nbc news confirmed that the so-called jihadi john was at several beheadings, that revolted the world. a u.s. intelligence official confirms that jihadi john is mohammed emwazi, a british citizen born in kuwait but grew up in west london in the suburbs. he graduated from college. he has a degree in computer programming. we also know now that he traveled to syria in 2012, and that is where he joined isis. mohammed emwazi appeared in the videotape executions of american hostages james foley and stephen sotloff and present at the beheading of two brits as well and we know that we're learning his name for the first time, but u.s. officials and british officials have said they identified him long ago as the person who their captives called jihadi john. we hope to have more for you. >> additional motives as well. wow. interesting. thank you very much, kris. 5:01 right now.

college transfer students could soon face a new hurdle getting into san jose state university. live in san jose this morning, class sizes are a big reason behind the new moves? >> reporter: that's right, laura. it appears transfer students are not ready for upper division courses when they get here to san jose state. so they have to take lower division courses, and that takes away seats meant for freshmen and sophomores. a new policy is considered to change the way this campus ranks a student's transfer application. according to the san jose mercury, those in popular majors like computer science and engineering would be ranked higher, increasing their chance of being admitted, if they've already taken the prep courses for that major. that way they are truly ready for upper division courses, and there would be more seats for lower division students in lower division classes. submitting the proposal to the chancellor people can give

opinions at any one of three public hearing. the first is later today from 3:00 to 5:00 at the student union theater on the ninth street plaza. the next swun monday, also 3:00 to 5:00 p.m. at the west valley college fox technology center in saratoga and the last one is back here at san jose state at the college of engineering from 6:30 to 8:30 p.m. if approved, the transfer change would only affect people transferring next year, not this fall. live in san jose, nanette miranda for "today in the bay." >> thank you very much. 5:03. a turf war brewing in the south bay. the community at odds over the redesign of santa clara's montague park. the city wants to build two soccer fields next to the baseball field already there, but families whose kids play baseball say if that happens there will be no room for baseball practice or for fans. in addition, a playground for kids dismantled in the process. >> we want a place where our kids can play have an open area to play. my daughter loves the playground

long from santana row in san jose -- sorry, from levi stadium to santana row in san jose after the sharks game caught one south bay man off guard, he's from san jose and says the uber ride to the game was $23. when the vta rail was too packed, he accepted charges that was 4.9 from uber. he did say he was shocked, though, by the total. >> recommend uber for any big events. that's what i did and i learned the hard way. >> hernandez reached out to uber asking for a price reduction but a representative suggested always getting a fair estimate or waiting for the lines to end and in a statement the company says the uber app was given to give riders a safe option to move around town at the touch of a button. that makes it possible for them to meet that standard of reliability even during high

demands. lawmakers in the country are trying to shut down the surge pricing policy altogether. more coming up in our next report in a half hour. >> thank you very much, steph. another delay in the trial of the man accused of killing morgan hill teenager sierra lamar. more time to prepare for trial. both sides will return to court in april to try to set a trial date. a water leak could lead to traffic delays in los altos this morning. one southbound lane closed from 9:00 this morning until 3:00 in the afternoon. that closure affects the stretch of roadway between portola and pine lane. cruise are repairing a water line at a nearby house. and helping save sea birds sickened by a mystery goo in the bay. more than 30 students at oakland the spark day school raised more than $600 for the birds. as thanks they get to help release brown pelicans back into the wild this morning. the pelicans were not rescued as

part of the mystery goo response but came in with fishing lines and other issues. and nice skies and temperatures out there. 5:06 and our meteorologist joins us. >> a chilly start for now. at least one more warm day for the rest of the week coming up. temperatures climbing into the 60s and 70s later on but you still need your jacket in the north bay where you have 41 degree, patchy fog. visibility at times down to less than a half mile around santa rosa. you can see towards napa, patchy fog, and clear skies to start in san jose. so as we go hour-by-hour, temperatures from 7:00, mostly in the 40s. as early as lunchtime today, notice temperatures climbing quickly around san jose and livermore. mid-60s by noon. by 3:00, approaching 70 in downtown san jose and out near livermore, but the wind part of the story. the wind pretty light now but pick up as you get into the afternoon. temperatures later today, low 70s around the santa clara

valley, close to the upper 60s for san francisco and in the north bay upper 60s to near 70 in mill valley. pleasanton and livermore looking good. low 70s today, but tomorrow we could see about a 10-degree drop in temperatures. watch wind speeds from the morning. relatively light. by the evening, wind speeds of 20 to 30 in the hills of the north bay. a system drops down the coast not impacting us today. by tonight a few showers in the north bay and tomorrow morning's commute running into some raindrops, perhaps around the santa cruz mountains and finally snow heading towards the sierra beginning late tomorrow. another check of your morning commute, here's mike. >> for tomorrow, also for this morning, talking about cooler conditions and maybe patchy fog in the north bay. over here, this is san rafael, easy drive. not a problem for this commute. look on the maps. a little west of there. there's san rafael, where the camera was. over here, stinson beach, north of there, patchy fog on the

index seeing the orange blog and from time to time there also santa rosa. watching those patches. no problems reported north of the bay bridge for drives or from chp on those conditions. the carquinez bridge, and the westbound highway building out of antioch over here in the brentwood area byron highway, a crash reported might affect traffic at intersection. positive as some folks head north to antioch or south towards 580, down towards the altamont pass in the livermore area, and so far towards this area, the tri-valley shot shows a typical slower drive. through livermore, dublin and the rest of the tri-valley, an easy flow of traffic as you imagine at this time on a thursday. no drama off the dublin grade towards the dublin interchange. that's typical for this time of morning. easy flow through the south bay. san jose, the rest of the silicon valley, at speed up towards palo alto. the live look, cameras show

all right. it is 5:12 right now. maybe clarity on a complex issue today. the commissioners of the fcc will be voting on new rules. some of the first rule, really, controlling the internet. they're doing so at president obama the urging. >> yeah. the fcc is supposed to be more oh less independent of the executive. yeah, president obama first pushed for the commission to regulate internet connections as utility similar to the way phone systems are, and the fcc will take up that issue today. commissioners have been briefed and they will vote. we have a pretty good idea of what the new rules are. that they're voting on. we, the public, though, don't have the full details yet. the general idea of net neutrality is that all data should be treated equally across the internet. no one's 1s and 0s or more important than anyone else's. theoretically we don't favor

cnbc but each morning we turn to the cnbc washington bureau. good morning. >> good morning, scott. come on now. i thought i was your favorite? >> definitely. >> golly. all right. let's get a quick check -- of the markets. futures are higher ahead of the opening bell. stocks searching for new heiss after the dow and russell 2000 closed at record highs yesterday. the nasdaq coming close to that 5,000 mark. it's a level it hasn't reached since the dot com boom of 2000. investors looking for data today on unemployment and inflation. rising 15 points to 182247 and the nasdaq closed less than a point at 4967. scott, back to you. >> thank you. the nasdaq had been on a tear ten straight days of gains, but then apple shares sank yesterday on news that google would be pushing android devices in the workplace. this is actually the long video. we'll talk about this later. apple's such a big stock. remember the nasdaq index weighted. pulled the index lower.

mile or so. so hour-by-hour, wake-up temperatures mostly in the 40s. still need a jacket at least through about 9:00 this monrnin. by lunchtime, t-shirt weather. san jose and livermore highs eventually upper 60s, low 70s through the afternoon today. 73 in los gatos toward saratoga mild today. san francisco upper 60s and close to 70 for one more day in the north bay before cooler changes arrive and tri-valley temperatures today in the low 70s. one thing you will notice, though, not much wind this morning, but watch what happens here heading towards the evening. winds speeds picking up a and friday blustery, a weather system dropping down out of the gulf of alaska driving down temperatures and bring a chance at seeing showers. not today but perhaps by tomorrow morning. beginning to see a few showers and look at the sierra by tomorrow afternoon. into saturday. some of the snow totals expecting out of the system that comes in for friday on in through the weekend. maybe approaching more than a foot above places there up

towards 8,000 feet and higher, but the snow level at times could be a little lower than 4,000 feet. there's goodness there in the high country. meantime rainfall totals out of the system coming in late tomorrow into the weekend. not expected to be much. the bigger punch will be the cooler air. driving down our temperatures. notice it beginning tomorrow a slight chance of showers and it looks like the weekend will start off with showers and maybe isolated thunder. one of the things to watch for saturday afternoon. then skies clear and we see a dry finish to the weekend. next chance of showers arriving by next tuesday. slowing down your morning commute this thursday morning, over to mike. >> the number of cars the issue for most of the bay. no issue as far as crashes in the roadways for 580 at least pap smooth drive through dublin and look at all the company you have. why speeds are coming down a little bit. look at your map. talking about your typical pattern here west 580 all the altima pass and in through here and the dublin interchange a little flow right here approaches hop yard and the

tri-valley commute, zoom out show you first of all point here towards antioch and we have the typical slowing for highway 4. through brentwood, earlier crash at byron highway in marsh cleared quickly from the roadway and no problems now off the carquinez and venetian bridges, and move all the way over to your left, my right here, this orange patch. maybe patchy, dense fog in the north bay. most of it along the coast and santa rosa as well. no major problems, mill valley and across that golden gate bridge. moving south, between the city and san mateo, peninsula side easy drive at the limit. across the bridge, live look out here. overnight road crews in both directions as is typical. both directions sound like all lanes open, without interruption. in the south bay northbound 101 volume going on throughout the silicon valley. easy drive. at the limit at the freeway. back to you. >> mike, thank very much. critical change to the 911 policy at the postal service in the bay area.

triggered by a series of investigative unit reports. investigative reporter vicky wynn broke the story revealing a policy that may have cost one man his life. >> reporter: the new policy for medical emergencies at the usps in oakland. allowing work toers call 911 directly in an emergency. sounds so simple and obvious, but employees tell us for years the old rules led to serious delays in medical treatment. in november we told you the story of sam, co-workers found him lying on the ground bleeding from his head. no one saw what happened. the dispatch records show up to 53 minutes may have passed before anyone called 911. it's unclear whether he would have survived had 911 been called sooner, but his family spoke out and fought for changes and it worked. for years the policy at the oakland facility said only oakland police initial. now in an emergency anyone should immediately call 911.

of those beheadings that revolted the world. mohammed emwazi appeared in videos of beheadings of american hostages and also present at the beheading of two brits as well. here's what we know about muhammad emwazi. he is a british citizen, was born in kuwait but grew up in west london in an affluent suburb, graduated from college with a degree in computer programming. he travelled to syria in 2012 and that's where he joined isis. a statement from the international center for the study of radicalization at king's college in london reads this demonstrates what we have long said about radicalization. it is not something driven by poverty or social deprivation. ideology clearly participates in some people participating in jihadi causes. a source from an advocacy group for the muslim community in britain their statements alludes to the fact muhammad emwazi reported to them he felt

harassed by security forces which that group says could have contributed to him joining isis. >> those videos, bone chilling. thank you. 5:31. in the north bay, three men under arrest accused of holding a woman captive almost two months. we first told you about this story last week. a 22-year-old victim says she was kidnapped and gunpoint and taken to a rural santa rosa home. the captors beat her and sexually assaulted her until she escaped. these photos show the suspects taken away by officers. police say the woman is safe and recovering. 5:32 late to. a woman is dead and a -- a man dead, i should say, a woman injured after a are the roed fight in a quiet east bay neighborhood. officers responded to a 911 call about two men fighting in a home in hercules yesterday, found a trail of blood from the driveway to the house. inside they found a fake handgun and a dead man. suspects arrested blocks away. and the university labeled

surge pricing. he went with uber back when the it was packed and surcharge of 4.9. >> the right itself should have been like $30 times four, doesn't add up to $452. >> now in a statement the company says the uber app was created to give riders a safe, reliable option to move around, adding that dynamic pricing makes it possible for abouter to meet that same standard for reliability even during times of high demand. one new york lawmaker is pushing to ban surge pricing altogether for uber and other services like it. assemblymen ortiz introduced legislation in that state to fine violators $250 each time. ortiz says consumer protections here are very necessary. that man did reach out to uber asking for a price reduction but a spokesman said you should just either wait for the surge pricing to end, or take the

here. the off ramp remained open. the crash that occurred cleared. easy drive away from the bay bridge. towards the bay bridge volume builds. look at the toll plaza itself, cash labs fully backed up past the end of the parking lot. fastrak moves nicely. should see metering lights on in a couple minutes. there's the incident, just cleared from the pash buy avenue off ramp from east 80. no problems, zoom out to show you the north bay. talking low clouds hovering around the coast not a major concern zooming out to the rest of your commute. easy drive all around the bay. back to you. >> mike, thank you very much. happening today, the fcc will make history voting on new rules to regulate the internet. the commissioners led by democrats are expected to approve a proposal that would give internet providers, characterize them at title 2 carriers the same way telephone or natural gas providers are regulated. cable companies including our parent comcast and republican lawmakers have been fighting the new regulations.

scott mcgrew joins us now. not john oliver but the next best thing in trying to break down the topic. >> not even close. if you have the chance go on youtube and watch john oliver's take on net neutrality. he does a great job of it. the basic idea, sam, why we should care about it is, the idea that all data ought to be treated equally over the internet. your 1s and 0s, my 1s and 0s are the exact same priority. this allows start-ups after all in san francisco or elsewhere to compete with the googles. googles can afford all kinds of fast lanes on the internet if those were allowed and you and i as a start-up couldn't. it will continue to help the internet become interesting and new and allow small companies to compete. >> supporters would say this kind of levels the playing field and kind of encourages more innovation? doesn't matter how much money to get involved? . true. i think everybody's a support purse cable companies would be

5:42 light now. washington, d.c.'s new pot laws are now in effect. but it may not mean a thing. tracie potts joining us live from capitol hill this morning where a battle brewing, tracie, between city leaders and the federal government. good morning. >> reporter: that's right, because unlike alaska and colorado and washington state where marijuana's been made legal, washington, d.c. is not a state. it's a city, under federal jurisdiction. they have to get the approval from here on capitol hill for everything they do. some republicans are objecting to this new law that was approved, by the way, by two-thirds of d.c. voters. mayor muriel bowser says as a result she is going to enforce it, and republicans, some of them here, say as a result they're asking the justice department to get involved, and mayor bowser may end up behind

bars for violating, willfully violating, as they say, federal law. so the new law is in place as of midnight, which is when the period for review here on capitol hill ran out. it means that people over 21 years old can have up to 2 ounces of marijuana for personal use. they can't sell it. they can't barter it. they can give up to an ounce to someone and cannot smoke it in public nap means including in your parked car. >> and you wonder, tracie, if at some point it's inevitable, the complete overhaul of marijuana federal laws that pertain to marijuana could be in the works. thank you very much. >> reporter: certainly they're changing and seeing them change here and we're seeing them change around the country. interestingly something that's likely going to come up in the next election. candidates are probably going have to take a stand one way or the other. >> yes, they will. thank you so much, tracie. appreciate that report. and at 5:44 this morning a surprising new admission from the former police chief who led the investigation into the death

and livermore. on our way to upper 60s and low 70s today, but enjoy it, if you like the mild temperatures in winter, because big changes are coming our way come tomorrow. so today's highs low 70s around the south bay including los gatos and saratoga. upper 60s around san francisco into the north bay. 69 degrees there in santa rosa. 71 napa. goin see changes first with winds later today. not much wind outside now. look at the wind speeds by the evening into your friday. blustery and cool will be canadian air conditioning helding our way with the system dropping right down the west coast bring as chance of showers during the day tomorrow into tomorrow morning when we'll see a chance of showers. look at the snow there in the sierra and last weekend we had two inches of snow in the sierra from those showers. now this system is going to make a difference as you can see there. elevations above 8,000 feet may pick up more than a foot. there's great news for the sierra and about at least six inches there at 6,000 feet and snow levels maybe as low as just

understand is overcrowded classrooms? >> reporter: that's right, laura. it appears that many transfer students are not ready to take upper division courses here at san jose state. so they end up taking lower division courses, and taking away seats meant for freshmen and sophomores. a new policy is being considered to change the way this campus ranks a student's transfer application. according to "the san jose mercury" close in computer science and engineering would be ranked higher increases chances of being admitted if they've already taken the prep courses for that major. that way they are truly ready for upper division classes and more seats for lower division students in the lower division courses. before submitting the proposal to the csu chancellor people can give opinions as any one of three public hearings. first is later today from 3:00 to 5:00 at the student union theater on the ninth street plaza. the next is monday also 3:00 to 5:00 p.m. at the west valley
