good mornings, coming up on "early today," a massive inferno wipes out the homes of hundreds as police look for a cause. the pressure is building on new england patriots over deflated gate. president obama takes on congress as they take a step back from abortion. and a weight loss miracle gets fda approval and will will ferrell be will ferrell? "early today" starts right now. good morning. good to be with you. i'm frances rivera. hundreds are homeless after this massive inferno in new jersey. it happened last night at the town of edgewater across the hudson river in new york city. the five-alarm fire destroyed a

luxury apartment complex with 17 5 units. floors collapsing one after another. inside a four-story building. making matters worse, the gas was still on. on the ground, this is what people heard, sirens wailing as more than 300 were evacuated. the scene was so bad that the mayor was declaring a local state of emergency. schools are closed today with limited access to nearby roads. the fire has people in disbelief. >> when the fire fighters got nervous and started running, i knew it was worse than we thought. >> it spread like a wild fire. it's just amazing how the fire spread so quickly. >> so far no word on what sparked this fire. officials say no one died or sustained major injuries. the same complex was the scene of a fire 15 years ago when it was still under construction. now to deflatedgate

controversy, so big vegas is taking bets on whether head coach bill belichick will be suspended. meantime they tell nbc sports footballs were properly checked by officials before the game. nbc's ron mott reports. >> reporter: espn citing anonymous sources say 11 out of 12 were underenveloped which could make them easier to catch. the controversy over deflated gate as it's called on the media, whether they tampered after they were inspected by the referee. >> i think it's possible the curtain pulled back on a whole series of things that go on behind the scenes that no one was aware of. >> according to league rules two hours before the game 12 balls were checked by officials, measured and weighed to meet league specs and marked with the

didn't know anything about the ball controversy until the morning after. now to new developments in the michael brown shooting case. two months since the missouri grand jury declined to indict former police officers darren wilson in the shooting death of the unarmed teen. now it lookts like the federal government is heading in the same direction. "the new york times" is reporting the justice department is not expected to recommend civil rights charges against officer wilson. law enforcement sources tell a paper an fbi investigation found no evidence to support such charges. the "times" is also reporting attorney general eric holder declined request by local officials to announce the doj's conclusion alongside prosecutor bob mcculloch. that way it wouldn't appear they reached their opinions together. attorney general holder expected to make an official announcement before he leaves office but that depends on loreette aircrafts lynch, the successor. her confirmation hearings begin next week with little pushback

expected. the family will await official word from the justice department whether or not any charges would be filed against the police officer who shot and killed him. brown's family could still file civil charges, although it's the ferguson police office they would sue not wilson himself. a trip to walmart for coffee creamer ends in a choke hold. he thought he was doing something good but got arrested. foster saw a man with a concealed gun and holster walking into the store. a video shows him tackling the guy and putting him in a choke hold. here is the problem. the man had a concealed weapons permit for the gun. foster is now facing a battery charge. president obama is on the move with a stop in kansas today. yesterday he visited boise state in idaho. he talked about economic proposals including free community college initiatives and middle class tax breaks. tracie potts in washington. it looks like both republicans
