a very good thursday morning. thank you for joining us. i'm sam brock. >> and i'm laura garcia-cannon. develop right now, gunfire at a south bay sports bar left two people in the hospital as investigators search for suspects. >> "today in the bay's" rob redell live from dvo sports bar and bob what do we know? >> reporter: good morning to you, looking inside the windows of the dgo sports bar in san jose the place is exactly as it was at the time of the shooting. bar tables littered with beer bottles and a large pool of blood in the very back of the bar, where at least one of the two men were shot at around 10:00 last night. again this is an establishment in east san jose on alum rock between white and capital. both men's conditions aren't known. police are not saying what they believe led up to their being shot. we know they temporarily the

officers temporarily detained several other men outside the restaurant, searched at least one of them, possible some or all were witnesses to the shooting. they were all eventually released and police tell us they do not have any suspects in custody. two men shot both at least once. reporting live in san jose, bob redell, "today in the bay." >> thank you, bob. it was a deadly case of mistaken identity. 21-year-old joe ramirez was shot outside of his home back in december. yesterday police announced that the shooter was actually after somebody else. someone involved with the marijuana grow operation in the house next door. investigators hope a $25,000 award will lead to a break in the case. a man vobd a robbed the cvs

earlier this month and a security guard tried to stop him, that's when the robber hit the security guard with a skateboard and took off. a teenager accused of raping a pizza delivery driver will be back in court. 17-year-old darian myles jr. kidnapped and raped a woman while she was delivering a pizza in antioch. myles jr. was already on probation for another crime when police say he attacked a driver. >> a santa clara university student accused of stabbing his roommate inside their dorm is headed to court today. officials say he may enter a plea. police say dylan kim stabbed his roommate tuesday and cut himself. the roommate is recovering. investigators have not said what led up to the stabbing. she had a baby and bolted. investigators are asking for your help tracking down a missing mom. 30-year-old jeanette hara gave birth and walked out of the hospital leaving her newborn behind. all this happened in 2012.

she's not been heard from since. a "today in the bay" follow-up to a story we told you about yesterday. we're now hearing directly from the san francisco priest who had teachers hand out inappropriate pamphlets to young children. >> inappropriate. we didn't think that one closely. the question of marriage, for example, he has always been clear that marriage is between one man and one woman, that homosexual acts are intrinsically evil. >> father joseph aislo regrets giving the pamphlet which mentions several sexual topics including abortion. a key white house player is going to visit the bay area today and a push to improve public housing here. housing and urban development secretary julian castro will visit san francisco and oakland. in san francisco he and mayor ed lee will discuss the latest efforts to improve affordable housing opportunities. castro will go to oakland for a roundtable discussion with young minorities.

children will be paying more to ride the golden gate ferry or maybe their parents. the change to the qualifying age limits for youth fares, right now any passenger 6 through 18 gets a discount and the proposed change would make 5-year-olds pay as well. >> tainted medical equipment may be to blame for a deadly superbug at the ucla medical center. nearly 200 patients were exposed to a bacteria, seven people infected, two people died. health officials say the bacteria likely passed from a device inserted into patient's throats during endoscopic procedures. >> this is not like the measles. it's not going to jump around from neighborhood to neighborhood. people aren't going to give it to each other, only if you got that scope procedure, otherwise you don't have to worry. >> disconcerting nonetheless. the exposure between last october and this january. potentially infected patients

have wrecking machines ready for demolition waiting outside in the parking lot. the idea of an implosion was mixed after community concerns about noise, implosion, and health concerns. $200 million project, 500,000 square foot development with restaurant village, movie theater and shops. it is set for completion by the end of 2017, part of the area wide project is the san francisco shipyard that's a residential development. construction of the initial 300 homes began over a year and a half ago in hunter's point so a lot of changes already starting. you know there's a demolition job construction work as well but we're also talking about permanent jobs coming here to the area. we'll have more on that coming up in our next report in about half an hour. live in san francisco, stephanie chuang, "today in the bay." >> it's a perk, you can say i'm living where the beatles first played in the u.s. >> yes, exactly, you're on

historic ground. stephanie in the middle of a darkened shot but there will be a lot of activity later today. thank you. we're waiting for the sun's arrival this morning, hopefully warming things up. let's check the microclimate forecast with meteorologist christina loren. >> good morning to you laura, everybody at home. happy thursday to you. some drizzle out there and low clouds, widespread 50s, a nice sunny afternoon, a few 70s in isolated inland valley spots and the clouds will return as we get into your evening. your sun will set at 5:53 so our days are getting longer as we get closer to the arrival of spring, that's march 20th in case you're wondering. day part forecast for today, temperatures mostly in the 50s to start with the exclusion of the north bay, starting out at 49 degrees by lunch time today, beautiful conditions, skies starting to clear in the tri valley, you'll be at 63 degrees at noon and 61 degrees in san francisco, rounding out the day

in the upper 60s to low 70s, so just a beautiful finish to the day, and a little bit warmer in some spots like the tri valley at 71 degrees today. 64 in san francisco, and 70 degrees in the north bay. we want to talk about those king tides, final day but definitely high tide at 11:47 over seven feet yet again so watch out for that flooding, bays, beaches, low-lying areas and of course we're going to talk about some of the trouble spots as we head throughout the morning together, plus oh my goodness, we've been doing our research in the weather department. tons of weekend events for you and the family, many of which are free, getting into some of those museums. we'll talk about that coming up. the right now check your drive, say good morning, happy thursday friday eve, mike inouye. >> happy friday eve. i've nudged this shot in dublin over closer to our camera and lower on the skyline where you see it's low clouds, not so much fog right here in dublin, but look at your maps. we're talking about 580 through the tri valley and you may encounter a patch or too coming

out of the altamont pass. low clouds registering everywhere we see this kind of orange highlighting. no drama at the interchange for 580/680 and we'll look to the north we see more fog registering for discovery bay or low clouds, brentwood, coming off of highway typical slowing through antioch, no big deal there. just north 780 eastbound at southampton crash activity out of lanes connector between interstate 80 and 680. novato to the left side another patch of low clouds from the north bay but no problem through san rafael. as we move our map down to the south bay, san jose, silicon valley moves smoothly. orange at the bottom of your screen so you may catch a lull bit of cloud cover, maybe some mist and drizzle coming over the santa cruz mountains. keep that in mind for highway 17, we'll watch as that continues to creep around. palo alto live look 101 moves nicely but the glow to the lights and top of the screen, low clouds hovering all around

for iranians excluded from courses at one major university. yesterday we told you about this story from the university of massachusetts at amherst. it was planning to ban iranian nationals from its science and engineering programs. the reason? concerns about contributing to iran's nuclear technology. students there were outraged. the school now says it's doing an about-face after getting advice from lawyers and the state department. yesterday you see president janet napolitano announce the system will not implement any tuition hikes until the fall. the hikes could have been as large as 5%. the increases mikt not happen at all if the university receives money from the state. google companies got some cloud no doubt about it but now gearing up for a fight against the fbi. >> google thinks the feds are pushing for too much power in all things search. >> certain warrants in this case. google, laura, has objected to a filing by the justice department which wants to expand the power

of a search warrant, allowing a judge to authorize a search anywhere on any computer. right now, if the feds want to see some data they need a warrant issued by a judge who can only issue a warrant for the computers in his district. think about that, that makes sense in legal tradition, right, a judge in new jersey can't sign a search warrant to search your house in california so why should he be able to write one for your computer? the fbi says in this day and age it needs the power to get a certain warrant to certain any computer anywhere. google is fighting that idea both in the court of law and in the court of public opinion. its top lawyer writing an open letter that says that kind of power would allow the fbi unlimited power all over the world. speaking of unlimited power, let's turn to cnbc and what reporter do we have today? oh it's landon, good morning, landon. >> hey, scott, good morning to you. i have to ask you real quick, i can't see you but did you get

moments. this morning temperatures are nice and mild, mostly in the 50s. couple 40s out there, 49 degrees in santa rosa, 52 in concord to kick off the new day. sunny and unseasonably warm, that's the weather story of the day. more cloud cover to start this morning than what we experienced yesterday but those clouds will make way to bright sunshine. as of lunch time for some of us, you're going to be socked in with fog probably until 3:00 in the city by the bay. temperatures if you want to head outside for lunch, mostly in the 60s. we'll round out the day in the 70s, beautiful day for the south bay. north bay 66 on the east shore for today and a comfortable day shaping up for you in the tri valley at 71 degrees. so here is the deal. i promise you some weekend events, it is the final weekend, sunday is the last day for those free daily tours of tulip mania, pier 39 in san francisco, just spectacular color out there, great for a photo shoot, a nice walk maybe with a loved one. 64 degrees for today.

you'll be up to 67 friday and temperatures in the upper 60s saturday into sunday also palace of fine arts community day, this is saturday. temperatures will be comfortable out there at the palace of fine arts, if you have not checked it out before it is spectacular. i can tell you free admission, hard to beat that. couple more free events happening, we'll tell you those as we head throughout the morning together. when we meet next week temperatures will be a touch cooler. we have a chance for shower activities as we head throughout the 27th of the month, starting to look good and towards the first week of march looking really, really good. i can tell you our pattern might just change entirely so stick around. more on that coming up. welcome in mike inouye. >> good morning, christina. looks like our pattern for traffic is holding standard for a thursday. looking out toward san jose, not the lighter traffic, that's what you always see but look at the top, you can't see parts of the overcrossing 280/680. low clouds hovering around here. look at your maps talking about

san jose, silicon valley and your traffic flow northbound is where the camera is moving nicely but the low clouds could be an issue for the southern portion of the south bay. looking over here, los gatos range here, highway 17. the orange highlighting here as well as morgan hill low clouds, potentially fog vasion situations coming other the hills and out of the south bay commute. the tri valley shows you fog and low clouds registering out of the altamont in toward livermore and dublin. smooth drive for 580, low clouds through discovery bay and brentwood. no problem from vallejo and the north bay toward the upper east shore. left side of your screen shows more orange highlighting for novato in towards san rafael, a smoother drive despite the low cloud cover in parts of sew llano county. couple of cash lanes are backing uhm, the low clouds as we reverse our angle from emeryville the low clouds horg over the city as well so keep that in mind. back to you. >> thanks, mike. time right now is 5:21. coming up next it's not

jerome kersey passed away. the cause is still unknown. kersey played 17 seasons in the nba, 11 in portland. he was only 52 years old. >> sad story there. 5:24. the man best known as screech in "saved by the bell" will be in court. his real name is dustin diamond. police say he stabbed a man in wisconsin christmas day, after diamond and his fiance got into a fight with some people at a bar. he pleaded not guilty. seven dogs missing after two men carjacked a doggie day care van in chicago. one of the armed men told the dryer to get out of the van. the doggie day care owner thinks the carjackers were after the van, not the dog. since the van was not marked with the company's logo. >> dogs barking probably not inconspicuous as you try to make your get away. a north texas woman got a

suspect yet but we know they temporarily detained several people last night outside the dzo sports bar and nightclub where two people were shot. if you're not familiar the business is located in east san jose on alum rock between white and capitol. the shooting taking place around 10:00 inside the establishment. two men were shot each at least once according to police, both taken to the hospital, conditiobp$fñunknown and just peeking inside the windows, the place is exactly as it was at around 10:00 last night, with unfortunately one large pool of blood in the back. officers forced several other men, possibly witnesses to sit on the sidewalk in front of the sports bar. they searched one of them. police won't say how helpful the possible witnesses were in figuring out what led up to the shooting. no suspect or suspects in custody as of yet. reporting live here in san jose, rob redell, "today in the bay." >> we will be following back up with you lsshortly.

this morning two men are in the hospital with life-threatening injuries, the men were standing at the intersection of 17th and capp streets in the mission district about 7:00 last night when the men got into an argument with another man who pulled out a handgun and opened fire. no description on the gunman. the mysterious death of a gilroy man earlier in the week being investigated as a murder. the victim has been identified as 56-year-old robert heiser. officers were called to his house early monday morning on reports of a loud noise and heiser was pronounced dead on scene. yesterday officers released this surveillance video from a convenience store in san jose. what's the zmex police say these two women were spotted using heiser's credit card. they're now persons of interest in the case. >> can't come into speculation how they came into contact with the credit card but they're persons of interest and we'd like to speak with them and identify them. >> police don't know where the victim would be targeted. heiser lived in the home for

nearly four years, went to santa clara university and has older children and grandchildren. >> 5:31. to an investigative unit exclusive. power struggle is brewing over a pot tax in the south bay. the city of san jose wants pot shops to pay up. owners of the marijuana businesses say the city has it all wrong. tonight we investigate the growing controversy over millions of dollars in unpaid taxes by businesses operating right now in the south bay. >> are you worried you're going to be put out of business? >> no, why would i be worried? i'm the only one that seems to understand the concept. >> what's your message to these businesses? >> pack up, time to move on, and pay up on your way out. >> are you worried the city is going to come and lock your doors? >> you know, it's been ajébñ co" five years ago. >> there's more than $2 million in unpaid marijuana taxes and penalties in san jose alone. tonight at 11:00 here on nbc bay area, chief investigative

reporter tony kobalesky covers the controversy, the battle over money and semantics. 5:32 right now. temperature drops going on across the country. our definition of a temperature drop is a smidge different than maybe what it might be in nashville but still some changing conditions out there, christina, good morning. >> we have a beautiful day shaping up in the bay area and warmer weekend coming your way. good morning to you. we want to start with the live picture of san jose, overcast sky to kick off the day, typical for this time of year. we typically see the morning fog making way to beautiful, sunny afternoons and i can tell you, today is going to be a little bit warmer for most places than where we ended up yesterday. mild morning temperatures in the 50s. as we get into the afternoon more 70s on the map than yesterday and the clouds will return tonight. your sun will set at 5:53 this evening. so with the return of those low clouds as we head throughout the evening, tomorrow morning count on another round of drizzle and fog. as we head throughout the weekend look at where we're

headed, the south bay at 71 degrees, abundant sunshine for you saturday, 69 degrees on sunday. for the peninsula this weekend, just spectacular conditions in the mid to upper 60s. san francisco looking good to hit the mid-60s. you're going to get more sunshine in the city on the ocean side of the city than what we're expecting over the bay. 69 degrees in the east shore area for saturday, and just a touch cooler for sunday. as promised, we are tracking a significant opportunity for showers as we meet back here next week starting on wednesday so keep that in mind. it's going to be really, really nice to see the return of rainfall, and then i'm really always watching 15 days out for you, so the first week of march also looking really good for some action. that's our next shower chance, as we head throughout the morning hours i'll show what you that looks like on our futurecast so stick around. if you're looking for something to do this weekend a couple of big events. thursday into friday, temperatures mid-60s, final week of tulip mania, really beautiful

so. it hasn't been above freezing. take a look behind me, it's been so cold for so long that the symphony center, the fountain here is still rubbinning but sly freezing over, turning into an ice statue. dusting of snow combined with ice, they've been dealing with power outages. the good news is it's going to warm up, it might be in the 20s tomorrow, woo hoo, that will be great. the bad news, it will bring more snow and ice so they'll be dealing with that through the weekend. it's supposed to warm up by the end of the weekend, get back to what it normally is here in nashville, in the 40s, 50s, but there's a lot to thank yw out a lot of things they're dealing with, the kids out of school and will be through the weekend, and as you talked about, this is a situation millions across the region are dealing with. it's just going to continue to be a tough go for a while, kris christina. >> i bet they're looking forward to the 20-degree reading but

creating some confusion here in the bay area. >> the injunction issued by a judge this week is stopping the efforts of many bay area immigrants who even seek information about changing their status. meeting last night in santa clara county was supposed to inform immigrants about political scams but look at that. the meeting was empty. experts say the ongoing limbo is leaving many confused. >> i don't know if it's going to pass or not or we have to fill it out right now or we have to wait, you know, so that is confusing. >> now this injunction there's a rumor out there or belief that everything's been suspended and revoked, that the law's over, there's no point in applying. >> some believe the holdup may provide a new angle for scam artists targeting immigrants desperate for help. immigration officials say the best advice is to wait until everything shakes out. a state senator is expected to introduce new legislation today repealing personal belief exemptions that to this point allowed parents to opt out of vaccinations. meantime on that topic, u.s. senator barbara boxer of

california injecting herself into this debate over measles vaccination. she appeared yesterday at a head start program in emeryville where the vaccination rate there is 100. her message to parents, vaccinate your kids or have them home schooled. >> vaccines are one of the greatest public health achievements of the 20th century. they have saved hundreds of thousands of lives according to the center for disease control. they are safe. they are effective. >> the senator is pushing a new bill requiring all preschoolers in federally funded head start programs to be immunized in order to qualify. 35:45 more details now, new evidence seems to point to the philippines as the source of the disneyland measles outbreak. state health leaders say the california virus shares the same genetic material as the virus found in the philippines. me see measles is a big problem in that country. doctors there treated 50,000 cases last year. 110 of those patients died.

suit against kleiner perkins, not a lot of money for that company. >> it is a fraction, sam, of a fraction of the kind of money that kleiner perkins deals with. leaders there are angry over accusations their firm has been accused of sexual harassment of one of its former employees. the case has gone to trial. jury selection begins soon but today we're seeing some of the first court filings. kleiner perkins showing off some of its strategy into these papers, including the plan to show some of the e-mails written by plaintiff ellen pao. she says she was ignored and denied opportunities after she cut off an affair with one of the company's executives, cut out of meetings or asked to take notes in meetings. the treatment of women of course a huge issue in silicon valley. new reports say uber is looking for more funding. uber is flushed with cash. why do they need more money? some analysts wonder if it's because their rival lift does need money and uber is looking
