thanks for joining us. i'm laura garcia-cannon. >> and i'm sam brock. happening today a former stanford swimmer now accused of rape will have his first chance to tell his side of the story to a judge. >> "today in the bay's" nannette miranda is live outside a courthouse in palo alto this morning. the case is receiving national attention. >> reporter: yes, sexual assault cases are, on college campuses are getting a lot of national attention lately. he was a star 19-year-old brock turner is a star, was a star in the classroom and was a star on the stanford swim team and now the former highly recruited student is headed to a to low alto courtroom. he will be facing five felony counts in connection with a rape of a drunk and unconscious woman he met on an oncatch us frat party. she is not a stanford student. both admit to drinking heavily january 18th, before stepping outside. according to the santa clara county sheriff's office report, the freshman said that he had

nine alcoholic drinks and she told authorities she downed four whiskey shots in less than two hours. that same sheriff's report also said turner admitted to sexually fondling the woman, but he denies raping her. in fact, he says he never took off his pants. two cyclists ran into the alleged outdoor attack and chased turner down, holding him after tackling him and waited for police. at today's arraignment, turner is expected to be informed of all the charges he faces, and can enter a plea. if convicted he faces 14 to 30 years in prison. live in palo alto, nannette miranda, "today in the bay." >> thank you, nannette. today the san leandro city council will vote on whether to move forward with purchasing a controversial armored vehicle for its police department. the vehicle would be paid for with a $200,000 homeland security grant and is similar to the one used by officers during unruly protests in ferguson, missouri. critics say the vehicle will increase the militarization of

the police force. workers at the tesoro refinery in martinez are on strike this morning, the union is seeking a new contract to focus on working conditions, worker safety, understaffing and fatigue. the tesoro refinery will continue to operate as a terminal during the strike. it's going to take in products and ship them out but not actually going to be producing anything. all right the bay area's own tom brady and the patriots are elated about last night's results. on the flipside you can see it and the pained look on his face, sorry richard sherman and the rest of his crew in seattle, they leave arizona deflated. shocking finish to one of the most controversial and talked about super bowls that will leave seahawk fans across the world asking what if? >> by now you're probably seeing highlights. in the end some deserve another look. down by three in the fourth, the bay area boys taking charge.

san mateo's tom brady found roadwood city's own julian edelman for the score. >> the seahawks got the ball back with two minutes to go, helped by an improbable and flat-out lucky catch by jermaine kearse, a circus catch on deflected pass giving them the ball on the 5 yard line which they advanced with time running down. >> instead of running the ball with marshawn lynch, russell wilson tries to force the pass in the end zone but malcolm butler with the pick. just like that the patriots were world champions. final score 28-24, marks the fourth super bowl win for head coach bill belichick and super bowl mvp tom brady. >> they were one yard away. the seahawks could not punch it in. that will be a continued kfgs today. the ticker tape parade is later this week. already we're getting ready for super bowl 50 which is why you look at the countdown on the tv. 369 days away until kickoff

february 7th at levi's stadium. >> "today in the bay's" rob redell is live at the super bowl where the ball's already been handed off now to the bay area. good morning, bob. >> good morning to you, laura and sam. while glendale and phoenix are winding down from a great game last night at the university of phoenix football stadium, bay area football fans are turning to the super bowl 50 host committee and this air plans for next year's championship game to be held at levi's stadium in santa clara. this was the scene in the phoenix area last night inside a local bar known as gringoes, known as a san francisco stronghold. we caught up with some 49ers fans watching the pats beat the hawks with their sights on next year. >> we will go to the super bowl. this is the third one so we'll continue to travel to the cities. >> very excited. i think we're going to have a great season next year. >> i will be there and all my

breaking for lunch you might be headed outdoors, what a pretty day to have the lunch outdoors maybe on the water if that's what you like to do. temperatures in the mid-60s so lovely out there. highs at 3:00 p.m. low 70s for just about everywhere except for san francisco. 68 degrees for you today. we've got rain on the way and quite a bit of it starting late wednesday into thursday and friday, but the storm system the way that it's draped right now it does look like only parts of the bay area are going to get that ample rainfall at first. and then we're all going to get to it as we head throughout this weekend, but i can give you an idea, as of 11:00 a.m. on thursday starting to get our first showers south of the golden gate bridge. if you're interested, stick around, i'll talk more about this and your futurecast in my next report. good morning to you, mike. >> good morning, christina. take look at dublin westbound 580. it was excessively slow this morning for a short time and that will blend right into the

morning commute. i don't want to use the bled term this morning. smooth drive for most drivers west 580 and your maps. you see a slower drive where the arrow is, it was in the 20s earlier and back up toward the 30s and maybe 40 miles per hour for the most part because you hit the 680 interchange. more folks move toward pleasanton and sunol. walnut creek a flow of traffic easy flow. no concerns west 24 off of 680. look at your map we moved oef toward the maze and the bay bridge, oakland itself shows a smooth flow of traffic toward the bay bridge as does the east shore freeway. traditional slowing approaching the inclain. live look oakland 880 southbound with the headlights, a lighter volume of traffic than we sometimes see on a monday. we had garbage that fell off the back of a garbage truck past the broadway off-ramp. i don't see any additional slowing on the map. back to you the bay bridge toll plaza with a live look as well.

at 6:13, here's a look at today's top stories. former stanford swimmer accused of raping a woman on campus is set to enter a plea in a palo alto courtroom. 19-year-old brock turner will be arraign odd charges stemming from the alleged rape last night. police say the victim was drunk and unconscious. workers on strike today, tesoro will still take in and ship out product during the strike. it's just not going to be refining or producing anything. tesoro in s in the middle of a maintenance upgrade so it's running half capacity anymore. >> seahawks lost super bowl xlix in heartbreaking fashion to the

new england patriots. seahawks were inches away from another touchdown when russell wilson threw a quick pass that malcolm butler intercepted. patriots beat the seahawks 28 28-24. happening today president obama unveiling his $4 trillion budget plan. the president wants to spend nearly half a trillion dollars on infrastructure, 10 billion on clean energy and managers on free community college. the budget also gives the middle class a break with their second tax credit for two-parent working families, expanded tax breaks to adults with no kids and expanded tax credits for child care. the president is talking about his new budget proposal on the "today" show this morning and discuss other hot topics on the minds of americans including the recent outbreak of me seeless that thrust its vaccination issue back into the spotlight especially here in california. you can see the president's full interview with savannah guthrie at k. silicone valley companies

will be interested in the president's plan to tax overseas profits. they're not opposed to the idea. ? they'd be okay with new taxes depending on the rate. companies from all over america who make money overseas keep that underoverseas because it would expose them to 35% tax rate. it is a no brainer, makes total finance sense. what the president proposes is to change the law so we can tax those profits but at a lower rate. more like 14%. the teach tour on the hill congress would be okay about that though they'd argue about the rate itself. how can we possibly say silicon valley companies would be okay with this the plan? we have literally heard from the ceos themselves. the two biggest local companies keeping the most money overseas are cisco and apple and here is

tim cook telling congress he'd like to repatriate apple's money, bring it back into american coffers but at a lower tax rate. february 2nd, looking back on january, the second straight negative month for the market and when we tunnel in just on last week, it was the seventh straight losing week. looking ahead, sam and law camera, we're backloading this week, thursday, friday, big in business. twitter reports its profits thursday, also thursday the fcc commissioner details on net neutrality issue they'll vote on later this morning and friday we have the big monthly jobs number which in the last couple of months has been spectacular. >> help keep that momentum going. thank you very much, scott. new regulations are now in effect for short term rentals in san francisco. it's called the air b were awere athe air bnb law.

homeowners have to register with the city when they offer homes for rent and be allowed to rent their homes up to 90 day ace year but only up to 30 days at a time. permits are valid for two years. plenty of people going to be out and about in san francisco trying to get themselves registered today. this as we take a live look at the golden gate bridge. we are in a crucial period of our year as far as rainfall is concerned. kind of like now or never. you've been looking at a couple different models, christina, both look promising. >> it's funny when i look at the models they get better and better every time when it comes to our chances for rain. today, tomorrow, the next day wash your car if it's that bad. i'm talking to myself particularly. there is going to be a reinforcing shot of rain and that means a free car wash for you coming your way as we head throughout the end of the week into the weekend. we're not going to see a lot

down here in the south bay from the first round but i can tell you as we head into late saturday into sunday looks like we're going to see some really good looking rainfall even right here, with he typically get shadowed by the santa cruz mountains. this morning temperatures chilly out there, mostly cloudy to start out the day. new week holds big changes for our forecast but not until we head into late wednesday and the changes are really going to take place north of the golden gate bridge before we get those here in the south bay. for today, everybody a clear and cool start, sunrise is at 7:13. it's really bizarre because we have showers coming down in lake county, even thunderstorms out there this morning, high pressure so firmly in control of our pattern we are starting out nice and clear and temperatures are going to jump about five to ten degrees above average yet again today, similar to yesterday. mostly clear evening. the temperatures starting out in the 40s and 50s. look at the rebound on the way as we get into this afternoon. 72 degrees.

72 degrees, that's room temperature here in the south bay. not much cooler in san francisco. lot of people will be outdoors waiting in line and you can't have a better day to do such a thing. tuesday and wednesday just a touch cooler and by thursday the noticeable cooling comes in friday, talking about rainfall and we always like to give you an update as to what the upcoming weekend will hold. after all we're all working for the weekend, the time off with friends and family. rain on the way for saturday and sunday across the bay area. you might be thinking indoor plans, maybe a movie, maybe bowling. maybe you like to listen to the pitter patter of rain drops. let's take you through your futurecast. starting at 11:00 a.m. on friday -- excuse me, thursday, through 9:00 p.m. on friday that storm track stays well to the north of highway 92. then we stop this clock for you, take you into saturday and we're talking about ample moisture and the potential actually for localized flooding with a lot of

rain coming in all at once. we need the rain, but you saw what happened in december, just make sure you're ready for that. you want to make sure you clean out your storm drains again and fwirts on your roof. you might need sand bags in the bay area especially in the north bay where we could accumulate over three, maybe four inches of rain if everything pans out. i'm going to stop this on sunday for you, our chance for rain continues into tuesday and wednesday of next week as well. so it's looking good for a pattern change just in time for february and january was so dismal, all with he know is it can't get much worse. let's check your drive with mike inouye. >> we'll watch for the dramatic change in the weather. right here not so dramatic but a little change northbound 101 at 680. the south bay map, because san jose is looking really good right now. we saw that early commute kick in and cleared as its tradition just before 6:00 and now as we're approaching 630 we're starting to see at 6:20, slowing at expressway.

nothing unusual for this pattern through the silicon valley. 237 a little more traffic off of 880, south of the dumb barton bridge. coming toward the san mateo and dumb barton bridges here is the east bay, hayward toward union city. 880 shows slowing for the nimitz and tri valley looking toward dublin south 680 out of pleasanton usual suspects and pattern after a couple of earlier crashes at the dublin interchange have cleared, things moving nicely there. we'll zoom out and show you north of the san mateo bridge in the east bay, antioch shows a typical pattern toward concord and the walnut creek interchange starts to show a little more activity but not a lot of slowing. upper east shore toward the 50-mile-per-hour range at your worst so far. the bay bridge metering lights are on. the north bay no surprises. 37 out of vallejo and novato. unlike late last week we don't have any fog registering on the index for that portion of the north bay. live look the bay bridge backup as all the lanes are filled in. we have all the cash lanes for

the 880 overcrossing and golden gate bridge a clear view across the bay. nice steady stream coming out of the north bay. no slowing waldo tunnel into san francisco. >> thank you, mike. police have until tomorrow to give prosecutors the case against the man accused of leaving a suitcase full of body parts on a san francisco street. close friend of mark andres told "the chronicle" andres is not the killer. says he was arrested because he was walking by the crime scene and he's homeless. happening today it's a rare aviation summit attended by experts from around the globe trying to help prevent planes from vanishing off the radar. this week's meeting in montreal is only the second summit the u.n. agency has held in the last 70 years. of course it follows last year's disastrous disappearance of a malaysia airlines flight in march as well as the one shot down while flying over the ukraine in july. experts will be discussing new

beatles and rolling stones from their early years will be offered this year starting on east bay. the candid photos sat in a private collection for nearly 50 years shot by one-time road manager bob bonas and part of a collection of some 5,000 photographs. more of those images will be offered in the months and years to come. prints will start at $175. i'm sure lots of interest. >> no doubt go upwards from there. you would think. 6:26. it's likely been a long weekend for someone in the bay area who purchased a winning lotto ticket. >> unless it's stuffed in their wallet. someone in ant knock matched six powerball numbers saturday night. it's worth $1.43 million. the person has to wait to claim the prize. here are the numbers again 5, 11, 16, 26, 50, the powerball is 34. since no one watched all six numbers, the jackpot goes up from 290 million to 317 million

chez with a look at some that did well and others fell flat. >> laura's favorite the brady bunch inspired snickers ad with marsha not quite herself and steve buschemi as jan was one favorite but it was the ad with that little boy who will never grow up that lit up social media. here's a look in case you missed it. >> i couldn't grow up because i died from an accident. >> nationwide insurance says it wanted to build awareness that preventable injuries are the leading cause of childhood death in america. an important conversation for sure but a lot of folks on social media took aim at nationwide saying it was too dark for the super bowl. budweiser playing on people's emotions but in a more heartwarming way, a puppy who is saved from a hungry wolf as he makes his way home, saved by his budweiser clydesdale buddies, that was the number one according to "usa today's" ad

meter. the dorito ad with the guy on the plane doing all kinds of rather yucky things to keep too emfrom sitting next to him. he sees the gal, all right, i have doritos take a look and then he finds out she's got a baby. it may be america's game but ecuador tried to use all of those eyeball focus in the same place to show america what it has to offer. super bowl viewership is seven times the population of ecuador, so the $3 million the ecuadorian government ponied up may be money well spent as tina fey says, i want to go to there. advertisers spend more than $4 million for a 30-second add to getting a strategy right is all important and lots of debate among the ad folks whether or not they got it right. >> they'll be able to tell some of the revenues. >> almost more fun than recapping the super bowl than the commercials.

time for a check of the forecast this morning. let's take a peek outside at beautiful bay bridge. the sun starting to creep up over the bay area, making way hopefully for a nice monday morning. maybe a little consolation prize for those seattle fans, christina? >> it is going to be nice out there. temperatures for today into tomorrow even wednesday above average, but this morning it is rather chilly out there. grab your coat, still feeling like wintertime in the morning hours and it feels like spring even late spring, early summer day in the afternoon with temperatures still running five to ten degrees above average but not just yet. we're at 46 degrees to kick off the day, the new day beginning in san carlo, 45 in oakland and this week looks really good we have quite a bit of rain on the way to the bay area. we want to show your temperatures at lunch time today as you make your way out of the office for a nice little break. temperatures in the mid-60s across the board and then by about 3:00 p.m. when our highs

come in, we're talking about the low 70s. 72 degrees in the south bay, 70 degrees in the north bay and 71 degrees on the peninsula. so as promised, showers on the way, we'll tell you with and how much for where you live in my next report but first let's check your drive, here's mike inouye. >> all right, christina. we'll take folks to a typical view for a monday morning, look at the bay bridge toll plaza where the millietering lights a on. the sun is coming up, a beautiful shot. the lights of moving nicely for the fast track lanes and if you carpool big advantage bottom of your screen. look at your map on the approach. this is the wrong map. we need to get off of the maps, folks in the control room i'll run over to my desk and rearrange the maps. the san mateo bridge shows the nice smooth flow of traffic westbound, that is your commute direction, taillights and we have a slow build just starting to form off of the hayward side because of all that activity around 880 coming through the area. as we look from the other side of the bridge toward the area right around the foster city approach as well and that's a nice flow of traffic as well.

no problems, no surprises but we can see this much better than last week. let's get back to your maps you guys. poll jiz. we'll look out here and see the sensors approaching the bay bridge. the east shore slows through berkeley and emeryville. the bottom of your screen was the something reported northbound 880 around 980. chp didn't tell me what it was, but some ufo or interstellar -- i'm not a scientist. the south bay at the bottom of your screen, there is the peninsula, all in the green there, a little build for your northbound routes through silicon valley. the san mateo bridge for 880 as well as the tri valley no big surprises this monday. the only surprise the last few minutes of the super bowl game which were very exciting even for someone who dpunt' care because i'm a 49 letters fan. >> there you go. we'll bring it on home next year. >> right on. >> even as he tried to juggle kids and football at the same

disaster preparedness. tony kobeleski joins us with growing concerns over cyber security. >> we followed the recent cyber breaches to sony picture, target and home depot. the problem goes beyond movie tickets and credit card numbers, potential cyber attacks on nuclear plants, gas pipelines are far more critical and concerning. this 2007 government video provided to cnn proved for the first time that computer hackers from anywhere in the world could destroy physical equipment that controls our vital equipment structure. it shows how with a computer and keyboard cyber experts were able to make this piece of equipment self-destruct. former member of the department of homeland security told us, this test from seven years ago should have been a wake-up call, but he said instead our country has elected to hit the snooze button. he says successful cyber attacks will continue until the

in court this morning facing five felony counts related to the rape of an unconscious and intoxicated woman who is not a stanford student. they were at an oncampus fraternity party january 18th. according to a report from the santa clara county sheriff's office turner admitted to sexually fondling her after having nine alcoholic drinks but denies raping her saying he never took off his pants. in a statement to investigators she said she downed four whiskey shots in less than two hours. two cyclists ran into the alleged outdoor attack and chased turner down, holding him until police could arrive. after being highly recruited, turner did resign, did withdraw from the university last month. his arraignment begins at 9:00 a.m. this morning. if convicted he faces up to 30 years in prison. live in palo alto, nannette miranda for "today in the bay." >> thank you. today the san leandro city council will vote on whether to move forward with purchasing a

tell you, just about the same forecast as we told you last week, 41 degrees in the north bay, 50 degrees in san francisco. i like to do whatever i can to keep you two steps ahead of each storm system and right now, we're talking about some really significant rainfall as we get into the end of the week, but for today, looking good. clear and cold, light wind to start. unseasonably warm today, temperatures in the 70s and as we get into this evening, temps will drop quickly once that sun sets. keep that in mind. we're headed towards a really nice day for today and we'll stay nice and steady through wednesday with the changes coming into the works thursday into friday, heavy rain at times by friday, all across the board. but here's what we're expecting. we always like to give you a preview of the upcoming weekend, that always makes it easier just to get out that front door and get to work. if you got the kids with you this weekend, probably want to think of indoor plans with rain on the way for saturday and sunday, the heaviest totals as per usual expected up in the north bay.
