both bridges and around the bay smooth traffic as well. you might get caught with a gust of wind but not a big deal like yesterday. investigators still on the scene of a deadly caltrain crash on menlo park. an suv got stuck on the track because of traffic. the driver died. the driver has not been identified but traffic kept her from getting off the tracks when the train arrived. >> it's just a basic fundamental rule don't stop across the tracks, don't start across the tracks until you're sure you can get across. >> the train was going about 80 miles an hour. there were 400 passengers on board. none of them were hurt. late last night another person was hit by caltrain. train killed a man in the tunnel south of san francisco, no word on why he was on the tracks. in morgan hill the driver of

this truck ended up stuck on the train tracks. the impact sent his truck flying. union pacific officials say the man drove around the crossing arm. the family says the truck stalled. a san jose woman connected to a crime spree in the south bay will be in court on murder charges later today. 19-year-old gabriele laortiz and another woman using heiser's credit card at a convenience store. investigators say this is another picture of ortiz. last week a man said he hired her through a prostitution website. when she got to his freeh month house investigators say she drugged him and left four men in the victim's house. the men beat and robbed him. a disturbing case of animal cruelty. they found a dead miniature

pinscher puppy friday. someone placed both dogs in a sandbag and threw them from a moving car. shelter workers are now treating the surviving dog. >> if you are in san jose or another city, every joors duction has an animal shelter that's willing to take animals unwanted. who abandon them along the side of the road. >> whoever is responsible for the crime will likely face felony animal cruelty charges. berkeley could become a no drone zone. it would last about two years. many local governments have been krut sn scrutinizing drones over privacy concerns. the sheriff's office is asking for approval to purchase a cell phone tracking system which allows the person to track all phones in a specific area. sheriff's office wants to use it to catch criminals but some legal experts have concerns about privacy. police are already using the technology in san jose, oakland

and fremont. and shocked full of hot button issue action immigration on the agenda for the santa clara county board of supervisors this morning. it will discuss whether to fund legal services for undocumented immigrants in the county, potentially eligible to stay legal in the u.s. under president obama's executive order. texas judge halted that order last week but the administration is appealing. meantime the immigration debate in congress may cause the department of homeland security to run out of funding. the senate could not pass a bill last night to fund the department because the bill also contained limitations for president obama's executive order on immigration. some bay area business and community leaders are calling for better late night transit options. the working transportation group said people who work nights or party late in san francisco need better public transit options. b.a.r.t. and caltrain stop before 1:00 and bus something

santa rosa, a little patchy frost to start the day. we'll warm you up nicely 3 to 5 degrees and continue as we head throughout wednesday and thursday and getting into friday, big pattern change on the way. it's really pretty out there. lot of those cherry blossoms starting to bloom and seeing plum blossoms, the sign of spring. cold start, mild finish. temperatures in the 60s as of lunch time. we were in the 50s at noon yesterday and we'll round out the day in mid to upper 60s. i'll time out the area of low pressure with showers coming up in my next report. good morning, mike inouye. >> looks like we timed this perfectly. take a look at the screen bottom right above where it says "nbc bay area" this is what goes on when crews clear construction. the cones are picked up by hand with other trucks escorting them. that's why we ask you to slow for them. be careful, just about cleared

as you are facing away toward the san mateo bridge. same section with the arrow is westbound. eastbound just a little yellow there, there may be another crew clearing lanes. i think they only had one close overnight from the peninsula to the east bay, that should be picking up as well and south 84 the dumbarton bridge clear, no overnight crew there is. anywhere north of the san mateo bridge we see a smooth flow of traffic. highway 4, no lanes blocked, a smooth drive off the carquinez bridge and bay bridge. to the south bay the silicon valley the peninsula no slows or delays. we'll get a live look at 580 the dublin area westbound shows a good volume of traffic, this is almost always here even at 4:38 in the morning, this is westbound out of the altamont through dublin and the dublin interchange. an easy drive, construction at hacienda in the eastbound

a very good tuesday morning to you. dark look at san jose this morning, waiting for the sun's arrival. no clouds out there. that means a cool start as well. we'll check the forecast coming up. 4:43 right now. happening today a decision that may lead to lower gas prices at the pump. california's board of equalization will need to consider reducing the gas tax by 7.5 cents per gallon. if approved drivers won't necessarily see any change in gas prices because suppliers are notúé%i to pass that savings on to consumers. kaleicalians pay about 54 cents per gallon in taxes.

google is timing up with a major cell phone company in the hopes of keeping up with bay area based apple. >> for more on that and the rest of the news before the bell we turn to landon dowdy live at cnbc world headquarters. good morning, landon. >> hey guys, good morning to you. google is keeping up with at&t, verizon and t-mobile to get people to use its mobile payment service instead of apple pay. it will be installed on android phones, currently you have to download and install the google wallette app. tgi friday's is bringing back its popular endless appetizers. are between $12 you can have mozzarella sticks and buffalo wings. analysts say it's an easy win for fridays as apps cost less to make and typically paired with popular drink orders.

>> why wait until friday, landon? >> thank you very much. crucial pairing there. some amazing video now out of south korea this morning. two people disappearing into a sirng hole while jusink hole wa down the street. the concrete tiles just collapse beneath them. firefighters rescued that man and woman and both victims suffered just minor injuries. >> frightening. 4:45, new this morning rescuers in florida worked into the morning hours to free a pod of manatees from a storm drain. you heard that right. wildlife rescuers and firefighters pulled 19 manatees out of a drainage pipe. crews loaded them onto tarps and released them into safer waters. the fire chief says cold weather causes manatee pods to come into canals in search of warmer weather. they're so large, they can get stuck. >> that is a very large mammal. 4:45 right now. i'm getting a nod from our

stuff but this definitely takes the cake. >> this is beyond words. happened south of tampa, florida, yesterday. the boat carried seven people. witnesses say it was speeding in some dense fog when it slammed into a crowded restaurant. other than a few terrifying moments no customers or passengers were hurt. investigators are trying to figure out the speed of the boat and if they'll file charges. >> had to go through all that sand. a chicago college student faces several sexual assault charges this morning for something he claims was just a "fifty grades of grey" re-enactment. the victim told investigators the encounter began as consensual but took a violent turn. the 19-year-old university of illinois student reportedly tied up,6jur blindfolded and used a to beat a female student. then investigators say he sexually assaulted her. she said she asked him to stop but he didn't. the suspect says the whole thing was consensual. after a month of silence, the controversial french

magazine "charlie hebdo"á6ñ hit newsstands again tomorrow. the magazine revealed its latest cover, a pack of political and cultural characters chasing a dog with a copy of "charlie hebdo" in its mouth. again." two islamic gunmen attacked the offices last month. they printed a survivors issue the week after the attack but has not printed one since. police in paris wants to know who is flying drones near landmarks. they spotted five drones flying over locations like the eiffel tower, the louvre and the french-american embassy. prosecutors say they will not file charges against three lapd officers who shot a car chase suspect. the whole thing aired live on tv. they shot the unarmed suspect more than a dozen times in 2013. the district attorney's office says it's hard to prove the
