struck the man five or six times. this is according to police task force. they say antonio montez was throwing rocks at officers. video taken by witnesses appears to show the man moving away froo none of the shots were to his back. police say they did use a taser at the incident has led to protestses are where more than half of the population is latino. and an update now on that commuter train crash and derailment in oxnard, california, on tuesday. the lawyer for a pickup truck driver who authorities say caused that crash says his complaint tried repeatedly to get his vehicle off the tracks but ran for his life when he couldn't. the crash injured 30 people. he is expected to be arraigned toda and the recent rough weather made couple looking to get married. first the roof caved in to the place they were going it to marry.

legalized marijuana in washington, d.c. to some it almost begs for a punchline. but it's no joke. when the clock struck midnight overnight, pot became legal in the nation's capitol. but this is washington wheritative made smoking into an art form. the law says you have to be 21 to smoke and for that up to two ounces roughly a sandwich bag's worth and can grow as much as six plants. only three are allowed to be mature. it's still illegal to buy or sell marijuana. but you can give away up to an ounce. still to really understand the law, you have to get into the weed. this is a local law. about 30 inches is on settable land. you can't light up on the steps of the lincoln memorial. either way, it only allows pot users to light up in a house. just not this house, which is controlled by federal law. some members of congress aren't pleased. two leaning house republicans wrote to mayor murial bowser if

jon benefit faye ramsay. the former police chief is shedding new light and questions about the case. here's nbc's halle jackson. >> reporter: it's a crime scene few could forget, the house where 6-year-old jonbenet ramsay was found strangled 18 years ago. but that scene may have been mishandled, according to the police chief who writes in an online q & a. we also did a poor job of protecting the crime scene. it was sort of like a perfect storm that day that set things off in the wrong direction. he took over the investigation nine months after ramsay was discovered dead in her parents' basement. no one has been convicted and the crucial piece of evidence is the dna on her clothes. the location of the foreign dna is significant, he writes, this could very likely be the person who killed jonbenet. >> i believe in saying that, help is really saying you can't prosecute anybody else certainly

until you could explain whose dna that is. >> reporter: reporter charlie brennan says beckner didn't understand his online discussion would be so public where he writes police should have separated john and patsy and gotten full statements from them that day. letting them go was a big mistake. the ramsays always denied any involvement in their daughter's death. >> i loved that child. >> i did not kill my child. >> reporter: it has created intense public scrutiny for decades. >> the interest we have seen shows the jonbenet ramsay's case is alive and well in people's imagination. >> reporter: two boulder detectives assigned to the cold case check out tips, which police say come in regularly, ramsey's father has now remarried. her brother burke lives in indiana and her mother died in 2006, buried next to jonbenet who would have turned 25 this summer.

morning. 7:40 now and time for an exclusive interview with robin williams' daughter zelda. after months of private mourning she's now speaking out and carrying on her father's charitable work. nbc national correspondent kate snow sat down with her. kate good morning to you. >> good morning to you, matt. zelda williams will be presenting what's called a noble award this friday night here in los angeles. it's an award that recognizes humanitarian work this one honoring the challenged athletes foundation which provides prosthetics. robin williams was a huge supporter, and now his daughter is doing all she can to keep his work and memory alive. >> laughter was incredibly important to him. >> reporter: you wrote last summer that your father was one of the kindest, most generous and gentlest souls you've ever known. and i want to quote what you wrote. quote, the entire world is forever a little darker less colorful and less full of laughter in his absence. we'll just have to work twice as hard to fill it back up again. >> yeah.

>> reporter: is that why you're doing this? >> i don't think it's sadder in general, that he's gone. i mean i think a lot of people feel his absence, but for me especially yeah it's going to take a lot of work to allow myself to have the sort of fun, happy life that i had. >> reporter: when everything happened last summer i'm curious how it felt to be you because it seemed like everybody was so stunned by it. and there was so much outpouring of -- i hope there was outpouring of support to you. did you feel that? >> it is not something that's even you can put into words, as much as i love words and have a lot of faith in them. there was an enormous outpouring of love from every corner of the world. and it's not to say that people didn't know dad. they knew a dad that he was proud of them knowing.

you should turn them into something that you can at least either express to other people or in his case he would make jokes out of it because it helped him not hide it. >> if you're on cocaine, daylight becomes a bit like a vampire on the day path. >> i think it was important for him for people to talk about important things. it meant a lot to him. he didn't like people feeling like the things that were hard for them they should go through alone. and i think that's -- that's the big legacy for him. and for me and for my brothers is that he somehow had an enormous number of people in this world who felt that he made them feel a little less alone. >> reporter: what do you want us all to remember about your dad? >> i -- people should remember what they want to remember about him. who am i to guide what their childhood memories of are watching his movies? that's their memories. that's what's important. i have mine.
