out. along with the early bloom high pollen. when rain will wash the pollen away in your full forecast. >> a good look long, longer wait at the bay bridge toll plaza. the metering lights are not on. we'll talk about this and a san jose crash coming up. >> let's peek outside get your tuesday morning started. it is february 24th. this is "today in the bay." >> good tuesday morning. thank you for joining us. i'm sam brock. >> and i'm laura garcia-cannon. what went wrong? nearly 14 hours after a deadly crash caltrain is working to get a busy railroad crossing up and running again. train slammed into an suv stuck on the tracks during last night's commute at the rachswood avenue crossing. >> "today in the bay's" stephanie chuang joins us live from menlo park. this isn't the first crash at this crossing. good morning.

>> reporter: that's right, good morning to you sam and laura. unfortunately this is the first time the worker has been out at the crossing for this repair work. 13 hours later caltrain cruise are installing this crossing gate, the arms are the focus right now. they did not give an estimate how long ravensroad between el ka miyo reale and ravenswood. the train heading south hit the acura suv before 5:00 last night as the vehicle sat on the tracks. the 30-year-old woman behind the wheel still unidentified was taken to stanford medical center where she died. the crossing arms did come down as they were supposed to. neighbors say they have seen cars hang off the edge of these tracks in traffic. some of them came out to watch the cleanup last night that reminded them of a similar accident in april 2012. >> two accidents in a couple of years, maybe it's an issue. changing that is very expensive and change the nature of the city so i imagine it would be

controversial. >> reporter: the good news this morning, no significant delays as a result of this repair work. the first train rolled through this crossing just after 5:00 this morning. trains aren't stopping but they are slowing through the area, so minor delays. also there were no reported injuries from the estimated 400 people who were on that train yesterday. meantime that train is set to be inspected and repaired. live in menlo park, stephanie chuang, "today in the bay." >> very tragic, thank you. also in morgan hill the driver of this truck ended up stuck on the train tracks. he was quick enough to get out with no injuries, but the impact sent his truck flying. union pacific officials say the man drove around the crossing arms, his family says that his truck stalled. it is 6:02. san jose woman connected to a crime spree in the south bay will be in court on murder charges today. this is 19-year-old gabriella ortiz. she and four other men killed robert heiser in gilroy last week. detectives say the video shows

ortiz and another woman using heiser's credit card at a san jose convenience store after his death. investigators say this is another picture of ortiz. last week a man said he hired ortiz through a prostitution website but when she got to his fremont home investigators say she drugged him and let four men into the victim's home. the men then beat and robbed him. santa clara university student accused of stabbing his roommate could enter a plea today. 19-year-old dylan kim faces an attempted murder charge. 'tacked his roommate with a knife last week, prosecutors say. he also had self-inflicted injuries. the roommate is expected to survive. a disturbing case of animal cruelty. the santa cruz animal shelter is searching for whoever put a dog and her puppy inside of a bag and tossed them from a moving car. workers from the shelter found the miniature pinscher puppy dead on the side of the road, the mother standing protectively by her puppy's side.

she's at the shelter receiving treatment. there is never an excuse to harm your animals. >> if you're in san jose or if if another city every joost diction has anhn animal shelter willing to take animals that are unwant nypd. there's no reason for someone to abandon an animal on the side of the road. >> whoever is responsible for the crime will likely face felony animal cruelty charges. >> it is 6:04. public safety or 1h2éspyin. today leaders in santa clara county are expected to decide whether to buy a new device that would track people through their cell phones. "today in the bay's" kris sanchez joins us live in san jose this morning and kris it's a sensitive and controversial issue. >> reporter: this is not new technology, laura. the sting ray doesn't listen in on private conversations, that's a different technology. what it does is it uses the cell phone signal to locate people. critics say it's looking for criminals and innocents alike and that really is one of their big problems with it. the santa clara county sheriff's department says it will only use

the tool to track down the bad guys with a warrant from a judge but that's not part of the official policy because there is no official policy. that's one krill simple along with another if officers can track down criminals they can track you, too. >> what's important for us with the device we don't narrow down the location and be more specific. instead of searching several mile area, maybe just a block. >> it's food to catch perpetrators but then it's invading privacy. >> reporter: the supervisors are under pressure because according to the sheriff's department, the department is running out of time to use that money. it is federal money and comes through a grant from homeland security. the meeting is today in san jose, kris sanchez, "today in the bay" >> thank you, kris. it's a packed agenda for santa clara, immigration also on the agenda for the santa clara county board of supervisor this is morning. it will discuss whether to fund

legal services or undocumented immigrants in the county, immigrants potentially eligible to say in the u.s. legally. texas judge halted the order last week but the administration is appealing. they have to stop the presses in san car close when it comes to unsolicited newspapers. city council members approved a new law allowing a do not deliver list. it makes it illegal to deliver unwanted newspapers and other advertising material. residents initiated the ordinance after trying unsuccessfully to stop unsolicited deliveries of "the san francisco examiner." they call the deliveries a nuisance. what will the headline say this morning on your weather narrative? >> they won't know in san carlos unless they're watching us. >> with this information, live look outside that is the bay bridge, sparklingy beautiful as your day is expected to be. >> pretty view out there, christina. >> yes, it's chilly out there. the coldest morning we've had in

over a month. good morning to you, everybody. thanks for waking up with us. temperatures right now widespread 40s, but i can tell you your isolated spots, look all around the perimeter of this map, and that's where you're going to find the 30s this morning, so down in san martin, coldest spot at 32 degrees. ooh, except for santa rosa, 31 degrees just one degree below that freezing mark t is chilly. grab a coat but something that you can peel off later on today by lunch time, temps in the mid-60s all across the board. as we get into your afternoon, that clear start that beautiful clear start is going to make way for a lot of sunshine. still doork oark for the next h hour. already starting to see sunlight in the south bay, sun sets in the west, rises in the east, you can see our camera here facing the east but it's dark just about everywhere else. let me take you through your day part forecast. by noon today low 60s on the way in the tri valley, 61 degrees in san francisco, and 62 degrees in the north bay. up to the mid to upper 60s later

on today, and i can tell you, a warmer day even at lunch time you'll notice the difference just about as warm as where we ended up yesterday. right now i want to check your drive with mike inouye. >> all right. folks i want to take you to what i've been monitoring with a live look instead of just the reports we get, we've seen the metering lights turned on. you can't make out the lights but over off to the right side of that, basically traffic is flowing a little better. folks are held off to the left, when you can see the metering lights just turned on, about 60 seconds ago, one minute ago. this just happened. the bay bridge toll plaza has seen the backup as we look from the toll plaza camera you've seen the full lanes for the last 20 minutes or so.]o6& cf1 o this would be the typical pattern for a tuesday and we're looking at the map, despite the fact that the metering lights were turned on a little bit later there's been no real problem. the map will show you the approach coming off the east shore freeway is smooth and nice flow of traffic. 580 slows more as it gums up here more and the freeway across the bay on the bay bridge itself

will also start to show a little more green toward the san francisco side. aside from that that's about it for the unusual at person for anywhere in the bay, a nice easy drive toward hayward and the tri valley, southbound 880 and southbound 60 where i put the arrows showing the typical build as traffic comes off of 580 and makes its way to the east bay and south bay at silicon valley. the only disturbance san jose northbound 101 at mckee. there it is, it popped up cupertino at 280 and 85, a new crash is reported near the interchange. i don't know about lanes being blocked but i do know it involves a motorcycle and sounds like the motorcycle was down, at least on the first report. we'll track that closely, that's a concern. >> very much so. thank you. time is 6:09. up next a mystery in the skied. drones spotted flying near some of the world's most famous landmarks. apple hits near sky-high records and we'll take a look at chickens in court ahead in business and tech.

stories. caltrain tracks in menlo park reopened just about an hour ago. they have been closed since yesterday when a train crashed into an suv. the driver of that suv died. former secretary of state hillary clinton will be dlifrg a keynote address at the conference for women today. the first time the event has opinion held. today santa clara county leaders are expected to vote on a proposed cell phone tracking system that allows law enforcement to track all phones in a specific area. a mystery in the sky above paris. place want to know who is flying drones over city landmarks. overnight police spotted at least five drones flying over locations like the eiffel tower, the louvre and the american embassy there. french authorities say they don't believe the drones pose a threat. closer to home, berkeley could soon become a no drone zone. city council meeting tonight to discuss a dwo year ban on drones. many local governments have been scrutinizing drone use over

privacy concerns. can you ban a drone over your own property? the law is struggling to catch up. >> scott mcgrew you say chickens are part of the story. you've captured our interest. chickens can't fly >> but they can go to court, sam. it used to be you owned the sky over your house all the way to the heavens, they said, but back in the early days of airplanes, a chicken farmer took an airport to the supreme court saying the airplanes were scaring his chickens to death, but the courts ruled against the farmer saying you can't prevent somebody from flying over your house at a safe height. that's why you can't tell southwest airlines to go around, right? so here's the thing. when it comes to drones, the law says you have to fly drones down low under 400 feet. well, that's down with the chickens, where you do have legal property rights. while no one's actually really tested this no fly zone thing in court it would appear, because it's illegal to fly drones up high and you do control your air

space down low, maybe you can tell drones to get off your lawn. other news, steve jobs would have been 60 years old today. tim cook, the current ceo of apple, tweeted out this morning "remembering steve, the only way to do great work is to love what you do." maybe even steve would have been astonished at apple's value today, and i mean today, today, not just modern times. this morning apple shares will open at an all-time high, a share value that gives the company a $774 billion value, that's not just the most valuable public traded company in the world, guys, it is twice the value of exxon mobil and is one of the reasons we're watching the nasdaq just rise higher and highhigher, nine day a row. apple is a weighted stock and pulling the nasdaq higher. >> juggernaut certainly. >> happy to have it in silicon

"today in the bay" all san francisco giants are set to report to arizona to work out the kinks before the start of the 2015 season. >> now is the time, right? this includes a couple new faces, fans will get to know over the next few weeks. comcast sportsnet's ahmed fareed is with the giants in scottsdale. >> reporter: we've seen thecatc field. today the first full squad workout for the entire team of the san francisco giants at spring training. bruce bochy will give a speech to the team before they have their first full squad workout. we'll have our eyes on some of the new faces. year to year a lot of consistency with the team but in left field a new face, nori an aoki, played against the giants last year for the kansas city royals. third base a local product replacing pablo sandoval. kasie mcgee says he'll do his own thing and hopefully the giants continue to win a lot of

out there, come by, take a picture. 6:17. we want to show you a beautiful shot as the sun comes up over the san francisco bay this morning. it is just lovely out there, but i got to tell you, it's clear and hence very, very cold. we don't have a blanket of low clouds to keep us mild. 31 degrees in the north bay. 46 in san francisco. that temperature took a big drop. 37 in the tri valley and 40 degrees on the peninsula. up here in the south bay the upper 30s to start. we are headed towards the 60s later on today. beautiful day at lunch time, we're going to hit highs today that are much warmer than yesterday. at lunch time it will feel just about as warm as it did in the heat of the day yesterday. let's talk more about your weather headlines. patchy frost until 9:00 a.m. especially through outlying cities. i'm talking about santa rosa, san martin, santa teresa as well, give yourself time to warm up your vehicle this morning. as we get into the mid section of the week, wednesday and thursday, will be the warmest with temperatures climbing by a

good three to five degrees each other. close to 70 degrees by wednesday. big pattern change on the way as we hit the end of the week, but that's what's going to help us out when it comes to your pollen levels which are still very high, and we're actually going to see the pollen peak as we head throughout friday before that rain comes in. that's the good news. the rain usually helps out this situation and you know what? one of the good things that comes with spring, of course we don't like that high pollen but we love our san francisco giants. let me show you what they can expect as they head throughout the day today. 67 degrees out there. they're going to be at 71 degrees tomorrow and 74 degrees on thursday, all boys reporting to duty today. i can tell you the first game exhibition game out there at spring training against the a's, one week away now, just one week away. so we're all getting ready to enjoy some baseball with our san francisco giants. looking forward to that. friday into saturday you'll see here on your five-day forecast temperatures for us are going to be chilly, kind of a cool weekend coming your way.

trying to get outdoors looks bet are for outdoor plans sunday than what we're expecting saturday. i want to show you when the showers first start in the bay area, expecting a south bay arrival first at about 11:00 a.m. on friday, then everything starts to push to the north throughout the second half of the day friday. i don't think we'll see a lot of activity in places like napa. santa rosa you'll get more rainfall than napa as this is an interesting storm system, has a strange track and i can tell you very dissimilar to the system that came through last time. overall for today what you need to know, grab a jacket, something you can peel off later on. temperatures coldest they've been in over a month's time. let's check on the drive, warm it up this morning. all right, mike >> folks might take a couple extra seconds headed toward the bay bridge because we have a different flow. we'll show you that in a pecked. in san jose a pleasantly light volume of traffic. it was starting to kick in as christina said. things have calmed down. sunrise coming up and the map will show you, i was$)ni watchi one crash northbound 101 at(ñ/ñ

mckee, that was a big concern, a bad spot at a bad time, hasn't been much of a problem. lighter build for 87 and 101. 85 just starting a little build but 280/85 over here where they intersect this is a problem, a crash blocking part of that connector from north 280 to 85. you might have to jump off at foothill, move around and thatk might be an easier route for folks in the area. there's a little slowdown cupertino toward los altos hill. the tri valley we have a crash involving three vehicles west 580 at airway. we have traffic starting to build now coming off of 84 in the north livermore off-ramp and holding up so it's lighter at the dublin interchange right now but sounds like everything should be moving off to the shoulder and there may be a secondary crash in the backup. lot of activity, we'll track the tri valley. headed southbound 880 at 92 a fender bender there over off to the shoulder but a distraction

for the build through hayward and continuing through union city. nothing surprising 101 or 280. the upper east shore freeway continues with a smoother flow through richmond. north bay no delays novato, san rafael. 101 moves nicely to the golden gate bridge. quick look at the bay bridge toll plaza, i talked about a different flow. we had the metering lights turn on late today but it might be because of a lighter flow. we have lanes off to the left, a little bit of break there. back to you. >> getting things moving, thank you. 6:22, still ahead on "today in the bay" a sink hole swallows two people in south korea. how they managed to make it out alive, next.

welcome back, everyone. the sun has arrived on this tuesday morning over the bay. uz s morning, nice start. amazing new have you had yo out of south korea. capturing a moment two people disappeared, into a sink hole. security from a bus service shows two people walking on the sidewalk when the concrete tiles collapse underneath them. firefighters went down into the sink hole and managed to rescue the man and woman. both were hurt but they should be okay. >> incredible there. a boat slamming into a packed restaurant in tampa, florida. thankfully everybody's okay. witnesses say the boat was speeding through fog when it

crossed the baechb and crashed straight into the popular restaurant. investigators say alcohol was not a factor in this crash. no word yet if charges will be filed. rescuers in florida worked into the early morning hours to free a pod of manatees from a storm drain. wildlife rescuers and firefighters pulled 19 manatees out of a drainage pipe. crews loaded them on to tarps and eventually released them into safer waters. the fire chief says cold weather causes manatee pods to come into canals in search of warmer water and often jtimes get stuck. >> an eight or ten-man job there. >> it is legal to smoke pot in alaska. voters approved a bat locale measure to legalize recreational marriage maurnlg last year. the new law takes effect today. people 21 and older can have up to an ounce of pot without getting in trouble with the law. alaska becomes the third state in the country where it's legal to grow and smoke recreational

tracie. >> that's right, laura and sam. at their weekly lunch democrats and republicans separately will undoubtedly try to find some way out of this. if they can't, on friday tens of thousands of border patrol agents, tsa agents and airports and others are at risk of being forced to come to work with no paycheck. 30,000 of their co-workers will be sitting at home until congress works this out. friday is the deadline, and the issue is immigration. will they pass a budget that does not undo the president's immigration orders? they tried to link the two last night. the senate could not come up with a compromise. democrats blocked it. after that, republican leader mitch mcconnell is pitching a bill that will delink the two so immigration separate from the money from homeland security. we just don't know yet how well that will work in the senate and even if it passes in the senate, the house is a whole different ball game. more conservatives there are meeting tomorrow morning and

we'll get a better sense of where they might go with it. sam and laura? >> tracie, you mentioned there are dhs employees being forced to work or would be without pay. is that because they've been deemed critical employees of the government? >> exactly. they're essential. in other words you're talking about all of our border patrol agents. can't pull them off the border, that's a national security issue. you can't pull all the tsa workers out of the airport. we have to screen people getting on airplanes so they've got to have the people on the jobs but congress has got to come up with a compromise to get them paid. >> tracie potts live from washington, thank you. after a month of silence the controversial french magazine "charlie hebdo" hits newsstands tomorrow. the satirical magazine revealed its latest cover, a pack of political and cultural characters chasing a dog with a copy of "charlie hebdo" in its mouth. two islamist gunmen attacked the "charlie hebdo" offices last month. the magazine printed a

the approach to the bay bridge looking lighter than expected and that may be why they held off on the metering lights. no harm done to the east shore freeway. slower hercules through richmond. the rest of the east bay looks normal. over here highway 4 jams up toward willow pass road out of

bay point toward concord. something blocking the roadway may have cleared. i see recovery of speed from orange to yellow in some spots. slower drive west 580, crash there and maybe debris and secondary crash around el charo. traffic is moving smoother as well. and more traffic heading down to 068 and 880 off of 580, that is the direction and trend for your commute. earlier crash 880 at 92 cleared approaching the san mateo bridge. headed to the south bay a typical pattern north 101, another crash at mac key and 880 shows slowing. the earlier crash involving the motorcycle rider no major injuries and the lanes are clear. palo alto live look shows us an easy drive here and clear skies, winds much calmer as well but it's chilly out there. >> clear skies with a blanket of clouds to keep us warm. >> can't have it all. :36 rig

6:36. the nasdaq approaching 5000. we're watching the markets. >> scott mcgrew, how are we looking? >> looking okay. good morning to you. the head of the fed, janet yellen will be in front of the senate this morning, i figure going to see the markets hold until she starts talking but at least we're moving towards the positive. dow industrials up 18 points. the head of greece has given the eu his plan to reform greece's taxes and retirement in order to get the european union's approval of an extension of loans. eu officials called it sufficiently comprehensive. the takeaway is one, greece may be able to stay in the eurozone and two, the prime minister of greece got elected on a platform of greece first, never back down, but he's negotiating. if he doesn't get kicked out of office he may get something else. >> that's the caveat. whistle-blowers and retaliation, still ahead. we investigate what happens to

deep float, mark felt, sharon watkins of enron all were whistle-blowers. >> what happens when the system fails to protect whistle-blow whistle-blowers? good morning p these are the people you want to speak up when they see a red flag. they work in nuclear plants, oil rigs, they work on the planes we fly. the federal government created the whistle-blower protection

program to encourage these people to report safety problems because they are on the front lines in industries that affect all of us. but current and former investigators at the agency say the system is broken and that a+eujp)e being vc-hmismanaged. they say there's pressure to dismiss the concerns rather than fully investigate them. look at the cases in region nine which includes california. numbers show osha issued merit finds 16 times out of 562 investigations from 2009 to that's just 2.8 pr% of the time whistleblower was awarded a victory. nationally the numbers equally dismal at 2.7%. osha reorganized its program and added more staff to improve whistle-blower protection efforts. we have a lot more in our complete report including workers who brought serious complaints about airline safety and asbestos testing. you can see the entire investigation right now at nbcbayarea.com. just click the investigations
