department's use of body cameras. stephanie chuang joining us live. the new rule comes after a deadly shooting, and the subject part of a larger national discussion as well. good morning. >> reporter: good morning to you, sam. the city council voted late into the night to require police officers to turn on those body cameras when responding to all calls. the big impetus is the deadly shooting that happened two months ago when police were responding to a report of a burglary on willow place on november 11th. they say they were forced to open fire after a suspect pulled out a gun and pointed it at them. the responding officers had the body cameras. only one had it on. and that was turned on right after the shooting had happened. >> they have some police officers who have not behaved to the highest standard we would expect in some cities and it's nice to have a record to amazing

sure that the correct actions are taken accordingly. >> reporter: the police chief requested having officers only turn on those cameras when responding to specifically in progress serious or high-priority calls for service. but ultimately, the city council deciding to have those cameras on except for certain situations, like writing reports or during breaks. it was back in 2011 when the city actually approved buying 40 body cameras and just earlier this month, council members approved upgrading those cameras and now an advisory committee has to determine how long the department will keep the video. right now, police want to retain it for at least two and a half years. the aclu would like the police to keep the footage for a matter of weeks, not years. this is absolutely a growing topic of conversation as the technology continues to get adopted. coming up in our next report, we'll talk trends and how menlo park fits into the picture. stephanie chuang, "today in the bay." >> very interesting. i guess they'll be hammering out those details now. thank you very much.

a south bay warehouse damaged by fire earlier this month will be demolished this morning. that abandoned commercial building at the intersection of bassett and north san pedro streets were frequently used by homeless people looking for shelter. earlier this month, a three-alarm fire broke out at that building, further destroying it. before the fire, crews were already planning to demolish the building, so today bulldozers will knock down what remains. today's federal officials investigating the 2012 fire at richmond's chevron refinery going to meet and talk with the people of the community to discuss their latest findings. they're also expected to recommend new safety procedures. just like last week, the u.s. chemical safety board released its final draft report. the report blamed a "flawed safety culture" for the fire and also blamed a lack of knowledge among emergency responders, putting more employees at risk. that fire sent huge black plumes of smoke into the air. more than 15,000 people needed some sort of medical attention. tonight's meeting starts at 6:00

and its location will be the richmond city hall. >> in less than an housework cal-trans will activate new metering lights along highway 85. bob riddell is live. >> reporter: cal- -- if today is like most other weak dekdays, i will be slow and go as workers are trying to get to their jobs. which is why cal-trans says it needs to activate these metering lights to improve the flow of traffic. so in just about an hour, cal-tracal cal-trans will turn on these lights. instead of running from 6:00 a.m. to let's say 9:00 or 10:00

in the morning, these will be on from 6:00 until 11:00 a.m., almost from lunchtime. we're talking about extended hours. cal-trans extending these hours based on studies showing longer periods of congestion. drivers are concerned this will lead to bad backups on the local residential streets. cal-trans is urging commuters to please be patient. >> motorists might expect some delays as we monitor and make adjustments as necessary for the first couple weeks during this activation period. >> reporter: last week, cal-trans activated metering lights on seven on-ramps. this all part of a $13 million joint project being put on by cal-trans, the metropolitan transportation commission and the vta. more metering lights are expected to be turned on on 101 between gilroy and south san jose. that's scheduled to take place over the summer. reporting live here in mountain view, bob redell, "today in the bay." >> thank you very much, bob.

let's stick with the transportation theme. south bay transportation leaders are getting feedback today on a plan to turn car pool lanes into express toll lanes in highway 101. vta and cal-trans have issued a preliminary report to widen 101 and add dual high occupancy toll lanes in both directions. those changes would impact the corridor between palo alto and morgan hill. it would allow solo drivers willing to shell out to use the lanes along with standard car poolers during commute hours. >> adding capacity and more people to use the lanes that's currently underutilized, not as many car poolers in there, and it's also saving people time in the general purpose lanes as well. so it's an overall benefit for the corridor. >> the express lanes would be similar to the ones already in place. the meeting takes place tonight at vta headquarters in san jose. sounds like it could zip things right along, but construction on that portion of 101, i would

guess years to do that, might be a slowdown in the near term. >> but make sure mike knows that we always feel like we need him. even with metering lights, it doesn't matter. we want you to be here. >> i appreciate that, kris. i will be happy to continue pouring your coffee in the morning. no, we're not going to get rid of any traffic flow or traffic problems sadly. over here, palo alto, we're talking about the hov lane. diamond lanes that take you through the area. making single occupancy cars drive through the area, if they pay a fee, it might continue to add more movement to the area because of that changing the flow of things. bob talking about those metering lights being turned on that should help 85 through this stretch getting on to the northbound side. be prepared for some folks frustrated at the onramps. it will take listener because the metering lights are there. and we're looking at this as the

latest build and the latest clearing. it is accurate according to our current plan as well. we're looking at the rest of your bay. the wide view shows you no real delays. we do have westbound 580 build. the crash still blocks the slow lane, but we don't see any slowing. the north bay shows a nice easy drive southbound 101. there's no fog here. and in fact, we don't have anything even close to a blizzard in this area. >> no. in fact, if you want a blizzard, you're going to have to head on down to the dairy queen. we have a good-looking day shaping up for you. it's one of those beautiful days, unseasonably warm, and then everything changes. and hey, if you're looking for free traffic all across the bay area, super bowl sunday is your day. you're not going to run into any traffic. that's one of the only days of the year when you can get out there with open highways. otherwise, we need you all the time, mike. 44 degrees in the south bay. we're at 41 to kick off the day in st. martin.

today, spectacular conditions coming your way. your sun will rise at 7:20. it's a little chilly because it is so clear. temperatures widespread in the 40s. three to five degrees cooler for today than where we ended up yesterday. you might not notice the difference because we lost a lot of that humidity. humidity adds weight to the air, so it feels even warmer than the true temperature. we call it a heat index factor. today we're going to lose that. your sun will set at 5:29. which is why it's so unusual to hit highs this time of year. today, 67 degrees in the tri-valley with rain just days away. more on that. co-ing up in just moments. right now, back to you kris and sam. >> there is something in the air above the peninsula that is causing a buzz. only not a positive kind. today, city leaders are going to talk about what to do about it. that problem is airplane noise. residents say it just keeps getting worse and worse. according to critics, there has been a threefold increase in the number of flights into and out

of sfo over some of the neighborhoods there. residents from palo alto to atherton will look at what they can do to reduce the noise and whether that action is enough. a special meeting will be held looking at why santa clara county was one of the slowest areas in the state when it comes to reporting election results in november. the boozer will be examining a report on that issue submitted by the registrar of voters. they're going to look at the processes and procedures on election day, as well as the technologies that are being utilized. just a day before the election, the county's top i.t. guy abruptly quit, but the registrar voters say that did not impact the process. today's meeting will be at 2:30 at the supervisor's chambers. there is a new policy in place. what the president is telling law enforcement officers to do when they come into contact with immigra immigrants. plus, san jose's breakthrough decision based on

american contractor. it happened at the corinthia hotel in that city. two attackers were killed during the lengthy standoff as well. the claim appearing on social media alludes to members of a tripoli-based isis group, but so far there's been little evidence to back that claim. the search is now back on for the people who died in the airasia plane crash, but this time, with less manpower. indonesia's military withdrew from the efforts today, but the country's search and rescue agency says it will continue to search the java sea for at least one more week. the air bus a-320 disappeared a month ago after hitting bad weather. all 162 people onboard died. so far, only 70 bodies, though, have been recovered. bowe bergdahl will likely be charged with desertion in the coming days. that is according to a senior defense official. bergdahl is accused of leaving his outpost in afghanistan in 2009 with the intent to never return.

officials say why a court-martial could lead to imprisonment, it will likely be taken into consideration that bergdahl spent five years in captivity already. bergdahl was freed last may in exchange for five taliban commanders who were being held at guantanamo bay. apple has ensured its role as the biggest, richest company in the world after it sold a record number of iphones. scott mcgrew, turns out people really did want a bigger phone. >> until a short time ago, the only option was the android, then apple supersizes its iphone with the iphone 6 and stole a ton of market share. apple said it sold 74.5 million iphones last quarter. and made $18 billion in profit. that is the most profit made by a company in a quarter ever. that is $8 million an hour. it's $2,000 a second. marissa mayer has decided to spin out yahoo's stake in alibaba into a separate company instead of cashing it in.

long-range data coming up. right now, here's mike and your drive. >> we're looking toward a nice flow of traffic. this is 580 westbound through dublin. no big surprises. this is a pleasant drive, believe it or not, at this time of the morning. as we look at your maps, we're talking about this area, which is actually expecting all these folks coming in out of the pass and west 580. just before you get to that dublin interchange. remaining activity is there, over on the shoulder. i scanned it with that camera i just showed you and nothing shows up on our live shots as far as any lanes blocked and that's good news. there's your build. no problems for either direction of 680. as we zoom out and show you the rest of your bay, the south bay, the independence, an easy drive across the bay, and the bay bridge toll plaza. we had a reopening of the webster tube between oakland and alameda. now it's open. and we'll look at the bay bridge over the water as well from the oakland side. starting a little backup.

a nice clear view across this span, and the golden gate bridge, a similarly clear view. back to you. >> mike, thank you very much. there is an apparent change right now in the works in homeland security protocol for undocumented immigrants. new documents obtained by the associated press order immigrant agents to notify people if they're eligible for protection from deportation. agents are also being told to review government files. in the past, the onus had fallen on immigrants to be aware of their own rights. the city of san jose is taking steps to deal with the influx of immigrants it expects to see because of the president's new immigration policy. the city council voted last night to establish san jose's first ever office of immigrant services or affairs. there's no word yet on what kind of services will be offered or how much the city will spend to provide those services. stay tuned. city leaders also voted last

long the department will keep the footage. right now, police want to retain it for at least two and a half years. menlo park is a fairly early adopter of this. about 250 of them in 2013 and showed just 25% of them had body cameras and 1/3 didn't even have any written policies regarding the usage. so an early adopter. coming up in our next report in about half an hour, the lessons learned in other departments. some interesting facts. we'll have that for you coming up. stephanie chuang, "today in the bay." >> a very hot topic right now. thank you, stephanie. a former stanford swimmer accused of rape will have to tell his side of the story to a judge. this morning, 19-year-old brock turner is out of jail on $150,000 bail. he's expected in court monday to answer to several charges stemming from an alleged rape of a woman who police say was drunk and unconscious. she's not a stanford student, not that that matters.

prosecutors say just after midnight on january 18th, two people who were riding their bikes saw the alleged attack happening on campus between the cappa alpha fraternity house and the jerry house. they say turner tried to run, but they managed to chase him down and a third witness called police. >> this is the kind of case that would be impossible to sweep under the rug. we had eyewitnesss and the police were called. >> turner, who is from dayton, ohio, voluntarily left the university and is not allowed back on campus pending the outcome of that investigation. all-new this morning, firefighters rescued a woman from the san francisco bay last night after she fell off of pier 39 and into the cold water. this happened just before 11:00. investigators say she was reportedly walking on the sea wall when she fell. but it's unclear what she was doing there on what caused her to fall. the woman was taken to the hospital, but we're told that she was not seriously hurt. in less than 30 minutes, cal-trans will start activating new metering lights on highway 85. bob redell is live where drivers

will start to see the effects of those new lights. they've been on so we could get used to it, but it's official the next half-hour or so. >> reporter: good morning to you, kris. they've been green for the past week so people could get used to the fact that they're there, but in just under a half-hour, these lights will be turning on and cal-trans is asking for commuters to be patient during the consumer of weeks of this rollout of these new metering lights. there's eight of them on the northbound onramps along highway 85 between cupertino and mountain view. they will run weekdays from 6:00 until 11:00 a.m. notice, that's an extended time, about an hour or two longer than usual. >> cal-trans as been monitoring the situation. in some cases, certain ramps have proven to have more congestion past the 10:00 time. so we have to be flexible and adjust the ramp metering times accordingly. >> reporter: and that shouldn't be a surprise considering just how bad the skmuts become along

highway 85 here in silicon valley. considering the boom in tech.co along highway 85 here in silicon valley. considering the boom in tech. campuses that are not too far from here. just last week, cal-trans activated seven metering lights in the reverse commute direction. that's southbound along highway 85. all this part of a $13 million project spearheaded by cal-trans, the metropolitan transportation kmu commissicomm the vta. there are more lights scheduled to come on in the south bay. we'll tell you where coming up in the next 30 minutes. meantime, reporting live here in mountain view, bob redell, "today in the bay." >> just be patient out there if you're hitting the roads. in a perfect world, this will help traffic flow, but i guess we'll have to see what happens moving forward. in the meantime, our best advice for getting to the morning is to check in with mike. >> my advice is to just be a little patient on the surface streets. ideally, it will pay benefit for 85 itself, but getting on the

freeway may be a little held up, especially the next few mornings as folks get used to it. it is right about 11:00 like the caltrans study showed. it starts all down here in san jose, and right now, the south bay is not showing much of an issue. 87, the same thing for 101, and late construction here at 17 and 880. slow you down a bit through that area as equipment starts to move. we see coming down through palo alto a smoother drive. talking about double hov lane through that area. we continue to try to adapt to our building commute throughout the bay. get a live look out here and show you how the camera is. 880 southbound on the live cam. the headlights coming towards you here. we're building the volume for both directions. southbound a little more significantly, but no delays here. a smooth flow of traffic as well. fast track not a problem. i do want to show you one more

but tim cook said the new apple watch will be available in april. it's a little later than we expected, but it's still early 2015 as promised. so no specific date. but at least we know the watch is coming. meantime, we're talking about oodles of money. marissa mayer ended up taking the soft road. >> i was being flip yesterday, saying she could either do her job or keep her job, but it's a good way of billing it down. her job is to make yahoo bigger and better. she should have been taking the money that they made from that alibaba ipo and used it to buy up companies, make yahoo better. but investors did not want her to do that, in part because yahoo would then have to eat billions in taxes. they could have very overwhelm fire e -- well fired her. yahoo is beginning to give that new company all of the alibaba shares that it owns. if you own yahoo shares, you'll

you're watching "today in the bay." >> president obama is back in washington this morning after his trip to the middle east, and air force one barely touched down this morning when the president immediately was thrown into the middle of the fight in congress. expect on this first day back on the job. >> reporter: hi, kris. in fact, before president obama even stepped foot off that plane, he was hearing from the top democrat in the house, nancy pelosi. she traveled with him to saudi arabia and she was telling him that even democrats don't like his plan to tax 529 college savings plans, so the white house now says he scrapped that. they're also dealing with immigration here. house speaker john boehner has told republicans behind closed doors they are moving forward with a lawsuit against the president, either on their own or teaming up with the 26 states that are already opposing his immigration orders. the senate is also going to deal with that as part of homeland security funding, which runs out at the end of february. that is their number two priority. their number one priority right now, the keystone xl oil pipeline, which they want to send to the president's desk, and he's already vowed to veto. another veto threat, rolling back the health law. the obamacare vote set for next

know, her mom's in here breast-feeding her. >> that camera is not password protected, but the home wi-fi that's attached is. they have unplugged the camera for now, but they don't know if they will ever plug it back in. >> that is creepy. neighbors say not enough is being done about blackwater running through the pipes of their home. it's not happening here in the bay area, but i wonder if it could. this is down in southern california. that is the tap water, the blackwater occasionally comes out of some families' faucets, toilets, even sprinklers. happened again last week and residents say iz smells as bad as it looks. the water department say it is an isolated incident but neighbors say it's happening off and on for months. some even think it's made them sick. the water department still trying to figure out why the water is coming out black and what's making it that way. >> that's a mystery i'm sure a lot of people would like to solve. if the east coast blizzard was not as bad as expected,

folks still have quite a bit of snow to fall out from. up to three fell in some places yesterday. parts of new england completely inundated. about 15,000 people lost power. a few coastal areas were flooded. travel restrictions were only lifted late last night. at the same time, the storm did not live up to its billing in places like new york city, which got less than a foot of snow. forecasters say the impact was less severe due to a late shift in that storm's path. >> it is a science, but there are different models and we know that you always have try to pick the right one, but if you're going to err on the side of caution, i think people should not complain, right? >> the thing is, when you're talking about potentially $1 billion of economic revenue down the drain for a full day shutdown in the city of new york, people start to get very concerned. because always when it's coming into our pocketbooks, that's when people really start to raise questions. now, some of the models did bring much lower expectations. and so it is kind of bizarre as to why they went so crazy with

that situation. but we're beginning to hear more bullet that in the coming days. we were watching it on this side closely as well. it turned out the rpm model, which is what i'm going to show you for rainfall, was actually the best. 44 degrees right now in san jose right now. temperatures out there are chilly. we are in the 40s, just about everywhere. but we're going to end up in the 60s. 68 degrees for the south bay. 67 degrees in the tri-valley for today. and 68 degrees, really comfortable conditions coming your way, up in wine country. so as we get into the next couple days, temperatures stay relatively steady. more sunshine by tomorrow. then friday into saturday, looking good for a warm-up. super bowl sunday looks spectacular for your outdoor plans. i think downtown san francisco -- that was your airport temperature there. downtown, 68 degrees. really lovely day coming your way on sunday. 70 degrees in santa clara. and glendale, just about as warm

through palo alto, where 101 here has no delays. all these folks are flowing nicely into and out of san francisco. back to you. >> thank you very much, mike. friends and family of the college stunt who was killed by two alleged street racers will hold a candlelight vigil for her tonight at the scene of the crash. the family of this young woman says the 24-year-old was just out for a run monday afternoon when she was hit and killed. police say two drivers were racing in san jose when they lost control of their cars, spun out, and hit pablo while she was jogging on the sidewalk. now there is a growing memorial at the spot where she died. >> the worst nightmare for any mother, any family to lose somebody so young from an accident like this. >> police arrested these two men at the scene. they are charged with vehicular

manslaughter and reckless driving. the district attorney's office tells us both of the men could be in court to face charges as early as today. now to a follow-up. the former chp officer accused of sharing racy photos of women that he arrested pleaded no contest yesterday. shawn harrington received three years of probation, a 180-day suspended jail sentence and community service. prosecutors say harrington sent the racy photos to his personal device while they were in his custody. he also shared the photos with other officers. he resigned in october. students on the peninsula plan to put off doing their homework so they can take part in a march against police brutality. teenagers formed an activist organization they call youth alliance for justice. today at 3:00, that group plans to march from los altos high school, where they are planning a rally with speakers, poets and

musicians. the group also wans the government to join the united nations international criminal court. wildlife workers will be releasing the very first birds rescued after being coated in mysterious goo. birds were found dead or later died from the goo. it was discovered about a week and a half ago. investigators are still trying to figure out what that substance is, but volunteers did manage to save more than 200 birds, many of which are recovering at a facility in fair field. today teams will release 15 to 30 of the birds back into the bay. on a positive note, no bird stricken with the goo have been found since last thursday. a california county declared a state of fiscal emergency because of those falling oil prices. curin county supervisors in the central valley made that decision last night. the county is really the heart of oil production in california. and that's why supervisors say those falling prices are leading to a massive short fall in property tax revenues.

that could result in a $61 million budget deficit by july. the county will begin scaling back county services and maybe temporary wage cuts and hiring freezes. >> that right there is a good example of bad news being -- excuse me, good news being bad news. low oil prices right now are hurting local communities the. coffers, for that matter. >> you're exactly right. it sounds like good news, and it can be good news, but it's not always good news. take caterpillar. this one will cost you $180,000. except let's say you're a russian construction firm and you want to buy one of these dozers. caterpillar is not going to take your rubles. it takes more rubles to buy a bulldozer. that bulldozer costs twice as much as it did last year for a russian, the same for an american. so all of a sudden, we're not shipping bulldozers all over the world. that's going to eat into

caterpillar's profits. that's one of the things that really affected the stock market yesterday. it was down more than 200 points yesterday because of the strong dollar. and the dollar could get even stronger if the fed scales back all of that quantitative easing. uber this morning says it's going to continue to help solve the scourge of drunk driving. in a blog post, uber, which has teamed up for a study with mothers against drunk driving, says when you measure up all the markets in california where uber operates, dui arrests have fallen more than 6% since uber started operating. and you do have a control in this experiment, sam and kris, in markets where uber does not operate. there was no change. when you have a drink, it's about that instant decision. do i go to my car, do i press a button. lots of people are smartly pressing the button. >> that is good to hear. >> thank you very much.
