>> and i'm sam graph. san jose firefighters are on the scene of a fire at a fourflex, marianne favro is live. the last time we checked most are still waiting to get back into their homes. >> i can tell you that firefi t firefighters are mopping up. seven people were evacuated from these four townhomes on wayburn lane. firefighters say it starts at 2:28 in a garage, they credit a neighbor coming home from the hospital making sure everyone in the unit got out okay. >> this guy did everything right. i mean, he pulled up in his car. he noticed a little smoke. he wasn't quite sure what he's saying. and he saw flames. and he thought, oh, my god, the

carson fire. he called 911. and 911 was knocking on the doors to get everybody out. they got everybody out. >> a lot of the neighbors here are calling their neighbor a hero. no one was hurt. arson investigators are on their way to the scene to determine the cause of the fire. firefighters say it does not initially appear suspicious. they can tell you in just a few minutes most of the residents are allowed back in. we've seen a lot of people out here standing in their had pajamas and they're grateful to be back in. the good news is because the fire is in the carport it did not go into the actual units. so it is safe for people to go back in. a little water damage but no one is hurt. marian favro, tb "today in the " and we're police are looking

for the person who drove that car into wells fargo bank. this is what it looked like on montgomery a few hours ago. we do have stephanie going to the scene. we'll tell you what they can do to make a well-traveled safer. a jogger was killed yesterday on yerba buena drive. neighbors said it sounded like the cars were racing, something that happens a lot in this area. police arrested the two drivers and booked them on charges of vehicular manslaughter and reckless driving. neighbors want more safety measures on the roads like stop lights to prevent this kind of thing. tens of millions on the east coast are hunkered down to wait out the storm. just moments ago governors in new york and new jersey lifted

the snowstorm relate travel ban. while they did that from earlier predictions, it's still the force. in plymouth, massachusetts, one of the areas hardest hit. you can barely make out the weather channel reporter right in the middle of it all. while the snow isn't hitting us here in the bay area, it's certainly leading to an impact we're feeling all the way out here. new york's laguardia airport shut down today. and there is minimal flight activity expected at new york's other airports. already around 7,000 flights have been delayed or cancelled. and that, of course, includes some coming to the bay area. sfl's duty manager said 85 flights have been cancelled and that amounts to 36 departures and 49 arrivals. flights to new york, philadelphia, boston and newark also impacted. they're awaiting word on cancel

las veg ations to oakland and san jose. we'll of course follow it throughout "today in the bay" and the "today" show. you have to feel some level of sympathy out there for the reporters throughout absorbing the weather conditions and the wind not comfortable. meantime, warm and breezy condition information the bay area almost seems unfair to have that forecast. >> we know it's one reason i want to be here. probably you as well. those reporter, it's nice to see him laughing, at least he's in high spirits out there. we've got interesting weather and something we desperately need. that's snow pack. we're adding the activity and snowfall to work its way throughout the bay today. at this point, getting activity

right here in san jose. we need the rain. i'm going to tell you it's going to be very light. we do have heavy wind gusts to tell you about, 33-mile-per-hour clocked in woodside. 40 miles per hour at south hills. and saratoga, 27. and if you have a high-profile vehicle, you want to take it easy. the higher the vehicle, the better the chance. what happens when you go up in the atmosphere, we see less friction. less friction means more wind. 49 degrees in the north bay. 69 degrees in the south bay. 63 degrees on the peninsula. on our way to a really mild afternoon. it's going to be damp. a little bit on the windy side throughout the day today. and also, a better chance of showers later on. but i drive a high-profile vehicle. i got slapped around a little bit. you said the same happened to

only one direction going at a time. and 39,000 pounds of glass that was loaded on the back of a truck. that has to be moved. this is san filippe road 101 out of gilroy. if you're heading to 105, that will delay you. the toll plaza, things are moving nicely over there. no delays down in east shore freeway or north bay. back to you. all right. and the man shot and killed by a san jose police officer has filed a lawsuit. 28-year-old antonio guzeman was shot this after had he charged two police officers with a 12-inch saw blade. officers said they had shocked him with a taser but he kept moving towards them causing them to open fire. they said the officers used excessive force. the suit says guzman was unarmed when he was shot. the officers have not responded

to that lawsuit. the city of san jose, the council will vote tonight on a law that will help set up residents to deal with wild pigs. the pigs are tearing up people's lawns, digging for brady. in 2013, you might remember the city passed a temporary law to it hire trappers. that law is set to expire next week. the city councilmen said it's working. and the council will vote whether to make that ordinance permanent. also tonight, a discussion on immigration. .the council wants to make a plan to deal with a flood of inquiries from undocumented immigrants in san jose. this is in response to president obama's recent executive order that gives thousands of immigrants release from deportation. among the discussion, establishing an office of immigrant affairs using city resources and coordinating with the county to address the issue. >> santa clara county residents are going to get an assessment

from supervisor. it is the annual state of the county address in santa clara. it will be can delivered by board member dave cortez. that's 5:30 p.m. at the montgomery theater. and the san jose board of supervisors will talk about how they're going to stop the power outage at the mobile park. asking the city to use $8 million to prevent buena vista mobile park from closing. the committee says if the park closes hundreds of low-income families will be forced on to the streets. the developer has offered the park's owner $30 million to buy that, tear it down and build luxury apartments in its place. it's 5:10. two people hurt when a plane is shot at in baghdad. we'll tell you what we're listening about this. plus, police say this woman was shoulder surfing and cut up multiple victims in her way.

guards and five foreigners. libya's security official says the situation is under control but does not say what happened to the gunman. he also said there were numerous hostages in the hotel. the hotel manager said the attackers stormed in wearing masks and bulletproof vests shooting into the air. they also set off a car bomb in the parking lot. it's 5:14 right now, most commercial flights into baghdad are suspended today this after a shooting involved a plane during landing. iraqi security officials say at least eight shots were fired from some kind of small arms weapons on the ground. it actually hit a fly dubai plane. transportation authorities are now investigating. at least four airlines are suspended their service to baghdad in the meantime. new this morning, search and recovery efforts for the airasia flight that crashed into the ocean are now suspended. officials have not saidful this is a temporary stop or it's

permanent. crews are trying to recover the fuselage, they say it's not a priority because there are no bodies inside. only 70 bodies have been recovered. airasia flight 8501 was on its way to singapore when it crashed. transitioning to business news. apple reports its profits today. and we got lots of them. >> got a concise summary there? >> yeah, i got nothing to add, sam. that's apple. yahoo! also reports today. and that's a much more complex issue. one of the biggest problems, ceo marissa mayer has is a giant pile of money. that doesn't sound like a problem but it is a challenge because she cannot make everyone happy. the money comes from yahoo!'s investment from alibaba from years ago long before meyer. the payoff came from alibaba ipo recently that meyer gives them money made to investors, the shareholders, technically, it's their money, right. they own the company. or use the money to reinvest in

places to go nowadays. who would ever thought that would have been the case, twitter as well which was working by the way. got great updates. we can tell it wasn't going to be as severe as some of the forecasters thought. which is a good thing we don't want any damage to property. when you have a big storm like that, it becomes rather dangerous. so the good thing is, not that bad. which is why we look at that travel ban from new jersey to new york city. for us, we could see flight delays avenue of this morning, courtesy of a little bit of wind and rain. this is going to be the trend throughout the morning hours. this is one of those mornings, you want to reach your destination safely. we've got a better chance of showers north of the golden gate bridge. a lot of activity south of the golden gate bridge. mostly south for highway 92 for the first part of the evening. as we head through the evening, here's what happens, we get a better chance out north.

you saw the yellow developing there. this morning, we've got the system coming in and it is a warm one. the temperatures we're waking up in the mid-60s. easily to the upper 60s. yesterday, low 70s, so you'll likely notice a difference. you'll want to pull out something to keep you nice and protected from those light showers. carry your umbrella all day. 66 degrees in trivalley, and 66 degrees in beautiful san jose. the story tells from your weather headlines, warm, breezy and damp for today. cooler for tomorrow. and then that warming returns as we get into the end of the week. if you enjoyed the 70s, that's back as we head throughout sunday. we're looking good for a nice sunny weekend in most parts of the bay area. then things start to change. you look at that first week of february and the storm track returns. we'll talk about that coming up. let's find out how the wind is impacting the drive.

here's mike. >> good morning, christina. the golden gate bridge, it's very clear. look how crystal clear it is across the span. no advisories. just watch, there may be a gust or two from the southwest christina was talking about. a nice drive here across the golden gate bridge. we'll look farther north, the san rafael camera is pushed right here. you see the volume eking up just a tad bit. a typical pattern. as we look at your maps for the entire north bay. 101, the live cam. highway 27, and as well as highway 4 with antioch, for that portion of the bay. we do have a typical day coming out of the altamont. and san jose valley and farther south here, some folks heading out of the area from gilroy towards i-5.

there's one-way traffic control here because of an overturned big rig, carrying about 30,000 pounds of payload there to casa and lover's lane. obviously allow a half hour to get through the area. back to you, guys. investigators trying to figure out what started a six alarm brush fire to consume chunks of wildland not far from the beach. we brought you this yesterday morning that started 3:30 a.m. that fire forced the evacuation of more than 80 homes. people were allowed to return home yesterday afternoon. firefighters said pacifica is not considered a high fire area. a woman is in custody after trying to steal personal information. police arrested this would of pittsburgh she's accused of shoulder surfing. shoulder surfing being a term

that they call it when thieves steal people's information by standing behind them at an atm. police say she used the pin numbers that she stole by stealing money. they say a sting operation caught her in the act. police are hoping other possible victims come forward. >> sometimes, they use mirrors to atms to alert you if someone is looking under your shoulder. add another unhappy former raider cheerleader to the list seeking more damages. suzie sanchez is filing her own class action lawsuit against the team. she said she and other cheerleaders were denied basic minimum wages. her allegation also challenges that cheerleaders were denied promised media opportunities. two others also rejected it. >> you can find that on our

morning. nice and clear, you can expect sprinkles but you don't have to pull around the umbrella all day. christina will tell us how long on this tuesday, january 27th. this is "today in the bay." >> announcer: from nbc bay area, this is "today in the bay." good morning. and thanks for joining us, i'm kris sanchez. >> and i'm sam brock. an update right now breaking news from san francisco. that's where an suv slammed into a bank in the football district early this morning. you can see the images right there. today, stephanie strong is live outside of the bank. investigators are calling it a smash and grab of sorts. >> reporter: good morning, outside the history museum where investigators are both inside and outside right now. a tow truck driver trying to figure out for the last hour how the suv involved in this smash

and grab robbery because there was at least one armed security guard when this happened in the 2:00 hour. you can see there's debris everywhere outside. there is concern trying to get that suv out of here. and it breaks more of the structure of the glass windows there. this is a museum that has a lot of artifacts. this was wells fargo first ever bank location. and in here, they actually have gold nuggets as part of the display. and it's kind of hard to see here, but it's behind the stage coach, there's a counter. and there was a display. and you can see broken glass on the bottom. that is where we're told some of the gold nuggets were. don't know how much was there. i did speak earlier with a man who works next door who said he's been there many times. he estimates there couldn't be more than $30,000 worth, maybe a lot less. there's gold nuggets there and investigators are looking at that as the major possibility,

we don't know what else was taken. whether it was worth a lot of money. again, this is the history museum where the headquarters are for wells fargo. it's very early on. it's difficult trying to get information for the police and investigators keep saying this is still under investigation. we know, of course, an suv is used to drive through the front here. we don't know about a getaway vehicle and how many people at this point police are looking for. we'll be here and keep you posted. live in san francisco, stephanie chuang live at the bank. >> thank you very much, stephanie. more breaking news right now. this time in san jose where a man is being hailed as hero after a fire broke out in a fourplex. flames broke out in wayburn. in the neighborhood with more is marian favro.

>> reporter: we actually knocked on the doors of the four-unit complex alerting people to the fire. we'll show you where the fire started. in one of the vehicles here inside the carport and charred all three vehicles. fortunately, the flames did not extend inside to the unit. firefighters said the three-alarm fire started at 2:38. a neighbor coming back from the hospital, saw the flames, called 911, then knocked on all the doors to make sure the residents got out safely. >> trying to figure out, people got work done on their car, whether electrical or anything like that that might have caused a leak or a short that caused the fire. >> reporter: the fire destroyed three vehicles, but again, fortunately, the flames did not leak inside the units. firefighters have now allowed almost all of the residents to return back to their homes. and after standing out here in

the cold and wind nearly two hours, they were very happy to return home. reporting live in san jose, marian favro, "today in the bay." >> thankfully, that man was out on the road and not in the hospital this morning. that's a very lucky break. thanks. new this morning, from the outside, it appears things could have been way worse for the people who live at this mountain view home. that's where a fire was reported around midnight on bella court near north wansworth avenue. most of the fire was limited to upstairs. everyone made it out safely. and leaders in san jose trying to figure out what they can do there to make the roads safer. yesterday, a runner was hit and killed when two cars crashed on yerba buena road near the high school. neighbors say it sounded like two cars were racing. a problem they say is constant. >> i'm sure a bunch of the local

very much here. and an hour ago, christina mentioned about 4:40 this morning, the delays are no longer in effect. the storms forecast throughout the morning and sometime throughout the afternoon. >> sometimes, they get criticized for being overcautious. i say be overcautious. christina loren, do you agree? >> oh, yeah, all we ever want is for everybody to get to work safely. if you have that precious cargo, the kids in particular, taking them to school. it's always nice to be right, but some meteorologists are probably upset. but you know what you live and you learn. and really the patterns that we've been seeing over the past couple of years very hard to predict. and the models have never been wrong. so our job as a team of meteorologists have never been more critical. 60 degrees in livermore. showers sneaking. you very unusual pattern.

we've got high pressure located over the four corners region. we call that a mansonal flow. really, it's an interesting pattern to have this time of year. we typically see the setup late spring into summertime. that's why it's so muggy out there. it's going to be muggy today for the showers from time to time. and maybe thunderstorms later on in the day. what you'll notice in the past 10 or 15 minutes showers are becoming more organized. and we're getting quite a bit of act south of highway 92. better chance of showers to move north of the golden gate bridge because they're moving south to north. stop that o'clock at noon, you see it mostly dry. but hey, about 3:00, more moisture moving through marin. here's the deal, temperatures in the 60s. 60 degrees in the trivalley, 60

degrees in the north bay. and the only spot in the 40s, part of the reason for that, we're not seeing the impact of the warm storm. not a lot of cloud cover up there. really, that clear sky and calm winds. right around today, 66 degrees. 66 degrees in the trivalley. you can see our cameras are shaking from time to time over the bay bridge. we're going to tell you why, the wind is so much more fierce through the higher elevations and the open water. got a great span to show you coming up in the next report. christina, on the edge of the open water, you see some of that behind me, this is the bay bridge toll plaza. we have the clouds rolling. but the metering lights not yet on, but any minute now, folks. as you look at the map, we're looking at the overall maze and the drive coming through the freeway as well.

>> announcer: you're watching "today in the bay." welcome back on this tuesday. when you hit the road for work this morning, somebody could be watching you. a new report said the federal government is very quietly building a database to track millions of drivers nationwide. tracie potts joining us from washington. tracie, what started as a way to track criminals is quickly expanding and maybe feeling a little orwellian. >> reporter: good morning, this is going on since 2008 when the dea agents started putting together a list of their own, traffic cameras, local cameras, to build a network that can track license plates in realtime. the initial reason for this is to track drug traffickers who

cross the border and brought drugs into our country. but now, according to that "wall street journal" report, it's being used by trackers of local criminals for asset confiscation. and even for a number of other things that the aclu says may violate privacy. and one thing they've been looking at, how to find children who have been lost or who are missing. and now the government is saying, yes it does fit federal guidelines. but some here on capitol hill are questioning whether or not there needs to be more oversight and more transparency about the program that's been going on for years now. >> it's like a constant debate between privacy and security. thank you very much, tracie. appreciate the report. okay. the gunman who shot at two police officers just after they were sworn in -- listen. >> get down. get down.

>> this happened in the town of new hope, minnesota last night. the officers had just been sworn in during that city council meeting. it just seems so surreal. when they were leaving council chambers, they were confronted with a man with a gun. the man shot the two officers wounding them. but several other officers fired back at the gunman. the gunman was killed. the two new officers who were just sworn in are expected to survive. >> a public service, and sad to hear that story. 5:45, it has been a busy front on the weather area. i guess certainly in the northeast, maybe not much here. but a chance of rain. >> yeah, we have rain right now. i keep showing you that radar, finally, right we needed it. look at wood cy now 33 miles per hour. that's the strongest gusts we've had out there. we've seen 40-mile-per-hour wind gusts in the highest elevations of the santa cruz mountains.

meanwhile, 11 miles per hour in fremont, dublin, we started to seat wind pick up. altitude up, pressure down. that's one of the things i learned in meterology that really stands out to me. and here's the thing, sea level you have that high pressure so the wind is not as fierce. but as far as you go up, 4,000 feet plus, you need that fixture. as a result the wind can whip through the higher elevations. also the same deal over the open water. pre less frictions so you get stronger winds throughout. in san francisco, 60 degrees. 60 degrees in livermore. starting out in 52 in san martine, we're getting light shower activities. right now, it's catching up quite a bit. you see showers starting to make their way up the peninsula. do count on that and give yourself plenty of time to reach your destination. and in the 50s and 60s. got to tell you, though, things

are going to change rapidly. >> christina, we're talking about showers in the south, we have cameras all over the bay. right now, the bigger issue for 181 and 680 is the volume. we'll show you how that affects you. in the south bay, we're starting to see a slower drive and then a break. and another slower drive, an hour, hour and a half from now, 6:20 is when the real commute will start for the south bay. and farther south to the silicon valley, we're looking for a cutoff between 152 and 101 and fruta. and folks traveling through know this connector well. cutting in a shorter time frame, i misspoke earlier. 580 to i-5. and you can get through there as well with 25, and the volume of traffic coming through the area.

that is an alternate as well. if you're looking for an easy one, over the north bay, 580 to the 205. with that mumbo jumbo, if you're not heading to the i-5 not a big deal. for 582, the trivalley, that dublin interchange, for dublin and all of that showing an average drive. as you get to keller, that's where there's an issue in oakland. the westbound side, two lanes blocked from keller avenue from the zoo exit. you see from 880 from the bay bridge where the lights have been turned on. >> mike, thank you very much. more fallout on the measles out break. the measles outbreak that start at disneyland last month.

according to the l.a. times, the almeida health department told the parents to keep the kids at home. there are five confirmed cases of measles right now in alameda county. four of those are linked to disneyland. meantime, the santa clara council said that a patient sent time at the great mall and dave and busters. there's a new sign at the dave and busters warning customers they may have been exposed to measles on january 19th between 6:00 and 10:00. the day before the same person shopped at a costco in gilroy and visited the walmart across the street between 4:00 and 6:00. an officer accused of sharing racy photos with women is expected to take a plea this morning. he's expected to plead not

guilty or none contest. authorities say he sent racy photos to the women's cell phones from his personal device. and then forwarded the photos to other officers. harrington resigned from the dublin office in october after he was charged. investigators are trying to figure out why a chp cruiser burst into flames on the bay bridge. take a look at this video. the chp says 7:30 last night, an officer driving eastbound across that bridge noticed smoke coming from the patrol car. you see how much fire ultimately developed there. he pulled over on the treasure island off-ramp and called for help. the patrol car became engulfed in flames. the officer of the car wasn't hurt, but the respondinging officer ended up getting hit by debris.

and hershey has filed a lot suit to stop the import of british candies by cadbury and kit-kat bars. they agreed to stop importing cadbury chocolates made overseas. a hershey's spokeswoman said the british wrappers too closely resemble the label of the american company. apparently neither sleet or snow kept wall street from trading. they slept on the floor apparently. >> markets are open as usual today. fewer shares traded. yahoo! we're watching this morning. big news coming out of that company this afternoon. stocks had a full day of trading after a huge runup friday. uber said it was careful to limit surge pricing during the snowstorm. raising prices by only a factor of 280%.

engine plane making a parachute landing in the pacific. the plane had just been retrofitted for the fuel tank designed to support a longer flight. the pilot survived after being rescued by a passing cruise ship. >> the u.s. coast guard in coordination so they worked as a team to get me out of there, getting me on the boat as quickly as possible. >> plane's model a sirrus aircraft was introduced 16 years ago and it's still the most popular selling models of light planes. one of the very few models with a parachute system that we saw. happening today, east bay leaders may be ready to redraw the playbook at least when it comes to keeping the a's and raiders in oakland. alameda board of supervisors expected to vote on revised plans to revisit the deal of the oakland sports teams.
