in the capital of port-au-prince. someone on the float used a pole or stick to try to move the lines so the float could pass underneath t ending with a shower of sparks. 46 other people were injured as well. happening today, long stalled talks between dock workers and their bosses could reignite. live look at the port of oakland where business has come to a standstill in recent days but help is on the way. >> "today in the bay's" nannette miranda is joining us live from oakland. the president is sending the u.s. secretary of labor in hopes he can kick-start discussions. >> reporter: good morning. people have high hopes that the labor secretary can somehow broker a deal to end this labor dispute. tom perez is expected to meet with both sides today, with the shipping company's bargaining agent. the pacific maritime association and the international long shore and warehouse union, the last contract expired in july. negotiations are stalled on things like pay and arbitration

changes. the results are work slowdown. that has had a crippling effect on moving cargo through the west coast seaports from southern california to seattle, including oakland. the ports are a critical link to trade for nature's sun-grown foods. it has been really tough on them. profits are hurting. it hasn't been able to ship products to asia in a timely manner for months. >> we're afraid that if our products don't arrive in our particular countries in east asia, that our customers will have to find other sources. >> reporter: upping the an te over the past holiday weekend a partial shutdown took place. shippers locked out workers starting saturday saying they would not pay weekend or holiday wage premiums to crews they say are intentionally slowing down work to gain a bargaining leverage which of course the unions are denying. back here live at the port of oakland the ports are scheduled

to reopen at 7:00 a.m. today. you could see the truck drivers starting to line up, and of course, all this is happening just as the labor secretary is in town to try to end this month-long work slowdown. live at the port of oakland, nannette miranda for "today in the bay." >> thank you. it is 6:03. this morning the white house is vowing to fight back against a federal judge's ruling blocking president obama's executive action on immigration. the president's order would spare as many as 5 million undocumented immigrants from being deported. "today in the bay's" stephanie chuang here now what is next. good morning. >> good morning to you, laura. what is next, an appeal. the obama administration expected to file a stay within 24 and 72 hours and some legal experts argued the u.s. court of appeals for the fifth circuit would quickly suspend any order to stop the president's actions in deferring deportation and access to work permits and job benefits. the first part of this program was set to go into effect tomorrow. the judge in texas blocking the president's executive action

late yesterday. immigrant groups say this is a temporary setback they believe will delay the program from four to eight months, something they say will greatly impact people here in the bay area. >> on average it's estimated about 30% of those 5 million are in the state of california. in santa clara alone we were expecting to be able to provide legal services and benefits to approximately 70, 50,000 to 70,000 people just in santa clara county. >> the judge decided with a coalition of 26 states which filed a lawsuit back in december they argued that president obama overstepped his constitutional powers. obama's program was set to help undocumented immigrants who have not committed serious crimes who have been here at least five years and have children who are u.s. citizens or legal residents. we'll have to see what happens next. >> most definitely. so many people paying attention. thank you, steph. right now we're following some breaking news on the peninsula where a search currently under way for a missing boater near oyster

point. it's going on near the san matei bridge. the coast guard and a crew from the south san francisco fire department are searching for 22-year-old man who was on a canoe that sank overnight. there were two other people on that boat as well. woman who survived, and a man who did not. all three were wearing life jackets and jumped when the boat started taking on water. the man they're looking for was last seen wearing a blue life jacket. we'll keep you updated. in the east bay a gunman is on the run after a shooting last night. the shooting happened just north of highway 4 in bay point just before 8:00. two young women were caught you have in the gunfire and taken to the hospital. they are expected to survive. a convicted sex offender just released on parole will be back in court facing new charges. carlisle villazon is accused of molesting a little girl inside a 99 cent store in hayward earlier this month. in 2010 he was convicted of molesting a girl at a walmart in san leandro. he served time in prison and was recently released on parole when

this latest attack happened. >> a follow-up, classes are back in session today at an oakland middle school after a fire seriously damaged the cafeteriaover night yesterday. it appears somebody broke into the campus at claremont middle school before the fire was set. the fire caused about $1 million woer worth of damage to the rest of the cafeteria which will be closed for the rest of the year. there's no word on what started a brush fire off of 680 in san jose. year-round fire season could be the new norm now, firefighters warn. conditions were dry enough to catch brush on fire in the neighborhood south of barryessa. the goal is to get about 120 new firefighters trained and ready weeks before the official start of the fire'son. 20 to 30 of those new hires would be for the bay area. while the fire season usually starts around mid-april, crews say the drought guarantees an earlier fire season.

ramping up resources, in the meantime we'll check your microclimate forecast as we give you a live look outside right now. the bay bridge on this tuesday, and some cooler temps on the way here. >> not too bad at all out there this morning. christina? >> it's really actually a lovely morning. you can kind of smell the moisture in the atmosphere as you make your way out that front door. we start with a live picture of san jose, where it's hard to see right now, but we do have low clouds widespread across the south bay and up and down the peninsula. we're also getting that typical coastal fog this morning. as we head throughout the day today, this is going to stay put for much of the day. by lunch time, still dealing with an overcast sky and in between noon and 3:00 that cloud cover will clear but good morning to you hopefully you had a nice long three-day weekend. as we head throughout the day today onshore flow certainly back. 'not going to stick with us for long, though, and temperatures mostly in the 50s.

we're only upper 50s to low 60s by noon. tomorrow trading these numbers in for the 70s. 69 degrees on the south bay side of the bay today. 66 for the peninsula. tri valley is at 68 degrees and you're going to hit about 66 degrees in the north bay. now we have those king tides, should be the final round of the year. we'll talk more about that coming up in my next report, what drives these king tides and more importantly looks like we could be looking at more of this in our future because of sea level rise so stick around. that's coming up next. right now we want to send it over to mike, he has a traffic alert. >> that's right for the south bay this is not a major injury crash but it is a major crash effect for the freeway. let me talk about highway 101, the complete closure for the southbound side, that's major. here the south bay we don't see a lot of build but 101 is the first to show the slowdown. northbound commute slower than typical for a tuesday. all the activity closing southbound 101 closed.

all traffic diverted off of the freeway on brokaw. folks relatively familiar get over to first, just off of brokaw, take first to 880 and that will get you back up to 101 past the scene of the slowing that will cause more traffic. surface streets, 87 also a smooth drive through the area but keep this in mind, it's not a major injury crash but there is a truck that went into some fencing so they have to cut that out before they can clear that and the area as well. this is more complication. chp does not know when they'll have this cleared. this is a huge issue and 101 problems will likely ripple out to the rest of the freeways. meanwhile southbound 880 an earlier crash here as we move toward hay woord and union city a crash at whipple road caused more slowing and causing a backup there but nothing unusual for tuesday. the tri valley as we move toward dublin and pleasanton shows a build much earlier than yesterday. the crash west 80 at mcbride leaves one lane blocked and chp is changing shifts now so

they're changing crews as well. we'll get more updates. the slow lane currently blocked, slow coming into richmond but clear by the time you reach golden gate field. the bay bridge toll plaza you have the backup and metering lights on. we have most of your lanes full but the left approach is a little bit lighter and we will see that in the south bay since schools are off for the entire week but the east bay, these schools are in and so are san francisco schools so we shouldn't see quite as many folks off today. toward the north bay for san rafael, an easy drive. we have the build and the glow to the lights here. you may see that in watches throughout the bay, a lot of moisture, low clouds and potentially fog develop. we'll send it back to you. >> a return to normalcy today. 6:10 right now. still ahead an historic option for travelers out of aof. >> and historic court case out of silicon valley. i'll tell you everything you need to know. and how this car ended up in a south bay pond overnight. live look outside downtown san jose, a little bit of moisture in the air. we'll be back with more news,

i am an electric crew foreman out of the cupertino service center. i was born and raised in the cupertino area. it's a fantastic area to work. the new technology that we are installing out in the field is important for the customers because system reliability i believe is number one. pg&e is always trying to plan for the future and we are always trying to build something stronger and bigger and more reliable. i love living here and i love the community i serve. nobody wants to be without power. i don't want my family to be without power. it's much more personal to me for that reason. i don't think there's any place i really would rather be.

here's a look at today's top stories, 6:13. crews pulled a car out of a pond in sunnyvale this morning. investigators say just after 1:00 the car crashed into the pond on recommendington drive. one person was pulled from the car. we've not been told if he or she is okay. the labor secretary on his way to the bay area hoping to hammer out a deal to end the west coast port slowdown. for the first time ever nonstop flights to china will taking off from san jose.

hainan hopes to offer flights five days a week to beijing. the service could start by mid-june. the a respected security firm said it sound evidence somebody put spy software right into the software dna of computers and hard drives. >> scott mcgrew not talking a hacker virus but something for more serious. >> right at the manufacturing level, the software that controls things like hard drives down below the operating system, spying programs essentially so deep inside computers, you could remove the whole operating system and it would still be there. the security company kapersky is not naming the government that it suspects but says the targets are countries like iran, russia, and pakistan, which if you're having a little trouble reading between the lines there, are countries that the united states would spy on. venture capital firm kleinor perkins is headed to court to defend itself in one of the most

bitter court cases in silicon valley in decades. ellen pow says she was sexually harassed working there and sued for $16 million. in court papers, pao entered into an affair with a co-worker. after she broke it off she was cut off from the company's business and excluded from meetings. jury selection begins today in san francisco. only a jury will decide who is right and who is wrong but kleiner perkins has not settled, something we've usually seen in cases like this, because neither side wants to spill secrets in court. but this one is going to the mat. pao left kleiner perkins, has since become the interim ceo of this website readit, something that kleiner perkins argued should reduce any damages paid to her in that she left the company to make more money and enjoy for prestige n their words. this is one of three huge, major court cases that are making

right here in san jose. let's talk about the king tides because this is our third round of the year. we have flooding potential, bays, beaches, low lying areas. we are expecting some roadway flooding along the embarcadero. keep that in mind if you take a bike or walk to work. avoid the embarcadero. 10:02 we are expecting high tides. we have a prediction on this, more king tide flooding is actually expected by 2015 from the intergovernmental panel on climate change. they've got a really tough prediction for us, because of that global sea level rising, looks like that's going to be up to one foot additional to what we already have out there, that's enough to have high tides every single month and it can affect the landscape of the embarcadero and the san francisco coastline so that's something that we're watching for, has everything to do with climate change and sea level rising. the debate of course is over whether or not climate change is manmade or if it's something

that cyclical with nature. temperatures are nice and mild as we head throughout the next couple of days. wh9 to 71 wednesday into thursday, staying nice and comfortable in the south bay and in san francisco, getting just lovely days. you know what? mike has a traffic alert. we want to send it over to him. good morning to you, mike. >> good morning. i'm staying out of this shot to give you the live look from josh our photographer who made it out to 101. the flashing lights and flares are out but the better news is they just reopened all lanes of southbound 101. the flares were put out across the entire freeway. we had a closure because of an earlier crash. thank you, josh, we zoom in, flashing lights still over on the shoulder. a big distraction but the traffic at brokaw is moving once again. out to the maps we'll talk about what was going on, a crash so the rest of the south bay and silicon valley very nice but it is 101 at the airport that was really jammed up. we were looking at the southbound side but the northbound side which is typically your commute direction is also slammed by this big distraction and the flares

across the freeway so slow from story road up to the scene. it will take a while to clear up but the earlier crash a truck went into some cyclone fencing on the side of the roadway and they had to cut it free. no major injuries, just that slowdown. over here on the east bay we're looking at hayward southbound out of hayward in toward union city for 880, a slower drive. the earlier crash at industrial cleared off of the roadway and a typical pattern for that portion of the east bay. same thing tri valley toward pleasanton, livermore and dublin. no big surprises, south 680 slower drive. highway 4 slows through concord. the walnut creek interchange showing a build and the upper east shore freeway as we zoom in toward richmond west 80, the crash at mcbride is off to the shoulder, that caused a little bit early slowdown but nothing dramatic headed toward the bay bridge. the bay bridge toll plaza where the metering lights are on has your standard backup. live look out here in the lanes to the left approach are the

slow toast build in, a little unusual for a tuesday but a tuesday after a holiday folks might be easing back into the week. back to the san mateo bridge, westbound 92 a smoother drive, a nice view of the flat section but look, you can't make out that high-rise from the east bay side. visibility on the span is okay but it's indicating what christina is talking about, low clouds and potentially fog in many parts of the bay. we'll track it. back to you. >> search going on for a missing boater near the san mateo bridge as well. want to lose some weight? up next a simple way to shed the pounds safely.

at 6:23 some health headlines this morning. new study finds the symptoms of menopause may affect some women for up to seven years. we have known about the hot flashes and night sweats for decades but until now there's been little information about how long those symptoms last. want to lose a little weight, eat more fiber. according to a recent study showed not only did 30 grams of fiber a day shedded pounds t showed improvements in blood pressure and insulin resistance. you can already use your phone to help diagnose ear infections, monitor a child's blood sugar. silicon valley companies are creating more mobile health apps and getting more help than before. the health patch m.d. is applied to the skun and monitors the health and other health metrics.

>> technologies can bring the cost down, at the same time the patient is more comfortable. he doesn't have to go to doctor if he doesn't have to, and is very much instantaneous. >> a recent study found about eight in ten health clinicians say mobile apps will only grow this decade. despite all, this doctors remind us to talk to your diagnosis before using your phone to try to diagnose anything, sam? >> that sounds likewise advice there. thank you. 6:25. it can be tough enough trying to find an affordable place in san francisco. having a pet makes it harder. pet owners are getting pushed out of their apartment and can't find new housing with pet-friendly landlords. because of this, san francisco's spca is seeing a lot of people forced to surrender their dogs and cats. the spca advises giving potential landlords a pet resume, a summary of your pet's best qualities. a calcongressman wants to get pets on board amtrak trains.

"today in the bay's" tracie potts joins us live from washington, d.c., this morning and tracey, federal investigators want to know if the winter storm is actually to

blame. >> exactly. it swept through there, came here, dumped snow and frigid temperatures overnight and they're trying to figure out is that part of what caused this train derailment. as with many stories, the pictures here really tell the story that 300-foot-tall fireball that we saw that many people in west virginia saw when this train crashed into a home, fortunately no one was hurt, only one person in all of this was treated for respiratory problems, smoke inhalation. it was a fiery scene but one of the problems here is that more than 100 of these train cars were carrying crude oil and one of them crashed into the river, and so now there are concerns about the water and possible contamination there in west virginia. this is about 30 miles from charleston, in a rural area. there were two towns where some people had to be evacuated, about 1,000 people overnight were put in hotels and put in

shelters. they shut down two water supply facilities, just to be sure that that water is not contaminated. it's a problem that west virginia has seen before. remember last year, $300,000 people lost their water in nine different counties and now as a result of this fiery crash, they're checking again to see if the water is clean. >> now the poor people there in west virginia, thank you very much, tracie. the latest east coast winter storm right now is slowing down government business in washington from its already glacial pace. federal offices will not be open today because of a snow emergency. parts of the eastern seaboard may see up to a foot of snow. federal workers who can are being told to just work from home. it is 6:32 right now. taking a live look outside the port of oakland this morning, where hopefully talks will resume today. president obama sending the u.s. secretary of labor over there. >> secretary of labor thomas perez will be in-house trying to

kick-start those talks. >> going on for quite some time. in the meantime. >> in the meantime the microclimate forecast with christina loren, good morning. >> good morning to you. we have some change in the works for today. staying pretty nice out there for the first part of the day, temperatures will be cool. those clouds will make way to beautiful sunshine. going to tell you, though, five to ten degrees cooler than yesterday. you know when you adjust the thermostat in your home a couple of degrees definitely makes an impact. five to ten will be noticeable. 54 degrees, good morning to you san jose. hey oakland you're at 54. 54 for concord and kicking off the day at 49 degrees in wine country, santa rosa, our hillside still nice and green. we're going osee a nice reinforcing shot of moisture for today courtesy of the low clouds and a little bit of drizzle out there so you'll notice we have low clouds, widespread across the bay area today. only place you're actually seeing that clear sky from the highest peak, right up and down the coastline along the east

shore and into the south bay, definitely seeing some cloudy skies this morning. that's all going to burn off as we head throughout the day today but not until about lunch time. that keeps your temperatures down. let's talk about your day forecast for tuesday, back to work tuesday for many people. morning fog making way to afternoon sunshine. 59 degrees on the peninsula. 60 degrees on the east shore as you break for lunch so already noticing that difference by noon today and then we'll round out the day in the mid to upper 60s. 64 degrees on the east shore today. 66 is the high for the peninsula today and 69 degrees in the south bay. now we've been checking in with mike on the traffic alert. find out if we have an update now. good morning to you. >> i want to start with this live picture. this is our live picture 101 southbound around brokaw. josh, our foreon the scene talked me through it. this is the railing we know about southbound side. over here these are poles for this cyclone fencing. what happened was a ryder truck,

a box truck, moving truck came off of the roadway, took out the fencing and poles and made their way back through to southbound 101 and ended up over here where all the flashing light are at the top of the screen. that's why they still have the slow lane closed. sounds like a dramatic scene but no major injuries and just one lane closed. the rest of the freeway reopened. back to the map the big backup has cleared south of the airport. the northbound side as we widen out our shot for san jose you do see a typical pattern for the slower drive really bogging down at 680 and heading up toward 880. 87 and 85 show a build, the typical pattern but lighter than normal. lot of south bay schools are off this week so we'll keep that in mind for surface street traffic especially. the orange that crept into the shot as well as moving up in toward the tri valley fog is registering on our road weather index, that he's our weather and traffic systems tied together. traffic westbound 580 moves smoothly and earlier crash to the shoulder not much of a

complication into the rest of the tri valley. south 068 shows a build and so does 880 south hayward and union city typical pattern there. the upper east shore freeway slower drive westbound 80 through mcbride through richmond. an earlier issue is sticking out into the slow lanes. consider the slow lanes stopped up, causing the backup from hercules, highway 4 toward richmond. bay bridge toll plaza the metering lights are on. across the bay looking at san rafael, 101 southbound picks up the volume a little. low clouds but not a fog situation, you're okay to the golden gate. with greece possibly on the verge of a euro exit markets could be jumpy. >> let's check the numbers with scott mcgrew. >> jumpy is about now, the dow industrials losing about 33 points, we're back to work now 42, we're back to oh after that presidents day or washington's birthday, but yes we're watching greece as they meet in brussels

very carefully. we're also looking at apple. apple talking about releasing that new apple watch. the "wall street journal" says that the apple watch may not have as many health features in it as first scheduled, this because apparently apple had some trouble getting them to work perfectly. also it could expose apple to some sort of regulation because health devices are specially regulated but apple watch coming out in april. we're getting closer and closer. 6:37 right now. still ahead an unwanted show. why a movie theater is getting an earful from people who never paid to see "fifty shades of grey."

prosecutors are expected to rest their case today in the american sniper murder trial. prosecutors showed a video of eddie ray ralph confessing to police he shot chris kyle and his friend chad littlefield. kyle inspired the movie "american sniper." ralph pleaded not guilty by reasons of insanity for the 2013 shooting deaths at a texas gun range. a south carolina college is apologizing after a teacher hand the out m&m's in per skripg pill bottles to little kids during a fun run. the labels read "happy pills" and instructed to take one m&m every two to four hours. parents say it confused children about the dangers of taking the.

ilz from pharmaceutical bottles. the school is calling the decision a mistake. opening weekend for the film "fifty shades of grey" included some unwilling viewers. the movie is being shown at a drive-through movie theater in sacramento off of highway 50. drivers could clearly see the r-rated movie and the theater is next to a go-kart track filled with families during the presidents day holiday. >> i don't think it should be on a big screen tv out in the middle of public to where anybody could turn around and see it. >> maybe not many parents idea of the birds and the bees there. the manager of the theater says he's moved a screen so it's not visible from the freeway or from the track. >> turn away, little one, turn away. coming up, gearing up, what calfire is doing to make sure it's ready for an early and dangerous fire season. an update to breaking news, chaos at carnivale.

breaking news out of haiti this morning. power line fell on a parade float there, electrocuting at least 20 people. this happened early this morning during carnivale in the capital of port-au-prince. witnesses said somebody on the float used a pole or some kind of stick to move the line so that the flow could pass underneath it, ending with a shower of sparks. 46 other people were injured as well. >> frightening for them. 6:44 this morning. the white house is vowing to

fight back against a federal judge's ruling blocking president obama's executive action on immigration. the president's order would spare as many as 5 million undocumented immigrants from being deported. "today in the bay's" stephanie chuang joins us now more. what's next, steph? >> good morning, laura. what's next an appeal by the obama administration as you might expect. the president has said that his hand was forced after congress failed to pass immigration reform. his executive action was set to offer work permits, job benefits and protection from deportation to undocumented immigrants specifically those who have not committed serious crimes, have been in the country for at least five years and who have children who are either legal residents or american citizens. local immigration groups are calling this a contrary setback but one that impacts up to 70,000 people in santa clara county alone who were counting on this program part of it was slated to go into effect tomorrow. >> very important that the community does not lose hope. very important that people understand that this is

62 degrees meanwhile at noon in the tri valley, 60 degrees in the north bay and we'll round out the day in the upper 60s but noticeably cooler than where we ended up yesterday about ten degrees cooler to the north bay today at 68 degrees, down from 77 yesterday. so here's the deal. as we get into the next couple days, temperatures stay steady. we'll see patchy morning fog tomorrow, not expecting widespread low cloud cover and as a result temperatures were warm. friday into the weekend a little bit of change coming your way. we'll boost numbers up friday through saturday with temps maintaining in the 70s. south bay is at 70 degrees on saturday. the peninsula at 71 degrees and 69 degrees in the tri valley. we'll shed a few degrees off on sunday, also bring in more cloud cover, as an area of low pressure sneaks up from the south and this could actually provide us with a very slight chance for showers. we're looking at this, 25% chance as we head throughout late sunday into monday. we'll take whatever we can get beyond this. i am tracking another system it's just too far out right now

to tell you whether or not it's going to rain for sure. but as long as we continue to see these systems develop out in the pacific ocean, it's a good sign for us and we still usually get significant rainfall in the months of march and april. so we'll keep you updated. right now he's keeping you updated on the traffic alert. mike inouye we welcome in. >> first of all mentions for the weather we have low clouds hovering around, maybe a fog issue for many spots. i couldn't show you west of the toll plaza toward the bay bridge and treasure island, where there are reports of a smoking vehicle on the eastbound direction, that should be the lower deck getting out of san francisco. i'll track that but i don't see any slowing yet. we see a backup at the toll plaza. the lanes off to the left approach very light coming off the maze. no incidents reported the stretch off of 24 and 580. i'll track it carefully. the fast track lanes have the most track here. out to the maps we're talking about down the east shore freeway as well. there's 580 coming off of the maze and looks luke a good volume of traffic but then it

dissipates at the maze itself. westbound 80 through berkeley, a distraction causing more slowing. it's a smooth drive, a little bit lighter because we're after a vacation monday, this is easing back into your commute. the crash at mcbride leaves one lane blocked westbound. this is not bad considering one of your upper east shore freeway lanes is blocked for west 80. crash southbound 101 at lucas valley road causing a distraction and slowing headed toward san rafael. south of there everything is all clear. i want to show you the rest of the flow of traffic for the south bay. northbound routes showing you typical pattern for tuesday but a little bit lighter and a lot of south bay school districts are off this week that will affect your volume of traffic. let's check with josh our photographer right there, 101 southbound as we're looking over here, one slain blocked at brokaw. we had all lanes earlier closed but now just one is closed. because this truck took out the fencing, took out all of this fencing and went back through more guardrail and continued down the roadway for a bit.

no major injuries but the flares are a distraction enough for the northbound side to wonder what's going on as well. back out to the maps why we see the slower drive northbound drive headed past the airport. the rest of the peninsula and bay shows a typical build, hayward slowdown as well as the tri valley no, major problems. san mateo seeing more traffic coming over 92. back to you. >> a little hazy out there, hopefully not affecting the breaking news on the peninsula. search is under way for a missing boater near oyster point, going on north of the san mateo bridge. the coast guard and crew from south san francisco fire department are looking to are a 22-year-old man who was on a canoe. it sank overnight. there were two other people on board, a woman who survived and a man who did not. all three were wearing life jackets, and jumped, when the boat started taking on water. the man they're looking for was last seen wearing a blue life jacket. happening right now, the president is sending u.s. labor

secretary thomas perez to the bay area to mediate discussions between dockworkers and their employers. live look at the port of oakland this morning as we expect to see some renewed activity. >> "today in the bay's" nannette miranda live in oakland this morning and nannette, in the meantime, more than two dozen ports up and down the west coast are expected to reopen? >> reporter: that's right, at any moment now people have high hopes that somehow the labor secretary can broker a deal to end this labor dispute. later on today in the bay area, secretary tom perez is expected to meet with the shipping companies bargaining agents, the pacific maritime association, and the international lockshore and warehouse union. the last contract expired in july. negotiations are stalled on pay and arbitration changes. the results a work slowdown. that has had a crippling effect on moving cargo through the 29 west coast seaports from san diego to seattle, including here in oakland. the ports are critical to trade so it's crucial to end this

dispute. upping the an te this past holiday weekden was a partial shutdown of the ports. workers saturday saying they would not pay weekend or holiday wage premiums to crews they say are intentionally slowing down gain bargaining leverage. the unions deny they are doing that. back here live in oakland the trucks are beginning to line up here as they expect the port to open at any moment now. again this is the same day that secretary perez will meet with the two sides. of course, with the eminent reopening of this port and the shutdown, partial shutdown over, there's the issue of the work slowdown. fingers crossed that the secretary can somehow get the two sides to work out a deal. live at the port of oakland, nannette miranda for "today in the bay." >> welcome sight to see the trucks moving. thank you, nannette. in the east bay a gunman on the run after a shooting last night. detectives say the shooting happened just north of highway 4

in bay point around 8:00. two young women were involved in the gunfire, taken to the hospital. they are expected to survive. >> a convicted sex offender just released on parole will be back in court today facing new charges. carlisle villazon is accused of molesting a girl inside a 99 cent store earlier this morning. in 2010 he was convicted of molesting a girl at a walmart in san leandro. leandro. he served time in prison and recently released on parole when this recent attack happened. a follow-up, you remember the blazing images from yesterday. class will go on at scheduled too for students at an oakland middle school damaged by fire. yesterday's early morning fire caused about $1 million worth of damage to claremont middle school. the flames were mostly contained just to the cafeteria and nobody was hurt. students meantime did have the day off. investigators are trying to determine if that fire was intentionally set. this morning, calfire interviewing hundreds of candidates preparing for the possibility of an early fire season.

"today in the bay's" kris sanchez live in morgan hill where the fire fighting hopefuls will be arriving any minute. >> reporter: good morning to you, laura. they will begin interviews around 7:00 this morning, though we have not seen a flurry of people arriving, maybe because they're pre-selected. but we are expecting to hear there could be an early start to what could be an explosive fire season here in california. about 300 recruits will arrive for interviews in just a couple of minutes, that's narrowed down from about 1,200 applicants who were trying to make the cut. by the end of the process, calfire may add 20 to 30 firefighters in the bay area, about 120 statewide. the pressure is on to get that ball rolling, because of the recent weather could make for an ugly fire season. >> staff worked really hard across the department to accomplish getting all of our hiring processes done even earlier so that we can get folks trained and get them out and deployed to the stations. >> reporter: so by now we know that the drought is in several

the case is closely watched. it will no doubt be one of the more historic silicon valley cases as carefully watched as apple versus samsung and the cases against google, intel and other companies trying to quash silicon valley salaries. the other thing we're watching, kapersky detected malware in hard drives and other computer components manufactured by a variety of companies placed there by a third party. the kind of malware that can supply on a computer right in the software dna below the operating system. kapersky, a russian firm, says it's one of the most sophisticated software malware it's seen and doesn't point fingers as a policy. it says it's similar to stuxnet used to destroy iran's nuclear centrifuges. nobody is claiming responsibility for that, but i think you can do the math to figure out who it may have been. >> some world superpower possibly. >> with three letters.
