i'm meteorologist christina loren. patchy morning frost makes way for a beautiful afternoon. and the tri valley is starting to build for the morning commute. we'll show you a crash i'm tracking a little farther north from there. >> a live look outside at the golden gate bridge, things nice and clear at this point. you are watching "today in the bay." today is february 24th. good tuesday morning. thank you for joining us. i'm sam brock. >> i'm laura garcia-cannon. crash on caltrain tracks killed one woman and tied up traffic for hours. stephanie chuang is live in menlo park. crews are still out there this morning fixing the tracks. >> reporter: that's right good morning, laura. it's blocked off from el camino reale to about laurel street.

the caltrain has been here overnight and put in the two signals damaged by yesterday's crash and they will be letting the trains through this morning, the first one left at 4:30, supposed to roll through menlo park at 5:04 so in just minutes. the crash around 4:00 yesterday afternoon was so big this is what was left of an acura suv, an impact so great the suv's engine was knocked clear away. the woman behind the wheel just 30 years old had to be extricated, taken to the hospital where she died. traffic backs up frequently from el camino reale and there is a risk getting stuck on the tracks in the path of a train if drivers aren't careful. >> just a basic fund mem rule. don't stop on the tracks. don't start across the tracks until you're sure you can get all the way across. >> reporter: we understand caltrain will inspect and repair that train involved in the crash yesterday and that will take

place at a shop in san jose. as for the driver who was killed, her identity has not been released. so again, the good news this morning is it does not appear the morning commute will be impacted for those who have used caltrain, the first of the trains going northbound should roll through in about two to three minutes. coming up in about 30 minutes hear from neighbors who say they've seen this close call time and time again. live in menlo park, stephanie chuang, "today in the bay." >> just a tragic sight out there. thank you so much, steph. in morgan hill the driver of this truck ended up stuck on the train tracks. he was quick enough to get out with no injuries. the impact sent his truck flying. union pacific officialsúrñ say man drove around the crossing arm. his family says his truck stalled. a santa clara county university -- santa clara university student accused of stabbing his roommate returns to court today to enter a plea officially. 19-year-old dylan kim faced an attempted murder charge. prosecutors say kim attacked his roommate with a knife last week.

police say kim had self-inflicted injuries. the roommate is expected to survive. rqó0&ut the punishment for form santa clara county supervisor george shirakawa jr. according to "the mercury news" he entered a no contest plea to corruption charges late yesterday. shirakawa is accused of cheat ch cheating, creating rather a deceptive campaign mail order to help xavier compost win a san jose city council race. he'll likely be sentenced to community service next month. should local officials have the ability to track you down in the event of an emergency? the santa clara county board of supervisors will decide if the sheriff's department can buy a machine called the sting ray that can pinpoint your location. "today in the bay's" kris sanchez in live in san jose. this sort of action would require warrants. good morning. >> reporter: well that's kind of the interesting point here, sam, it seems like the department is asking to buy this device. however, there is no formal

policy in place just yet, some folks putting the cart before the horse. if you have a cell phone then you already have a tracking device on you, maybe you used the information that your phone sends out to find it when it's been lost or dístolen. it says they want to do with the half million dollar tool that would allow them to do the same thing only in the case of law enforcement, they say they want to track down the bad guys or missing, jat risk people using the same triangulation technology your phone uses. the department would only use the sting ray after getting a warrant from a judge but there's no formal policy yet. because the device mimics cell towers some folks are asking if officers can track down criminals or missing people, can't they track me, too? >> what's important for us with this device we don't narrow down the location and be more specific, instead of searching the several mile area maybe searching down to a block.

>> if you want to catch perpetrators, people that are not supposed to be out and about, but it's also invading your privacy. >> reporter: the supervisors are under the gun so to speak to act because according to the santa clara county sheriff's department, the department is running out of time to use the federal grant money, $500,000. the meeting will happen today. kris sanchez, "today in the bay." >> a big decision kris and one quick question. if they're not using the gps on your phone to track location, how does the sting ray follow where you're going? >> reporter: it mimics the cell phone towers the way your cell phone emits a tower it pings when people are lost in the wilderness or folks who are missing, it sends a signal ping and you get to the location, it pings and to the other one. it's not listening in to your phone conversation as i understand it, but using those pings to find your location, the problem is when i'm standing

here and you're finding my ping you're also following my photographer, alan weibel, his ping as well, and anybody else who is around me and so the warrant doesn't cover all of that area. >> another question like you said for protocol they have to figure out.nñ thank you very much, kris. it's 5:06 right now. two local lawmakers are calling for a probe of san francisco's catholic high schools. according to "the san francisco examiner" phil king and kevin mullen asked the state committee to probe the san francisco archdiocese. they say the church's requirement that flees sign a morality clause sets a dangerous precedent for workers right. salvatore cordealone says the state should respect the church's right to hire people who uphold the catholic teachings. city council members have approved a new law allowing for a do not deliver list. it makes it illegal to deliver unwanted newspapers and other advertising material, residents initiated the ordinance after

trying unsuccessfully to stop unsolicited deliveries of "the san francisco examiner." they called the deliveries of anuisance and said the paper ignored requests to stop deliveries. 5:06, time to check out your microclimate on this tuesday morning, a crisp start for us. >> it's chilly out there. good morning to you, laura, sam. this live picture of san jose, which is as clear as a bell this morning, same clear sky over the san francisco bay, we have cold air but a gorgeous rebound coming your way. let me take you through the day part forecast for today starting out in the 30s and 40s. by lunch time warmer by three to five degrees and we'll round out the day close to 70 degrees in the north bay for example. lots of 60s for us, mid to upper 60s right here in san jose and on the peninsula as well. something a lot of people have been complaining about, your pollen levels. these will be high for the next couple of days until we get the rain we've been promising you.

if you don't know what to look out for, juniper is the plant that has the little purple berries on it. try to stay away from that if you suffer from asthma and allergies and ash and of course pine. i always like to think mentally in pictures to put things into perspective. we have change on the way when it comes to pollen levels and a big change in the weather pattern. rain on the way, more on that in moments. right now good morning to mike inouye. >> we'll do a nature walk later on and point out spots for me to avoid with the trees. over here, 580, no reason to avoid this, this live picture a smooth flow of traffic, a lot of company. we'll look at the map and starting to build and starting to slow a little bit westbound. this eastbound blip i didn't see any problems, that was in your live traffic shot. we'll track that. if there are any issues, we'll follow those as well. altamont pass the volume is starting to build coming out of theali altamont. farther north a trash through

concord, southbound 242 coming toward pleasant hill. crash on the shoulder, no slowing, haven't seen any issues over the last few minutes. north bay a crash 29 at 37, light volume of traffic keeps things moving smoothly. no problems san rafael down toward the golden gate. peninsula and south bay, you see a smooth flow of traffic as well, live look for palo alto, 101 moves nicely and as stephanie told you the train looks like they're on schedule this morning. back to you. >> thank you very much. for the next two weeks in the south bay the silver screen comes alive, the silver anniversary of a celebrated festival. >> "today in the bay's" bob redell is live in downtown san jose where cinequest kicks off, a movie about a memorable event in the bay area. >> reporter: good morning to you, laura and sam. cinequest kicking off tonight at the california theater here in downtown san jose with a documentary about an enormous event that took place in san francisco about 15 months ago. that film, that documentary called "batkid begins."

as you can guess by the tight tell chronicles what the city and volunteers did to help young cancer patient myles scott live out his dream in november of 2013 of becoming a superhero to save gotham from the likes of the riddler and the penguin. this film has been so well-received that julia roberts, the actress, signed up to turn it into a feature film "batkid begins" the documentary producered by current and former staff at nbc bay area it should be worth noting. this being the 25th year, the silver anniversary for the cinequest film fest. it's remarkable how much it's grown. the founder points out to "the mercury news" in 1990 people told it would fail and san jose wouldn't support film culture. back then there was a three-day festival with 60 films and roughly 3,000 ticket buyers. today cinequest runs for 13 days, they're going to be screening over 200 films, around

very good tuesday morning to you. 5:13. tickets for this year's birdie manifest i feel have come and gone and officials say some people hacked into the system to get first dibs. organizers say about 200 people were able to hack the site and claim the first tickets when the sale opened at noon last wednesday. tickets sold out in a matter of minutes. officials say they're working to track down the hackers and revoke their tickets. the hackers say it was really more of a trick. scott mcgrew the problem the word hack has no good legal definition. >> we often think of hack is as a way they show in the movies tracking through elaborate security. sometimes you can hack something through a loophole. the computer users were able to guess the characters of the address of the web page that put them in line for tickets before

the web page was published. trick? a hack? i'll remind you when the ipad first came out computer experts were able to use a similar hack to work backwards and determine ipad owners' e-mail addresses using ipad data at&t had published on a website. though people's ipads were never invaded that hacker actually went to prison. it's no regular tuesday. it's yellen day. let's turn to landon dowdy at cnbc world headquarters. good morning, landon. >> that's exactly right, scott. all the buzz on wall street is about janet yellen, as she heads to capitol hill to testify about the state of the economy and the fed policy. investors will be listening closely for clues as to when the fed will start raising interest rates which is expected sometime this year. we also get data on home prices dow falling 23 points monday and the nasdaq rising five to 4960.

start, but a nice finish. 36 degrees in livermore, 32 in san martin, and 34 degrees in santa rosa, and many of us work for that weekend, and if you want to get outdoors this weekend we'll see different sides. we'll talk about that in a moment. first we want to take you through your day part forecast, it's actually the coldest morning out there in over a month, with widespread 30s. i can tell you though, upper 30s for most of us. we will see temperatures hovering near that freezing mark, only in the isolated inland valley spots. rapid afternoon warming under beautiful sunshine. our air quality not suffering, it's really nice out there and the fog will return tonight as your sun sets at 5:57. so temperatures work like this, 40s, 30s to start, temperatures in the low 60s by lunch time so we've got a big rebound coming your way, and widespread mid to upper 60s as we get into your afternoon. if you will be headed out to cinequest i'd love to meet you out there, i'll be on the red

carpet and get to introduce the first film, honored for my fourth consecutive year, 53 degrees. for the evening gowns, 10:00 p.m. cold conditions, and then for the afterparty, 50 degrees out there at midnight. so here's the story. area of low pressure came through, that's why we've got that really cold start, nice and clear out there because of all the wind but high pressure will take control, reign supreme as we head throughout the rest of the week. then as we head throughout late friday into saturday, this area of low pressure comes through and is t is going to bring us shower activity mostly for saturday across the bay area, not expecting anything heavy but we'll take whatever we can get, if you want to make outdoor plans not looking fantastic for your saturday. much better for sunday, clearing clouds, low 60s. we'll have more on your pollen levels and what to expect in that department if you are someone who suffers from the allergies of the season, coming up right now i want to check your drive with mike inouye. >> our family has our fingers crossed maybe some of that rain

will clear things out. toward the south bay as we look at 101 northbound, we have a good steady flow of traffic, nothing dramatic. look at your map, basically green all over, san jose and the rest of silicon valley, bli bli yellow. over here we move toward the east bay, here is the tri valley, dublin easy flow of traffic, close to the speed limit for the dublin interchange, same down toward hayward and union city and as we move up toward the bay bridge and farther north the north bay the only incident showing up is highway 29 at 37. an earlier car crash went off the roadway. activity not blocking any lanes off of the connector with 29. we'll track that smooth flow through the san rafael area and bay bridge. let's show you a live shot san rafael southbound easy drive no, problems, very chilly up there in san jose specifically around freezing so watch the smaller bridges in the north bay,

charming but possibly frost. looking toward the bay bridge toll plaza there's no problem here, just have a couple of cars waiting for the cash lanes which is typical on the oakland side. back to you. >> mike, thank you very much. edward snowden, deep throat, mark feldt what happens when the public fails to protect whistleblowers, vicki nguyen is here. >> this is the people who work in nuclear plants, oil rigs, work on the planes we fly, the people you want to see speak up. the federal government started a whistle-blower program but current and former investigators at the agency say the system is broken and that cases are being mismanaged. they say there's pressure to dismiss whistle-blower concerns rather than fully investigate them. look at the cases in region nine which includes california.

laura. this is rush hour last night, the woman who was behind the wheel was heading toward el camino reale, toward 101. this morning they just installed -- >> that is stephanie chuang reporting from menlo park this morning, at about 5:00 yesterday -- we're having some trouble ow our audio. we'll goet that fixed. about 5:00 a woman got stuck on the tracks in menlo park and the train came through, not able to stop and authorities are continuing to look into that matter this morning. we'll be checking in with stephanie once again. caltrain is investigating another deadly crash, late last night a man was hit in the tunnel just south of san francisco. transit police have not said why he was on the tracks. a san jose woman connected to a crime spree in the south bay will be in court on mrd charges today.

19-year-old gabriella ortiz. she and four other men killed robert heiser in gilroy last week. video shows ortiz and another woman using heiser's credit cards aa convenience store after his death. this is another picture of ortiz. last week a man said he hired ortiz through a prostitution website. when she got to his fremont home investigators saw she drugged him and let four men into the victim's home. the men then beat and robbed him. a disturbing case of animal cruelty in santa cruz county. animal shelter workers say they found a dead miniature pinscher puppy on the side of the road. the mother stood protectively by its side. shelter workers are now treating the surviving dog. >> we have the santa cruz county animal shelter. if you're in san jose or another city, every jurisdiction has an animal shelter willing to take

animals that are unwanted. there's no reason for someone to abandon on animal on the side of the road. >> whoever is responsibility for the han us crime will lukely face felony animal cruelty charges. supervisor also decide if santa clara can purchase a tool that operates almost like a cell phone tower tracking your phone's location. "today in the bay's" kris sanchez joins us live in san jose. officials say that's not the case that they'd be listening to phone calls. >> reporter: this is a different technology. the sting ray doesn't listen in to conversations, that's something else but it uses the pings off of cell phones to find somebody's exact location and why the santa clara county sheriff wants to use $500,000 in central funds to buy the half million-dollar high-tech tool. the sheriff says the department can use that technology to find the bad guys faster, maybe even find people who are missing or at risk. sheriff laurie smith says the

supervisors are deciding whether or not to fund the immigrants in president obama's executive order. it is 5:34 right now. it is a big day for meteorologist christina loren. you're going to be on the red carpet for cinequest and, and just as importantly tracking rain in the next couple of days. >> most important for everybody across the bay area. thank you, sam, good morning, laura, everybody at home. live picture of san jose, we're in the heart of a drought but we've been able to kind of very slowly chip away at the deficit so far. 2015 has been good to us. looks like we're going to see a pretty active next couple weeks, and i'm really watching the first week of march the 3rd and beyond so keep that in mind if you're someone who likes to follow the rain chance across the bay area, it's nice and clear out there to start and temps are actually chilly enough for a little bit of the frost formation especially through inland valley spots. we're at 41 san jose to start the day, right at freezing in

san martin and 34 degrees in santa rosa. half moon bay waking up with 37 degrees so here answer the deal for today. coldest morning in over a month. you'll probably notice that around sunrise as we head through the next hour. the coldest temps of the entire day will settle in. we're going to see rapid afternoon warming with temperatures ending up in the mid to upper 60s. your sun will set tonight at 5:57. so a little patchy frost this morning, warm day ahead, warming even more so as we head throughout your wednesday and then we have a big pattern change ahead by friday, that rain that sam was alluding to starts to make an appearance, we'll talk more about that coming up in my next report. i'll show you the futurecast and the best bet for where you live. let's check your drive with mike. >> here is your bay bridge with the cash lanes backing up. we should see the metering lights in 90 seconds or so looking at smooth fast tracker slowdown as it builds. i want to show you the maze on the approach, there was a little slowing earlier here for 580, for 24 approaching the maze, a

smoother flow of traffic now as folks are starting to buildsb1ñ here. no big problems for the east shore freeway through berkeley or out of richmond. around the hilltop mall the signs overhead to this west side of the freeway, reports of a car fire on the right-hand shoulder. no injuries and in fact crews are just getting on skeent. i haven't seen a lot of slowing. we'll track this carefully over the next few. things can bog down from about highway 4, hercules to the scene. we have things woged down west 580 approaching the dublin interchange. there was slowing out of the eastbound direction as well and around hacienda overnight construction. let' show you the live shot from our camera. there's the hacienda off-ramp and traffic jammed up, had started to move. there may have been a crew on the westbound side which had to pull over from the shoulder and get out of the area, where i'm going to assume what is going on. there's the dublin grade you see the volume of traffic here. as we look back to your maps the volume coming in and out of the altamont pass and southbound no problem as you'd expect this

lock. good morning. >> exactly. here it is with another issue of homeland security funding and immigration, something with a huge impact on california. today senator republicans and democrats are holding policy lunches out of this this afternoon, we hope to find out if they've come up with any solutions. president obama said we can't afford to play politics with national security. some governors are frustrated saying washington is throwing its problems in their laps. the issue here republicans want to get rid of the president's immigration orders to protect immigrants from staying in the country if they're undocumented. democrats insist on funding homeland security and dealing with that issue separately. that's what the senate republican leader may try after democrats blocked linking the two issues once again last night. so they'll try again today to see if they can come up with some solutions, if not, we're

looking at tens of thousands of tsa agents, border patrol agents who could be working without paychecks come friday. >> you say we can't afford to play politics, that's what our elected representatives said. let's get to the politics of all this. who gets blamed if there is a partial shutdown as a result of the back and forth? >> well republicans are concerned because republican, john boehner, mitch mcconnell, the senate leader came out and said no, we're not doing government shutdowns, there's not going to be a government shutdown on our watch but this is one where democrats are blocking the funding, but it's because of the immigration issue that they have linked to that funding. so bottom line is if the government shuts down, partial government shutdown, the homeland security department shuts down on friday, republicans could bear some of that blame. >> we'll see what happens. as you said it's the language of the bill that the democrats are filibustering there. we'll find out. thank you very much, tracie potts, from washington. it is 5:42. people who want to smoke pot in alaska can surmly light up now

without worrying about breaking the law. voters approved a ballot measure to legalize marijuana last year and the new law takes effect today. alaska is the third state to legalize recreational marijuana use along with washington state and colorado. trouble in paradise as a boat vamz into a packed restaurant but amazingly, everybody's okay. >> i've seen a lot of crazy stuff but this is definitely, it takes the cake. >> someone say cake? this happened south of tampa, florida, yesterday. the boat carrying seven people. witnesses say it was speeding in dense fog when it slammed into a crowded restaurant. other than a few terrifying moments, no customers or passengers were injured. investigators are trying to figure out the speed of the boat and if they'll be filing charges. >> i'll take your boat and see your sidewalk here. amazing video out of south korea this morning. two people just disappeared, watch it here, into a sink hole. they were just walking down the street. security or video from a bus service shows the two people walking on the sidewalk, when concrete tile just slaps collap

underneath them. firefighters rescued the man and woman. both victims have minor injuries. >> that will no doubt take your breath away. glad everybody is okay there. you probably might not be able to see your breath,' not that cold but it's dipped in the last couple of days. >> some microclimates you may be able to. not a whole lot of moisture out there this morning. 5:44. new day, new forecast to talk about. it's chilly out there to start, only in your isolated inland valley spots. the temperature map tells the story. san francisco is waking up at 50 degrees, right by the water, you get that cool, moderating temp there. i can tell you, though, widespread 30s now starting to settle in, 39 degrees even in half moon bay, 32 degrees in san martin and 36 degrees in livermore so if you're waking up in the city, it's much colder on the bay side than what we experience on the ocean side and that has everything to do with our mild pacific ocean, where temperatures are still in the upper 50s this time of year.

very unusual to have temperatures in the upper 50s, just offshore but that has been the case for much of the month. temperatures we'll show you your forecast temps in the low to mid-60s at noon. if you want to break for lunch, have lunch out on the water it will feel true to temperature out there, take out the windchill factor it was breezy yesterday and cool as a result but temperatures today will be nice and really mild out there in the north bay, 69 degrees. because of the wind we had to deal with yesterday your pollen levels are really high, especially pine and cedar. ash and oak as well, predominant offenders this time of year. not too bad in san francisco itself. here's what we're looking at as we head throughout the area, area of low pressure that brought the cold and high pressure headed out of town. an area of low pressure comes through as we get into the end of the week, and your

the crosswalk the municipal transportation satisfying repainting crosswalks with zebra stripes. the idea is that bolder, white stripes will make the crossings more visible. the change is part of vision zero an effort to end all traffic deaths in the city by 2024. the city of berkeley could soon become a no drone zone. city council meeting tonight to discuss a temporary ban on drones. it would last two years. many local gofls have been scrutinizing drones over privacy concerns. vip appearance at the debut of a new bay area event. hillary clinton will deliver a keynote address at the watermark silicon valley conference for women. the first time the event has been held taking police station at the santa clara convention center. the line-up includes several women touted as female role models for millions around the globe. right now boston is enjoying a bit of a break. it's not supposed to snow until next monday but scott mcgrew there's so much snow on the

ground already that boston is suffering an economic disaster. >> that's exactly right, sam. there's a push to rethink blizzards and snowstorms as total disasters. we know they're crippling. we know they shut down cities but we them the same way as say a hurricane or a tsunami. economists though say we need to start thinking of boston the way we think of a hurricane zone. people cannot get to work. the t has been shut down for a month. roads are impassable, businesses may fail. you think, for instance of a movie theater. employees can't get to work but that's okay. nobody can make it out to the movies either. fed chair janet yell listen give her briefing to the u.s. senate today. you can bet the weather on the east coast is going to be one of her talking points. the fed's been very vague about when it's going to raise interest rates and we expect she will say she can't give a better forecast because of the recent snowstorms have obscured too much economic data. we continue to watch the

fail, that san jose wouldn't and couldn't support this kind of film culture. back then a three-day fest with 60 films and roughly 3,000 ticket buyers. today, cinequest runs for 13 days, will run through march 8th starting today. will screen over 200 movies, more than 90 of which will be u.s. or world premieres and the [ ts to 100,000 people. as i mentioned the festival kicks off tonight at the california theater in downtown san jose with a documentary about an enormous event that took place about 15 months ago in san francisco.
