nbc bay area news begins with breaking news. >> good monday morning. >> breaking news right now. firefighters in san jose are trying to gain the upper hand on a fire burning not from san pedro square in downtown san jose. the flames broke out within the last hour. >> yes, just got to the scene. an abandoned warehouse, we're told. annette, what can you tell us? >> reporter: i can tell you that san jose police say one of its officers was driving in the area and saw the fire and reported it in. as you can see behind me, crews are still actively trying to get the upper hand on this fire.

it is still active. you can see the ladder truck is out, spraying water on the building. when you see white smoke, that means they are getting the upper hand. it appears that this is an abandoned warehouse, although it's hard to tell because we're being septembkept so far back. the wire fence around the building seems to indicate it is an empty building. it quickly grew to a three-alarm fire. as we were headed here on highway 87, you could see the orange glow in the night sky. the cause of the fire is still under investigation. but many of the empty buildings in this area are occupied by homeless people who like to start a little campfire to keep warm. that's not confirmed, but that has been known to happen in the area. we are also hearing reports of wires down, so that could also be a possibility of the cause of the fire. for now, westbound julian is

closed so that firefighters can stage their equipment in the area. so for now we're hearing there are no reports of injuries. that's the latest here, live from downtown san jose. >> that was in san pedro market square and the 87 overpass. >> as we were watching the flames themselves, the smoke just seemed to be going up in a single column. not a lot of wind activity. want to check the current conditions with christina. >> you're right on point. we don't have much wind out there at all, which is good news, but it is certainly chilly out there, which could prompt somebody to want to have that warming fire. temperatures are running about three to five degrees cooler than 24 hours ago, and it's going to be a chilly start to today. much difference a day makes when it comes to the fog. let's check your drive. mike has the day off. >> good morning to you.

that traffic problem is going to really be right around 87 because of that fire you can see on the screen behind me. on our traffic maps, just because traffic is so light, there's lots of green in the silicon valley. even driving in this morning, you can notice the fire from the highway, so i do think this is going to be in the area that will cause a lot of slowing, especially from 880 coming in from the northbound side and 87 coming from southbound. even really 101 because the smoke is so expensive. it's going to catch a lot of folks' attention. take it easy, go slow. otherwise no accidents to report here early this morning. guys, back to you. >> thank you very much. san jose fares will actually have to take extra precaution in the field after making a troubling discovery. a firefighter fell through this boobie trap while responding to a grass fire on the east side of communications hill on sunday. it was covered with burlap and filled with sharp wooden spikes.

firefighters believe it was not intended for them, especially since it was at a former homeless encampment. >> our guess is that it was there for sometime, maybe as a means of defense from one encampment to another. >> the firefighter that fell through the trap is okay, but it's still unclear who set the trap and why they did. this morning, richmond police are asking anybody who may have witnessed a deadly shooting to please come forward. officers patrolling the area near the crescent park apartments on hartnett avenue heard gunshots just before 7:30 last night. they found three men who had been shot, and one of those men died on scene. the two others were rushed to the hospital and are expected to survive. police say they don't know what led up to that shooting and they have no suspects. in oakland, investigators are trying to figure out how two people wound up dead. their bodies were discovered next to grand and lake park avenues. we're told there are no visible signs of any trauma and the

victims have not yet been identified. a deadly train emergency in washington, d.c. has the attention of bart officials here in the bay area. earlier this week, a metro train in the nation's capital filled with smoke. one woman died and dozens were taken to the hospital. the ntsb says electrical arcing caused the emergency. the train system is in d.c. is a lot like our own bart system. bart had its own close call with electrical malfunctions on the third rail. in september of 2012, an arc filled the civic center with smoke. what has them concerned is that many passengers got tired of waiting and evacuated on their own. that's a move that could put everyone in danger. >> we always want to avoid people opening that emergency latch to open the door. the problem with that is the train operator may be very close to moving that train out of the area, and if you open the emergency latch door, it's going to cause that train to not move. >> bart says in an emergency,

talk to your train operator. there's an intercom on every car. the passengers we spoke to say bart operators need to be more vocal and clear during an emergency. san carlos city leaders have aproved a controversial new plan to monitor drivers in that area. the mercury news reporting that police are going to be equipped with two automated license plate readers. this week, council members agreed to a trial plan for it. going to be at least for the next six months. those devices will collect and store license plate data. one reader is being placed near the busy 101 onramp at briton avenue. the other one is going to be mounted actually on the patrol vehicle. critics call the devices an excessive surveillance tactic. happening today, mountain view hopes to put an end to a smelly problem. starting this morning, the city will begin flushing out its water main pipes. people have been complaining the tap water smells like rotten eggs. the city normally flushes the water mains every year, but had to push last year's flush back to conservative water during the

drought. the work should be finished by the end of the week. the yosemite climbers just a few feet away from history. we've been told santa rosa's kevin jorgensen will likely reach the summit today. >> lots of media attention, too. so how impressive is this historic attempt? the wall they're climbing right now, 3,000 feet tall. that is about three times the height of san francisco's transamerica pyramid. four and a half times the height of the washington monument. experts say the vast majority of climbers have never attempted anything this hard, even 1,100 feet off the ground. >> they said they're just used to it, this is what they love to do.

welcome back. we continue to follow breaking news out of downtown san jose. this is a fire that is burning at a warehouse near san pedro market square, not too far from that and 87 westbound julian. i should say 87 westbound julian

is actually closed door, as firefighters continue to try to tackle this. at one point, those flames were leaping high into the air. no word of how this fire started exactly, if any injuries. we do have crews on the scene of the fire. we'll continue to bring you updates this morning. 443 right now. new this morning, al qaeda's new claim of responsible for the massacre at "charlie hebdo." a top leader in yemen's al qaeda branch says it chose the target, laid out the plan and actually financed that operation. in paris today, the new issue of "charlie hebdo" is out. it is the first since the attack. demand has really been overwhelming. despite a run of three million copies, scuffles are breaking out amongst people wanting to buy the issue. new video also emerged showing the "charlie hebdo" shooters just moments after the massacre. the kouachi brothers pause in the street, shouting "we have

avenged the prophet mohammed" as they reload their weapon. the drivers eventually escape. in another incident that shock the world, lawyers for suspects in the boston marathon bombings are using the events in france as an argument to delay his trial. dzhokhar tsarnaev's attorneys have asked to suspend it for a month. they say the comparisons to boston will cloud the jury pool. jury selection began three days before the "charlie hebdo" massacre. the judge has not ruled, but experts believe a suspension at this point would be highly unusual. we're learning more this morning about a bizarre death threat against one of the most powerful politicians in the country. a former bartender has been indicted on suspicion of threatening to kill. house speaker john boehner. the suspect used to work at a country club near cincinnati, where boehner is actually a member. he allegedly had plans to poison

or shoot the lawmaker. court documents obtained by nbc news show the man thought boehner was to blame for the ebola outbreak. investigators say the man is disturbed and is under psychiatric evaluation. president obama heading to america's heartland today in a push to boost internet speeds there. putting him actually at odds with republican lawmakers. the president's internet push is part of an agenda that he's going to lay out more extensively during next week's state of the union address. that agenda is under attack from the gop. they are focused on other issues they say like immigration. the house today will be debating a series of amendments to block president obama's immigration orders. this as part of a homeland security funding vote. >> it's not about actually the issue of immigration. it's about the president acting lawlessly. >> this is privilege. they know this will not become the law. >> that's a contentious issue. republican lawmakers are also

focused on that, the keystone xl pipeline, which is now in the hands of the senate. but even if approved, which it's expected to be in congress, the white house says president obama is going to veto that pipeline bill. a follow up now. supervisors will not give themselves the 33% pay hike after all. back in october, the board voted to raise its pay from $97,000 to $129,000 a year. but yesterday, they voted to repeal that ordinance. the supervisors maintain they have the second-lowest salary in the bay area and that they took a pay cut during the recession. critics of the pay hike were in the process of trying to overturn the raise before yesterday's vote. the supervisors say they'll take another look at pay options when they meet up again next week. if you had some money tied up in the market yesterday, it might have been a good time for some anxiety medication. to say yesterday was a wild day on wall street would be a bit of an understatement. for that and the rest of your news before the bell, we turn to landon doughty at cnbc

headquarters. good morning, landon. >> you're exactly right. and it could continue today. there could be more red arrows on wall street after the dow had its biggest one-day reversal in six years on tuesday. the dow was up nearly 300 points during the session on optimism over alcoa's earnings, but also fell as much as 120 points on profit taking. oil prices dropped to a six-year low below $44 a barrel before closing higher, but crude is down again today. we get data this morning on retail sales on import prices and earnings from jp morgan and wells fargo. the dow closing down 27 points. the nasdaq slipping three. verizon wants to put a virtual mechanic inside your car. the company has a device that you plug into your dashboard that can diagnose what's wrong when your check engine light goes on and it can provide in-depth info on the problem and what it will cost to fix it. the device will be available for any car made after 1996. and get your order ready, because pizza hut is going

show you this morning. it was a really intense fire. this is at a citrus packing facility, causing an estimated $1 million in damage. it was in the central valley, broke out late last night. that is about 45 minutes southeast of fresno. firefighters still on the scene actually, keeping an eye out for hot spots. one out building has been completely destroyed. so far, no injuries have been reported. investigators are now looking into what started that fire. let's move now to some consumer news. ikea recalling nearly 200,000 crib mattresses this morning. there is concern that babies can actually get trapped in a gap between the mattress and the great britain. if you bought any of these five models you see on your screen rigt he right here on your screen, make sure the gap is no longer than the width of two fingers. if any gap is larger, return it to ikea for a refund.

at 4:50 right now, for years we've been hearing about the dangerous of bpa, but a new study shows its alternative may not be any safer. researchers at the university of ca calgary, looked into the replacement, which is in baby bottles and plastic food containers. they found the synthetic compound could pose a serious risk to unborn babies. in animals tested, bps changed the part of the brain that actually plays a key role in fear, impulse control, obesity, and even early puberty. pregnant women in particular are being told to steer clear of both bpa and bps. with early education so critical in a child's development right now, preschools in san francisco are getting a big boost. the mayor says the move is going to provide parents the best access in the country. >> the city is actually expanding its funding of its preschool assistance program thanks to a measure voters approved last november.

the new funding allows all 4-year-olds free access to public preschools. also parents can receive partial funding for private preschools. the program is called preschool for all. the funding is now in place for the next quarter century. a 3-year-old utah boy is home safe after using a cell phone to actually get him out of his mother's stolen car. >> this is a crazy story. yesterday the mother dropped off her other son at daycare, then saw somebody take off in her car with the son in the back seat. after the mom called for help, police found her cell phone that she left in the car and her son answered the phone and the thief quickly abandoned the car. officers told the boy to honk the horn, and within minutes, the mother and son were reunited. police are now on the lookout for that car thief. luckily, everybody's safe. >> thank goodness he's okay. we are following some breaking news in downtown san jose. fire crews are at the scene of a warehouse fire. these are live pictures from the scene as they continue to try to tackle this one. we've got a crew there as well. we'll have an update coming up.
