antioch, and we just learned that one is a homicide investigation. >> "today in the bay" stephanie chuang live in antioch and steph, police think these scenes are linked. >> reporter: yes, good morning to you, sam and laura. right now, police are being very tight-lipped because they're saying it's too early to tell. they are not confirming a link of this crime scene as well as a couple others but we're here at hudson court where they have confirmed, police confirmed they are investigating a homicide that took place at 11:18 last night. we've seen officers around here taking pictures, talking to people. there is a body on the sidewalk here in front of the apartments. we are not going to show it, but as you mentioned there are several crime scenes here in antioch this morning, including there was a shotgun that was discovered not too far from hudson court here in antioch, again, police not confirming the link to this homicide investigation. they're also not confirming any connection to a scene about a mile away at ma mog fee way wei aenspanos street where a car barreled into a corner house

where a woman was sleeping. she's physically okay but a friend and neighbor said she's shaken up. the officers took two people, a man and woman, into the patrol car. police and crime scene technicians aren't even here so they'll be out here for several hours, we're hoping to get an update within the next couple of hours. live in antioch, stephanie chuang, "today in the bay." >> thank you very much, stephanie. also happening today the family of an oakland girl is filing a lawsuit against ucsf bennie hoff children's hospital for a botched surgery. they claim hospital staff igred their calls for a doctor and later hounded them to donate their daughter's organs. she remains in a new jersey apartment on life support. the family believes the 13-year-old girl may still regain some of her brain function. neighbors in a mission district are calling for an independent investigation.

dozens showed up about last week's officer-involved shooting on fulsom sheet. they killed 21-year-old almicar lopez because he had a knife and lunged at officers. neighbors believed he dropped the weapon and was trying to get away. >> the suspect, the deceased lunged at the officer with a knife. he fired five shots. the original initiating officer fired one. >> we understand he did drop the knife. they had guns trained on him. he tried to get away because they weren't in uniform and they shot him. >> neighbors say perez lopez worked construction and sent money to his family back in guatemala. >> 4:34. new details about the deadly police shooting on l.a.'s skid row. about 30 minutes before the homeless man known as africa was shot by police he got into a fight with another man. surveillance video from a nearby store shows africa flipping a tent into the street and then getting into a scuffle with another man. people who knew africa told the "l.a. times" he had been living

on skid row for about a year and previously spent several years in a mental health facility. they say he had a temper but was also generous. he was shot by police on sunday after police say he grabbed an officer's gun. >> 4:35 right now. a california supreme court decision on where sex offenders can and cannot live could have ripple effects here in the bay area. jessica's law passed by california voters in 2006 was been successfulfully challenged as unconstitution. >> kris, this only applies in certain areas? >> reporter: it only applies to san diego county. we could see similar challenges here. put it in perspective. jessica's law requires sex offenders to live at least 2,000 feet away from a school or a park or where children gather, that is less than a half mile or fewer than two laps around a high school track, so in a setting like this in santa clara, where we are this morning, maybe there's a little

bit of space for that. however, san diego convicted sex offenders challenged this law saying that for them, it made it nearly impossible to find a place to live. if you're thinking, so what? they are criminals, why should their rights come first, law enforcement sided with them on this one saying that when the offenders cannot find a place to live, they can be a lot harder to track. sometimes they live on the streets or they stop registering all together. still, in san diego, where the change is beginning, folks are feeling really unsettled. >> those folks have problems and they have problems throughout their lives. >> why wait for a problem? why allow something like that to even become an issue? >> reporter: this week's decision in san diego is likely to affect other counties, where affordable housing is hard to come by, so we could see challenges in bay area communities as well, particularly in highly populated areas like san francisco, and oakland. by the way, the convicted sex

offenders are still barred from entering schools without a judge's permission and they are also barred from being anyplace near a park like this one if their victims were under the age of 14. in santa clara, kris sanchez, "today in the bay." >> so not a complete dismantling of the law there, thank you very much for that breakdown, kris. >> it is 4:37 right now. venture capitalist will take the stand today in a high-profile sex discrimination lawsuit. ellen pao sued kleiner perkins saying she was left out because she was a woman and fired because she complained. protester also make their voices heard in cupertino, upset over a proposed cell phone tower at a high school. verizon wants to install a cell tower at lindhbrook high. some say the school board didn't

do enough to notify them of the plan ahead of time. tonight they'll be urging the board to reconsider. >> it is 4:37. skateboard boarders in almeida county may have some legal obstacles to pass. ban would cover all county property, allow for citations to be issued against violators. other bay area jurisdictions have similar bans but critics say they're often ignored and seldom enforced. 4:38 and a colder start so far to your day, yes. but we have faith, rob, that could change and change very soon. good morning. >> that's right. we're going to see a warming trend as we go through the rest of this week but as our skies cleared late yesterday set the stage for a chilly start to the morning. 39 degrees in the north bay, napa, san francisco, 49 degrees, that's closer to the water keeping the temperatures up a little bit compared to what we're seeing in san jose right now. 41 degrees so you're going to certainly need a jacket this morning with upper 30s and low 40s. not much in the way of patchy

fog. few patches of low clouds but visibility looking good and as we go through the afternoon today mostly sunny skies. the area to watch around the hilltops, south of livermore and gilroy we'll see the clouds building up during the afternoon which could kick off showers south of gilroy but for the rest of the bay area, partly cloudy skies moving into the afternoon with temperatures despite that chilly start, mid-60s in spots. napa up to 65 degrees. mid-60s, pleasanton and livermore and after today the temperatures will vault up, not just talking 70 but mid-70s in the forecast there, getting into thursday and friday, the weekend starting off around san jose close to 75 degrees. now for another check of your tuesday commute we send it over to mike. >> looking from our foster city camera look at the eastbound lanes here, the tail lights. we can, i can kind of see it out here, one lane is blocked, that is your slow lane. we take this full to screen there's signs blocking your slow lane heading up the high-rise but on the other side as you get

close to hayward our camera at the toll plaza look at the flashing lights, two of the three lanes is blocked. that's the reason for more slowing, losing one more lane eastbound for san mateo bridge. westbound i saw flashing lights, crews should be clearing from that direction as well. we look at the map the slower drive eastbound with the direction for the arrow over to the east bay. over on 280 and 92 san mateo hills reports of overnight deer must have been hit in the area, so we will have to see a crew in there to address that issue. north of there a smoother drive approaching the bay bridge, easy flow from the top of your screen, novato, mill valley to the north bay. no problems for antioch, just a little bit of build for highway 4, close to the speed limit and zooming toward san jose and silicon valley a lot of construction, 280 and 85 around cupertino throughout the interchanges, watch for crews clearing over the next few. a proposal for a new tech

morning, at the early hour of 4:43. there say new push for an 11th uc campus, one focused exclusively on science and tech nothing. glendale assemblyman introduces a new bill for what he calls a public version of caltech. location to be determined. it calls on the university of california to study feasibility and potential locations along with funding, land acquisition and initial building costs. >> it's 4:44. nasdaq numbers are up this year thanks in part to a bay area business. >> for that and the rest of the news about of your bell we turn to, who else, landon dowdy live at cnbc world headquarters. landon, happy tuesday to you. good morning. >>. >> hi guys, happy tuesday to you. futures are lower this morning, following monday's rally that saw the nasdaq close above 5000 for the first time in 15 years. investors showing off economic reports showing a slowdown in consumer spending and manufacturing last month. it's just the third close above

5k for the nasdaq. the other two were in march of 2000 right before the dot-com bubble burst. the nasdaq is up nearly 6% thanks to apple in large part, up 17%. the nasdaq rising 44 points monday to 00008. the dow closing at a new record of 155 to 1888. less than three months after the u.s. and cuba agreed to restore diplomatic ties they've noticed a shift to cuba button on amazon site. it doesn't work and it's unclear how quickly they could start shipping packages. swiping left or right is free on tinder but taking it back will cost you. the popular dating app launched a premium service called tinder plus, for $9.99 to $19.99,

"the merkley news" reporting a newport beach oil company sued the county in hopes of getting a ban on fracking there overturned. if the lawsuit is successful it could set a new precedent in counties with similar bans including santa clara and almeida counties. in a few hours water officials will take the third snowpack survey of the year.

previously readings 19% below normal for this time of year. we had a little bit of snow this weekend. hopefully that will make a little bit of a difference. >> a little bit of a punch the last couple of days. in the meantime we had a burst of rain or several bursts of rain yesterday, rob, that could only be a good thing. good morning. >> we've been seeing more snow headed up to the sierra this weekend and from what happened yesterday. the numbers according to the automated stations, 15% of average, 20% average around the tahoe basin and 21% close to yosemite. we'll see what happens when they measure the snow at echo summit. not much drought relief in terms of the snowpack but the reservoirs year-to-date looking better than last year. chilly start around dublin, 44 degrees to wake up to this morning and closer to san jose, chilly, downtown san jose 41. we'll see the same numbers to 7:00 and lunch time climbing up

close to high temperatures yesterday, so low 60s showing up by noon and by midafternoon highs in the mid-60s today with some clouds trying to build over the hills of the south bay. right now, the radar is dry but a different story down in southern california where they had all of our wild weather across the beaches, huntington beach hail all over the place, the system continues to move through southern california today. with the cooler air aloft and daytime heating clouds trying to build around the hilltops, 2:00 south of gilroy a stray shower or two possible but most of the bay area looking dry today and high pressure builds you'll see the temperatures really starting to climb for the second half of the week. today near 65 in san jose, low to mid-60s around san francisco for the north bay and tri valley today. we'll see highs in the mid-60s and from here, temperatures start to climb on up close to 70 as early as tomorrow in san jose and mid-70s in reach just in time to start the next weekend. back to you. >> thank you very much, rob. happening today, pro-palestinian active is will

hold a protest in san francisco, angry with israel's prime minister over what they call the massacre of thousands of palestinians. new jersey new jersey benjamin netanyahu is scheduled to speak in front of congress at the israeli consulate in san francisco tonight at 5:00. 50 members of congress say they will not attend netanyahu's speech. republican leaders invited the prime minister to speak two weeks before his election. some lawmakers say the speech could be seen as just another campaign stop. president obama called the speech a distraction. >> it is a distraction from what should be our focus and our focus should be how do we stop iran from getting a nuclear weapon. >> for three years we've gone round and round in pointless negotiations. while we endanger both our security and israel's security. >> netanyahu and some republican lawmakers say the u.s. is not doing enough to stop iran. israel and the u.s. are in talks

to freeze iran's nuclear program but have not announced a deal yet. sam? new this morning the u.s. has 15 days to cut staffing at its venezuelan embassy after president nicolas maduro accused several americans of spying and says the u.s. is seeking to topple his presidency. he ordered caracas to cut back to 17 staff members because that's how many work at the venezuelan agency in washington. thousands headed to capitol hill to talk about controversial school nutrition standards. opponents of first lady michelle obama's healthy lunch program say the new menus are costly and unpopular. the senator from north dakota proposed his own school lunch standards giving schools more flexible. hillary clinton has turned over 55,000 pages of e-mails after people started asking why she used a personal e-mail address for government work. under federal law letters and

shot. the reason all the flashing lights. the crash hisperian boulevard on-ramp to southbound 880 is not affecting the freeway itself. build on the right out of livermore, a typical build off of 580 and theality month pass and the bay bridge toll plaza, no problems on the approach. the cash lanes are backing up to mid parking lot. we have two of the cash lanes closed typical overnight, they should reopen when everybody gets ready for the 5:00 shift and commute pricing and all the things that go on at the toll plaza. we'll track it for you, back to you. it's a chilling tribute that should make you feel warm inside. the boston red sox spring season starts today with a big nod to the ice bucket challenge. >> the ice bucket challenge when the sox kick off their exhibition season against boston college all players from both teams are going to wear jersey number 3, the number formally won by a boston college baseball player pete freits.
