who shot a woman eating in a restaurant. it happened at may hong at the intersection of center and tully. police do not think the woman was exactly targeted? >> no. they say that there were heavy curtains on the restaurant windows and that she was inside, the shooter was outside across the parking lot. so they say that it's likely that the shooter was aiming at the restaurant, though not directly at that woman. that restaurant is the may hong restaurant near center and tully road. this is san jose's little saigon neighborhood, and even at, you know, just a couple minutes before 9:00, it is a bustling part of town. several lanes of traffic in each direction. officers say that witnesses told them that the suspects shot at the restaurant, then took off on foot. >> the restaurant had curtains on it. we believe that the shooter was possibly shooting at the restaurant, but didn't really have a target in mind. one of the rounds went in

through the restaurant, through the curtains and struck a patient while she was eating. >> reporter: witnesses told police that the shooter fired more than one time. though that woman was only hit, it appears one time. that was in the neck. she is in stable condition. police are working on a suspect description that might be helpful to release to the public. sometimes it's just too general. witnesses say that the suspect managed to leave the scene before police arrived. that person was on foot. in san jose, kris sanchez, "today in the bay." >> no doubt frightening for that woman. thank you, kris. happening today, the antioch teenager accused of kidnapping and raping a domino's pizza delivery woman is going to face a judge. the 17-year-old darion miles jr. will be charged as an adult in this case. he's facing eight felony counts. the victim told police that miles kidnapped her at gunpoint and she delivered his pizza sunday morning. she says she was forced to drive to another location where police say miles sexually assaulted her.

this morning, palo alto police hope to release a sketch of a man who's been taking pictures of women in a public bathroom. last night a woman was stunned to see someone holding a camera over her stall and recording her. police say a very similar crime happened at the facility in july. and the suspect description is also similar. a man in his 20s, about 5'7", hispanic or asian with a buzz cut and a thin mustache, wearing a black zippered hooded sweatshirt and pants. two men on a neighborhood watch patrol now are facing charges after an attack on a newspaper delivery driver. the men on volunteer patrol confronted that driver early yesterday morning in santa rosa. they thought he was connected to a rash of thefts. police say the man chased and attacked the delivery driver. they say there's no indication the delivery driver is connected with thefts in that area. a bigger paycheck could soon be on the way for some workers in palo alto. the city council voted to move

forward with the proposal to raise the minimum wage above $9 an hour. the proposal is now on its way to the policy and services committee. the committee is now responsible for drafting an ordinance that outlines the new base wage. it's a contentious topic. the school board in marin county taking flax the fige ining acti against measles. with measles cases across the country mounting, the reid union school board in tiburon voted last night to take a stand against parents who are opting out. they're publicly supporting an effort to abolish the state's personal belief exemption. the family of a 7-year-old cancer survivor who goes to school in that district helped to make this case. >> we know what it's like to get up every night in the middle of the night to give an i.v. medicine and feed our kids through a feeding tube. to have that complicated by an illness that was eradicated, that could be avoided. >> making everybody get vaccinated unless they are doing chemo like i did. soon, we will say gone with the

what do you know, christina? >> no, she did not. she's raiders. >> thanks for pay attention, sam. thanks for making me feel important and special right before valentine's day. i'll shed a little tear later on. say a little prayer for you. it is chilly out there to start. grab your jackets. something you can ditch by lunchtime. sunny and unseasonably warm out there. i'm a raiders fan, so i had to go for the giants. as we get into this afternoon, temperatures are going to climb pretty quickly. we'll be in the mid 60s out there by lunchtime. and so your hour by hour forecast really tells the story of the day. we hit peak warmth at about 3:00. 71 degrees on the peninsula. and 73 degrees at 3:00 p.m. what a beautiful day out in the tri-valley. temperatures where going to be rather warm this weekend, but we received quite a bit of snowfall up in tahoe from the recent storm that came through. i'm going to take you up to tahoe. in my next report, we'll talk

smoothly now. the crash at mckey just outside of our shot here has cleared to the shoulder. let's look at your map. we do have the slowing on the approach now. 101 slows all the way up to mckey itself. that might cause a little more slowing. north 680 might be taking on a little more traffic. a fender bender just reported. we'll see if it's cleared to the shoulder. here's the rest of the south bay. silicon valley moving smoothly. zooming over toward the east bay where we have southbound 880 through san lorenzo and into hayward. it may be sticking around for a couple of minutes, enough to cause a slowdown. that is a bad place to have it at a bad time right now. the rest of the east bay pretty predictable. the arrow there at university is off of the roadway. you have your building slowing from richmond down to the bay bridge toll plaza where the metering lights are on. you also see san rafael coming out of the east bay.

zooming out, we see north of the san mateo bridge, on the peninsula, easy flow as well. a live look at palo alto. nothing unexpected here. northbound with those taillights past willow. southbound heading towards university. very nicely from the bayshore as well as 280 through that same stretch. >> sounds good. have to pay attention to all those traffic signs out there. hayward is using humor to take on the serious issue of dangerous driving. signs began popping up last month on hayward boulevard where cars tend to zoom downhill. the signs are funny, but pointed, too. one reads 30, it's a speed limit, not a suggestion. >> no hint, hint about that. another tells pedestrians to cross the street first before updating their facebook page. speeding a major concern for many people who live in that area. it's 6:09. just how much money is up for grabs in tonight's big drawing. and the nsa wins a huge case against spy critics in court. we'll take a look coming up, next.

moments. >> and a live look at fremont, 880, both directions. >> we'll check back with you. meantime, here are today's top stories. police in san jose looking for a gunman who shot a woman while she was eating at a restaurant on center and tully road. the woman is doing okay this morning. officers do not think she was specifically targeted. >> this morning, a suspected gunman is facing charges for the murder of three muslims near the university of north carolina at chapel hill. police have not released a motive. and president obama has sent the congress a draft for authorization asking the u.s. military to go after isis. in the draft, the president tells congressmen and women that the islamic state poses a great threat to the united states. a big power ball jackpot drawing. $485 million is up for grabs.

people's phone calls and internet messages. the case turned into a class action lawsuit against the white house. tuesday in oakland, a federal court judge ruled against the plaintiffs. people like you and me saying they could not prove that they had standing in this lawsuit. they didn't have the right to sue. and the reason the people couldn't prove their information was captured. it's a real pickle because if the plaintiffs had the access to the secret files to prove they should be in court, the courts would strike it down anyway because of state secrets. so they lose the case in the sense that it cannot go forward. other news. apple will start trading this morning at $122.2 this morning. that's an all-time high for those shares at the start of the trading day. the stock price gives apple an overall value of $700 billion. the highest value of any

publicly traded company in history. we'll have to watch it again today. >> each new generation of iphone definitely drumming up a lot of business. they know what they're doing over there. >> thank you very much, scott. it's time to check the microclimate forecast. let's take a peek outside. clear skies making for a cool start, but a beautiful look from emeriville. across to the by bridge this morning. >> we have a second live look. downtown san jose. double your pleasure, double your fun. on a weekend which lots of folks are looking to make some plans. valentine's day one of the major holidays of the year. coming up. any ideas here what's going down? >> oh yeah. my husband and are going down to el corn slew. we like to go kayaking down there. we have a good time. so whatever your plans are beginning to be, you want to think it's going to be very

warm. but some of us might want to go to tahoe. and i'm talking about those of you who have been really disappointed in the season so far. take a look at this. 26 inches of new snowfall at squaw and alpine meadows just in the last seven days. scene so 43 inches at the bi ee. just about three and a half feet out there at the base, which is very impressive. a lot better than what we were doing earlier this year. high pressure is building in. only the high thin clouds can make it through. also we're seeing everything forced to the surface. that translates to fog out there. some fog starting to develop there. the weather story of the day is that it's going to be sunny and unseasonably warm. going to take you through your

forecast. temps in the mid 60s. at lunchtime today all across the board, we'll round out the day in the low 70s. a couple of upper 60s out there, but san francisco this time of year, usually it's 59 degrees. temperatures will continue to climb all the way through saturday. of course, that's valentine's day. don't want you to forget about that if we haven't told you enough already. this ought to inspire you to get outdoors. the tri-valley is at 80 degrees. trying to get into the bay area. we'll keep you updated on that. want to check your drive. here's mike inouye. >> looking towards san jose where north 101 does start to slow a bit. good recovery right here. this is 680 to 280. let's show you on the map what we're talking about. the crash north 101 at mckey caused slowing.

big slowing, which actually has started to clear very well. a lighter volume today throughout the south bay. lighter than yesterday. the big backup right here caused more folks to force their way and look over here as they crossed over the freeway, saying i'm going to continue on southbound 280 as well to try and get out of that backup. so these surface streets for the time being might be a little more crowded as folks try to get there this way. getting stuck into a fender bender as other folks are not sure. that's the ripple effect that happens for any issue on the bay area freeways. right now, the earlier crash has cleared, as we look at your map here. we have a smoother drive now. and now having a lot of traffic move toward union city and fremont. same thing for 680 through pleasanton. here's the tri-valley look. a typical pattern out of livermore and dublin. no drama as we look in toward oakland and anywhere north. we're looking at a typical

the news came down last night, nbc has suspended brian williams from the nightly news for six months. the suspension is without pay and it is effective immediately. williams has been the subject of an internal review after questions surfaced about the accuracy of a story that he told about an iraq war assignment that dates back to 2003. williams claimed a military helicopter he was riding in took on enemy fire. williams has since said he made a mistake in recalling the incident and he's apologized. another tv shake-up. jon stewart saying goodbye to "the daily show." >> 17 years is the longest i have ever in my life held a job by 16 years and five months. [ applause ] thank you. the upshot there being i am a terrible employee. but in my heart, i know it is time for someone else to have that opportunity.

president formally asked congress to use our military to go after isis. but lawmakers want to know how long will that engagement last? for that information, we get the latest from tracie potts live on capitol hill and it's kind of an open-ended question i guess at this point. good morning. >> reporter: we actually learned this morning that this authorization is going to be for three years, so the next president will have to seek another one. that lawmaker seemed okay. we've already been bombing by air. how much deeper into this does president obama want to take the united states. that's what the debate is going to be all about. that request has now been submitted here on capitol hill as of this morning. now, the other thing we're watching today is a hearing about foreign fighters and extremists overseas. some of them coming from the united states. the national counterterrorism center in their advance testimony said they believe there are about 20,000 isis

fighters worldwide. about 150 of those, they think, are americans. and while that might not sound like a lot in the big scheme of things, it's three times as many as they reported this time last year. sam? >> hard to even fathom the pull that you have people from this country going abroad. the few americans still behind at the u.s. embassy in yemen are now gone. the state department shut down the embassy's doors overnight. france made a similar move just hours ago. last month, yemen's government collapsed amid heavy fighting with iranian-backed rebels. the u.s. military is preparing to pull most of its troops from the epicenter of the ebola outbreak in west africa. president obama is expected to make that announcement later this morning. now, infection rates in the region have declined significantly in recent months. 1,300 troops are currently providing aid there in west africa. >> today, the republican-controlled congress will pass a bill approving the keystone xl pipeline project. that will set the stage for a showdown with a dead end. president obama has vowed to

veto the bill. he wants the review process to play out ensuring the pipeline will not make global warming worse. more snow is on the way to new england. >> just what they wanted to hear. nearly six feet of snow has already struck the boston area over the last 18 days. and the national weather service says the area is on track to see another two to four inches over the next two days. forecasters are watching another larger storm coming for this weekend. >> wow, the snow blowers hard at work there. certainly not the case here. time to check the forecast this morning, taking a peek outside live at san jose, where we're seeing temperatures now creeping up. >> just breathe it in. enjoy it. we know that we've finally got some rain, and now some beautiful weather. >> you know, it makes you enjoy that beautiful weather a little bit easier. we do have a little bit more rain on the way. i can tell you that much, as we head throughout the beginning of next week, and a better chance toward the end of next week. that's the number one question posed to me on my facebook page,

please ask me your questions. i love answering them. and you know what, every microclimate around here is different. that's why we give you a microclimate weather forecast, and don't forget, we've got your seven-day always scrolling at the bottom of your screen. temperatures are mostly in the 40s to kick off the day. 41 degrees in san martin. 43 in concord. the reason for the warm-up is high pressure firmly in control. this ridge is only going get bigger and stronger throughout the next couple days, impacting southern california with santa ana winds. unseasonably warm as we head throughout the day today, but l.a. is going to be in the 90s. for us, we're going to see the 70s and the 80s, so it will be really lovely out there. temps right now, though, looking pretty chilly. we'll be in the mid 60s by luchb lunchtime. stick around, i'll tell you about some big waves and dangerous surf on the way as we head throughout the next couple days, especially thursday into saturday. more on that in my next report.

right now, though, i want to check your drive with mike inouye. can't do it. no saving me. >> it's fine. mike inouye. they call me that at home. like in the old country. we're looking at northbound 101. traffic flows very nicely right here. we had really good recovery actually. this was the issue. typical pattern as far as the colors go. earlier crash just north of our camera shot caused a real big slowdown. it's starting to kick in once again. that additional traffic and two crashes now over on the shoulder as to more slowing than you might expect coming around that bend off of 101 and 680. clear by the time you get up to 273. as we zoom out the map, we're showing you farther north, southbound 880 slows a bit. no problems. actually clearing a bit through

the widow of chris kyle will be among the first to testify. kyle was depicted in the movie "american sniper." opening statements will be made this morning in the trial of eddie ray routh. he's accused of killing kyle and kyle's friend two years ago at a shooting range in texas. we have new details this morning in the shooting of a popular tv sports anchor. authorities in san diego have arrested the man suspected of shooting kfmb's kyle kraska. kraska was shot yesterday in the leg and in the stomach outside of his home. he's now recovering after

if it's helpful, we will cert n certainly pass it along to you. kris sanchez, "today in the bay." let's get a check of your microclimate forecast. we say it enough, should be able to get it straight. this is a live look at downtown san jose this morning. pretty clear look. >> yeah, it's a nice start to our day. and the warm-up is coming as well. >> yeah, it's going to be absolutely lovely out there. and you know what? what a difference a weekend makes. you probably were kept indoors by the rain showers that came through last weekend. going to be a very different scenario, the kind of weather that promotes getting on outdoors, breathing in that good air quality. i do have to keep this on the forefront of your mind. we have dangerous rip currents. whenever we get offshore flow, it tends to bring in some fire danger. we'll the talking about that throughout the rest of the week. let's talk about what's happening out there with temperatures starting out in the 40s and 50s. just a lovely start to the day.

by lunchtime, the mid 60s. and then you'll round out the day as you pick the kids up from school. maybe you start to make your way home from work at 3:00 p.m. warmest time of the day. temperatures in the low to mid 70s at that point for just about everyone. san francisco, you'll be at 68 degrees. high pressure moves in. this is a strong ridge of high pressure. it's going to boost that storm track way to the north, at least for the next few days. and as that ridge takes hold, temperatures will jump today and tomorrow by a good five to ten degrees on average. then as we head into the weekend, we are going to see the peak of that offshore flow trend 70s and 80s on the way as we get into your valentine's day weekend. friday, though, looking good for your outdoor plans. that's when we'll hit the 70s in both san francisco and in san jose. saturday into sunday looking nice and warm out there. upper 70s on the way all weekend long. you want to hit the beach, check out these numbers. 70 degrees in bodega bay.

san mateo, both directions of 101. we have an incident southbound 880 as you're heading in toward union city. that might be now have cause this backup, and making those folks decide to take the san mateo instead of the dunbarton bridge. typical pattern here. north through santa ramon without incident, heading toward the walnut creek interchange. 680 northbound, earlier crashes have caused quite a slowdown off of 101. this is much slower than you would expect. no surprises for concord over here. the earlier crash at buchanan has cleared. live look. you'll see the volume building

up as the sun comes up. >> happening today, the antioch teenager accused of kidnapping and raping a domino's pizza delivery woman is set to face a judge today. 17-year-old darion miles jr. will be charged as an adult. he faces eight felony counts right now. the victim told police that miles kidnapped her at gunpoint as she delivered his pizza sunday morning. she says she was forced to drive to another location where police say miles sexually assaulted her. this morning, palo alto police hope to release a sketch of the man who's been taking pictures of women in a public bathroom. last night a woman using the restroom was stunned to see someone holding a camera over her stall and recording her. police say a very similar crime happened at this facility in july and the suspect description is also similar. a man in his 20s, about 5'7", hispanic or asian with a buzz cut and a thin mustache, wearing

a black zippered hooded sweatshirt and pants. two men on a neighborhood watch patrol facing charges this morning after an attack on a newspaper delivery driver. the men on volunteer patrol confronted that driver early yesterday morning in santa rosa. they thought he was connected to a rash of thefts. police say the men chased and attacked the delivery driver. police, though, say there's no indication that that delivery guy is actually connected with the thefts in the area. drivers in one bay area community will notice some quirky signs on their way to work this morning. one of them reads heads up, cross the street, then update facebook. >> stephanie chuang joins us live from hayward. the city using some humor and lightheartedness, kind of, to get drivers and pedestrians to pay attention. >> reporter: that's right. laura mentioned that sign. it's for the people around cal state east bay who have been glued to their phones as they cross the street. there are signs for that. you can see the flashing lights and signage all along the

boulevard, which turns into hayward boulevard, including this brand-new batch. this one reads 30, it's a speed limit, not a suggestion. a little bit of humor there, i suppose. we've counted about eight signs, including two farther up on hayward boulevard. use eyes, brakes, brain. there are pictures next to it. also right at the main campus entrance is a sign for people walking around. that one reads heads up, cross the street, and then update facebook. city spokesman frank collins says the humor is to result in a double-take. the recent survey in hayward revealed that speeding is one of the top concerns for the people who live here. these signs, again, about eight of them, cost about $200 a pop. all installed last month. remains to be seen how effective they will be. live in hayward, stephanie chuang, "today in the bay." >> time to slow down. thanks, steph. a school board in marin county taking action in the fight against measles by tack

tackling the sensitive issue of vaccinations. with measles cases across the country mounting, the reid union school board in tiburon voted last night to take a stand against parents opting out. they're now publicly supporting an effort to abolish the state's personal belief exemption. a bigger paycheck could soon be on the way to some workers in palo alto. this week the city council voted to move forward with a proposal that would raise the minimum wage above the state mandated $9 an hour. that proposal is now on its way to the policy and services committee in palo alto. the committee is responsible for drafting an ordinance that outlines a new base wage. >> here we go. happening today. big power ball jackpot drawing. $485 million. it's all up for grabs. >> you can do a lot with $485 million.
