from nbc bay area, this is "today in the bay." >> a very good wednesday morning. thank you for joining us. i'm sam brock. >> i'm kris sanchez. laura garcia-cannon is off this morning. police wearing body cameras. a lot of communities are talking about this commercial issue, garnering nationwide attention. so, last night took center stage right here in the bay area. >> just hours ago, the menlo park city council wrapped up a heated debate about what to do with those body cameras. stephanie chuang joins us with all of the details. good morning, stephanie. >> reporter: good morning to you both. the city council hasn't voted before on police policies like use of force. so they didn't vote on this, but there were a lot of recommendations. definitely tense moments with the police chief. they want police officers to turn on their body cameras, which is about this size. they're about this size. responding to all kinds of calls. instead of what the police chief

had requested, which was having officers only turn them on in progress to high priority calls. the discussion taking place following a deadly shooting that happened november 11th when police responded to a report of a burglary on willow place. they say they were forced to open fire after the suspect pulled out a gun and pointed it at them. two of the three responding officers had body cameras, but only one had it on, and that was only turned on right after the shooting had already taken place. >> we all know they have some police officers who have not behaved to the high standard we would expect in some cities and it's nice to have a record, to make sure that the correct actions are taken accordingly. >> reporter: city council members agreed to revisit this with an update from the police department as well as the aclu. there is a meeting february 19th when he will make sure officers are in the loop on having to turn on the cameras before responding to calls. now a committee has to determine how long the department will

keep that footage. police want to retain it for at least two and a half years. the aclu would like police to keep the footage for a matter of weeks, not years. there have been some lessons learned. the mesa police department in arizona said in a pilot program, they got 40% fewer complaints against officers who wore body cameras and 75% fewer use of force complaints. so some positive numbers there. we learned some new numbers for menlo park last year with body cameras. we'll have that for you coming up in about 40 minutes. live in menlo park, stephanie chuang, "today in the bay." >> thank you very much, steph. a former stanford swimmer is now accused of rape and he will soon have to tell his side of the story to a palo alto judge. brock turner is out of jail on $150,000 bail. he's expected in court on monday to answer to several charges stemming from the alleged rape of a woman who police say was drunk and unconscious. prosecutors say just after

midnight, two people riding their bikes saw that attack happen on campus, and they say turner tried to run when he saw them, but they managed to chase him down and hold him, while a third witness called police. >> this is the kind of case that would be impossible to sweep under the rug. we had eyewitnesss and the police were called. >> turner voluntarily left the university and is not allowed back on campus pending the outcome of this investigation. later today, federal officials investigating the 2012 fire at richmond chevron and refinery will be meeting with the people to talk about their latest findings. they're also expected to recommend new safety procedures. just last week, the u.s. chemical safety board released its final draft report. it blamed a flawed safety culture, and also blamed a lack of knowledge among emergency responders, putting more employees at risk. you'll remember the fire sent huge black plumes of smoke into the air. more than 15,000 people needed some kind of medical attention

as a result. tonight's meeting starts at 6:00. if your drive to work takes you through the south bay, you'll want to listen up. >> new metering lights will stay on until almost lunchtime. >> "today in the bay's" bob redell joins us from mountain view. the lights just turned on about five minutes ago. how's it going so far? >> supposed to be turning on. they haven't turned on yet here, but we're expecting them to turn on at any minute, and when they do, caltrans is warning commuters to expect delays during this rollout of these metering light here's on 85. this stretch of 85 will soon be slow and go aztec wos tech work to near jobs.

caltrans will be turning on lights at highway 85 between cupertino and mountain view. we put this map up to give you a better idea. instead of running from 6:00 a.m. to let's say 9:00 or 10:00 in the morning, these will be on from 6:00 until 11:00 a.m. that's almost lunchtime. we have spoken with drivers who are concerned that this will lead to bad backups on the local residential streets. caltrans is urging commuters to please be patient. >> motorists might expect some delays as we monitor and make adjustments as necessary for the first couple weeks during this activation period. >> reporter: last week, caltrans activated metering lights on seven onramps in the reverse commute direction, southbound highway 85, and this is all part of a $13 million joint project that incorporates caltrans, the metropolitan transportation

commission, and the valley transportation authority, vta. and more metering lights are going to be installed here in the south bail. going to be on 101 between gilroy and south san jose. that's scheduled to take place over the summer. reporting live here in mountain view, we're still waeting f iwa these metering lights to turn on, "today in the bay." >> we thought we had it timed perfectly. hopefully the next time we talk to you. >> it's not our timing. it's caltrans timing, honestly. transportation leaders will get some feedback today on a plan to turn car pool lanes into express toll lanes on highway 101. vta and caltrans have already issued a preliminary report on a plan to widen 101 and add dual high occupancy toll lanes in both directions. those changes would impact the corridor between palo alto and morgan hill. it would also allow fellow drivers willing to pay to use those lanes along with standard car poolers during those peak commute hours. >> adding capacity and more

people to use the lane that's currently underutilized. not as many car poolers in there. it's also saving people time in the general purpose lanes as well. so it's an overall benefit for the corridor. >> there are several meetings about this. the second of three scheduled meetings is tonight at vta headquarters in san jose. we are joined now by traffic reporter mike inouye. all of these measures aimed at relieving the congestion we all experience on a daily basis here. >> shifting it to the onramp. that's how some folks look at the metering lights. some of the metering lights, they have sensors in the roadway that cue whether or not they're even on. that may be what's going on with boch bob. they are scheduled to tim duncan on for this stretch right here, northbound. as bob talked about caltrans and their study, that does reflect the same thing on our censors. that's one of the last to show a slowdown, really building up for the south bay and one of the last to clear about 11:00 when

they will turn those metering lights off. looking at a smooth drive, speeds just below 60 there. that's the yell low. more of a build typical for this pattern as well. about 680 up toward 180 itself. reports of a stalled vehicle, but no lanes blocked. meanwhile, as we look at the rest of your south bay and zoom out, let's first of all pick out a couple of live cams. i did want to show you the san jose live cam. there was a car fire reported. you can see the silhouette of 280 right above 101 with all these headlights. we don't see any fire in the vicinity. no lanes reported blocked for this either, but i'll track that as well. we'll look at fremont. 880 is smooth. nice volume building both directions southbound. now showing all of its advertising. back to the maps. as we showed you all of these lit up green and yellow for most of your bay. that's close to your typical

pattern. a new crash, a fender bender reported just past the toll plaza after the bay bridge. we'll show you the backup there. i don't see the crash in this camera shot, but you do see the backup. i don't think there's actually a crash in the lanes. it will jam everybody up. but i'll check that and swing our camera around as well. >> we know you will. thank you. >> thank you very much. meantime, we are told it is not too late to already be looking forward to the weekend forecast, as we take a live look outside right now at downtown san jose and temperatures that are supposed to be on the rise. >> i think nice and mild to start, right, christina? >> yeah, really mild out there. some parts of the bay area. and in others, it's pretty chilly out there. gompk good morning to you. running about 16 degrees cooler here in the south bay than we were at this time yesterday. part of the reason why is this gorgeous clear sky we're seeing right over san francisco. no fog whatsoever over the bay bridge this morning. want to show you what it looks like from san bruno mountain.

here are some of today's top stories. isis claiming responsibility for yesterday's attack on that luxury hotel in tripoli, libya, in which ten people were killed, including an american. the two attackers were killed following an hour's long standoff at the seaside corinthia hotel. family and friends of a jogger hit by street racers will hold a vigil at the scene. she was hit and killed on the

sidewalk. police arrested the two drivers at the scene. at least one of them is expected in court this afternoon. last night, menlo park police officers talking about turning on body cameras, and when they should do that. use of body cameras at all times has been part of the national bylaws on reforming law enforcement tactics in light of the michael brown and eric garner cases. marissa mayer has stared down investors. >> and then scott mcgrew. she had to blink because it's all about the investors. >> she blinked. it was the right thing to do. wasn't the best thing for yahoo probably, but the best for the people who bought yahoo shares. sometimes shareholders win and companies lose. at issue is what the billions and billions that yahoo made after it invested with alibaba, what it should do. she had two choices. she could cash out the money and use the billions to make yahoo bigger and better, which would have exposed yahoo to billions in american taxes. or she could take the alibaba

stock and essentially move it into a new bucket, and then avoid those taxes. but there would be no fun money to play with. which is a bummer. if you make tens of billions in a smart investment and then you can't use it. so what yahoo is going to do is it's going to spin out one of its businesses. now, it might be flickr, it might not. this is my purely hypothetical board. it spins out flickr, and then it gives flickr the alibaba stock. this is a totally legal tax dodge. if you own yahoo stock, you'll also own flickr stock as well, so you keep all those riches. then what? yahoo becomes a standalone company. no rich uncle. that makes meyer's job much harder and flickr becomes a proxy for alibaba stock. let me repeat, by the way, that yahoo is definitely going to spin out something. i don't know that it's flickr, this is just a for instance. let's talk about something simpler. last month, tesla started

tell me more. >> that's fun. thank you very much, scott. this morning, millions of people across much of the east coast will grab shovels and start to dig out from under several feet of fresh powder. some folks, though, still not in the clear, and a state of emergency is still in effect. northern massachusetts saw two feet of snow yesterday. the state's coastline took the brunt of the storm. as many as ten homes may have to be torn down because of the extreme flooding. boston logan international airport expected to resume some flights this morning. the city's amtrak trains in new york and washington also up and running once again. >> let's get a quick look at what's going on more locally at the golden gate bridge. some decent traffic flow out there and it's always a nice thing when we can actually see or make out parts of the golden

gate bridge. >> that means we lost our blanket overnight. >> it's chilly out there, but it's going to be nice, feeling like a nice comfortable spring afternoon later on today. we want to start with tahoe, because believe it or not, we're still working with some pretty good snowfall. the system was so, so warm. below 7,000 feet. it was just rain. and unfortunately, we really need that snow. 50% of our snow pack fills the reservoirs for the water that we drink in the bay area, so we need as much as we can get. but the good news is they've got very advanced snow-making technology going, because temperatures are so chilly overnight, they're able to make a lot of that snow. 33 inches at the base. it's all about the upper mountain. in truckee, they're making that

snow as we speak, doing whatever they can to keep people coming to tahoe. we've got some natural snowfall coming in. temperatures this morning, just like kris pointed out, certainly chilly out there. 43 degrees in livermore. 45 degrees in mountain view. so here's the deal. temperatures are beginning to stay nice and cool. at least until about 11:30 today. then all of that cold air will mix out. high pressure builds in quickly. i wanted to show you just how fog-free it is just about everywhere. daily city this morning, nice and clear. as you know, that's what we like to think of as the fog belt of san francisco area. chilly start. a little patchy fog. you will find that through the tri-valley this morning. although there's not much. very little out there. sunrise at 7:20. that is the chilliest part of the day. and then we'll see the temperatures climb. three to five degrees cooler than yesterday.

welcome back. a nanny in texas says that somebody hacked into the nanny cam of the child she was caring for and started talking to her. >> ashley stanley says she was changing 1-year-old samantha's diaper when she started hearing a man's voice coming from the security camera near the baby's crib. that man started pointing out things that ashley was doing to make it clear that he was watching her. the camera allowed samantha's parents to check on the baby from work using their cell phones. someone managed to hack the system and access that camera. >> what i'm afraid of is who's been watching quietly while, you know, her mom is in here

we've got three kids inside. >> oh, my. it's one thing to hear it. it's another thing to see it. the rescue happened sunday. but the video just released overnight. you can see the firefighters going into the fire. the home was already filled with thick black smoke and they searched room by room, looking for the little kids, aged 1, 3, and 4 years old. all of them were unconscious. today the children are still in the hospital, but they are expected to be okay. >> this is the first rescue that i've made personally, and a lot of people in the department, we just don't do it very often. fortunately. >> the kids were home alone when that fire started. their mother arrived home shortly after crews got to the scene. she's being questioned by police, but they say she is cooperating. again, the kids will be okay. >> a rare vantage point there. president obama is back in washington. this after a trip to the middle east. air force one barely touched down early this morning when the president was thrust right back

into the middle of the fight in congress. >> tracie potts is live in capitol hill with the details. even getting a little pushback from his own party this time. >> reporter: exactly. nancy pelosi of california was on that flight, talking to the president about his idea of taxing 529 college savings plans. democrats don't like it either. republicans definitely don't like it. the white house has confirmed the president is not moving forward with that. but there are some other things he wants to do where he's getting some republican pushback here. one of the things is immigration. those orders that he issued at the end of the year. republicans are challenging that. in fact, house speaker john boehner said to republicans privately that they're moving forward with the lawsuit against president obama, either on their own or teaming up with 26 states that have already objected.

bay area. and we really get to see the sunrise show you that vantage point from just about everywhere. i do that between about 7:30 and 9:00 right here on nbc bay area throughout the "today" show. we'll be showing you those live pictures. really good-looking morning all across the board and we're doing that for you all morning long. negative 14 in san martin. what does that mean? well, 14 degrees cooler than 24 hours ago. 14 degrees cooler in san carlos. when you adjust your thermostat by maybe one to two degrees in your home, makes a big difference. we are getting into the coldest point of the day. you can see how clear it is here in the south bay. no haze. you're going to get a clear shot of those hills, which are still green from that rainfall that we accumulated in the month of december. and we've got more on the way. we want our hills to stay nice and green as long as possible. san francisco bay showing you, you can see that reflectivity on

station. the other lights -- they're not paying us for advertising. as we move your map, we're going to show you anywhere south of the dunbarton bridge. no big surprises for that commute. 85 shows a nice little slowdown toward saratoga. the metering lights are turned on now. he'll have more of a follow-up coming up in a few minutes. over here north of the san mateo bridge on our maps, we see a typical pattern here as well. we're going to zoom in toward the east shore freeway. westbound 80 shows a typical pattern, but a little extra slowing approaching gilman. on the shoulder, a distraction past golden gate field and the bay bridge toll plaza. i know you know what it looks

like, but if it did look different, we show that to you as well, that would be big news. rest assured, i'm sure they're comforted by that shot. everybody there waiting for them. markets have been open for a few minutes, but are they all normal? let's check in with scott mcgrew. >> a lot normal than they were yesterday. the dow industrials up ever so slightly as we take a live look at the big board in new york city. 35 points in the positive after a real drubbing yesterday. yahoo is up about 2%. apple gaining 7%. let's talk about apple. apple turning in blockbuster profits. in fact, the biggest profits of any company in history ever. also, this apple watch, we now know will come out, kris, sometime in april. we don't know exactly when, but that's straight from the ceo's mouth. so apple watch in april. >> thank you very much, scott. it is 6:37 right now. still ahead, blackwater -- really blackwater coming out of

here's a bit of good news this morning. wildlife workers will release the first birds recently rescued after they were coated in that mysterious goo in the bay. some 250 birds were found dead or later died from that goo. it was discovered about a week and a half ago. investigators are still trying to figure out what that substance is.

volunteers managed to save more than 200 birds and scrub them clean. many of them recovering at a facility in fairfield. and at 10:00 this morning, teams will release about 15 to 30 of those birds back into the bail. positive note, no birds stricken with goo have been found since last thursday. also a substance that remains a mystery, neighboring in southern california say not enough is being done about black water that is currently running through the pipes of their homes. >> don't take our word for it. look. it is black water that comes right out of the family's faucets, their toilets, even sprinklers south of los angeles. it doesn't happen all the time. but it did happen again last week. residents say it smells as bad as it looks. the water department says it's an isolated incident, but neighbors there say it's been happening off and on for months and some say it's even made them sick. the water department trying to track down the problem that's making that water black. >> one example of that probably enough to say okay, let's have someone look.

nationwide attention and it took center stage right here in the by area. >> while many of us were sleeping, the city council was still wrapping up a heated back and forth with their police department over that topic. stephanie chuang joins us now from menlo park with what we know. good morning. >> reporter: good morning, kris and sam. the city bought 40 body cams in 2011, but it was last year the department says that all officers and sergeants were outfitted with one. the hope to increase transparency and accountability. but it does bring up similar concerns when dashboard cameras came up to be very popular in the mid 90s. officers a bit concerned about their privacy, among other issues. the police chiefs have requested having officers only turn on cameras when responding to in-progress serious or high-priority calls for service, and off when talking to, for instance, confidential informants. but the city council did have recommendations and will revisit these issues. the impetus is the november 11th deadly shooting when police were

responding to reports of a burglary on willow place. they were forced to open fire after a suspect pulled out a gun and pointed it at them. two of the three responding officers had body cams but only one had it turned on and it was only turned on after the shooting already happened. >> the changes for us, getting our officers in the mindset of activating their camera prior to arooirival for a call for servi. >> do i want an officer worried about the emergency event or remembering to turn their camera on? >> the city council just approved earlier this month upgrading the body cameras to some with higher battery life and ability to record for 12 hours. now an advisory committee has to determine how long the department can keep the video. right now, police want to retain it for at least two and a half years. the police department also released new statistics and we learned that there were 31 citizen complaints filed against the department last year. half of them exonerated. over 22% of them withdrawn. and 6% sustained. and really the overall theme
