if good morning, a crisp and relatively clear start at least in the south bay for this morning. it's tuesday, january the 20th, and this is "today in the bay." a very good tuesday morning. thank you for joining us. i'm sam brock. >> and i'm laura garcia-cannon. an exclusive neighborhood on the peninsula is on alert this morning. this after repeated sightings of a man neighbors say is not supposed to be there. "today in the bay's" rob redell is live in atherton to explain. >> reporter: good morning. people are asking police who live in the small town with a reputation for low crime to keep their wits about them to make sure they don't leave their homes unlocked whenever they go out for errands or whenever they hit the hay. this comes after several incidents over the past few weeks, two just this past saturday at homes in southerland

drive and mesa court. police tell us the person that lives at the house on southerland spotted a suspicion man on his property saturday looking into their windows. the prowler bolted when they made eye contact. the suspicious person was then spotted inside the poolhouse of the home on mesa court but was gone by the time police arrived. >> i have to be sure that my husband knows that he can't leave any doors open and so you have to be more careful obviously. >> reporter: a resident of atherton taking the heeding or warning from the police department. here's the police department's description of the man, he's hispanic, young, between 25, 31 years of age, slender build. the only distinguishing features of the face he has a pointed nose and a closery cropped beard. earlier in the month place in atherton received report of an unlocked door and stolen spare

key left in the deadbolt of a front door at another residence. no arrests so far. rob redell, "today in the bay." >> thank you very much, bob. moving on, the two men accused of a violent attack inside of a bathroom at levi's stadium are expected to appear before a judge this morning. the brothers are expected to enter their pleas today. the men are accused of attacking two other men during a 49ers game in october which you have video of, police say the attack was unprovoked and one of the victims could face lasting damage as a result. oakland city council members today are expected to back a new game plan to redevelop the coliseum complex. new oakland mayor is proposing extending the current negotiating agreement with developers to allow time for the raiders and a's to pitch proposals to develop the land. the new project may include one new stadium, homes and businesses. almeida county supervisors must also agree to the plan but already indicated they will do so. an ongoing saga right now,

state fish and wildlife could soon shed some new light on a mysterious substance that's covering see birds along the east bay shore. "today in the bay's" stephanie chuang joins us from almeida county. animal rescue groups continue to treat a growing number of birds since that substance was first spotted and many of which have died unfortunately. good morning, what do we know? >> that's right, good morning to you, sam. we know the numbers keep climbing. so far about 256 birds rescued and 50 found dead. you can't see it but we are in almeida by the water, it's obscured by the fog. crews said to come out here this morning to comb the east bay shoreline and that goes down to hayward up to san leandro, up here to almeida, about an 18 to 20-mile stretch of shoreline where they've been looking for these sick seabirds. now crews with the international bird rescue center yesterday found a second condam nated surf skoter in two days, they took it to a mobility facility.

this mysterious thick, sticky substance which state officials said is not toxic more oil-based has killed countless birds by stripping them of their feathers leaving them to die of hypothermia. >> these birds that gather in the winter out in the east bay and all throughout the san francisco bay area in large numbers are being covered in this goo. we don't know where it came from, and have yet not identified the source or the product. >> reporter: volunteers have been washing the birds with vinegar, baking soda and hydrating the birds. this morning the state is slated to perform thnecropsi on some o the dead birds. it could be days before we have a definitive answer on what this deadly substance is. today the state is set to begin its investigation into not just what it is but perhaps who is responsible. coming up, what could happen if that is determined. live in almeida this morning, stephanie chuang, "today in the bay." >> hoping for some more clarity

here, thank you so much, stephanie. happening today at 5:04, the president will address the nation tonight and though the skimping not dry in his state of the union address, already a number of folks are lined up to criticize it. >> this as "today in the bay's" kris sanchez talks more about the president riding a bit of a high coming into the state of the union. >> yes, scott mcgrew is talking about the economy improving and the approval rating improving for the president tonight, with the highest approval rating in a year, which of course could change depending on what he says in his state of the union address tonight. taxes are expected to be front and center with the plan to cut taxes for some members of the middle class, but to raise taxes for the wealthy, even close a loophole that allows the rich to pass their wealth down to their children tax free. the president's plan includes a fee on the biggest financial firms making it more expensive for them to borrow. those reforms could raise up to $320 billion over a decade and

pay for some of the middle class plans. in a republican-controlled congress there could be resistance that's putting it mildly. the president of one conservative political advocacy group is more blunt about it saying when it comes to higher taxes, it's not going to happen. >> i think the president's plan to raise taxes is dead on arrival in this congress. it won't work. it will cost us jobs. >> as always, there will be average americans sitting with the first lady during that address. the president will share some of their stories. he's also expected to speak about how his policies have helped them and others and how he aims to increase wages and grow incomes in the middle class. here are some of the things to consider as you watch tonight, hopefully here on nbc bay area. the president's approval rating is at 50%, the highest it's been in a year. americans in a new "wall street journal"/nbc news poll say they feel more positive about the economy. however, only one out of four people who were polled in that poll say their own financial

situation improved. the majority says it's the same. coming up in the next half hour a preview of the president's message in his own words but really the focus is expected to be on the middle class. >> very good. >> at least the economy is doing well. more taxes may rub some people the wrong way. thanks very much, kris. nbc bay area will air the state of the union live. coverage begins at 6:00 p.m. tune in early at 5:00 where we will have all of your local news. from politics to weather, meteorologist christina loren off this morning. we are joined by the very amiable rob mayeda, what's going on outside? >> i didn't want to talk taxes, i almost did but i didn't. >> let's talk about what's still free, fog. sunshine and temperatures may be climbing into the 70s a little bit later on. right now the fog is very thick there around oakland. you see it, 48 degrees in oakland and to the golden gate bridge there. san francisco 52, very foggy but san jose a little bit of a break there. we've got overcast skies, low

clouds, a little bit higher off the ground at 46 but look out for that fog, very thick at times along your 580 commute through livermore, concord about a half mile visibility. about a half mile in oakland. not too bad in the south bay. during the day about lunch time we'll see the low clouds breaking up with hazy afternoon sunshine and temperatures like we saw yesterday climbing into the low 60s around san jose. closer to 60 for san francisco for the north bay, low 60s in santa rosa and pleasanton and livermore with highs in the low 60s but the trend here as we wrap up the week and head into the weekend shows numbers in the 70s. maybe a case of guilty sunshine. 70s are nice to have for the weekend. we could use some rain or snow but nothing like that showing up in the next five days. now for another check of your morning commute here answer mike. >> watch for the guilty sunshine. none of that right now. tough drive, look, here's the parking lot north of our camera, the oakland z[j;÷coliseum, we i to about 6 from our camera and not much beyond that because of

the low clouds. look farther north the bay bridge toll plaza, the same situation at the toll plaza. light volume of traffic but tough to see. visibility here as we look at our maps the approach for the maze and the vicinity coming off of 24 and the rest of your vicinity. as we look at our traffic maps the orange is highlighted around the area as well as through the walnut creek interchange. coming across the bay bridge and carquinez bridge, fairfield, vallejo and novato, the rest of your bay as we look at the wide view no problems as far as speeds go for the peninsula, but watch the dumb barton and san mateo bridges they have fog advisoriy iesis issued by the c. heads up for some b.a.r.t. riders. park something going to cost more money at several locations. b.a.r.t. is hiking parking fees at 50 cents at 15 different stations. the changes will take effect at bay fair, fremont, fruitvale and

lafayette. lake merritt is also impacted, richmond, rockridge, san leandro and south hayward and union city and walnut creek, too. next monday parking fee also increase by 50 cents at 13 other stations. >> may have been seieasier to s where they're not. we'll finally find out today what bp will pay for the devastating oil spill in the gulf of mexico. plus new troubles for air b&b. the city considering restrictions on the temporary home rental website.

welcome back everyone. good tuesday morning to you. more trouble for air b&b, this time in new york. hearing before the new york city council set for tonight. several residents are expected to testify that illegal rentals have been driving out tenants and hurting living conditions. air b&b allows people to list their apartments for travelers looking for a place to stay. san francisco just passed a new law regulating air b&b rentals. the new law restricts rentals to permanent residents and lists entire home rentals to 90 days a year. people wanting to rent out rooms have to register with the city

and if they want to list their rooms on the site like air bnb the city will notify landlords first. fingers are crossed and good luck charms ready in sunnyvale as engineers hope for clear skies and good rocket ride for their satellite. scott mcgrew you know about this. >> doesn't seem mathematical, does it? they sometimes wear the shirt for each launch. at nasa they have beans for breakfast. the folks at lockheed martin gathering around the muof site, it will launch on the back of the atlas flight in florida, actually this afternoon 4:30 our time, delivering mobile phone data and connections to soldiers on the battlefield. google reportedly thinking about investing in spacex as elon musk's company plans to build and launch small satellites to bring the internet to more parts of the world. spacex has not accepted outside funding before. you may recall richard branson announced something similar for

his company. he worked with one web to create more than 600 satellites to deliver internet, so bottom line, lots of connections. let's check the markets this morning. landon dowdy is live at cnbc world headquarters. good morning, landon. >> hey, scott, good morning to you. futures reporting to a higher open as the markets look to build on friday's rally. stocks snapped a five-day losing streak but the dow, nasdaq and s&p 500 still in the red for the third straight week. look for data on housing and earnings from johnson & johnson and morgan stanley. on friday the dow was 17,511 the nasdaq adding 63 to 4634. back over to you. >> thank you much. france and germany are teaming up to try to get some of that terror messages off the internet. we'll talk more about that coming up in a bit. >> thank you. >> sounds good, thank you very much. 5:15. checking in with rob, foggy in parts of the bay. >> especially in the north bay and east bay valleys.

visibilities down at times to about a half mile. this afternoon sunshine and warm you are weath warmer weather on the way. concord and livermore this morning, 46 in san jose, as you can see there with the overcast conditions, we'll take you over to the golden gate bridge, where you got the fog and 52 degrees and another stop for you we'll be looking at places like concord and livermore, there you see less than a half mile visibility also into oakland we're seeing the visibility at times reduced, not too bad in the south bay. another foggy start to the day, and we're going to have to watch for day two of three days of these king tides, another high tide coming up later on this morning. the highest that we'll see with this stretch of king tides close to about seven feet at ocean beach there at about 9:57 in the morning. watch out for unusual rip currents and localized flooding along the inner bay and coast as the king tides continue. another one coming up for

tomorrow morning. later this week the weather will turn interesting as high pressure starts to strengthen. we've got some warm days ahead and high pressure strengthening to the point we could be breaking some records as winds turn offshore later this week, this will set us up for temperatures soaring into the 70s. the storm track way off to the north so the temperatures today in the 60s but soaring as we get towards friday and saturday. highs today low 60s in san jose, closer to 60 for san francisco and in the north bay, highs in the low 60s. mid-60s closer to pleasanton and five-day outlook for san jose and san francisco, approaching 70 degrees there on friday and mid-70s this weekend. would be enough to break some records and both saturday and sunday we could do that in the south bay and north bay highs approaching the mid-70s with mostly sunny skies here as we go through saturday and sunday. for another check of your morning commute here's mike. >> rob, the fog still here, commute building slowly at the bay bridge toll plaza, where we're looking at, believe it or not. the cash lanes show a few cars

waiting and no problems for fast track there. problems with visibility, can't see the 880 overcrossing. as we look at your map i'll show you the orange highlighted here throughout the maze and come off of 24 on the walnut creek interchange, that's where visibility is the toughest. you saw that from our live look this. here the approach to the maze and upper east shore freeway moving at the limit. west 24 at west 580 there is a fender bender reported, sounds like everything is out of the lanes but with lower visibility that's a major concern for that commute, focus approaching the maze. here in the north bay but novato, petaluma, south 101, visibilities tough toward san rafael. same thing for fairfield, rio vista, a light build for highway 4. carquinez and benicia bridges might be a tougher view of the roadway coming across. live look at our wide view of the rest of the bay, shows you the south bay and peninsula, no problems for speeds and timical build in livermore in the trivalley where fog may be a factor as well. it is definitely a factor.

looking at live san jose, 680úd and 280, as rob told you visibilities is fine throughout the south bay, no problems for the santa cruz mountains reported to me and we'll look toward the san mateo bridge where west 92 just one of your bridges with the fog advisory. the traffic builds 92 and 84 to the south the dumb bar to be bridge also an advisory. >> thanks so much, mike. if you have ideas on ways to improve expressways in santa clara county tonight's your chance. county leaders are holding one in a series of meetings about the expressway project. it will explain maintenance for vehicles, pedestrians and bicyclists. tonight's meeting for lawrence and santamonte expressways. the meeting at 6:30 on the west branch library in san jose. over in europe four men police say are connected to the terror attacks in france are expected to appear before a

judge today. amedy coulibaly shot and killed an officer in the outskirts of paris before taking hostage action at a kosher supermarket. four people died before coulibaly was killed by police. it's not clear if the men facing the judge today weren't involved in planning the attacks or even aware of coulibaly's plans. five other people also arrested in this investigation were released today without charges. over in germany, 200 police officers raided 13 homes this morning on terror suspicions. most of the homes are in berlin. police think the homes are connected to two people arrested last week, suspected of being tied to an islamic cell. there's no evidence any of the people whose homes were searched were planning an attack and there are no reports at this point of any arrests following those raids. 5:20, happening today, energy giant bp returns to court to learn how much it will pay in federal fines for the deepwater horizon oil rig accident in 2010. 11 people died. the government says nearly 11 million gallons of oil subsequently spilled into the

gulf of mexico. damages in this case may potentially top out at nearly $14 billion. that's on top of the billions bp has already paid out in earlier settlements. cleanup kaugcosts and criminal fines. >> breaks down to $4300 a barrel. epic unpress departmented payout. where the three world championship trophies are going to be next.

affected some this morning. >> very thick across the golden gate bridge and similar to yesterday. they'll be sticking around until about lunch time and later on this afternoon breaking out to hazy sunshine. so 40s and 50s outside right now on our way to low 60s this afternoon with a high of 63, closer to san jose and about 60 later on in san francisco. mike? >> rob, we're looking over here toward dublin cam area, looking at a little slowing toward the dublin interchange. we have a lot of fog coming westbound 580 out of livermore in toward our camera, and that is impeding our visibility but speeds and the traffic flow moving all right for this morning's commute, not so bad for tuesday. we have a crash reported 580 at 234 and not presenting a problem as far as the lanes being blocked but there's all this fog throughout that portion of the east bay, and that will be a factor for your drive from walnut creek interchanmú.auxñ oo the bay bridge toll plaza, same thing for highway where where we see the build through the

antioch. vallejo watch for visibility there, petaluma and novato, the orange blob shifts around. we get the updates for the fog reports, hitting 101 toward highway 37 is an issue. look at the bay bridge toll plaza the live camera showing you the build for the cash lanes but not a major concern just yet. we don't have any metering lights on but they may be turned on earlier, because of visibility and tough patches for the span across san francisco. the golden gate bridge a stuff view coming across the center divide from the north bay in towards san francisco. this is 101 getting into san francisco but in palo alto, 101, a lot clearer. look at the view north of university, there's willow and easy drive, nothing out of the ordinary for 101 or 280 along that side of the bay. we'll send it back to you guys >> thank you. it is 5:6. late night rescue after a south bay boat gets stuck in low tide. plus a south bay convenience

police on the lookout after a suspicious man is seen lurking around a number of homes in one peninsula neighborhood. we'll have details next. a flight out of san francisco stopped on a new york tarmac because of a bomb scare. we'll hear from one of the passengers on board that flight next. and we got temperatures in the 40s and 50s with patchy, dense fog and some misty skies for parts of the bay area, that plus 70s ahead in your mic microclimate forecast. traffic as far as the volume the 70s but not as far as the limit legally as well as visibility wise. we'll look at the trivalley and what you're encountering for your slowdown this morning. a live look outside, a clearer shot from the south bay this morning but the fog is out there, north and east. it's tuesday, january 20th. this is "today in the bay."

"today in the bay's" rob redell is live in atherton where police are telling residents they should be on alert. what does that mean? good morning. >> reporter: good morning to you, sam. atherton having a reputation for having little, if any crime yet this morning the police department is asking people just to keep their witsñ]vy will the make sure you do the common sense things when it comes to leaving your home, don't leave your home unlocked and certainly don't leave it unlocked when you're going to bed at night. this warning after several incidents over the past few weeks, two this past saturday at homes on sutherland drive and mesa court which as you can see on the map we put together for you on your screen they're in the same neighborhood these homes are. police tell us that the person who lives at the house on

the past couple of weeks. no arrests as of yet. reporting live in atherton, rob redell, "today in the bay." >> thank you very much, bob. two men tied to the beating death of a popular tennis instructor could enter a plea in court today. last month, 24-year-old oleg talamai decided after a fight outside a bar in palo alto. his head hit the ground after someone punched him. he died three weeks later. police say four men were involved, one is facing involuntary manslaughter charges for throwing the punch. another accused of driving the car that nearly hit officers when the group tried to leave the scene. both men are due in court today. >> 5:32. new this morning, investigators in sunnyvale are looking for an armed man who held up a local 7-eleven. the clerk tells us around 8:30 last night a man came into the store flashing a gun. he did not actually pull out the gun but did demand money. the clerk emptied two cash

registers and the gunman took off. as far as we know, nobody was hurt. >> a mysterious substance covering bay area seabirds could soon be identified. "today in the bay's" stephanie chuang joins us in almeida this morning and stephanie, since the substance is discovering more birds every day are treated at animal rescue centers trying to help them. >> reporter: absolutely, good morning to you, laura. it's almost a desperate attempt at this point. we're at one of the hot spots again amassed by the fog here in almei almeida, the waters behind there. this is the northernmost hot spot where crews have been coming out and so far found overall 250 birds they've rescued, they've been sick and 50 dead bird. it goes down to hayward which is where we yesterday were just standing a few feet away from a dead bird also coated in the substance. crews with the international bird rescue center and wildlife emergency services have worked hours to spot and catch these sick birds that have been dying of hypothermia. the seabirds are coated in this

sticky substance which is not oil, but strips them of their feathers. officials are said to start an investigation into where the substance came from and who might be behind it. >> what this is, what we can do to negate it and if there's a responsible party go after them for financial and possible criminal charges if it comes down to that. >> reporter: here is an example of one of the sick birds, a second contaminated sirve skoter, a shore bird found by crews in just two days and taken to a mobility facility in hayward. volunteers are washing the birds with vinegar, baking soda and hydrating them. the state is going to perform necropsies on some of the bird. it could be days before we know what the substance is. coming up in a half an hour, the actual cost of this and what you can do to help. this morning live in almeida, stephanie chuang, "today in the bay." >> a lot of animal lovers here in the bay area will want to

help. thank you, stephanie. we have new details this morning on a water rescue in the south bay. two boaters got stuck because of the low tide. memo fire airboat picked up the men at 10:30 last night after a coast guard helicopter spotted them near coyote creek and@[ fremont. the boaters used a cell phone to help around 6:30 but then the phone fell into the water. rescuers searched for about an hour and a half before calling in the coast guard to help in the search. this marks the second rescue in a little more than 24 hours. both boats were caught in the low tide. we know you're starting your day, rob mayeda starting our tuesday but taking a peek at the weekend. you mentioned 70s. >> it's hard not to notice what's at the bottom of the screen, the seven-day forecast, numbers jumping into the 70s but the meantime watching the patchy fog-filled mornings. 46 degrees in san jose. different view across the golden gate bridge at 52 and obviously fog setting up across the

bridges this morning. towards dublin, 48 degrees and locally thick fog again out towards the trivalley around concord into livermore, you're seeing less than a half mile. oakland into the fog and sunnyvale patchy fog, less than a mile visibility. san jose not too bad. the trend just like yesterday some of the low clouds may linger until lunch time and later on today we'll see hazy sunshine winning out. watch out if you're headed to the coastline. you saw the story the problems with low tide last night. we have another king high tide today at seven feet just before 10:00 this morning, another usually low tide come up just before 5:00 later on today. watch out for some unusual rip currents and localized flooding on the coast and inner bay into tomorrow as the high tides condition. san francisco closer to 60 for the north bay and trivalley today, highs in the low 60s. the trend ahead will boost the temperatures into the 70s which would be record-breaking territory possibly as early as

friday but the warmest days of the next seven coming up for the weekend saturday and sunday. no rain but plenty of winter sunshine with the highs in the 70s. for another check of your foggy looking tuesday commute here's mike. >> good morning, rob. definitely very foggy. this is the best view we've had for a while, this is 580 approaching our camera around tassa hard as the overpass and the gloomy view of the cars. let's look at your maps because even though it's tougher to see with the live camera you can see from the speed sensors west 580 through the trivalley predictable pace. very good for this time on a tuesday, no major problems for 84. foggy in patches through pleasanton and sunol may be a factor later on. 680 moves nicely out of pleasanton. north of san ramon into danville and, danville and alamo where we have visibility issues. north of there, orange painted up for visibility problems over through oakland as well. the south bay and peninsula as you look at our wide view moving just fine. as we look over toward our live look the bay bridge toll plaza

is representative of the east bay problems we have. we have the building commute for the cash lanes at the toll plaza no metering lights yet but tougher visibility past the coliseum and east shore. back to you. >> thank you very much, mike. passengers on two delta flights got a scare on the tarmac in new york late last night. authorities say someone called in bomb threats forcing them to evacuate the planes. we have cell phone video from a passenger on one of the planes. police say they got two anonymous calls saying there was a bomb on board delta flight 468. it turns out there were two flights numbered 468. one of them left sfo landing in new york around 8:00 eastern time, the other was on the tarmac heading overseas. >> the man said there is a pom threat directed towards our plane and then they went to a different part of the terminal, and we got on buses and waited there for a while. >> passengers stayed there long enough for police and bomb-sniffing dogs to search the plane. no bomb was found on either

plane. dozens of stanford students are out of custody this morning and a few more are still behind bars, this after bringing traffic to a halt on the san mateo bridge yesterday. just before 5:00, protesters blocked all westbound traffic for about two hours. protesters were citing the martin luther king jr. holiday saying they wanted to bring attention to racial injustice the chp detained 68 people, most students or members of the stanford community and almost all of them were released. 11 others were sent to jail. it's 5:39. new details to dismantle candlestick park. and how did south bay kids help make "american sniper" a box office success? >> live look outside san jose the traffic is picking up, the holiday slumber is over. mike is back here joining us to talk about what the best options are for you this morning. we're going to be back with 15 minutes of nonstop news, traffic and weather right after this break.

welcome back. we are coming up on 5:42. take a look outside right now, the approach to the bay bridge toll plaza, no surprise there is both a combination of fog and traffic this morning. we're going to get into both of those elements coming up in a little bit. japanese leaders are vowing this morning to save the lives a ransom by isis militants. in an online video released, two extremists claiming to be with isis threatened to kill hostages in orange jump suits. we choose not to show the images because they are isis propaganda. the militants are demanding $200 million in the next 72 hours. the two hostages are identified as a military contractor and a freelance journalists. recent terror attacks in europe are putting australia's police officers on high alert. the main security agency today raised the terror threat level to high specifically for police officers. this after recent attacks

against police elsewhere in the world. high is actually the second highest level on the four tiered terror level scale. australia's general population has been at that level actually since september. happening today, jury selection begins in the trial of the man accused in a deadly shooting rampage in a colorado hoffie theater. james holmes faces multiple counts of first-degree murder and attempted murder for the 2012 shootings in aurora. 12 people died. holmes pleaded not guilty by reason of insanity. 9,000 prospective jurors at this point, one of the largest juror pools assembled. the selection process is expected to last until may or maybe june. a busy section of interstate in ohio will be closed for two days after a bridge collapse killing a construction worker. crews were working to take down an overpass in cincinnati. construction worker was killed by falling pieces of the bridge. big rig driver was also taken to

the hospital. as a buildup to the oscars it was a record-breaking weekend for the iraq war drama "american sniper" which grossed $90 million. while it stars bradley cooper two 6-year-olds from san jose play a key role in the move movie. the story is about chris kyle the most lethal sniper in u.s. military history. the 6-year-old twins madelyn and aidan mcgraw play kyle's kids. >> i got to meet bradley cooper! >> i did. >> and i also got to meet clint eastwood. >> yes. >> everyone was so excited, it will just make your hair stand up. they both have small speaking parts in this movie. the twins parents say they're proud the kids were a part of the flick not just because of the superstar line-up but also because their dad and several of the family members are veterans. so some personal residents as well. >> very cute kids.

seattle ma enradioers are about to change the way we see baseball. the team is in the process of replacing the stadium lights with l.e.d. lights. l.e.d.s imitate natural light. researchers say they're easier on the eye and produce crisp, true colors for broadcasters. the lights will save the mariners about 60% on the electricity bill as well and the bulbs will last for years. no word on whether at&t park or o.co coliseum plan to follow suit. we'll see how they look. we're still two and a half months from baseball season. >> can't wait. >> a tennis break. >> we see weather coming. >> i notice some blossoms ready to pop. >> yes. that's one of the things, last january we had the same problem the weather turned dry and the sunshine. we're going to see a repeat performance of that towards the weekend. this morning the fog very thick and as mike has been pointing out could slow your morning commute at times. later on we're going to see more sunshine break out. 46 degrees in san jose with overcast skies, not too foggy in

downtown you'll find the fog into the north bay and east bay valleys. 46 currently there in san jose. we'll show you another view from the golden gate bridge right now, 52 degrees or what you can see of it there in the fog, low clouds and mist near san francisco and the worst of the fog in terms of visibility in less than a half mile you'll find it in livermore along 580, oakland into concord, visibility at times reduced and now into sunnyvale less than a half mile visibility. watch out 101 or 280 into the south bay you could see some thick fog and just like yesterday it will take until about lunch time before the fog begins to break up so we'll see areas of dense fog in the north and east bay valleys and then as we head through the afternoon more hazy sunshine. if we could head up to the coast we'll get the sunshine but watch out for another round of the king tides, the astronomical high tides which occur as the gravity of the sun and moon work together and make an unusually high tide. seven feet at ocean beach just

before 10:00 this morning and we'll see one more as we get into wednesd y morning be&az the tides kind of equalize out later on this week. highs around the south bay near 63 in san jose, closer to 60 for san francisco and the north bay will see highs in the low 60s and mid-60s around the trivalley. the forecast ahead as you see there in the seven-day forecast on the bottom of the screen shows the potential for some record-breaking warm temperatures, low 70s, starting as early as friday around san jose, and even some mid-70s and forecasts there as we head into the weekend and we should see a little less fog, too, by saturday and sunday. mike? >> we're looking to the south bay, we have visibility, that's just fine for 101 but the volume of traffic seeing the burst we typically see before 6:00 the first burst for the south bay causing the slowing north of 280 and 60. that's this stretch on our maps. nothing really unusual about this pattern. 85 at almedin expressway we had a bit of debris that cleared from the road which and the rest

of your south bay looking good for this time on a tuesday. fog advisories for the san mateo and the dumb barton bridges and a little slowing westbound your commute direction to the peninsula. 101 and 280 smooth as far as the volume of traffic, a lighter flow. look at the orange painted all over the east bay and the trivalley and that is an issue, fog, lower visibility coming up here. livermore and north looking at the walnut creek interchange. west 4 at the central lafayette off-ramp a crash moved from the roadway but fog along 234 is an issue all the way in toward the maze and lower part of the east show freeway through berkeley and the bay bridge toll plaza. eastbound highway 4 a crash counter commute but there through hercules off of the east show freeh bay. fog likely through petaluma and novato north of the richmond/san rafael bridge. at the bay bridge toll plaza the

metering lights has lanes back up. tough to see that 808 overcrossing but you can see the stream of light and the metering lights may turn on slower today because visibility is a factor for the bay bridge and of course the golden gate bridge has lower visibility as well. back to you. >> mike, thank you very much. we were talking a little baseball before. now football. at least the home of a football team formerly. the future of candlestick park or more accurately its demise will be the focus of a meeting today in san francisco. the contractor lenar had nshlly planned to implode that decided yum but last week it instead took out permits to dismantle the stadium piece by piece. people living near candlestick supported this idea for demoliti demolition, they were worried about health concerns imploding it. today's meeting with city leader also focus on the current demme in addition plan expected to start any day now. happening today, president obama will deliver his next to the last state of the union address and as he does, more people may be listening with an open mind. the economy is improving and more people are at work.

"today in the bay's" kris sanchez joins us with how the president may capitalize on that to talk a little bit of tax reform as well. >> a touchy topic. the president will speak to a largely receptive america. the president enjoying his highest approval rating in a year. 46% as always there will be average americans sitting with the first lady during the state of the union address and the president's expected to mention how they have benefited from the affordable care act and small business loans. recent weeks the president revealed a plan to offer community college for a year for qualified students, which would benefit the middle class the most and the middle class is expected to be front and center of what is this second to last state of the union address. in a preview the president called on the republican controlled congress to work with him to make sure that every american feels that they are part of this country's comeback. >> that's what i'll focus on in my state of the union, how to build on our momentum with rising wages, growing incomes

and a stronger middle class and i'll call on this new congress to join me in putting aside the political games and finding areas where we agree so we can deliver for the american people. >> the president doesn't set the agenda in the senate, but we are anxious to make progress for the american people on thingsk÷2i w we can find areas of agreement. we earlier discussed the potential for tax reform. >> how some of they said president closing the trust fund loophole which by the rich pass on their wealth tax free to their families and wants to raise capital gains taxes on couples making more than $500,000 a year and a $500 credit for second earners in a family and also a plan to give a $3,000 per child incentive to help working families with child care. the gop member who is going to give the response to the state of the union address is a freshman senator from iowa. we expect that they will say

films in theaters and on prime a month or two later. amazon won the golden globe for its original show transparent. speaking of movies we were talking about what a nice job a couple of bay area kids did in "american sniper." youtube users not so sure about the performance of another actor in that movie. good morning. >> good movie, good morning to you as well. when i saw this movie the aud yeshs downright giggled through one dramatic scene trending on youtube. the actor who seems to have not done his job very well is the baby, who i think to most people is very clearly a doll. it is listed as the second fastest trending clip on youtube, fake baby. my casual poll says parents spot the doll immediately and there you see bradley cooper flicking his arm back and forth. non-parents don't spot the fake quite as fast.

france is trying to get some real life videos off the internet. the president said he and the chancellor of germany will pressure content companies like youtube to remove more videos that may promote terrorism. youtube already got such rules in place but france is now threatening legal action as well. back here at home, we're waiting for federal court judge lieu is ako set to announce whether she will approve the settlement after workers were caught conspiring to keep employees salaries low by agreeing to a no poach policy. ko rejected the first proposed settlement. what's startling about this court paper, sam and laura, is how explicit some of the e-mails are between execs. what they must have known was an illegal agreement. in one case let's not write this down so it's not used against us later. >> if you're talking about it and it's documented and now coming up in court, that's also probably a bad idea.
