he sat in a car on camilia drive on jasmine way a little after 6:00 p.m. he was shot multiple times and died at the scene. the gunman ran off. no arrests have been mind. two victims were shot on 88th avenue in oakland last night, two more shot on 60th avenue. one person was shot on 105th and san leandro street happening 9:00 last night. police say none of the victims suffered life-threatening injuries. no word if the shootings are connected. mountain view police need your help finding a man accused of an attack at a local restaurant. police released this image here. officers say around 2:30 sunday morning the man was at the fuhua, i'm probably going to get that, fa noodle soup restaurant on castro street when he got into an argument with another man. he punched the man several times in the face before leaving. the victim experienced some bruising and cuts to his face

but he is expected to be okay. happening today uc regents will vote on a controversial plan tying coaches' pay to the academic performance of student athletes. if the students athletes fail to live up to the level, coaches and athletic directors will lose bonuses that could add up to thousands of dollars. uc berkeley ranked lowest among football and basketball. new calls for people to talk to their doctors about the measles vaccine as an outbreak thought to have begun in southern california is spreading to two more bay area count yus. >> kris sanchez joins us with what we need to know even if you didn't visit disney land in december. >> some people are getting the measles, catching it from other people who caught the measles

down in southern california and cases confirmed in santa clara county, almeida county and san mateo counties, and some of the folks who caught the extremely contagious virus were nowhere near disney land. the outbreak is considered the worst measles outbreak in california in 15 years. now the california chief epidemiologist who tracks things is discouraging anyone who has not been vaccinated to avoid going to disneyland. the state department of health urging anyone who has not gotten that mmr vaccine which includes measles to avoid visiting dis y disneyland and other crowded places with international travels. if you have the vaccine, you should be fine. however, again, if you have a baby under the age of 6 months, too young to be immuneized, avoid going to disneyland and perhaps airports because of the concentration of international travelers. experts say people without the vaccine are 35 times more likely

to contract measles than those who have been vaccinated. >> in 2000 we pretty much eliminated measles and now we are seeing an upswing and it has to do with people not getting immunized. >> how california and the bay area in particular has a very high rate of nonvaccination or undervaccination rates and doctors say those communities are at risk during outbreaks like this current measles one. one california school district is actually banning unvaccinated kids from coming to school for 21 days. coming up in the next hour i'll show you how that's being received by the families. >> very interesting and it is spreading. thanks so much. >> parents have to be responsible about this, thank you, kris. some great news this morning about the young boy who fell into a coma after tumbling down a north bay cliff in santa rosa. the boy has gone home. back in november 4-year-old sebastian johnson tumbled more than 200 feet down a cliff in

bodega bay. he was in a coma for more than a week. last week he met with firefighters who rescued him and yesterday he finally got to go home. sebastian's parents say he has lots of recovery and more surgery ahead of him, including removing a tracheal tube this summer. uplifting the spirits of a lot of those people there. >> and the happiness to his parents no doubt to have their little boy home. guess who came home, too? christina loren. >> we're all back in house, good morning. >> the band is back together. good morning to you. hopefully you're off to a great start this morning. cold enough for a coat out there. 38 degrees in san jose, 36 in san martin and 55 degrees to kick off the day in half moon bay where we'll see the mid to upper 70s as we get into your weekend. right now you can see what's happening out there in sonoma county, thick fog settling in. for most of the bay area, high clouds moving in and enough wind out there to keep our air quality better. we're not sparing the air for

today. mild afternoon sunshine, temps 5 to 10 degrees above average and your sun will set at about 5:22, if you can get out there today look at the highs. 66 degrees in the south bay. 65 on the peninsula. 66 degrees for the east shore. 65 in san francisco and north bay. even though it's chilly and a little foggy you'll hit the upper 60s later on as well. as we get into your weekend that's when temperatures start to get comfortable for outdoor plans. we'll talk about who will see the warmest temps as we get into this weekend, the 80s at the beaches. that's your tease for now. see what mike's working with on a thursday, a friday eve. good morning to you. >> good morning, 80s at the beaches, we got to hear more about that. over here we have the 65. we'll give you credit for going the limit and nothing more, folks. other here in the south bay, two spots, we had two crashes reported nimitz northbound 880 at montague expressway. major damage to the car, not to the driver presumably, none

reported and that has cleared, more slowing farther north, going from green to yellow here north 880 at 237. tow truck that was towing a vehicle, the vehicle became detached, possibly one involved in this crash. don't know. we'll let you know. you have a couple lanes blocked north 280, north 880 before you get to 237. that's it for the south bay. no other issues for areas on 880 itself. we're looking at eastbound 580 eaton canyon road a crash blocking two lanes as well that's causing some slowing out of hayward into the dublin grade. oakland past the 880 coliseum area northbound a nice easy drive and good view. back to you. >> always is, thank you very much, mike. a palo alto improvement project not finished is already catching some heat. the reason, glass meant to be embedded in the walkways is turning to a potential hazard. bob redell is live in palo alto

to explain the problem. how are they going to address it? good morning. >> reporter: good morning to you, sam. 4>ñ city of palo alto spent about $7 million to beautify this area. it includes a brand new sidewalk that is embedded with the recycled glass. the problem is that some of this glass as yous.@ç can see right is popping up. it's becoming loose. it's also very rough as you walk on it. certainly you need to keep your shoes on here. the concern is from shoppers and business owners around here is that somebody could get hurt especially little kids or people with pets like dogs. some people have complained to city hall and city hall recognizes that, yes, there is a problem, has gotten the contractor who is behind this project to agree not to only fix the problem, to repair the parts of the sidewalks but to pay for it as well. >> i reported the concrete with the glass. >> i'm not happy about it but what can you do?

who wants to go out to eat? there will soon be new life for lou's fans. south bay foodies were sad when lou's village closed last august in willow glen, replaced by the restaurant opa. according to "the mercury news" lou's will live again called lou's beach shack.

time will tell. let's take a quick look at the markets. landon dowdy is live at cnbc world headquarters. good morning, landon. >> good morning, scott. futures pointing to a higher open after stocks rose for a third straight day, the longest running streak we've seen all year. investors reacting to news the european central bank is unveiling a massive stimulus program and will keep interest rates unchanged. this is similar to what the fed did to boost the u.s. economy. we get data on new filings for unemployment, the dow rising 39 points to 17,554, the nasdaq adding 12 to 4667. scott, back over to you. ebay is laying off more than 2,000 people as part of its breakup with paypal. ebay is a big company and not all the cuts will come from san jose but many will. we totally expected this, sam and laura. here is a headline from last december predicting the cuts. if anything it's fewer employees than we expected.

thousands fewer so i guess that's good news and weirdly enough, challenger gray and christmas says when you total the layoffs from last year it was one of the worst in high-tech for a long time. blame microsoft, cisco in particular hp, old companies shedding weight, new companies, startups, boy, they can't hire fast enough. >> which is so interesting. that is funny to look back at the pets.com. i think we even did satellite interviews with that dog at that time. >> remember, because pets can't drive. that was the advent of pet celebrities. >> i think morris the cat was probably the original. thanks a lot, scott. >> personally i'm partial to boo or jiff the pommeranian. let's talk about what's going on outside. >> i want to see you walking boo the pomeranian. you know what? it takes a real man to walk a little frufru dog.

5:15 now. it's chilly out there if you have pets and they need to get outdoors. keep an eye on them in san martin and san jose where we've fallen into the 30s. 36 degrees in san martin, 38 in san jose and 40 in livermore where you have a little blanket of fog trapping in some much the warmth from yesterday that's why it's milder than in the inland valley spots in the south bay. 45 degrees on the east shore and 49 degrees to wake up and start thursday. you might think of it as friday eve and that's san francisco. i want to talk about where the fog is right now. actually pretty thick up in the north bay, especially through sonoma county. that's northern sonoma county. you can see here as you cross that marin county line, mostly clear. as we get into this afternoon, lots of clear skies ahead. we are going to see some high clouds passing from time to time, but really comfortable temperatures. 66 degrees in the south bay. 65 on the peninsula, and temperatures are going to be really, really nice in the north bay, once that fog burns off, you're talking about 68 degrees in santa rosa, and the numbers

keep on climbing as we head into this weekend. so tomorrow, friday, can't say that enough, 07 degrees. 73 by saturday in the south bay, and then we'll be at 77 degrees by sunday. lot of people are still very concerned about the drought including myself. if that's you, good news is we do have showers expected as we get into next week. let me show you your future cast because this is a really interesting system. it's actually going to sneak up from the south. i stopped that clock for you monday at 9:00 p.m. looking good for some shower activity at that point, a better chance as we head throughout tuesday at 8:00 p.m. and even on wednesday we're going to keep that chance going. that is good news for us. we want to keep the hillsides nice and green, although precipitation totals right now not looking that great, maybe up to a quarter of an inch at best. nonetheless we'll take what we can get and hopefully as we get into your february it does look a little bit more active than normal. we'll talk about that coming up right now. let's check your drive with mike. >> we're going to talk about the thin veil of fog you're talking

about in dublin. the roadway itself moves well, lighter volume of traffic. the lights here in the foreground is over the parking lot, one of the auto dealerships there, right through this stretch of 580. you have your little build at the approach out of the altamont pass, typical pattern here. over toward the castro valley/dublin interchange, dublin eastbound 580, caltrans, most of your commute a slowdown because of a crash involving a big rig, two other vehicles and possibly three of the five lanes are currently affected by cars and the big rig still there, but chop has just arrived and i've seen the speed sensors coming one the speeds a bit so they may be moving things out of the roadway. i'll track that closely. i assume there's minor injuries because an ambulance has been called. the rest of the bay shows an easy drive in the south bay along the peninsula. no problems across the san mateo or dumb barton bridges. the bay bridge there was an earlier fender bender around the toll plaza itself. all lanes are clear from our live look here and no problems off the 880 interchange or east

shore freeway, you can see that along the middle part of your screen. golden gate bridge also moves smoothly and a clear view across the span. you can see the lights all there. we have fog in the far north bay as christina is talking about, santa rosa area. over here we have had that zipper truck move the center divide so you're ready for morning commute into and out of san francisco. back to you. >> all right, thank you very much, mike. it is 5:19. indonesian divers pulled six more bodies from the airasia jet crash in the java sea. 59 bodies have been recovered in the weeks since the plane crashed in stormy weather, killing all 162 people on board. the bodies were found still belted in their seats near the main section of the plane. rescuers are still struggling to find the fuselage and what appears to be the plane's cockpit. australian officials are planning a salvage mission for malaysia airlines flight 370, even though no one knows what it is. authorities say they're asking interested parties to contact them in advance in case the

plane is found. the boeing 777 vanished without a trace in march flilg from kuala lumpur to beijing. the search has covered a 23,000-square-mile area. akoshding to a new study published in the "journal of national cancer institute" drinking coffee regularly may help protect you against skin cancer. the study found that people who drank four or more cups of coffee per day were 20% less likely to develop malignant melanoma than non-coffee drimpbers. this does not mean you should stop doing other things to protect yourself from melanoma, including the use of sunscreen. experts say setting realistic targets may be the key to increasing exercise rates. two articles published in the british medical journal find the current goal of 150 minutes of exercise per week is maybe unrealistic saying that small increases in daily exercise is more beneficial.

short program today. at last year's national championships she finished second, qualifying for the winter games in sochi. if she finishes among the top three this weekend she'll qualify for the world championships and those are held in march. later today we'll find out which golden state warriors will be playing in february's all-star game. >> there are a few guys that have a pretty darned good shot, that's one of them, star guard steph curry at the top of the voting in the western conference, guaranteed to be named the starter tonight. the real question can curry unseat or dethrone the king, lebron james, as the top vote getter in the entire league? last count curry was about 13,000 votes behind the very popular james. leading this year's western conference team, warriors coach steve kerr. last night's win over the rockets secured his spot as the coach. the warriors lead the league with a 34-6 record. i think we should all get together and go to a game. >> i'd love that, oracle arena known as one of the best venues

coming up. and good thursday morning to you. i'm meteorologist christina loren. we are in for a real treat today, not sparing the air, mainly clear to start, not as much fog. mild sunshine, temps in the mid-60s and we're talking 70s and 80s as we get into your weekend with some big breakers at our beaches. more on that in just moments. >> not as much fog but we have a little bit, that's not the worst of it for 580, though. we'll follow up on the crash blocking the lanes, castro valley dublin area an issue for 580 coming up. >> let's take a live look outside this morning from the south bay. it's thursday, january 22nd. this is "today in the bay." a very good morning to you. thanks so much for joining us. i'm laura garcia-cannon. >> aim essam brock. we mentioned this a second ago happening now firefighters in new jersey are still trying to put out a massive fire that destroyed a luxury apartment complex. this broke out yesterday afternoon in the town of

edgewater, still going on. flames and smoke could be seen from across the hudson in new york city. authorities say that everybody got out safely, amazingly. but the mayor of edgewater has declared a local emergency. schools in that area are also closed today. >> the san francisco police department is investigating an officer's conduct after a disturbing video was posted online. this is one of two videos that shows what appears to be an officer trying to dump a disabled man out of his wheelchair. the video has been posted to several websites. the incident reportedly happened on sunday afternoon in the ingleside neighborhood of san francisco. police say officers went to stop an argument between several men. the man in the wheelchair was involved. in the end, police cited four people. it's not clear if the man in the chair was one of the people cited. the measles outbreak that started at disneyland has now spread even further. it's in the bay area. two more local counties reporting cases. "today in the bay's" kris sanchez joins us here with more

details on the outbreak and now advice from doctors as well. >> not just doctors but health officials for the entire state, laura. here in the bay area there are more parents than in most places who choose to not vaccinate their kids or choose to forego some of the recommended vaccinations and there are now three bay area counties with measles cases, santa clara, almeida and san mateo. now the outbreak that started at disneyland which is in orange county continues to grow and the health department there for that county is doing something drastic. they are banning 20 unvaccinated students from a high school there for 21 days, after a student with measles showed up on campus earlier this month. 21 days is the incubation period for the airborne virus. seems drastic but consider that people can catch the virus from just being in a room where someone with measles has been, even if that person is not present and there's no contact. the virus can live on cold, dry surfaces so not like a cold or the flu.

uc regents could give the okay on a controversial plan tying a student's academic performance with their pay. stephanie chuang, the pay issue coming as the uc system is struggling right now to find state funding. good morning. >> reporter: that's right, good morning to you, sam. and what a hot button topic of course, you may remember here in front of the ucsf campus where the regents meet there were crowds of protesters, students outside, much calmer now but same usual security ahead of today's meeting. the issue, employee salaries. figures are available online, the top three are all from the athletics side making more than $2 million a year, and this of course coming as the uc system is struggling with the issue of funding. again, the student protests in november you may remember when the board of regents approved uc president janet napolitano's proposal for a 5% tuition hike

by next fall and 28% during the next five years. the form ear sem blee speaker john perez asked his fellow regents to rescind the tuition hike. >> enough of my colleague also see the error of their ways in the last meeting and be able to have a discussion where we're not using students as pawns. >> the state and uc system leaders are far apart on how to get the money but now at least both sides are discussing options or agreeing to it. yesterday governor brown and uc president napolitano got preliminary approval from the regents to be the only members of the select advisory committee to study the costs and the role of a public research university and they are expected to get the full approval today at the meetings, which begin with open remarks at 8:30 this morning. coming up in about 30 minutes we'll talk more about what brown and napolitano will be looking at. live in san francisco, stephanie chuang, "today in the bay." >> okay, stephanie, check back with you soon, thank you. at 5:34, a follow-up now,

scientists are getting closer to identifying the mysterious goo that's killing seabirds by the dozens in san francisco bay. the fish and wildlife department announced it is not polyi polyisobutylene. more than 200 birds have already died. wildlife experts will file lawsuits against whoever is responsible for the chemical. the birds are dying from hypothermia because the goo is actually altering the way birds regulate their body temperature. >> very interesting stuff there. if you're trying to regulate yourself outside right now t has been a little bit chilly in recent days but that warmup is so close. christina, good morning. thanks for coming back. we missed you. >> it's really lovely around here as we get into this weekend and tomorrow we'll warm you up as well. today a mostly clear start, seeing a lot less fog out there and sam and laura, we're talking about record, i mean record temperatures, potentially shattering some temperature

records at our beaches on saturday and sunday. with that said, you can still head up to tahoe, where they are steadily making that snowfall, in fact, we're going to show what you we're working with up there in just moments. 38 degrees in the south bay to start, the peninsula at 42 degrees. as we head throughout the day temperatures are comfortable, tip delight upper 50s this time of year, we'll trade in the upper 50s for the upper 60s today in the north bay, just lovely conditions in wine country. big waves, that is the story of the day. there's an area of low pressure that looks like it will bring in some shower activity. what it is doing for now is kicking up this big surf and so as we head throughout the next few days, friday specifically continuing all the way through sunday, we're talking about six to ten-foot swells, potentially 20-foot breakers out there and sush lent seas. if you're one who is a mariner, want to get on the bay not looking so great, really choppy as we head throughout the next few days. frizz looks to be the heaviest,

where we'll see the biggest waves especially in the san francisco bay. keep that in mind. otherwise temperatures are really going to want to drive you to the beach. look at the numbers saturday, 73 degrees in monterey, up to 76 degrees by sunday. santa cruz will be jam packed, 74 degrees on saturday and 80 degrees on sunday. what's so great is if you wanted to stay down there, maybe do a little staycation in santa cruz you can find some great rates because it's the offpeak season. you might not find as many tourists out there. as you know they'll be coming in droves as we get into the summertime and late spring so enjoy this. we'll let you know how long that will last and when the area of low pressure might bring in shower activity, coming up in my next report. first good morning to mike inouye. >> good morning. there weren't going to be as many people out there but now that you advertised 80 degrees -- there's a little fog as she talked about, but one issue

we're tracking could. dublin right about here a typical pattern look at the trivalley, altamont pass livermore towards dublin, a smooth drive and typical pattern for westbound 508. eastbound out of castro valley and in toward dublin and dublin grade the crash has cleared to the shoulder. it's a big rig and two other vehicles, one of the vehicles has a lot of damage to the side that's clearly a spectacle as well as folks are traveling by, lanes have just cleared but an ambulance is still heading to the scene to take care of minor injuries reported there, so slow from five canyons toward eden canyon. lots of canyons over there. smooth drive to the castro valley, and approaching the san mateo bridge, this is the westbound commute direction typical for the morning, no problems across the dumbo either or the bay bridge. live look at the bay bridge toll plaza camera, where we see the cash lanes starting a typical stackup. >> thanks so much. the ferguson police officer who shot and killed michael brown will reportedly not face

civil rights charges. this is the latest news we've just learned according to the "new york times." an fbi investigation did not find that there was any evidence to support the claim that officer darren wilson violated brown's civil rights when he shot the unarmed teen last year. attorney general eric holder says he has the final say but it would be unusual for him to overrule the fbi. grand jury refused to indict wilson late last year, leading to protests that erupted across the country. gas prices below $2 a gallon. >> it's been the reality for a little while. we'll have more on how long that could last. plus deflate gate grows. in just about an hour, patriots head coach bill belichick is going to be holding a news conference, where he will likely tell us nothing, but he is going to be addressing the accusations. and taking a live look outside this morning, a cool start to our morning, but a warmup on the way. you won't even believe the temperatures for this weekend. we're back with 15 minutes of nonstop news, traffic and weather after the break.

in politics it is a tale of two agendas. one by republicans intent on building an oil pipeline through the middle of america, the other from a president pushing policies to help the middle class could end up going nowhere. we heard a lot of the rhetoric in his state of the union address. tracie potts is live on capitol hill with a laundry list of what the congress is facing today. good morning, tracie. >> good morning, sam, everyone. what tno%-q doing here is very different from what we hear from president obama on the road, call it state of the union part two. yesterday he was in idaho, today he'll be in kansas, another red stit state, pitching his middle class economics. as president obama crisscrosses the country pitching what he calls middle class economics, congress is moving toward a vote on the keystone oil pipeline and dealing with a hodgepodge of

other issues, from authorizing military force against isis. >> it's got to be a clear mission. >> reporter: to apportion. there's a vote to prohibit federal funding on the 42nd anniversary of roe versus wade. >> women's reproductive rights must be respected. >> reporter: livinging the trade embargo with cuba is on the back burner as historic high level talks begin to move in havana today. >> he need to move an oen and the united states needs to move on. >> reporter: the tone in washington could threaten congress. >> the job of congressmen is to put forward alternative ideas but they've got to be specific. it can't just be no. >> he owes it to the american people to find a serious way to work with the representatives that they elected. >> reporter: and now a new controversy, house speaker john boehner invited israel's prime minister to address congress on iran without clearing that with the white house. >> the congress can make this decision on its own.

i don't believe i'm poking anyone in the eye. >> reporter: his colleagues are working on a bill to fast track sanctions against iran. so you heard a lot of issues being debated there, either on the road with president obama, here on the hill, but nothing about immigration. seems that's getting pushed to the back burner because there's no agreement whatsoever on how to move forward. sam? >> no question, tracie, as we approach 2016, immigration will come right back into the fold. thank you very much for that report. it's 5:44 right now. in about an hour new england patriots coach bill belichick will answer or perhaps deflect the questions surrounding deflate gate, what they're calling the controversy surrounding the new england patriots. they're being accused of underinflating balls in the afc championship game. they won sunday over the indianapolis colts. belichick faces the media in a news conference meant to address the super bowl in seattle. it's presumed belichick will be blitzed with questions about the

deflate gate, the coach is known for being a little cagey in his answers, controversy or not. >> he's a tough cookie to crack so to speak, bill belichick. people excited for the big matchup on the super bowl, that will be a little bit too far ahead, looking at two weeks of weather. how about this weekend? think in the short term, good morning meteorologist christina loren. >> i'm looking for a challenge, 15 days out but i will tell you with certainty best forecast i can give you is 72 hours out and the further out we get the less accurate it typically is. however, with that said, we actually have rain within that next 15 days. 38 degrees in the south bay, 46 degrees on the east shore, at 43 degrees in the north bay. the weather story of the day is the fact it will be five to ten degrees above average and we are going to hold onto this lovely weather and keep that warming trend coming in all the way through this weekend. so your five-day forecast really tells the story. let me put things into perspective for you first.

temperatures this time of year typically are in the upper 50s. we're going to hit 66 degrees today as we get into your friday, 70 degrees, these are your south bay temperatures. 73 degrees by saturday and we'll hit the peak of the warmup sunday. by monday temperatures start to fall. we're still going to be in the 70s though, and then we have rain on the way late monday. here's the deal. this is a warm system. it's coming up from the south and this could provide some pretty generous rainfall totals to areas south of the golden gate bridge starting on monday. the system will slowly move to the north as we head throughout your tuesday at 8:00 p.m. better chance for some rich moisture to move over the north bay at that point and we're going to keep that shower chance going through wednesday as well. we'll take every drop that we can get, we want to keep the hillsides nice and green and they are still green in the dublin area, just really pretty out there for a drive, maybe that's something you want to do, although it's still dark out there. as you make your way home tonight nice clear conditions, looking good for the high clouds

to dissipate and we're going to see some really, really lovely temperature this is weekend, more on your beach cities and how warm they'll get coming up. first let's check your drive with mike. >> the last few minutes we've had some big changes at the bay bridge toll plaza because the metering lights have been turned on, right on schedule, 5:41, filled in the lanes, passed the 8808 overcrossing. the south bay with san jose this live shot filled in for about five minutes. we've seen a lot of traffic flowing northbound 101 just north of 680, that's not unusual. let's show you the map the smoother drive around the rest of your bay, the bottom of your screen is that slow you saw on the live camera. that will sort itself out over the next five minutes. we want to zoom in san mateo area northbound 101 through redwood city and approaching holly we have reports of a crash there. not a lot of detail and no slowing shows up but this just happened, this is potential for some unusual slowing early on the peninsula, but the san mateo bridge moves nicely in toward foster city for westbound 92.

eastbound 508 has the big slowdown. lanes have cleared but there's still crash activity east 580 at eden canyon road through castro valley toward the dublin grade and folks just a heads up, castro valley toward the dublin interchange is a problem right now this morning. westbound typical commute looking pretty typical out of the altamont pass and in toward the dublin area. and north of there looking at an easy drive back to the bay bridge toll plaza where we showed you the metering lights are on. we'll send it back to you. lots of people using gas in the bay area as they go to and from work. how low will it go? the price of gas tong drop. the national average will dip below $2 by the end of the week. california always a bit above that. the national average is $2.04 for a gallon of unleaded.

$2.67 is the average in san francisco and $2.50 in san jose and oakland. an auburn woman is taking action after her son was forced to take off his clothes at school. the mother complained about the principal and superintendent, she said what happened that day traumatized her son. >> it was in front of the whole class and all the kids were laughing up on my son. he's been crying in the night. mentally he doesn't want to go back to school. >> gonzalez is pulling her son out of school because of continued bullying. the school district was notified of the complaint earlier this week. district officials declined to comment. >> no place for school bullying. still no word on the fate of a pit bull who was caught after attacking several people on the peninsula. here are the details. it happened yesterday morning near san mateo high school. investigators say the two pit bulls chased numerous people,

bit one of them, then the dogs tried to attack a local gardner who had to fend them off with a leaf blower. you can see what appears to be the dog bites in that plastic blower. the dogs reportedly weighed 55 and 70 pounds respectively. the high school was advised to close its doors when a san mateo police officer stepped in. >> one of the officers struck both animals with his patrol car. one was killed instantly. i've been here almost 17 years and never seen behavior like this from two dogs. >> like that officer said, one of the dogs died on scene and the other one ran to its owner's house with police in pursuit of the dog. the dog's owner reportedly apologized for his animal's behavior and helped officers to catch the surviving one. >> it is 5:50. a new plan to gatt xwath an old problem in the east bay getting a lot of attention this morning. dangerous car demonstrations known as side shows are keeping people up at night in east oakland. neighbors report cars spinning

out of control while large crowds watch the action. they're begging for a solution. now a city councilman wants to make side shows legal but only at one place at the port of oakland. >> i need to get it out of the neighborhood. at the port of oakland they have space, we don't have to deal with the families, the neighborhood. >> oakland police had no comment regarding the proposal. spokesperson says nothing has been given to them formally so she has no comment. >> the topgs use ecigarettes on b.a.r.t. trains may be snuffed out. today board members will meet and consider banning the electronic cigarettes from all b.a.r.t. trains and properties. several bay area cities have limited ecigarette use including san francisco, which now treats ecigarettes like your more traditional smokes. walking on broken glass was the plan all along for a palo alto retail improvement project. supposed to be pretty smooth but now that the nearly, the project is nearly complete the city is actually experiencing a little

buyer's remorse. "today in the bay" rob redell is live in palo alto where the glass is getting a lot of attention from shoppers. pretty visible there, bob? >> reporter: it is and also getting attention from some of the business owners, very visible. you can actually pick some of it up. it did take us a while to find this but it is here and this is the sidewalk we're talking about. the city of palo alto invested $7 million to rebeautify california avenue from the el camino to the caltrain tracks and includes the new sidewalks which is embedded with this. it's pretty looking. it's recycled glass. the problem is that some of it is popping up and coming loose, like these pieces that we found here. i'll let that street sweeper go by. as you walk on it it's rough on your feet. of course you have to wear shoes. the concern is coming from shoppers and some business owners, say there's little kids out here or people with pets like dogs or, well dog, the concern is that people would get

hurt on the glass or the surface is too rough. the city has taken notice. there were complaints filed to city hall. we did catch up with the city of palo alto yesterday. they recognized there's a problem. they tell us they have gotten the contractor to agree not only to fix the problem but to pay for it as well. >> basically jackhammer that area and repour the concrete with the glass. >> i'm not happy about it, but what can you do? >> reporter: now that last gentleman you heard was the owner, is the owner of a bagel shop that has the glass sidewalk right up at his doorstep here on california avenue. he's not happy about the fact that some of the sidewalk has to be redone. he's afraid more construction outside his shop will hurt his business again. the city is confidence they will be able to get the sidewalks fixed. however many sections they need to fix, that they will be able to get those fixed in time for the project's completion date, scheduled for march. in other words they don't think this will cause much of a delay.
