>> we're talking chilly conditions for these folks overnight, this is the san mateo bridge getting ready to move. you're slowing down your move across the bay. and a live look outside this morning, there it is the bay bridge, it's tuesday, march 3rd and you are watching "today in the bay." good tuesday morning, thank you very much for joining us. i'm sam brock. >> and i'm laura garcia-cannon. we do have an update to breaking news this morning just moments ago police confirmed a homicide investigation is tied to another crime scene at a car and a house. "today in the bay's" stephanie chuang live in antioch this morning, steph, investigators just told you they detained three people? >> reporter: they have. they've got three people at the station who have been questioned by investigators. now, we're here on hudson court where a man was found shot to death lying on the sidewalk in front of the apartments after 11:00 last night. that body is here. we are not showing it. police have confirmed that three crime scenes are linked, all

surrounding this homicide. police say starting with an officer on patrol in this area, he heard a gunshot, saw a car driving away without lights on. that officer then tried to stop the car, but that car did not stop, so there was a chase. not sure how long it lasted but it ended here at mahogany way and spanos street where you see the blue toyota kamentry that smashed into the garage, into a dodge viper sitting there. police detained three people inside that car where investigators are questioning them at the station. police discovered a shotgun lying in the parking lot of the double dragon chinese restaurant that's on summersville road, very close to the scene of the homicide just a couple of blocks away. back here live, crime scene technicians are still here. they've been out with flashlights taking pictures. police expect to be here for an hour and a half, two hours. coming up, hear from one of the neighbors from that scene of that car crash and what she had

to say. live in antioch, stephanie chuang, "today in the bay." >> thank you, steph. the rules in california shaping where registered sex offenders can and cannot live about to get a little looser. state supreme court found it's unconstitutional to prevent offenders from living within 2,000 feet of a park or a school when there is a lack of available housing. "today in the bay's" kris sanchez is live in santa clara. the ruling applies directly to san diego county but it could end up back here, too. >> reporter: sure, we expect there could be challenges similar to the one in san diego here in the bay area and to put it in perspective as to why, jessica's law just as a reminder requires sex offenders to live at least 2,000 feet away from schools and parks. where we are right now between where we are and the lights behind me, that's a school we're at less than half a mile so we're actually about that distance away from where the sex offenders would have to be. that's the spacing basically what i'm saying, about the same

amount of space as folks who, offenders would have to stay away from the school. sex offenders in san diego county challenged that law saying that made it impossible for them to find a place to live, so if you're thinking so what, they're criminals, they should have to suffer the consequences, law enforcement actually sided with them on this one saying that when the offenders can't find a place to live, they can be a lot harder to track. sometimes they live on the streets or stop registering as sex offenders. in san diego a trial judge found that 97% of housing was off limits to sex offenders because it was too close to schools teen parks, and then the remaining 3% wasn't necessarily available. even with that, some folks say this change is trouble in the making. >> those folks have problems and they have problems throughout their lives. >> why wait for a problem? why allow something like that to even become an issue? >> reporter: this week's decision in san diego is likely

to affect other counties, where affordable housing is hard to come by, particularly highly densely populated areas like san francisco and oakland, so we expect that we could see some challenges similar here in the bay area as well. by the way, the convicted sex offenders are still barred from entering a school without permission and they are also still barred from being near parks if their victims were under the age of 14. in santa clara, kris sanchez, "today in the bay." >> thank you very much. volunteers will hold their final search for sierra lamar this next week. the morgan teenager disappeared on the way to school in 2012. they've run out of places to look. the last search for sierra will be march 16th. torres is charged with her murder and due back in next month to set a trial date. fairfield police need your help identifying a young bicyclist knocked unconscious in a crash with an suv.

this happened just before 1:00 monday morning on airbase parkway, between clay bank road and dover avenue. the driver stopped and called 911. when police arrived the bicyclist was unconscious. they say he was riding a blue mountain bike. he's in his mid teens to early 20s with a scar on his right eyelid and the bridge of his nose. if you know who he is, call fairfield police. happening today a family will file a lawsuit against children's hospital in oakland, the teenager declared brain dead after she suffered complications from throat surgery. bob redell is live with the new details of her case described in the lawsuit. good morning. >> reporter: good morning to you, laura. the lawsuit being filed in almeida county superior court for the first time describes the family's account of what happened to their 13-year-old daughter after what's been described as a botched surgery at ucf children's hospital in oakland. you might recall back in december 2013 a doctor operated

on jahai's nose and throat to alleviate her sleep apnea. when she came out of surgery she began coughing up buckets of blood. the suit claims two nurses contradicted each other how to stop the bleeding and refused the parents' initial request for a doctor. she allegedly bled for five hours, lost two pints of blood. doctor finally arrived, the teenager suffered a heart attack. the hospital eventually declared her brain dead and according to the suit started hounding her parents to sign over for an organ donation and allegedly approaching the mother when she was praying for her daughter inside the hospital chapel. the hospital won't comment on pending litigation but did tell the bay area news group their hearts go out to the family. the family believes jahai is not brain dead, that she has limited brain function. she remains on machines in an apartment in new jersey where

nurses tend to her 24 hours a day. reporting live here in oakland, bob redell, "today in the bay." >> a lot of details emerging now. thank you very much, bob. a south bay emergency animal hospital is open this morning even though a car crashed through the front door. take a look at these pictures. the crash happened at the united veterinary clinic in campbell near the camden exit off of highway 17. no word on what caused the driver to lose control. no person nor was any animal injured. san francisco's ferry building all dressed up today marking the 100th anniversary of the world's fair. crews installed a lighted 1915 on the tower, the same way it looked 100 years ago to welcome visitors to the world's fair. tonight, san francisco mayor ed lee and community leader also hold a special ceremony to light the tower and kick off the centennial celebration. it starts at the ferry building at 5:0. very cool. >> very much so. >> nostalgic. >> a little history for you on your tuesday morning. we saw a little breeze in the video, blue skies, looked inviting. maybe that's the kind of thing

we might find in the bay area this week. >> let's go, sounds great. rob, a cold start to our day. >> it's still inwither it outside at least for the north bay. 36 degrees. 48 in san francisco, warmer near the water obviously, the water helps to retain some of the heat and you got 48 degrees right now, 36 in the north bay. 41 in san jose and there you see 48 degrees, cloud-free across the bay right now looking nice in san francisco but a bit chilly in san jose right now. 41 degrees. fog not much of an issue for you in the north bay. little bit of patchy fog forming out towards fairfield, back into the sacramento valley and central valley. good visibility in san jose. still a jacket will be needed for this morning, through about 9:00 and lunch time pretty good, upper 50s to low 60s, highs today at least will be in the mid-60s and we're talking 70s for the second half of the week. one item to watch in the weather today, clouds building up near the hilltops, mostly to the south of morgan hill for a change, could bring a few isolated showers if you're traveling south of gilroy but

other than that the weather pattern is certainly turning drier and warmer. today mid-60s, close to 70 tomorrow, mid-70s thursday and friday and if you're planning ahead for the weekend the beach will be a good place to go. you'll see numbers in the mid-70s around the south bay, a little bit cooler as we approach sunday. now for a check to see what's going on in your tuesday morning commute here's mike. >> hail last weekend and beach this weekend. love california. over here we also love those crews because they maintain our bridges and roadways. they're starting to move, two lanes blocked approaching the hayward side of the san mateo bridge, eastbound restricts your flow toward one lane just off of that high-rise, the reason why we still have slowing. this crew is not cleared. westbound the crew cleared no more issues. eastbound it fluctuates from green to yellow, just a little overnight typical transition. the dumbarton bridge to the south moving nicely, highway 84. here's the south bay a little build as far as the volume of traffic north 101 at 680. getting ready for the first burst which doesn't kick in for

another 45 minutes. gentle flow of traffic. the peninsula moving at speeds for the bay area freeway, 280 through the we ininess laand up toward san francisco or out of the city. behind me a little slowing for livermore and behind me is the bay bridge toll plaza, the backup of the cash lanes clear as all lanes are open. back to you. >> looking good out there. as you fill up on your way to work don't cringe but gas prices continuing their steady climb upwards. according to aa they jumped two cents overnight. the national sanch naverage is $2.44 for a gallon of regular. here in san jose they are also inflated, $3.39 in san jose and san francisco $3.47 and oakland $3.37, up three cents from yesterday. we all love our coffee in the morning. is it good for your heart? that's what some researchers are saying, details next. >> love and also need. california's whacky winter

all right, coming up on 5:14 on your tuesday, and here is something you definitely don't hear every day, a wattle over herbicide brewing on the peninsula. caltrans plans to spray next week. the agency says vegetation is a fire hazard and a driving hazard when it's overgrown. people who live in the area say it is unsafe and unnecessary. >> i understand about fire safety but it is always possible to mow as an alternative. >> caltrans says it is not an option because they don't have the manpower to do it. if you are ready to talk trains in the future of b.a.r.t., now is your chance. b.a.r.t. board president host a one-hour twitter town hall today at noon. the topic, building a better b.a.r.t. system. some of the issues covered will

end to the appetite and the to the-com bust would come fairly quickly after that. so let's talk modern day, landon dowdy is at modern day cnbc. what do you think of that, landon? >> we're back. the adviser tech stocks just can't be stopped. we are all partying like it's the year 2000 on wall street. weak economic data with consumer spending and investing. investors seem to shrug it off. this is the third time we've seen the nasdaq close above 5k. the other two were in march of 2000 right before the dot-com bubble burst. the nasdaq is up nearly 6% thanks in large part to apple which is up 17%. we can't forget to tip our party hats to the dow, s&p and russell hit new records yesterday. >> landon dowdy, thank you much. tinder is out with a new version of its dating software. it's normally free.

certainly you'll find that heading into southern california but today it will be areas south of morgan hill and gilroy, around lunch time the clouds trying to build up on the hilltops but today we're thinking most of the showers should stay to the south of gilroy, the last chance of seeing any showers in our forecast for quite some time. high temperatures today as you saw, mid-60s around san jose, low to mid-60s for san francisco in the north bay you'll see the highs in the mid-60s today and then climbing tomorrow, close to 70 degrees for you on wednesday, and then low to mid-70s friday into saturday, as we move into the weekend these temperatures will stay warm as high pressure here acting like a wall, this has been the story of our winter taking all the rain and snow for the most part off to the pacific northwest, next chance of rain coming up march 10th a long ways off. gorgeous weekend ahead, mid-70s to start thing off saturday trending cooler towards sunday. let's see if your morning commute is shaping up innicely.

>> no big drama this morning. 580 slowing because of the volume of traffic headed to the dublin interchange no surprises. yesterday a tough morning, isabela vineyard. we usually see the compression and a crash will cause a big problem yesterday, back to the normal commute for pleasanton and livermore, the stretch 580 and 680 and a big build for your commute, moving over east to the altamont pass is where the slowing is, where the build happens farthest down on the bay area, same antioch in the northeast and folks moving over to the bay bridge we have the upper east shore no problems here. the north bay, novato, mill valley into san francisco no problems 101. anywhere north of the san mateo bridge moves nicely toward san francisco or oakland and looking toward the san mateo bridge itself. the earlier crew here has cleared lanes on the hayward side but you see flashing lights making their way backwards across that span. they still have to clear the lane on the other side and of

course we have san jose an easy drive for the south bay, guys, back to you. >> thank you very much, mike. it is 5:20 right now. family members of two men killed in the uc santa barbara rampage have filed a lawsuit. the parents of roommates of elliott roger is suing the county, sheriff and landlord. both men were from the bay area. the apartment complex and campus housing did not properly screen roger or warn that he was violent and unstable. the suit also alleges that the sheriff failed to perform a gun background check or watch youtube videos roger posted online. last may roger shot and killed six students and injured 14 others before killing himself. 5:21, rob talking about this a second ago, alluding to it. march coming in like a lion for part of the u.s., that has not seen much snow so far this winter. the northern midwest is bracing for blizzard conditions today, that includes areas from the dakotas to michigan. northeastern minnesota may see a

half foot of snow. minnesota is at about half right now of its normal snow levels this winter. gladly take some of it. not as extreme but certainly unusual, huntington beach in southern california covered up in hail. look at this, the beach turned into a winter wonderland yesterday, even stuck around for a while so people could check it out. are they making little snowmen out of hail? >> hailmen. >> go grab that extra cup of coffee. new research suggesting it could reduce risk of stroke or heart attack. >> the study was published online in the journal "heart." researchers found people who drink three to five cups of coffee per day had the lowest amount of coronary artery calcium a precursor to heart disease. they say don't go overboard. those who drank more than five cups per day had a higher level of coronary artery calcium. right in that window, sam.

everyone is headed this morning, tuesday, march 3rd. this is "today in the bay." a very good morning to you. thanks so much for joining us. i'm laura garcia-cannon. >> and i'm sam brock. an update to breaking news, police in antioch are investigating several different crime scenes this morning. one of them is a homicide, another is a car into a house. "today in the bay's" stephanie chuang is live in antioch and steph, officers tell you those two are, in fact, linked to each other. good morning. >> reporter: they are, good morning, sam and laura. detectives just left the scene a couple minutes ago and it appears that the coroner's office has just arrived in that van, this is the focus of antioch's first homicide of the year here where a man was funned gunned down lying on the sidewalk. an officer was on patrol when he heard a gunshot, police say. he saw a car, a blue toyota camera speed away without lights

on. look what happened after the police pursuit, you can see in the video the camry plowed into a house on the corner of mahogany way and spanos, that's the 1700 block of mahogany way. police detained three people from the car but have not made any arrests. no one was hurt, that's the good news, including the woman who was inside that house. her neighbor and friend spoke to us off camera. said the woman is physically okay but incredibly shaken up. >> barely get outside, of course, people have broken into her home on several other occasions literally so it's had it hard since she's lived here. >> reporter: police also discovered a shotgun lying in the parking lot of the double dragon my cheese strunt on somerville road a couple blocks from the scene of the homicide road where crime scene technicians wrapped up and the coroner's office has arrived so the scene should be wrapping up in the next hour or so. live in antioch this morning, stephanie chuang, "today in the bay." >> very much an active scene there still. thank you very much, stephanie.

the 19-year-old woman accused of killing a man in gilroy will be back in court today. gab ree ella ortiz used heiser's credit card at a san jose convenience store. police found heiser beaten to death in his home in gilroy last month. three men accused of sexually abusing a woman and holding her against her will in sonoma county are expected to enter plea deals today or pleas. the woman told detectives that the men kidnapped her in december, held her in a compound near santa rosa. she also said she was repeatedly beaten, threatened and raped. the alleged ring leader of that group faces 13 tell know charges including rape and sodomy. 5:32, happening today, the family of jahai mcmath is suing the hospital and surgeon who treated her following what they call a botched operation that left her brain dead. discuss plans to enforce a skateboarding ban that covers all county property. that ban would allow citations to be issued against violators. other bay area jurisdictions have similar bans but critics say they're often ignored and seldom enforced. people looking for federal relief after december's flooding have until today to apply for disaster loan applications for the small business administration, the sba. the storms on december the 11th and 12th damaged homes and businesses in san mateo, almeida, san francisco and santa clara counties. >> we'll find out today whether recent rain has done anything to help the snowpack in the sierra. state official also conduct their third snowpack survey this morning. previous surveys turned up some dismal results. the department of water resources says the water content this year is 19% of the historical average. >> we'll be watching the readings perhaps with one eye open, rob, hoping that maybe we'll get some encouraging news.

>> we managed to get about two feet of snow at sugarbowl this weekend, a little fell yesterday but when you're missing out on a winter that hasn't brought much snow you see the percentages north of lake tahoe, 15% of average, closer to 20% of average around yosemite. when they do the survey around echo summit some numbers may not look good but hopefully the last numbers we had will bring the numbers up slightly. 36 degrees in napa, 41 in san jose. hour by hour jacket weather through about 8:00 or 9:00 this morning and by the afternoon, clouds building up near the hilltops and eventually highs reaching the mid-60s today, and a slight chance still maybe south of gilroy for the afternoon, as the heating of the day ensues and you might see a stray shower or two for the afternoon but for the rest of the bay area, breezy conditions, dry conditions today and the stage will be set for a warming trend that will take us all the way into next weekend. 65 today in san jose.

mid-60s closer to san francisco and oakland at about the same towards the tri valley. things begin to warm up starting tomorrow. you'll see highs close to 70 around san jose and low to mid-70s as we approach the weekend with dry conditions lasting at least for now all the way through monday of next week. now to see how your morning drive is shaping up so far let's send it over to mike. >> rob, good morning, it's tuesday, hello everybody at the bay bridge toll plaza, getting ready for the metering lights, fast track lanes building a little more gradually than we often see on a tuesday so we'll track this, we have a standard flow off of 880 and look at the maps, no big drama but the slower drive heading up the incline as more folks head toward the funnel toward san francisco. east shore freeway 24 out of the caldecott and through the maze close to the speed limit for most of the areas. bigger build coming out of that area. the upper east shore no problems across the carquinez bridge and bay bridge also smooth. north bay san rafael the richmond/san rafael bridge clear across the water, golden gate bridge to san mateo close to the

area as a lot of the action now is across southern california and the low brought a lot of wild weather around the beaches of los angeles yesterday continues to head off toward arizona later today. one spot to watch hilltop south of morgan hill and gilroy for the afternoon around 2:00 and 3:00, still enough instability in the atmosphere for day time heating around the hills you might see a stray shower or two. most of the bay sunshine and mild temperatures, highs in the mid-60s around san jose. 60s for san francisco into the north bay and tri valley and as high pressure builds and winds turn offshore temperatures are going to climb on up starting tomorrow, close to 70 degrees, low to mid-70s for thursday, friday, into seaturday and with the high setting up where it is now the next chance for seeing rain in the forecast probably going to have to hold off until about march 10th as you can see that's the reason why temperatures climbing as we go through the week. another check of your tuesday commute here's mike. >> reporting from our gender

non-specific cave, hr makes us say that, over here the traffic and weather center we have the traffic because the metering lights are now on at the bay bridge. those lights were turned on just seconds after we showed it from the last report. there you go, all the backup in all lanes including the fast track lanes have the wait. we're looking at your maps and an easy drive on the approach, the slowing compression as you approach the metering lights, and a little slowing actually coming off that bay bridge, we'll check again but there are no incident reported on eastbound 80 out of the city and in towards oakland. well there it cleared up. love that live update. over here in the north bay moves smoothly and no drama there. same thing for the carquinez bridge and bay bridge. you just have your traditional build west highway 4 for antioch. we'll talk about the tri valley in a second. the peninsula down between the south bay and the city an easy drive there. northbound 101 shows your traditional build coming up toward 6:00 the first burst although it looked heavier than we often see, we'll track that and give you an update as we look at the live cameras in a second. i wanted to show you this,

one source tells "the times" you can hear an officer shouting "he's got my gun" multiple times. protesters are expected to march to express their anger over that shooting. >> a california supreme court decision on where sex offenders can and cannot live could have ripple effects here in the bay area. jessica's law passed by california voters back in 2006 has been successfully challenged as unconstitutional. "today in the bay's" kris sanchez joins us live in santa clara this morning. kris, help us understand this ruling only applies in certain areas? zbrr ohm applies in certain areas and certain conditions but we remind you jessica's law requires quon vikted sex offender to live at least 2,000 feet away from a park or school. that's about how far we are from the school behind us lit up. they say it makes them nearly impossible to find a place to live. if you think so what, they are criminals they should have a

price to pay. law enforcement sides with them saying when offenders can't find a place to live they can be a lot harder to track, that means sometimes they live on the streets or they stop registering. in san diego, a trial judge found that 97% of all housing was off limits to sex offenders because of the proximity to schools and parks, that left 3% available but doesn't necessarily mean it was available to them. even with that some folks say this change is trouble in the making. >> those folks have problems and they have problems throughout their lives. >> why wait for a problem? why allow something like that to even become an issue? >> reporter: this week's decision in san diego is likely to affect other counties where affordable house something hard to come by. judges and prisons can still require very strict standards for offenders, depending on what their offenses were, and what their history is. the offenders are still banned
