season. >> we are going to see more moisture in the atmosphere. the low clouds returned a cooler day on tap. we want to tell you about the king tides, final king tides of the season returning to the coast today and winter warmth persists as we get into the mid section of the week. we'll be back in the 70s. your full forecast just moments away. >> moisture in the air, i see what you're talking about. we'll point it out for our drivers as well. it may be a concern as we get started on this early morning commute. let's talk a live look outside on this tuesday morning. there come the crowds on the golden gate bridge. it's february 17th. this is "today in the bay." >> and a very good morning to you. thanks so much for joining us. i'm laura garcia-cannon. >> and i'm sam brock. happening today, the president is sending u.s. labor secretary thomas perez to the bay area to mediate discussions between dockworkers and their employees. nannette miranda joins us live

from oakland. nearly two dozen docks are expected to reopen at some point today? >> reporter: 7:00 a.m. is what we have heard as well. people on all sides have high hopes that the labor secretary with k broker some sort of settlement to end this labor dispute dispute. tom perez is scheduled to meet both sides with the shipping company's bargaining agent the pacific maritime association and the international longshore and warehouse union. the last contract expired in july. the two sides have reached a tentative agreement on key issues but are stalled on pay and arbitration changes. the result a work slowdown. that has had a crippling effect on moving cargo through the west coast seaports from southern california to seattle, including oakland. the ports are a critical trade link not ohm fornly for our imports but also our exports, for nature's sun-grown foods profits are hurting. it hasn't been able to ship products to asia in a timely manner for months.

>> we're afraid that if our products don't arrive in our particular countries in east asia, that our customer alsos will have to find other sources. >> it's having a very significant impact not simply on the bay area or california but on the entire country. in some cases it's an inconvenience. in other cases it's a disaster. >> reporter: over this past holiday weekend, a partial shutdown took place, starting saturday. shippers locked out workers saying they would not pay weekend or holiday wage premiums to crews they say are intentionally slowing down to gain a bargaining leverage but the ports are scheduled to reopen today just as the labor secretary is coming in to try to settle this dispute. again, as we mentioned earlier, we're told that workers and the port should reopen here around 7:00 a.m. live at the port of oakland, nannette miranda for "today in the bay." >> some encouraging news there. thank you. it is 5:02.

police in the east bay looking for the gunman who robbed a little sighcaesar's in el cerrito. the two got the cash shot the employee, then took off. we're told the employee was rushed to the hospital. no update on that person's condition. bay area nurses will be rallying in sacramento today. this as six hospitals operated by daughters of charity health system are slated to be sold to prime health care. four of them are in the bay area. the hospitals are operated as non-profits, meaning the sale must be approved by the attorney general. daughters of charity says the hospitals will have to shut down if that sale is blocked. there's a flipside to this story, though. the seiu filed a lawsuit against daughters of charity claiming that workers are being coerced into supporting the sale for fear of losing their jobs. a federal judge in texas is signing with a group of 26 states trying to block president obama's executive action on immigration, a move that could

save as many as 5 million undocumented immigrants from being deported out of the u.s. "today in the bay's" stephanie chuang joins us with more. the white house already responding. >> absolutely good morning to you, laura. the white house saying the president acted well within his powers and the justice department will appeal the ruling that prevents the order from going into effect. judge andrew hennin outspoken critic of the obama administration regarding immigration policy brokdlocked the executive policy at least temporarily to as many as 5 million undocumented immigrants. this does not take away if are that deferred action program that went into effect three years ago. >> if you qualify for deferred action under the original obama administration program that was announced in 2012 you can continue applying and you definitely should continue renewing your derd action status. >> judge hennin sided with the

coalition states in the south and midwest, followed the lawsuit in december arguing the president had stepped beyond his constitutional powers. the question is though whether the judge's ruling will stand and for how long. some legal scholars have said the u.s. court of appeals from the fifth circuit would quickly suspend any order to stop the president's actions. coming up in half an hour we've got more on the states that support the president and why. laura? >> the different sides and perspectives, thank you, steph. despite being in the dead of winter right now, cal fire is planning for the summer. this morning they're holding interviews for seasonal fire fighting jobs. "today in the bay's" kris sanchez joins us live from morgan hill. >> reporter: they're looking forward to the summer and looking forward to the spring because the fire season could start two weeks ahead of schedule and that makes this now hiring not completely good news. about 300 fire fighters will show up here for interviews in just a few hours, narrowed down

from about 1,200 applicants who were trying to make the cut. by the end of the process it will be further whittled down. calfire may add 20 to 30 jobs in the bay area and 120 statewide. the pressure is on to get that ball moving because with our recent gorgeous weather and our recent rains back in december we could make for an ugly fire season. >> staff work really hard across the department accomplish getting all of our hiring processes done even earlier so that we can get folks trained and get them out and deployed to the stations. >> reporter: the cal fire plan is to have the new firefighters ready to go, believe it or not, by the start of april, and that is several weeks ahead of the wildfire season schedule and of course, we will be battling for resources both with southern california and northern california as recent rain and wildfires have led to the

concern of erosion on the hillsides and so when the fire season does start, it will be statewide. in morgan hill kris sanchez, "today in the bay." >> kris thank you very much. dry and hot, that's how it's been really could use a lot of rain. not a lot in our forecast although i did see a little mist in the air. christina joins us with a look at the microclimate forecast. >> good morning to you, sam, laura, everybody at home. happy tuesday. we are looking towards a little bit of that patchy drizzle, some fog out there as you make your way out that front door and you can see the temperatures showing you that blanket of clouds almost uniform numbers. 49 degrees in santa rosa 55 degrees right here in san jose and kicking off the day at 52 in half moon bay. what a pretty day we have coming your way. i have to tell you it's a gray start, kind of murky out there, until at least lunch time and that fog is back. that's going to keep our hillsides nice and moist making way to beautiful afternoon sunshine but really staying nice and cool all the way through lunch time today.

that's 59 degrees at noon on the peninsula. today 61 on at east shore and 62 degrees as you break for lunch in the tri valley rounding out the day in the mid-60s about ten degrees cooler for many locations than where we ended up yesterday. we have the king tides back. we'll talk about that that might actually interrupt your bike plans this morning. we'll tell you where they will be the most severe and we're also going to talk about your weekend, because there is more change on the way to the bay area. so stick with us. your microclimate forecast is coming up in moments. right now check your drive, back to work tuesday, good morning, mike. >> good morning, christina. the san mateo bridge christina talked about low clouds maybe mist and drizzle. coming through the south bay she had to use windshield wipers. easy drive westbound on the flat section. can't make out the high-rise. we have a camera on the other side of the bay and can see the foster city drive come off the high-rise. lot of moisture in the air and not much of a back drop but the approach about half way across

the span as far as visibility and that's plenty for drivers. let's look at the maps. that will change over the morning and we'll track it as the fog develops in parts. 92 the san mateo bridge dumb barton bridge and the south bay moving nicely. the north bay novato san rafael, mill valley 101 at speeds same thing for 37 a little bit of build both sides, 101 as well as out of vallejo interstate 80. traffic on 24 not a major concern, the caldecott moves smoothly toward lafayette and the walnut creek interchange. look at the slowdown there seems to be a stalled vehicle that turned into a crash scene right here west 580 around north flynn. most of our viewers and commuters are west of there but this will slow folks coming out of the altamont pass. they're just going to buzz straight through and head toward the rest of the bay, back to you guys. >> thanks mike. there will be a public

america's new secretary of defense officially takes the ranes today. ashton carter iswill be sworn in today by vice president joe biden in a private ceremony yu in washington. later today, carter will deliver remarks to military and civilian staff at a pentagon welcome ceremony. a new contender in the race for california's u.s. senate seat. rocky chavez will make what his camp calls an important announcement. many speculate the state assemblyman will announce his candidacy to replace senator barbara boxer on capitol hill. carmela harris is the only candidate to officially enter the race. 5:13, a respected security firm said it found evidence that

someone is putting spy software right into the software dna of computers and of hard drives. scott mcgrew, we're not talking about a hacker or virus, but something far more serious. >> we're talking about right at the manufacturing level, the software that controls the things like hard drives down below the operating system. spying programs essentially so deep inside the computer you could remove the whole operating system and it would still be there. the security company kapersky says it's not naming the government it suspects of doing this but says the targets are countries like iran russia and pakistan, so if you're having trouble reading between the lines there, those are countries the united states would tend to spy on. well let's check the markets this morning. let's turn to meg terrell, live at cnbc world headquarters. good morning, meg. >> good morning. stocks could face pressure today as investors worry about bailout talks in greece which have stalled and the shaky cease-fire between russia and ukraine.

futures are lower ahead of the opening bell. the markets come off a positive week, we saw the s&p 500 index close at a record high friday. we get data on housing and reports on inflation, home construction, manufacturing and the minutes from last month's fed meeting later this week. on friday the dow rising nearly 47 points to 18,019 the nasdaq up 36 to 4893. back to you guys. >> are the will meg, thanks. we're hearing more about the apple watch, the "wall street journal" says it won't have as many health features as first planned partly because apple was not able to get them to work as dependably as they would like partly because it would expose the watch to too much government oversight as a health device this according to the "wall street journal." separately apple founder steve wozniak says he feels confident the watch will be a huge success even though he has not liked smart watches in the past. he tells the bbc that hip camp

easier to get back to business for today. after all for many of us not me, but for many of you it's actually a very limited work week with presidents day holiday and so if you're one of those people who get to enjoy that abbreviated work week beautiful conditions will persist for today. we want to take you through your day part forecast temps in the mid-50s to kick off a tuesday. 55 degrees on the peninsula. 53 degrees right now in san francisco, and what a gorgeous day coming your way, after we lose these low cloud. temperatures closer to average than any other day this week. 60 degrees in san francisco at noon and we'll round out the day nice nicely comfortably. temperatures ten degrees cooler than yesterday. as promised the dipping tides are back. here is the deal. high tide at 10:02. you want to keep that this mind. if you live near the ocean beach a walk near the embarcadero you don't want to muck up your shoes

and avoid the embarcadero around high tide 10:02. i say avoid it between 9:00 and 11:00. other low-lying areas, roadway flooding likely as well. coming up i'll tell you how this is directly correlated to sea level rise and how we could look at more of this as the norm as we head throughout the coming years. that's coming up as we head throughout the 6:00 hour together. for today, temperatures are going to be cooler than any other day this week. we'll be back in the 70s and i know a lot of you like the 70s wednesday through friday. here in san jose mid to upper 60s on the way for you for most of the week in san francisco but you're back up to 70 degrees by saturday with a very slight chance for showers in the system that's going to sneak up from the south as we head throughout late sunday into monday. more on that coming up. i want to check your drive and see how mike inouye is doing on a tuesday morning. >> we're doing all right for the tri valley. new incident for the south bay and we'll point that out in a second. this is west 580, more cars than

we saw traveling through the same shot yesterday. we expect to see that as a lot of businesses had presidents day off. you see the glow as well low clouds hovering around much of the bay. the tri valley not a concern the dublin exercise change it's farther back coming out of the altamont pass a crash earlier a stall and then a crash. i don't know if it's the same vehicle that was hit as it was in the middle of the roadway but it's over here north flynn road. look at the jam approaching the scene. the activity moving off the shoulder but the kickoff to the slowdown is enough to keep it there for the time being. there's vasco, anywhere west moving smoothly. southbound 101 at brokaw that may be slowing. it happened a few minutes ago, maybe in the middle lane. we'll wait until chp gives us more details. a live look at the san jose camera shows more glowing lights.

christine had to use her windshield wipers. moisture indicated here as well. we'll show you the rest of your commute the south bay no problems, the peninsula an easy drive and anywhere north of the san mateo bridge pleasant including the approach to the bay bridge and the north bay, where no delays are showing up from novato through san rafael but we'll track that as the volume builds again. the only red over here for west 580 out of the altamont toward north flynn. back to you. >> thank you, mike. we have breaking news out of haiti this morning. at least 18 people were killed during a cairnal in the capital of port-au-prince when the parade float was electrocuted by a power line. this is the chaotic scene on the street. someone on the float used a pole or stick to move a power line so the float could pass under it that ended with a shower of sparks. 46 others were hurt. city leaders in new orleans are hoping for a safer mardi gras celebration. it is fat tuesday and people are already out not surprisingly in

the french quarter. despite a slight chance of rain and colder than normal temperatures, 95% of the city's hotel rooms are booked. look at elvis even in the crowd. another round of partying is set to start in rio de janeiro this morning. the third day of carnivale festivities in the brazilian city. thousands of performers danced in the city some riding halloween-like floats. thinking of taking your four-legged loved one on an amtrak? that day could come very soon. lawmakers are pushing for amtrak to allow certain pets on trains as in small dogs or cats traveling in carriers. right now only service dogs have been allowed onto the train. amtrak agreed to try a test run on two lines in the midwest. one lawmaker is pushing to expand that program nationally. >> there's hope for cocoa. >> yes cocoa, we'll explain who cocoa is at some point in the future. in asia millions are people are preparing for the chinese new year. >> it's the year of the sheep which is bringing a lot of attention to a cafe in seoul.

a very good morning to you. 5:24. police in sunnyvale are investigating how a car wound up in a pond sending one person to the hospital. it was pulled out of the water in front of the sunnyvale community center just after 1:00. one person was taken to the hospital. we're not sure of the extent of anyicries. 5:25 right now. 49ers star aldon smith put his san jose house on the market. according to the "l.a. times" the home is listed for just under $3 million. this is the same house that police searched after an infamous house party back in june of 2012 when partygoers say smith was stabbed and two partygoers were hurt when someone opened up fire at the house. when police searched the home they found five unregistered weapons. smith was later sentenced to

it is tuesday, february the 17th and you are watching "today in the bay." a very good morning. thank you for joining us on this tuesday. i'm sam brock. >> and i'm laura garcia-cannon. this morning the white house is promising to appeal a federal judge's ruling that blocks as many as 5 million undocumented immigrants from deportation protection and work permits. >> "today in the bay's" stephanie chuang joining us now. the president's executive order was set to go into effect later this week. >> that's right, in fact as early as tomorrow. we're talking about some undocumented immigrants who were slated to begin receiving applications tomorrow on wednesday. the president's executive action was set to offer the work permits, protection from deportation to as many as 5 million undocumented immigrants but the federal judge in south texas sided with the coalition of 26 states most of them in the south and midwest, led by texas, by the way, which filed a lawsuit in december arguing the. the has overstepped his

presidential powers. immigration groups are calling this a temporary setback. >> very important that the community does not lose hope. it's important people understand this is temporary, this is light at the end of the tunnel and as we've been saying for the last several months people should continue to prepare. >> the question now is whether that judge's ruling will stand in for how long. some legal scholars said the u.s. court of appeals for the fifth circuit would quickly suspend any order to stop the president's actions. 12 states including california and the district of columbia support the president's executive action saying undocumented immigrant workers coming out of the shadows would result in increased wages and taxes, so a lot going on here. coming up in half an hour immigration groups say this is a setback and they'll talk about the impact actually here in the bay area. we'll go7zñ? more into detail with that. >> deeper dive thank you, stephanie. happening now, the stakes in the west coast port shutdown have been raised. with talks stalled between the

dockworkers' union and the maritime association, the u.s. secretary of labor is stepping in. "today in the bay's" nannette miranda live in oakland this morning. nannette 29 ports up and down the coast have been shut down. will the secretary's presence really jump-start shipping for now? >> reporter: well the hope is the secretary can work miracles to get this dispute to an end, consumers are suffering because not as many goods are coming in and bay area companies are not making as much money if they can't ship goods out, take sun-grown foods which haven't been able to send products to asia in a timely manner. it's caught up in the west coast port slowdown that's been simmering for months because of a labor dispute affecting 29 ports from southern california to seattle, including oakland. the stalemate has caught the attention of president obama, so he has sent his labor secretary, tom perez, to the bay area to try to broker a deal between the

pacific maritime association which represents the shipping companies and the international longshore and wariousehouse union which represents 20,000 workers. the first meeting is scheduled for today. >> i'm hoping that he won't leave until we have an agreement. >> also today as you mentioned, the three-day holiday weekend partial shutdown is supposed to end today since saturday's shippers have locked out workers saying they would not pay weekend or holiday wages to the crews because they are accusing them of intentionally slowing down work to gain a bargaininglerrage, and the union denies that it's doing this and with the u.s. economy, parts of it at stake, all hope are on secretary perez to broker a deal. live at the port of oakland, nannette miranda for "today in the bay." >> a lot of businesses would like to see some movement. thanks nannette. >> 5:33 right now. gunman is on the run this morning after a shooting in the east bay. detectives say the shooting happened just north of highway 4 in bay point, just before 8:00

last night. two young women were taken to the hospital as a result. we're told they should survive. a convicted sex offender just released on parole will be back in court faces new charges. carlisle villazon is accused of molesting a little girl inside a 99 cent store in hayward earlier this month. in 2010 he was convicted of molesting a girl at a walmart in san leandro. he served time in prison and was recently released on parole when this recent attack happened. class will be in session at claremont middle school after all in oakland this morning, despite a large fire there yesterday. that fire caused about $1 million worth of damage to the cafeteria. investigators say it looks like someone broke into the building and they're now trying to figure out if it was intentionally set. the school is making arrangements to make sure that student lunches will still be served. happening now, another round of winter storms moving up the east coast today. state of emergency has been declared in tennessee, where icy roads have caused crashes and stranded drivers. the national weather service

says parts of west virginia could get more than a foot of snow and the federal government has closed its offices in washington d.c. where they're expecting six to eight inches of snow. >> back at home right now, 5:34. it's kind of a royal forecast this morning. we're going to check in with your microclimate forecast with christina loren talking about the king tides. >> good morning to you. going to definitely see the king tides today, should be the last of the season. we'll talk about how the king tides are directly correlated with sea level rise and how this could become more of a norm as we head into the coming years, coming up in the 6:00 hour. i want to start with what's happening out there when it comes to low cloud cover this morning, as you're making your way out that front door. might be an abbreviated work week for you. keep in mind you might have to use your windshield wipers from time to time. the low clouds are thick and settling in just about everywhere, in san jose fremont, through concord, napa san jose and up and down the coastline this morning across the bay area so for us that's going to translate to a cooler

day, stronger onshore flow means more moisture not going to be as dry out there. you'll probably notice that difference and temps almost uniform across the board. 49 degrees in the north bay, we're at 53 in san francisco. 54 to start the new day in the tri valley. on our way to comfortable temperatures by lunch time but still cool enough for a coat. so it's going to feel kind of like winter for one day only. we boost your temperatures back up as we head throughout the rest of the week. 63 in san francisco today and 68 degrees in the tri valley. let's find out what mike is working with. definitely more commuters. i noticed that on my way in. look behind you, it's back. >> we have a few more cars on the road a little more slowing. i want to point out the glow to the lights moisture in the air as christina is talking about. low clouds hovering around the bay. no problems or delays reported by fog but we'll track that as it continues to develop as we look at san jose area we also have a crash coming southbound. this is southbound 101 at brokaw

past the airport there. reports of at least two left lanes, the two center lanes blocked there. sounds like there's a crash that went into the center divide affecting southbound. not a lot of slowing shows up there, except right at the scene. northbound slowing 101 as well as 87 starting to build for the south bay. tuesday will show a heavier volume of traffic but schools throughout the south bay are actually off all week so we should see fewer commuters as far as surface street traffic and we may see less silicon valley traffic because many parents will take off during the week when their kids are off as well. still we'll have the backup might be shorter lived though. over here toward 101 southbound at embarcadero on the peninsula side. live look palo alto sorry not a live look. i've been tracking with my live camera and haven't seen anything. i'll show that to you coming up. over to the east bay and the tri valley looking at westbound 580, the earlier crash at vasco cleared to the shoulder. another one in the backup out of the olt month pass altamont pass.

some stations never even closed for the winter. about 300 recruits will aruf here for interviews in just a few hours for those job interviews that's narrowed down from about 1,200 applicants trying to make the cut. by the end of the process, calfire may add 20 to 30 positions in the bay area and about 120 statewide. the pressure is on to get the ball moving. with our recent gorgeous weather we could have an ugly fire season. >> staff worked really hard across the department to accomplish getting all of our hiring processes done even earlier so that we can get folks trained and get them out and deployed to the stations. >> reporter: now the drop made for a tough fire season last year and all of the rain that we got in december made things worse because the grasses were sprouting up and then they just dried out, so there's lots of small fuel. the calfire plan is to have the new firefighters ready to go by the start of april, which is several weeks ahead of schedule. calfire stations in southern
