good morning. >> reporter: good morning, laura. good morning, sam. police say that they don't have a suspect description to release just yet, but the woman who was shot in the neck last night was just in the wrong place at the wrong time. and that wrong place was the may hong restaurant at center and tully road in san jose's little saigon neighborhood. police say the woman was having dinner just before 9:00 when someone took aim at the restaurant from the parking lot, though not directly at the woman. >> the restaurant had curtains on it. we believe that the shooter was possibly shooting at the restaurant, but didn't really have a target in mind. one of the rounds struck a patron while she was eating. >> reporter: that woman was struck in the neck. she was transported to the hospital and is in stable condition this morning. witnesses told police that the suspect fled the parking lot on foot before police arrived, and police have not again released a suspect description at this

point. it's worrisome in that it's random, but also because it's random, you can probably walk around in that area and be rrt. in san jose, kris sanchez, "today in the bay." a record-breaking settlement has been awarded to the family of an oakland man who died in the county jail. martin harrison died in 2010 after deputies stunned him with tasers during a confrontation. he was in the midst of alcohol withdrawal at the time. the $8.3 million settlement will be paid by the county and its jail medical services provider. two men on a neighborhood watch patrol are facing chargers this morning after an attack on a newspaper delivery driver. the men on volunteer patrol con fronted the driver early yesterday morning in santa rosa. they thought he was connected to a rash of thefts. police say the men chased and attacked the delivery driver. police say there's no indication the delivery man was connected with theft in the area. okay, laura, not everybody

responds to warnings the exact same way. that is why one bay area city decided to inject a little bit of humor into its traffic hoping to create some safer drivers in the process. >> it actually catches your eye. stephanie chuang joins us live from heyward this morning. the city is using these unusual signs to really grab people's attention.ayward this morning. the city is using these unusual signs to really grab people's attention. in a new way. >> reporter: that's right. good morning to you both, laura and sam. we counted eight of them as you go up and down the hill. take a look at this one here, one of these creative signs that says 30, it's a speed limit, not a suggestion. there are plenty of other ones as you drive along here. you get hit with two near the top of the hill. on hayward boulevard, downhill, use eyes, brakes, brain, with illustrations of each. below that sign is another one. 35, again, it's a speed him, not a suggestion. the entrance of the campus is perhaps a more creative one

geared towards pedestrians. that one reads heads up, cross the street, then update facebook. the signs were installed last month. the city spokesman says the goal is to maybe have the rumor result in a double-take, get people to pay attention more than to the usual signage. speeding is one of the top concerns for people who live here in hayward. these signs cost about $200 each. it remains to be seen how effective they are, but certainly i think catches people's eyes so far. live in hayward, stephanie chuang, "today in the bay." >> as you were observing, a lot to read on those signs. >> i mean, they're catchy, but a little wordy. all right, what words can describe this beautiful vista this morning? a nice start to our morning. >> yes. let's jump start things, shall we? to do that, we bring in our ray of energy, christina this morning. how are you? >> i'm doing great. in fact, i wanted to take a live

>> we're going to look at the san mateo bridge eastbound. you look at the high-rise. the bottom of your screen, we're looking over toward the trees and moving up the eastbound direction. we had that left lane blocked by a crew. they've cleared. we did see them on the flat section. that also cleared. let's look at the hayward side, because we have cameras on both sides of the brichblgdge. we're looking at a smooth drive once again across 92. back to your map, you see a little bit of slowdown on our censors, so very good reaction from our readings out there, and no problems as far as any issues north of there, heading in toward the bay bridge in san francisco. to the south, we're looking at no issues. we have a very light volume as this time. a little build over here on the right side. this is the altimont pass. hayward and the oakland area move nicely. as we move our map north, we're

will pass a bill approving the keystone xl pipeline project. that will set the stage for a showdown with a dead end. president obama has vowed to veto the bill. he wants to review the process and -- he wants the review process to play out ensuring the pipeline will not make global warming worse. the cost and the weight of college textbooks may soon be a little less burdensome for cal state students. students at 13 different schools are going to have access very soon to a new online textbook program. the resource is funded by a philanthropic book. those textbooks will be offered in core subjects online and via low-cost print versions. music to the ears of all those families that shell out big bucks to go to school. typically the students would spend more than a thousand dollars a year on textbooks alone. homeland security is streamlining its cyber security efforts. the government is launching a new cyber security center that will collect information on all cyber threats. leaders say the goal of the new center is to sync up efforts in

fighting online terror, and quickly share information with other departments and companies in the private sector. it's part of the ongoing white house effort to beef up cyber security. >> much-needed. 5:12 right now. apple shares are going to open this morning at 122 boxes a share. that marks an all-time high. >> apple was already the most valuable company in the world. now, scott mcgrew, new records. >> apple the first company in history to be worth $700 billion. that's the company's market capitalization. you take all those shares worth 12$2, multiply them, and apple worth 700 billion. the shares of the apple 6 and 6-plus drove the company to new heights. it's funny to look back at the questions as to whether a bigger screen was a good idea. the answer is oh, yes it was. apple's tim cook said the company would commit more than $800 million to buy solar generated electricity from a

they hollow out the barrel of that wave. we're talking about a beach hazard statement. there is a warning for those of you who do want to hit the beach. we'll talk about that in my next report. temperatures drop wednesday through thursday. i'm talking about a pretty good climb between today and tomorrow, but we're not even going to hit the peak of this warming trend until we get into your all-important weekend. don't leave that chocolate in the car is my message to you. forecast works like this. temperatures mostly in the 40s to start. we'll be in the mid 60s by lunchtime, and we'll round out the afternoon in the low 70s, so room temperature, 72 degrees. that's your forecast for today in the tri-valley. 68 in san francisco and 73 degrees in the north bay. want to check on yur driour dri. they like to come out when the weather is nice. >> we have wonderfully nice wemplt and getting even warmer for the end of the week.ather.

and getting even warmer for the end of the week. looking over here toward 580 westbound, where there's not a lot of lane changes, but folks are holding steady and building. 580 through dublin, we see the speed sensors turning from green to yellow. a typical pattern. slowing a tiny bit through livermore. nothing unexpected through this tri-valley map right here. we'll move you south and look at the south bay itself. northbound through san jose, 101, 87, 280 all moving smoothly. we still have the overnight road work. crews heading through the area or clearing the area may be slowing a little bit for our sensors. give you a live look right here. volume holding steady. we'll zoom out. we'll look at the peninsula. an easy flow. all the way up through redwood city. or 280, beautiful freeway.

once the sunlight comes up, can't see much of a view of the hillsides. easy drive along the east bay. and heading up toward the bay bridge. north of the bay bridge, we're looking at havevallejo. i'll talk about the top of your screen here. the only incident reported, it's not a problem for our commuters, so a smooth flow of traffic. we'll look at the golden gate bridge, a clear view and no delays. we missed the zipper truck, but it did realign for the morning commute, so its job is done and under the radar again. back to you guys. foggy weather being blamed for a 100-car pile-up in south korea. two people died. at least 42 others hurt. it happened on a bridge near seoul's airport. not only was the fog thick, the roads were icy as well. look at that. just crunched cars.

investigators are looking at other factors that may have contributed to the crash. all-new this morning, one in five pilots for one major airline could not pass a p proficiency test. the news comes exactly one week after 42 people were killed in a crash linked to engine trouble. brian williams has been suspended for six months. the suspension is without pay, effective immediately. williams is the subject of an internal review after questions surfaced about the accuracy of a story he told about an iraq war assignment in 2003. in a piece that aired on "nightly news" last week, williams claimed a military helicopter he was riding in took on enemy fire. williams has since said he made a mistake in recalling the incident and has apologized.

kris sanchez joins us. do police know where those shots came from? good morning. >> reporter: it appears that at this point, the shots came from outside the restaurant in the parking lot. witnesses told police that they thought they saw that gunman firing into the restaurant from that short distance away. we can tell you that the woman who was inside who was hit in the neck with the bullet happened to be just in the wrong place at the wrong time. that place was, of course, the may hong restaurant, as you mentioned. that's near center and tully road. in san jose's little saigon neighborhood. police say the woman was just having dinner before 9:00 when someone took aim at the restaurant, though not at her. >> the restaurant had curtains on it. we believe that the shooter was possibly shooting at the restaurant, but didn't really have a target in mind. one of the rounds went in through the curtains and struck a patron while she was eating. >> reporter: those bullets didn't just go into the

tall, asian or hispanic with a buzz cut and thin mustache, wearing a black zippered hood, a headed sweatshirt and some pants. happening today, the antioch teenager accused of kidnapping and raping a domino's pizza delivery woman will face a judge. 17-year-old darion miles jr. will be charged as an adult. he faces eight felony counts. the victim told police miles kidnapped her at gunpoint as she delivered pizza sunday morning. she says she was forced to drive to another location where miles allegedly sexually assaulted her. a school board in marin county is taking action in the fight against measles by tackling the very sensitive issue of vaccinations. with measles cases across the country mounting right now, the reid union school board voted last night to take a stand against parents who are choosing to opt out. they're now publicly supporting an effort to abolish the state's personal belief exemption. the family of a 7-year-old cancer survivor who goes to school in that district helped to make the case here. >> you know what it's like to

renovations at the mcguire correctional building in redwood city. the changes will include a move towards all video visitation. instead of talking behind glass, the new correctional facility will have 48 kiosks setup so people can visit inmates through a computer. not everyone is happy about the change. >> i think we need to be cautious before investing too much in mcguire until we really understand how exactly we're going to use that facility. >> social media and online and on a computer is not as personal anymore. it would be better to have person to person. even though it's through glass. >> they're using the system right now and alameda and monterrey counties are considering the change. going to shift gears now and take a look at our microclimate forecast. this as we take a live look outside downtown san jose on your wednesday morning. >> maybe you want to head to the beach. can you believe that's a possibility this week? with great temperatures headed our way. >> yeah, it's going to be really

"american sniper." opening statements will be made this morning in the capital murder trial of former marine eddie ray routh. he's accused of killing kyle and kyle's friend two years ago at a shooting range in texas. we have new details in the shooting of a popular tv sports anchor. authorities in san diego last night arrested the man accused of shooting kyle kraska. cameras were rolling when he surrendered. he's now recovering after surgery. there's no word yet on a motive. two people have been hurt in southern california by exploding electronic cigarettes. in san diego, a man was rushed to the burn unit after his e-cigarette exploded inside a liquor store, shattering windows. the e-cigarettes heat liquid
