this tuesday, february 10th. beautiful look at the bay bridge. you're watching "today in the bay." good morning. thank you for joining us. i'm sam brock. >> i'm laura garcia-cannon. to a developing story a suspected car burglar is on the loose after trying to run over a police officer. it happened last night during rush hour at the intersection of el camino real and wolf road. that officer shot at the vehicle as it moved towards him. bob redell has the latest. >> police are still looking for the driver who tried to run down the officer. there are two santa clara police officers, one in the squad car, one in the unmarked suv. they pulled over the mercedes

around 5:45 last night because they thought it might have been involved in nearby auto burglaries. the driver of the mercedes stopped his vehicle. as one of the officers with you standing outside his unmarked suv, the driver of the mercedes made a move. >> the driver made a move towards the officer who was standing in the roadway, fearing for his life, the officer shot into the vehicle, and the vehicle fled past him. >> we heard eight shots being fired continuously. no gaps in between. >> i just whaalked outside to wk my dog, it sounded like fireworks going off. they counted ten shots, i think. >> police don't know if those shots hit the driver or any of the other people in the m mercedes. the officer did give chase, but the driver got away. the officer who fired his weapon, first of all, is okay. secondly, is on paid

administrative leave. even though this involves santa clara police officers, the sunnyvale police are heading up the investigation. reporting live here in sunnyvale, bob redell, "today in the bay." in just a few hours, the former radioshack employee who allegedly stole photos from a customer cell phone suspected to enter a plea in court. jose miranda faces several charges including petty theft. back in november, a woman says she took her phone to the radioshack store to get a broken screen fixed. when she got the phone back, she realized 17 of her photos were texted to an unknown number. she is suing miranda and that radioshack. >> this morning oakland police hope a new surveillance photo will help them find a killer. police say this is the car that's wanted in connection with a double homicide in west oakland last month. it's described as a four-door, light blue 1994 mercury sable.

it was last seen leaving the scene of a deadly shooting on january 20th. police are offering a $20,000 reward for any information leading to the arrest. happening today, protests in downtown san francisco calling for an end to the violence against transgender men and women. >> stephanie chuang is live at city hall with the details. good morning. >> reporter: good morning. right in front of city hall, a protest and a so-called die-in demonstration to call attention to the violence in the transgender community. the most recent victim, a 36-year-old taja dejesus. she had moved to san francisco from san jose ten years ago, seeking a safe haven for a transgender woman of color. her life was cut short february 1st on the steps of her apartment in the bayview district. stabbed to death. her suspected killer was found hanged nearby.

the death has torn apart the victim's mother who is refocusing her pain into spreading her daughter's story. >> everybody's life matters. tran's life mattered as well. if this can save one person. >> people spend hours at san francisco's lgbt center last night to prepare for the demonstration. taja is the fourth known transgender woman of color to be murdered in california in the last four months and the fifth in the u.s. since the new year alone. the demonstration set for 1:30 this afternoon at city hall, including the release of a report with information like how trans women of color are seven times more likely to feel unsafe in their lives, also there will be plans about a new jail here in san francisco. we'll talk about how that all fits in in the next half hour. >> all right. thank you.

we now know who was killed in a fiery head-on crash on 880 in fremont last week. the "mercury news" reporting that 23-year-old gina caudle was driving the wrong way for at least five miles before slamming head on into a pickup truck early friday morning. this happened near the thornton avenue exit. three other people were seriously hurt in the accident. investigators are looking into whether alcohol or drugs might have played a factor in the crash. a south bay neighborhood hit by burglars in the past is dealing with armed robberies. this is the evergreen community of san jose. there have been five robberies there in the past two weeks. some occurred in stores, others near parks. a robber pulled a handgun at a victim at a park last week. days earlier, another happened at fowler creek park. neighbor's say they have seen the uptick in crime. >> i knows there a shortage of police, but it has to be

handled. >> it can't be a safe place to live in there are robberies in the park. >> police have stepped up patrols in evergreen. we are getting to your micro climate forecast this morning. 5:05. a live look at downtown san jose. >> things will warm up as we progress through the week. >> that's the case. temperatures now mostly in the 40s. we have fog developing out there. storm track lifts to the north, boosts up high. then talking about near record temperatures by tomorrow. that will continue well into your valentine's day weekend. but because of that remnant moisture, i'm counting on fog this morning and a really foggy start tomorrow morning. sunny finish for all. temperatures mostly in the low to mid 60s by lunch time today. we'll see a couple 50s out there. as we get into this afternoon, a big boost in your numbers. by about 3 to 5 degrees.

tomorrow we hit the peak of what we're expecting from this warming trend. it will be very warm out there. just about all week long, temperatures in the mid to upper 70s. most of this in moments. right now we want to check your drive and say good morning to mike inouye. >> good morning, folks. dublin, a smooth drive right now after that construction picked up. that caused some delay west of dublin and out of livermore. we have some more slowing on the approach around airway. there was an earlier crash. it looks like authorities have gotten fothose folks off to the right hand shoulder, a slowdown did develop. we track your tri valley as we move down to the south bay, looking at northbound routes no issues for san jose. the rest of silicon valley moving close to the speed limit.

it is 5:11. the trial begins tomorrow for a man charged with killing the former navy s.e.a.l. depicted in the film "american sniper." a texas judge seated the jury in one day. eddie ray ralph is charged with killing chris kyle and his friend at a shooting range in 2013. there were concerns of the release of the film about kyle's life would cause potential jurors to be biased, but turned out not to be the case. ralph is a former marine who struggled with post-traumatic stress disorder. attorneys plan to pursue an insanity defense. a scare in the sky over southern california involving a jetliner and a drone. >> one of those radio controlled helicopter things went right over us at 4,000. >> over the top of you at 4,000? >> yep. >> over 4,000 feet.

that's the pilot of the descending southwest jet as he landed two days ago alt l.a.x. authorities are investigating that incident. the drone would have been flying ten times higher than the legal limit. software embedded into drones may be used to prevent them into busy airspace. is she at it again? the sear yell stowaway has struck again. >> marilyn hartman is in court right now kris sanchez joins us right now. she struck last year, and now she's in florida. >> she should be before a judge as we speak now. she was busted in a luxury hotel room she didn't pay for near jacksonville. we first came to know of marilyn hea hartman for stowing away several times, either trying to sneak on to planes without a ticket or into secure airport areas.

according to arrest report in florida, this time the 63-year-old started out in minnesota on sunday when she boarded a plane without a ticket and arrived in jacksonville sunday. she allegedly used a fake name to get to the omni resort amelia island plantation where she stayed in a $300 a night villa until the real guest showed up. she has previously told law enforcement that she feels safer in airports than on the streets where she usually lives. when she was referred to a residential mental health treatment facility where she could stay, she did not. we are working with our partner station in florida this morning to bring you more. >> it's amazing how she's able to continue to do it. >> she seems surprised by the reaction. in video to show you. no one was hurt when a us airways plane made a rough

landing. the front landing gear would not deploy, after talking it over with the control tower, the pilot decided to try to just land without it. passengers say it was extremely tense but overall ended up just being a bit bumpy. >> it's been bumpy trying to launch spacex. they'll try again this afternoon. >> you learned something new about that mission. >> i did. we were talking yesterday about how the satellite will be used to take pictures of earth from deep space. live pictures of the earth in a way we haven't seen since the 1970s and the apollo moon mission. a helpful viewer points out the satellite's camera was paid in pa palo alto. google says it will give lick observatory $1 million to keep the center open.

like to go outside when it's pouring rain. we will get a nice stretch of dry weather. first let's start with what's happening on the satellite imagery. then we will talk about how our reservoirs are standing after the recent rainfall in december and what we accumulated over the weekend. right now you can can see what's going on in the satellite imagery. looking clear for the bay area. we have high pressure building in, for us, that means a little bit of fog is possible as we head throughout the morning. let's start with folsom lake, big improvement after this weekend's rain. nearly four times the amount of water in folsom lake than this time last year. today 91% of average storage. it was at 62% in october. let's talk about the san luis reservoir. 56% of average. we were in the 30s when it came

the latest information. >> reporter: that intersection is back open, it has been for quite some time. police are still looking for the driver of a white mercedes sedan who tried to run over one of those officers yet. two santa clara police officers, one in an unmarked suv, the other in a squad car, they pulled over the driver around 5:45 last night in front of a 76 station here. they were pulling him over because the mercedes matched the vehicle involved in nearby auto burglaries. as the one officer stood outside his unmarked suv, the driver of the mercedes drove straight at him prompting that officer to fire several rounds into the oncoming vehicle. >> all we know is he feared enough for his life that he would be pinned between the two vehicles, he decided to take the course he did and shoot at the vehicle. >> the officer in the squad car chased the mercedes, but the driver of the mercedes got away.

still on the loose. police don't know if that driver or any passengers in the car were hit. the officer who did the shooting is on paid administrative leave. even though this involved two santa clara police officers, sunnyvale police are heading up the investigation since it happened in their city. reporting live, bob redell, "today in the bay." firefighters are trying to figure out what caused a fire in a safeway store in san rafael last night. the fire started about 11:30 last night in a trailer at the store's loading dock. fire crews were able to put the fire out before it spread inside the building. happening today, raising awareness is the theme. protesters in downtown san jose are trying to end the violence.

no big drama off the east bay curve. the view from emeryville, shows you the fan and heading towards san francisco, there is the volume. also the camera steady. yesterday shaking around a lot. a lot of wind. today much calmer. as we look at maps, talking about the fog christina is reporting. marin county with a little bit of fog. in ]ov.>isrichmond, before you the merge, a little fender bender there. no slowing has showed up. zooming out to the upper east shore freeway, concord, walnut creek this section moving nicely. close to the speed limit. the build off of highway 4 for antioch. north bay, no delays. novato, mill valley at speed. over here, the dublin interchange moves smoothly. look at the tri valley. we have a lot of slowing coming into livermore. a crash reported at greenville. we had an earlier crash at airway causing early slowdowns.

confirmed with cases of measles. good morning. >> reporter: that's right. washington is on the list now. the cdc tracks 121 cases so far spreading across the u.s. we talked to health departments in different cases where they are having more cases that the health department has not caught up with. california has 88 of those cases. it broke out at disneyland, but now it's spread across the midwest to the east coast. that's part of what they'll talk about here in the senate health committee today, how do you stop it? the health experts so far have said you have to get more people to take this vaccine. some people are opposed. some people cannot take the vaccine. but most health experts say it's the best way to develop the herd immunity so everyone around you is vaccinated and stops the virus from spreading further.

>> thank you very much. this morning doctors in hong kong are talking about a strange medical condition, babies being born with embryos inside. >> the condition is extremely rare. only 200 cases have been recorded. the article describes a study of newborn baby girls. doctors thought she had a tumor in her stomach, but test results revealed the growths were twin fetuses. doctors say the embryos were fertilized by the parents but somehow grew inside the baby. a simple invisible spray may allow consumers to track items through their smartphones. >> you're thinking what? this is the product of a bay area brainstorm. the technology is called dna tracks. it's a small dna infused traceable spray that's harmless. it was developed at laurenceville labs. the spray may one day be used like a bar code or fingerprint for items like produce. it may determine where it comes from or if it's been genetically altered.

60 degrees at the south bay. rounding out in the mid to upper 60s. significantly warmer than yesterday by 3 to 5 degrees. here's the deal. area of low pressure left some remnant moisture. high pressure comes in, pushes everything to the surface. i think tomorrow morning, as this ridge gets stronger, we'll have that remnant moisture. we will see more fog as a result. that high temperature ridge builds in for tomorrow. look at our temperatures. some records. 68 in napa. the record is 70 degrees. record is 68 degrees. we'll hit 70 tomorrow. 71 degrees is the forecast in hayward. the record is 68. 74 is the forecast for santa rosa. we have longstanding records. that will bypass 72. you know what? just to give you an indication how much warmer it will get, typically we hit the low 60s in the south bay. we're talking about 78 degrees by friday. even warmer conditions as we climb into your valentine's day weekend.

2013. there were concerns of the release of the film about kyle's life would cause potential jurors to be biased, but turned out not to be the case. ralph is a former marine who struggled with post-traumatic stress disorder. his attorneys plan to pursue an insanity defense. a las vegas casino implosion, the first in eight years. that's how it's done. the 12-story clarion casino hotel was reduced to rubble this morning. part of it on the right stayed standing after the dust settled. the site is off the strip. it went through several lives since 1970s, including the greek isles and the debby reynolds. >> look at that thing go. her court appearance has just wrapped up. wait a minute, is this the same woman again? marilyn hartman just made an early morning appearance in florida. >> someone needs to figure out

how she keeps boarding these plans. kris sanchez has what happened this time and what's next. >> we've been talking to our partners there in jacksonville. they got a phone call from the tsa in washington saying we need answers. we are looking for the exact same thing. we can tell you this morning that marilyn hartman just finished appearing before a judge after she was busted in a luxury hotel room this she didn't pay for near jacksonville. she faces two charges of fraud, one charge of trespassing. she remains in custody. her bail is set for $50,000. we first came to know marilyn hartman after she jumped a flight from mineta to san jose and landed. they said it was not a secure if i breacsecurity breach, she was arrested, though, as she landed at l.a.x.

according to the arrest report in florida, this time the 63-year-old started out in minnesota on sunday where she boarded a plane without a ticket, arrived in jacksonville, then upped it a notch. she used a fake name to get to the omni resort there near jacksonville where she stayed in a $300 a night villa until the real jest showed up. she has previously told law enforcement she feels safer at airports instead of on the streets where she usually lives. when she was referred to a residential mental health treatment facility in northern california, she did not stay. hartman was assigned a public defender. her bail was set at $50,000. she has said to -- she has claimed to be homeless, so they may not have the funds for this. she told the court she's retired and has an income of about $800 a month. a lot of questions. >> it's amazing. you can't judge a book by its

cover. >> who knows what to make of this, but she probably needs gps tracking. president obama is ratcheting up the heat on isis. as soon as today he may ask congress to approve use of congressional aides say the white house is in the final stages of formulating its plan. that request will be made as early as today or tomorrow. the u.s. has been involved in air strikes for months but never received approval from congress. this would be the first congressional war vote in 13 years when u.s. ground forces returned to iraq. in the meantime, president obama comes back to the bay area on thursday. >> yes, but there will be fewer photo-opes and fun raisers, and more action. on friday, he will be at stanford. it's the first time in 40 years that a sitting u.s. president will make a speech at stanford university. president obama will meet with faculty, tax ceos and law enforcement. >> a great opportunity for students on campus to dive into
