going to be really comfortable out there for today but another spare the air day. our sixth consecutive, as a matter of fact, and because we're not going to see a strong enough onshore flow in the next couple of days we'll likely be sparing the air all the way into friday and looking much better for the weekend with a storm system on way. here's the deal. temperatures chill toe start. you'll need to grab that coat and something you can layer up in. 74 degrees is the high later on in the sobbed. peninsula 72, and we will likely break some temperatures records. more about that as we head through this morning together. right now back to you, sam and laura. >> thanks very much, christina. you'll recall from a year ago it felt like we had 17, 18, 1920 straight spare the air days and kept stacking up. right now it's another day of smoggy air across the bay area which means health issues for a

lot of people as we enter a sixth straight day of spare the air. >> athe love concerns. more on some of the potential health problems from all the potential air. >> reporter: good morning, laura and sam. you might hear that the source of pollution for this time of year isn't the car your driving but rather the wood people are burning in their fireplaces which, again, why it's northern to heed the spare the air warnings when it comes to not burning fires. the air has been very poor in quality this week. you can see it as you look across the valet floor in the south bay, the quick haze hanging over us. what makes the santa clara valet so beautiful makes it so prone to poor air. namely you've got the mountains on the three sides, add to that a little wind and the pollution gets trapped pushing it closer to the ground making it difficult for us to breathe. dr. thomas daley, a pulmonologist says he's seeing a

12 people. >> and there are concerns this particular outlet had provoked before in terms of saidrizing islam. do we know how relevant that is today? >> it is being called a terror attack and that is likely at play. the newspaper published political cartoons depicting prophet muhammad. the french president confirmed 12 people were called what he called a terrorist attack in that newspaper office. nbc reports that he said, quote, several other terrorist attacks were thwarted in recent weeks. what you're looking at now is a live feed from french tv where you can see it's still very much an active scene with law enforcement. planses there on the scene as well. just as dramatic, this, and you can listen in. >> video in which you should hear the gunshots ringing out. french president hollande says that 12 people were killed in what he calls an act of

exceptional barbarity including two police officers and at least one journalist. you can see the bullet holes and at least one patrol car and a journalist who witnessed that attack said he witnessed several masked men armed with machine guns. it appears the shootings were a targeted attack as you mentioned, sam, at the offices of a satirical weekly newspaper called "charlie hebdo" and even if you don't remember the name you might remember them for republishing political cartoons, danish cartoons, that depicted the prophet muhammad which enflamed some members of the muslim community. most recent tweerkts however, was a cartoon of the leader of isis. before today's deadly rampage, the newspaper officers were firebombed. that was back in 2011. police say that today's attackers maced to escape in two vehicles. now, according to the prime minister's office, france raised its anti-terrorism alert in the greater paris area to the

highest level, and they are putting extra security not only at media outlets but also at houses of worship. this is, of course, a developing story and we'll try to bring you more details and, of course, as you might imagine, word leaders are also reacting saying that they will stand with france. >> of course, wow. happened owe quickly. >> thank you. now to another developing story we're following this morning. we could soon get new details about what happened in the minutes before the airasia plane crashed in the java sea. crews have located the tail of the missing plane, and they have been able to get picture of the debris. this find is important because the black boxes which record the voice and data from the cockpit are in this aircraft's tail. 162 people died when the flight crashed 11 days ago. so far crews have recovered 40 bodies. police trying to find a man who they say ran up to a woman who was jogging and pulled her shorts down. this happened on monday around 10:00 a.m. near the intersection of marchison drive and valencia

drive. the man wore a burlap cloth over his head and face. if you know anything about this incident, you're asked to please contact police. san francisco investigators are searching for what they call a botox bandit, a patient who pulls quick ones at unsuspecting medical offices. stephanie chong joins us live from san francisco police headquarters and the crimes are also a warning to other businesses as well. how are they snachtching the botox? >> reporter: good morning. exactly that point. really a warning to other businesses, especially in this area because this may not be the first time that this man has gotten away with not paying for thousands had dollars of worth of botox treatment. take a look at video. this is what police want you to look at. surveillance video from a plastic surgery office in san francisco showing the man coming in and leaving the office. dr. larry fan says this man got three botox treatments and laser treatment worth about $6,000

without paying. the doctor say he usually asks for a credit card but the client showed the employee a wallet full of cash. his name was paul halford and gave an address of 1140 folsom street which turned out to be an office building. >> he also seemed to know quite a bit about what he wanted done, and so in looking back there were some red flags. hopefully this kind of thing won't happen to many people and hopefully this particular person won't be able to continue to get away with this. >> reporter: now in an e-mail a local botox sales person recently warned plastic surgery community about the so-called bow tax bandit. a man fitting the same description got similar treatments at another san francisco office and got away without paying. this time he was pretending to be on his cell phone. not had a high priority case on list for police but did go to the office last night to get some information but they are hoping that information will

video game. yesterday a federal appeal court gave them the green light to take their case to court over the use of the likeness in the game. the defendant in the case, the video game maker redwood city's electronic art. three former players believe they deserve compensation for their likenesses being used in historical matchups offered over nine years. ea argued the free speech doctrine knownans dental use. after further review, the three-judge panel disagreed. ea is vowing to appeal. >> staying in the entertainment worm, net. ics expects to bring a lot more original programming to customers in 2015. the chief content officer expected to outline the company's programming plans for future. now, the ultimate goal, about 20 new original scripted series every year with a few movies sprinkled in for good measure. this year company is expected to release episodes in old standbys like "house of cards" and "orange is the new black" as well as new shows such as

marvel's "daredevil" and movies including a new adam sandler move and the sequel to "crouching tiger hidden dragon." have to go to net. ics for that. >> another way to eat up my free time. yelp has won another victory against its critics. scott mcgrew joins us. >> reporter: yelp says the ftc has dropped an investigation into the company's business practices. as you've heard, some small businesses claim that yelp pressures them into advertising in exchange for no negative views. the ftc has launched two investigations into this and dropped them both. last year yelp was taken to court over the same issue. not only were small businesses unable to prove their case. the judge said if yelp did pressure businesses, which yelp says it doesn't it, would still be legal. in a separate issue yelp did settle a suit with the ftc over

collecting information from children. yelp allowed kids under 13 to sign up and supply their e-mail addresses without parental consent. the law is very strict about that. you can't do that. weirdly enough yelp would ask your age and then not stop you if you said you were under 13. speaking of numbers and small ones at that lets turn to landon dowdy live at cnbc headquarters. what's going on with the stock market? good morning. >> i don't know. it's been a rough start to the year, but the markets will try to shake off the new year blues after stocks fell for a third straight day to start off 2015. futures are higher ahead of the opening bell, but investors continue to worry about europe's economy and oil prices. crude is hovering around $48 a barrel and look for data on the job market, trade deficit and minutes from last month's fed meeting. dow dropping 173 points and the nasdaq falling 59 to 4522. scott, back over to you. >> all right, landon, speaking

bay and there's patchy fog out there this morning and overall looking pretty good for a nice day. spare the air. that's the only thing. the sunshine will be hazy as we get into your afternoon so do keep that in mind. otherwise near record warmth. that's the story of the day with temperatures running about 50 degrees above average for this time of year, so we're going to jump a good 20 to 30 degrees over the span of the day, hitting 72 degrees at about 3:00 on the peninsula and 74 in the south bay and 73 is the forecasted high for beautiful wine country. here's the deal. next couple of days, temperatures steadily dropping o.out of record territory by friday and a little area of low pressure which will purify our air quality so that's looking a lot better for us and then this weekend temperatures fall back to average. we're going to talk about our next best rain chance because it has been dry so far because it's looking pretty good for the second half of january. we'll talk about that in just a little bit. right now let bring in mike inouye and check that dry. how you doing? >> how you doing? you doing all right. good to be here, christina, all

right. looking over here. looking at 580 which is doing just fine. as far as approach in towards the dublin interchange. let's show you the tri-valet on the map an sensors have changed from green to yellow in the westbound commute and also typical this time of year coming eastbound off the dublin grade. no surprises. looking at the 84 with a little build as well as altamont pass, the biggest culprit, and a little farther south looking at northbound 670. this is flowment as you're traveling north towards mission boulevard right there at the connector. reports of a fender bender. traffic moving smoothly for the last five to ten minutes after this was reported. we do see the southbound side of 880 starts a little build and a little slowing right past the connector. the south bay and northbound routes no problem as far as the commute. the yell oakes, up towards cupertino and debris reported and not a major concern. should be cleared very quickly. peninsula moves smoothly but the

tier that was killed. southbound 280 hassled two left lanes blocked through burlingame. the bay bridge toll plaza, live look and there's no backup right now, not even for the cash lanes, so a little bit lighter flow of traffic. we've seen more traffic coming in, guys, but not so bad as the full commute, not just yet this week. back to you. >> we'll keep checking back with you. thanks, mike. hundreds of thousands of californians will soon be told they need to switch their doctors. sutter health and blue shield of california are in the middle of a contract dispute. at the beginning of the month letters were sent to more than 285,000 customers telling them they will need to find a new primary physician starting april 1st. sutter health says the two sides are very far apart in financial terms of the contract. right now there are no meetings planned between the two sides. >> a big turnout is expected this morning for a hearing over the recent sale of four bay area hospitals. in all six hospitals owned by daughters of charity health system on the block right now.

nonprofit group is selling it to the for-profit prime health care services. all of this pending approval by the state's attorney general. four of the hospitals are located in the bay area and two in santa clara county and two in san mateo county. the meeting takes place at 10:00 at connor hospital. the accrediting commission will decide whether to restore accreditation to the city college of san francisco. the commission starts three days of meet this is morning, and during those meeting the fate of ccfs will be discussed. while a decision will be made this week, an announcement may not be made for a month. the college will not be allowed to appeal if it is denied restoration status. you'll you recall the school's accreditation was revoked in 2013. the city of san francisco has since sued the commission saying it broke the law when tried to strip ccfs of its accreditation.

"today in the bay's" chris sanchez joins us with new details about what nbc's senior foreign correspondent says it was an organized attack. >> talking about richard engel and he says the attackers may have been inspired by the group isis. today's terrorist attack is called an act of exceptional bar barrett. as you mentioned, 12 people are dead including several police and journalists as well, and looking at the surveillance video you could hear the gunshots ring out. [ gunshots ] >> it is chilling video. it is also -- you can see that it is a very active scene. there's still ambulances there. there's a patrol car riddled with at least nearly a dozen bullets as well. a journalist who witnessed the attack reports seeing several masked armed men leaving with machine guns. french police do confirm that

airasia plane today despite poor weather. divers in an unmanned sub spotted the tail of the plane that crashed into the java sea on december 28th with 162 people on board. now, it is an important find because the jet's black boxes are located in that part of the aircraft. so far crews have recovered 40 bodies. happening today, there are some serious health concerns about bay area air quality, this as we enter the sixth straight spare the air day. bob redell joining us live now from san francisco -- excuse me, san jose, where there will be a near record warmth later today. good morning. >> reporter: good morning. as christina has been mentioning, we're talk about temps in the 70s today and here we are in january. add to that the fact that you've got dry air, little wind and the bay area air quality management district is now calling for another spare the air day, the 12th this winter season, because the air quality is so poor.

>> really tiny particles, ten microns, two microns, tine particles that get into the lungs and blood vessels, they exacerbate people's asthma and cause people with emphysema to feel worse. >> that a pulmonologist who is already seeing people with breathing problems. you can see why people are having issues. this is a picture. thick haze lingering over the south bay and you're thinking that's a lot of car pollution. well, the greatest source of air pollution this time of year is fires which is why the organization is urging you to heed the spare the air day. this day, wednesday, and if you are caught burning an illegal fire, $100 and for a second

offense, $500. bob redell, "today in the bay." >> try to discourage the violators. the entire bay area region and air quality, over to christina loren who has been looking at that very closely. >> good morning, sam and laura and everybody as home we all know spare the air around the bay area means you want to limit your outdoor activities and watch the little ones, too, as they head to have to school. a lot of questions heading back this week and a lot of kids don't go out for recess and likely sparing that air into friday. like to move you ahead. here's the difference. high pressure is taking storm track and for us that means pressure will be even. this will be peak of our warming trend as a result and you may wonder why is it so hazy? the plus rises into the air.

don't get much of a marine influence but enough to bank up all that pollution against the mountains surrounding the santa clara valet so that's where we'll see the worst levels of pollution, tri-valet area as well. tomorrow, area of low pressure, we'll start to change your pattern that will drop your patterns. do want to keep that in mind and it will provide better air quality. more mixing and wind. 74 degrees in the south bay and 72 on the peninsula. 70 degrees on the shore and 69 in san francisco. one benefit that we do get from all hayes suspended in the atmosphere, a gorgeous sunrise as you head off. >> we'll use our traffic cameras to our advantage. the bay bridge toll plaza. -lanes have the backup traffic and it's built considerably over the last five minutes. now have the rush towards the toll plaza. looking at the map, one issue for the east bay oakland getting

into san francisco. no surprises. 24 slows a little bit towards 580. through this stretch 880 coming up past the coliseum and folks well aware of the coliseum and first the map shows you 880, there's the coliseum and just on the other side of the coliseum and 66, right there near taint section, i'll show you our camera at the coliseum. i've turned it towards a fire going on. this is just southeast of the coliseum. this is affecting the industrial area there. for what we understand it's a single structure on fire. oakland fire department is on scene. it's not under control, but right now as you see it's not a huge issue. there's smoke in the area and we're tracking that as a local incident. back to the maps, 880 is not affecting oakland's traffic and 580 very clear of all the activity. 580 through the tri-valet and you can see the dublin interchange. the south bay moves very smoothly as does the peninsula. no major issue, just a crash clearing from mission boulevard. back to you. >> all right, thank you. >> thank you. it's 5:37 right now.

facing concerns at the l.a. international airport are growing after authorities say recently there's been at least three laser-pointing incidents involving planes in the area. the incidents happened on three different planes at l.a.x. this past sunday. first on a delta flight leaving in the afternoon and then around the same time a laser reached another delta plane leaving the airport two miles into the sky and then at night, a third laser struck an inpound plane in the air. pilots say lasers can be blinding and put passengers and crew at risk. so far no suspect has been identified. >> well, a mystery solved 20 years after the fact surrounding a heisman trophy belong to o.j. simpson. simpson won the heisman in 1968. college football's most outstanding player. it is the sport's most prestigious award. a copy of the trophy went to his alma mater usc. someone stole it from its display case in 1949 shortly after simpson's murder trial. so far police in los angeles won't say how they recovered the

thanks very much, tracie. >> maybe they can all cool off and happening today in the eastern half of the nation they are brace for a bitter arctic blast. in minneapolis it's 10 below zero and all public schools are closed. in most places it's not just the cold, it's dangerous windchill. advisories are in effect for a large part of the northeast with strong winds that can lead to frostbite for the unprepared. the windchill in some places may reach 40 below, and it is expected to get even colder tomorrow. new numbers show californians are doing slightly bert on conserving water but still not good enough. you're going to remember a year ago governor brown asked everyone to cut back by 20%. officials reported yesterday that californians cut overall water use by almost 10% in november compared to the same time last year, but important victories are being overshadowed by huge deficits. for example, the bay area has cut water use by 18% while los angeles, san diego, orange and riverside counties have only cut

we see that pollution enhanced. right now it's the best time of the morning. by the evening is when we see the highest levels. 44 degrees on the east shore and we're at 34 degrees in the north bay and 42 on the peninsula. on our way to some really comfortable temperatures. we'll hit 74 degrees and that will likely be a new record here in san jose. 72 degrees is the high on the peninsula, and right around 69 degrees in beautiful san francisco, but we're head for a change. starting tomorrow temperatures drop off and we increase that cloud cover. it's been very dry around here so keep that chapstick handy for today, that moisture irz as we get into the mid-section of the week starting to see the levels really improving with a stronger onshore flow on the the way and we'll see the low 60s as we head through saturday and sunday. a little chance for some rain here. better chance for some snow in tahoe. we're going to take you live to tahoe because as you know technology has come a long way and that means the ability to make that snow. it has been enhanced over the past few years. we're taking you live up there

plaza with all the metering lights and backup there because you expect that coming off of the mays. typical build at the toll plaza but the east shore freeway typical and that's great news. back to you. >> mike, thank you very much. 5:48 right now and new this morning police swarmed the bay fair b.a.r.t. station in san leandro after a fight that started on a train spilled out into the parking lot and ended with one person being shot. this happened a little bit after 10:00 last night. b.a.r.t. police say that one man was shot in the torso and is currently in serious condition. police are still looking for the person who is responsible for pulling the trigger. >> well, san francisco's police chief is shedding more light right now on what happened in the moments before two of his officers shot and killed a man. at a community meeting last night, police chief greg suhr says it appears 32-year-old matthew hoffman wanted to die. suhr says hoffman approached two officers in two separate encounters asking about their guns and when they used them and then showed up at the mission station pointing out what turned

out to be an air soft pistol at officers. police said hoffman left suicide notes on his phone telling officers mott to blame themselves. critics say officers should have called the crisis intervention officer earlier when hoffman was asking about the guns in the first place but suhr says at that point he wasn't a threat. >> his questions were odd, but, you know, the officers contend with folks all the time that are a little bit not just so and it doesn't mean that you're home sidal or suicidal. >> two police sergeants who shot and killed hoffman are currently on paid administrative leave. >> it's 5:49. bay area medical clinics are being warned of a so-called botox bandit. that this warning will prevent other businesses from losing thousands of dollars. this is who police are looking for. it shows a man walking in and out of the plastic surgery office in the civic center neighborhood. the surgeon says the man identified himself as 43-year-old paul halford and gave an address of 1140 folsom street which turned out to be an office. the doctor says he usually does ask for a credit card but that the client showed an employee a walt full of cash and in the end the man got off without paying for $6,000 worth of botox and laser treatments. >> he also seemed to know quite a bit about what he wanted done and looking back that was a red flag. hopefully this kind of thing won't happen to many people and hopefully this particular person won't be able to continue to get away with this. >> reporter: now, there was a recent warning. in an e-mail a local botox sales

person told the plastic surgery community about this botox bandit hitting other bay area offices. a man fitting same description got similar treatment at another san francisco office and pretended he was on his phone and walked out. apparently this is not the first time this has happened. the police did go to the office to get information and they are hoping video surveillance, video from the surveillance camera will lead to a break in this case. live in san francisco, stephanie chuang. >> he didn't steal viles, he got the treatment and then last. >> the police dog zeus has snagged a suspected drug dealer. officers say during a recent traffic stop in santa clara. dog found $240,000 in cash and a large amount of methamphetamine. the cash and drugs were found in a hidden compartment in the car. zeus also discovered 50 pounds of meth in another location in santa clara. he's got a nose for it.
