good morning to you. >> we're going to have more on the latest news from around the bay and the nation's capital in just a moment, but first let's check with a view of your forecast. >> good morning. we're seeing some changes outside. one, you'll notice it's cooler outside. 41 degrees in san jose compared to the mid and upper 40s yesterday morning. oakland down to 42. we've got less fog this morning, so our temperatures running a little bit cooler. you still see some patchy fog from santa rosa over towards fairfield and concord. as we go through the day with clear skies, temperatures should be warming a little bit warmer. still some low 70s in the forecast. now for a check of your morning drive, here's mike. >> less fog means better view,

more roadway visible. we couldn't see the shot of the bay bridge yesterday, but traffic flows very nicely, just as it did this time yesterday morning as well. we're showing you the approach. also we're looking at a clear view of the east shore freeway. rio vista and toward antioch, the water edge. the crash has cleared, southbound 101. i've got another crash in santa clara to tell you about, coming up. back to you. >> thank you. new this morning, within just the past hour and a half, chp reopening highway 4. >> a cig alert was issued as officers shut down the three lanes between willow pass and port chicago highway in concord. concord police have not commented on what they were investigating, but our cameras found one car covered in bullet holes. we'll bring you an update in 30

minutes. crews are working to repair a gas leak and to reopen a busy south bay road before the morning commute sets in. we're talking about tully road. that entire area right now is shut down while repair work is being done. the problem really started more than 12 hours ago when a construction crew hit an unmarked high pressure gas line. firefighters rushed out, immediately evacuating three nearby businesses as a precaution. crews are hoping to have that road reopened sometime around, say, 7:00. >> president obama struck a defiant tone during last night's state of the union address, planning on taking the republican-led congress head-on with more plans that would boost the lower and middle classes. some of the main points in his domestic agenda, sweeping newcastle united tax plan, hiking rates for the wealthy, and providing more breaks for the lower and middle classes. as well as improved worker benefits like guaranteed pay, sick leave, and a higher minimum

wage. and greater access to education, highlighted by a plan to make the first two years of community college free. he also pledged to work with congress on a new plan for military action against isis. reaction to the president's speech was mixed here in the bay area, but some groups were energized. education advocates say the president brought his a game. they were pleased with where he stood on social issues. they also believe his vision for free community college education would benefit everyone. >> increasing competition for jobs because you still come out with a degree. the more the competition, the better you have to be to get the job. >> i think he was just very honest. completely different from his past state of the unions. he was just very honest. >> others felt the president may have left a few items on the table. for example, some say he didn't do enough to forward his agenda on immigrants' rights. the republican response to last night's address was delivered by joni ernst of iowa. she said the gop is willing to

work with the president on some issues, but added the party will reject what it considers to be failed policies. those policies include the affordable care act, which she claims she will fight to repeal. to see the republican response, just go to nbcbayarea.com. you can find a link at the top of the page. a bay area woman's battle to end her life with dignity is inspiring new legislation. britney maynard very publicly decided to end her life before brain cancer did. the 29-year-old newlywed had to leave california and go to oregon just to do so legally. today, a new end of life options act will be unveiled in sacramento. san mateo lung cancer patient jennifer glass is at the state capitol urging lawmakers to pass that. glass says that while she fights to survive, she also wants options at the end of her life. >> i'm at peace with the idea

that my life will end. but how it ends if cancer runs its course, that terrifies me. that is an ugly death. i want peace. >> glass will be standing on the capitol steps with the bill's authors and britney maynard's widower and mother. the last time they debated this issue was some eight years ago. new this morning, two army national guardsmen from california recovering this morning from a rough landing in their blackhawk helicopter. it happened last night near san diego. officials say the two aviators were flying a blackhawk helicopter when something went wrong. they had to bring the bird down immediately and it landed hard on the ground. the two aviators were hurt, but we're told they're going to be okay. the helicopter, however, was badly damaged. investigators are still looking into exactly why they had to make that forced landing.

to another developing story from the middle east out of israel, where a manhunt is over. police say a man armed with a knife boarded the commuter bus and then attacked the driver and multiple passengers. 13 people were injured. four of them badly. after that stabbing, the man jumped out of the bus and then just took off. but nearby officers were able to chase him down, shot him in the leg, and then placed him under arrest. officials say he is a 23-year-old palestinian man who is from the west bank. it is 4:37. french prosecutors issued the first charges in connection with three days of terror in paris. four men were handed preliminary charges for their alleged role in the attacks that left 20 dead, including three gunmen. they are suspected of providing logistical support to one of the terrorists. he shot a policewoman to death on the outskirts of paris, and then killed four hostages at a kosher supermarket before being

shot and killed by police. in new york, a man is facing charges of trying to stockpile a deadly toxin and sell it online for profit. prosecutors say that chang lee tried to buy lethal doses of ricin from an undercover fbi agent. lee contacted the agent using encrypted messages in a web browser. fbi agents arrested him as he picked up what he believed to be a box containing ricin. he was charged with trying to obtain a biological weapon. new details now on that measles outbreak tied to disneyland. health officials now say five of the people who have measles are employees at the theme park. two of the employees were previously vaccinated for the disease. the number of cases is now at 53 with a majority of them in california. in the meantime, disneyland is offering refunds to some people who don't want to risk going to the park. it's taking requests on a case by case basis. the health department said while

there is a risk of contracting the disease at the park, the same risk exists across the state. did you feel a little bit of a chill in morning? >> i was bundled this morning, so maybe i was prepared for it. i listened to rob. >> paying attention, rob. using this information to better our preparation. good morning. >> for those of you just waking up right now, yes, the winter coat would be a good idea this morning. we've got some 30s and 40s outside right now. san jose, 41 degrees. the peninsula view, looking down. we had the blanket of low clouds and fog, and the fog does literally act like a blanket. keeps the mornings not quite as cold. we don't have that this morning. so those temperatures are pretty chilly. we still do have some patchy fog around the north bay, santa rosa, towards fairfield and concord, but again, the south bay already in the clear, and as we go through the afternoon today, temperature-wise, not all that different from yesterday.

san francisco close to 60 again today. b we'll make a nice temperature recovery heading into the afternoon. the forecast moving forward, though, still looks like 70s ahead. san jose, low 70s. no sign of any rain, at least for the weekend. san francisco also approaching 70 on sunday. we do finally have a chance of rain showing up on tuesday. we'll have more on that. now for more on your wednesday morning commute, here's mike. >> things are very calm around the bay, and an easier drive as far as the dublin view shows you. 580 westbound with these headlights. we're showing you more camera shots than we could yesterday morning. we'll show you the tri-valley on our maps. this is a much easier drive. yesterday we had the orange highlighting through this entire area. and it's cleared up. orange means there's some fog. but nothing like that for the south bay.

firefighters rushed out and immediately evacuated three nearby businesses just as a precaution. the crews are hoping to have that road reopened by sometime around 7:00. meantime, microsoft is getting ready to pull back the curtain on the new version of windows. for that and the rest of your news before the bell, we turn to -- >> landon, she's at cnbc world headquarters. >> futures are lower after stocks ended mostly positive on tuesday in an up and down session. investors tracking oil numbers. the dow, nasdaq, and s&p 500 all closing higher for a second straight day. we get data this morning on housing starts or new home construction. the dow, which had been down as much as 164 points, closed up three to 17515. microsoft will show off the new version of its operating software at an event this afternoon. windows 10 is designed to offer a more consistent experience

across all of the viruses. consumers have been disappointed with windows 8, which they complain is hard to navigate. microsoft may also take a new web browser called spartan and demonstrate more uses for voice crimin controlled digital assistant. wal-mart is letting people pick up their tax refunds in cash in stores. wal-mart is partneri ining for wal-mart direct to cash. it may appeal to people who don't have a bank account and wal-mart could benefit as well if consumers are inclined to spend some of that cash in stores. back over to you. >> yeah, see if that can work out for all parties. i have some fresh money, i'm at a wal-mart. >> spend, spend, spend. a new study finds millions of americans are keeping financial secrets from their significant others. >> uh-oh. the study was done by creditcards.com. here's what it found. more than 7 million americans, including more than 4 million

men, have hidden bank or credit card accounts from their live-in spouse or their partner. >> that's not all. the study also found one in five americans have spent $500 or more on a purchase without their significant other's knowledge. >> honesty, transparency, so important in a relationship. why would you conceal that kind of information? >> that's right. just don't look for the shoes in the trunk of the car. >> you know something is up when that trunk is a little too full. rob, good morning. >> good morning. heading out this morning, you'll want to have your winter coat with you. temperatures in the mid 30s. down to 35 degrees. 42 around oakland. san jose around 41 degrees. we do still have some patchy fog. not as widespread yesterday morning. into the north bay, santa rosa, you see fairfield and concord, visibility less than a mile. very good visibility across the south bay this morning. what's left of the fog should break up a little before lunchtime today and you could see a few patches of low clouds

there moving down the coast. offshore there's some rain here off to the west. this is going to head up towards oregon and washington. another case of oregon mist. it's beginning to head on off to oregon. high pressure keeping that storm shut. morning fog and p.m. sunshine. as we get into the weekend, this high is going to strengthen, which will put offshore winds across the bay area. the temperatures starting to climb out of the 70s. then by monday and tuesday, this is what we're hoping for. an unusual pattern. a low moving west of baja, california. it will push some moisture away. hopefully by tuesday afternoon, that will finally bring us some rain here in january. today's highs, despite the cool start, low to mid 60s around san jose. still near 60 in san francisco. low 60s for the north bay and tri-valley. the seven-day forecast, should be saturday through monday. possibly breaking some records around the bay area and we hope

that rain makes a comeback come next tuesday. >> that would be nice. thank you very much. it's either a misguided message or an unusual prank, but whatever the intent, it's leaving berkley residents unnerved. someone is leaving boars' heads on the street. we should tell you some of the images here are grsk. one boar's head was left on top of a garbage can, another on shaddock and haze. on each case, vegan restaurants are nearby. >> i can only see from the torso down. pretty much with white gloves on, dumping the pig on the ground and just putting the head on the top and that was it. >> people say they don't yet know motive, or whether there's a connection to those vegan restaurants. >> that's really grisly there. an iowa woman who faked her daughter's cancer diagnosis is not going to be serving any time in prison after all. in court, 30-year-old lisa

slauson admitted to dying about her daughter's nonexistent cancer. she even administered cancer drugs to the child. she pled guilty to child endangerment and possessing and administering harmful substances. she was sentenced to five years probation and ordered to undergo mental health treatment. deflate-gate not only won't go away, but it's blowing up. deflate-gate is what they're calling the controversy surrounding the new england patriots. they're being accused of under-inflating balls at the afc championship game. they won sunday over the indianapolis colts. the practice apparently makes footballs more catchable and throwable, especially in bad weather. the nfl tested the patriots' game balls and found 11 of 12 were significantly less inflated than the rules allow. the nfl so far not commenting. the league could take away a draft pick if it finds the patriots are at fault.

welcome back. a live look outside from the san bruno mountain off the bay area. a shot that was only yesterday shrouded in clouds and fog. rob was facebooking that out. perhaps he'll tell us how conditions are clearing up now. even the smallest lives are worth saving. this cat was stuck in a miami storm drain for more than 24 hours. neighbors heard the cat crying from inside of the eight-inch pipe on monday. and then firefighters tried to free it, but they didn't have any luck. they returned yesterday, so the cat was still down there for a day, and eventually managed to get the animal free. it's not clear if the cat was hurt, but crews did rush it to a vet just in case. >> just in case.

they do have nine lives. a new york man has been charged with criminal mischief after he bulldozed his home, not getting the proper permit. but perhaps riskier, he didn't tell his wife. he said he tried to get the permit he needed to demolish the home, but he couldn't because the office he needed to visit was closed. you know what? he just rented the bulldozer from a construction company and he tore the home down himself. at one point, his neighbors say his wife, who is the legal owner of the home, came home and was understandably very upset. ryan says he tried to call her before tearing down the home, but she didn't pick up the phone. >> do you think you did anything wrong? >> no. i didn't do nothing wrong. the house had to come down. that's it. >> most people get permits before they tear a house down. >> i'm working on it. >> ryan says the home was in disrepair and was unsafe. neighbors say it was demolished with all her things inside. he admits his wife was initially

distraught, but he says she's now "over it." >> she's also gone. did you see the wife in any of those shots? >> i heard an interview with her earlier and she looked like she was in shock. >> but she's sticking around for the long haul. we need some counselling on how to get around open roads. >> he should have sent a text is what he should have done. we have clear roadways through san jose. let's show you the maps. we have the crash at montague, but that's not really causing any slowing. this, we told you about that just a few minutes ago, tully at quinnby. we do have that gas main repair work going on, but you can use capital expressway to get around that. light traffic flow. again, just a couple blocks around this gas main closure. and we'll follow that, hopefully have those lanes reopened about
