the dublin interchange. >> a live look outside, love that view of the bay bridge, on this thursday, march 5th. this is "today in the bay." a very good morning to you. thanks so much for joining us. i'm laura garcia-cannon. >> and i'm scott mcgrew in for sam brock this morning. many eyes in silicon valley focused on a high-profile sex discrimination file. the woman who filed the case is going to take the stand today. >> "today in the bay's" stephanie chuang is live in san francisco. the former executive says she was passed over time and time again for promotions because of her gender. >> reporter: that's right, good morning, laura, good morning, scott. ellen pao has her law and business degrees from harvard and a double e degree from princeton. she wants $16 million in damages for what she says was gender discrimination and retaliation. she says she was fired because she complained.

taking the stand the last two days was john dohr, the man who clearly tried to avoid the cameras trying to hide behind staffers is the kleiner perkins partner who hired pao in 2005 to be his chief of staff. pao left in 2012. her attorneys say she was consistently performing better than her male peers who with less tenure were promoted over her. kleiner perkins defense lawyers say the firm's partners did not trust pao enough specifically indicating she lacked interpersonal skills and was dismissive of more junior employees. dohr also says unlike other firm partners he supported pao when he learned that she had an affair with another junior partner. e-mails show that dohr blamed that man and called him untrustworthy. that man was later promoted to general partner at kleiner perkins. pao was not. this is the end of the second week of what could be a very

longlasting trial, maybe lasting up to four weeks or more. coming up, the decision by the judge in this case that could have an impact on the outcome. live in san francisco, stephanie chuang, "today in the bay." >> interesting one to follow. thank you, steph. 5:02 right now. we have new video to show you this morning of frightening moments after a u.s. ambassador with ties to the bay area was stabbed and slashed multiple times. mark lippert is the ambassador to south korea. overnight he tweeted "doing well and in great spirits. i will be back asap to advance u.s./korea alliance." a man with a ten inch knife attacked lippert before a snepeh in seoul. he received 80 stitches. guards wrestled the attacker to the ground. the suspect was upset about u.s. and korea military drills and the split from north korea. palo alto police will be on patrol keeping their eyes out

for people who may be breaking into cars. >> kris sanchez is live where two people are already under arrest. >> reporter: two men arrested and we don't know whether they were specifically connected to the nine burglaries that happened tuesday night alone but when police tracked them down they had stolen property on them. palo alto police increased the pressure to find the car burglars that were getting a bit too comfortable in the city. the thieves broke into nine cars tuesday night alone, not exactly a record, but still not enough for pd to stand by and let it happen. they activated a task force, they put officers out in uniform and in traditional patrol cars but also plain clothes and specifically targeted parking garages in the city, where nine of the recent car burglaries happened. >> they may look in windows and see an ipad or a laptop bag, that's all they need to see, they'll smash the window, grab items and they're gone quickly. >> reporter: police rounded up

two men in the sting and did recover some stolen property. police also perhaps most importantly identified a pattern they say the thieves seemed to like rental cars because it's often a place that travelers leave their valuables and also find that the top floors of the city parking garages are ripe for the picking. knowing that, they say that you can make some decisions to better protect yourself today, make sure you park where there is traffic, don't leave anything valuable. thieves are smashing through the windows and taking anything, they don't care what the value is because for them it's all free. kris sanchez, "today in the bay." >> thank you. police trying to figure out what led to a shooting in the middle of a busy bay area freeway, it happened yesterday during the evening rush hour on eastbound 580 in oakland near the broadway off-ramp. police shut down part of the freeway while they investigated. investigators say at least two cars were involved in an accident. how the shooting happened is still unclear.

sun yu veil showdown over gun rights. federal appeals court upheld an ordnance banning people who live in the city from owning and possessing high capacity ammunition magazines. in 2013 voters approved the most restrictive gun control law in the state. an attorney representing the nra pledged to appeal the decision to the u.s. supreme court. six southern california police officers are suing their department claiming they faced retaliation for not meeting ticket and arrest quotas. the six whittier police officers claim the department imposed quotas in 2008 when they opposed the quota they were threatened with disciplinary action including counseling sessions and unwanted transfers. police quotas are illegal in california. the officers claim the practice continues there to this day. 5:05. the fda is encouraging extra disinfection procedures at hospitals after a deadly bug was discovered at another hospital.

hospital representatives say four patients are infected with the drug-resistant bacteria. another 71 patients may have been exposed. officials are linking the superbug to a device used to diagnose digestive issues. the discovery of a destructive insect raising concerns in the north bay. inspectors discovered a sharp shooter in a marin county nursery. the pest is a threat to the water levels and grape crops. inspectors discovered it in a plant shipment from southern california, that shipment was sent back and traps set at the nursery. no other sharp shooters have been found. >> that could be detrimental to the crops. also needed some rain but i think that could be in the work for next week, right, chris tee fa? >> early next week. we're already getting close to that weekend at this point, you might be trying to make the plans and before you know it, we'll meet back here and tracking showers. 43 degrees in concord. good morning to you, out in livermore, another place where they're growing those grapes, 40

degrees there. 39 in san martin and 46 degrees to kick off the new day in san carlos. high pressure is firmly in control of our pattern and this is going to continue to move the winds offshore, as that wind moves from the hills toward the ocean it negates the marine influence. we're seeing warm temperatures even at your local beaches. sunny skies on tap today and near record highs, five to eight degrees warmer than where we ended up yesterday. these are your noon temperatures taking you through your day. cold to start, you probably want to dress in pllayers. 66 degrees on the peninsula at noon if you wanted to have lunch outside and palo alto, comfortable conditions there. 6on the east shore and looking good to hit the mid to upper 60s at noon in the south bay as well. we'll round out the day in the 70s and a beautiful weekend with even warmer temperatures coming your way. i believe we'll see 80s in some spots. as we get into your weekend. because of the recent snowfall in tahoe it's a ski and surf

weekend. two and a half hours up to the snow, maybe two hours to get to your favorite beach, even closer if you're trying to get down to santa cruz from the south bay. this is what you can expect, lake tahoe upper 50s, lows still in the 30s, it's cold enough to make that snow and they are definitely doing so on the central coast abundant sunshine, highs in the low 70s. beautiful weekend for the central coast, mid-40s as lows and like laura was pointing out we have rain in the forecast and how much snow we expect in tahoe. first we check your drive and see what's changing with mike inouye. >> we're lucky we can ski and surf on the same weekend. my gosh. over hoar no problem. the backup of the cash lanes cleared, all open for the morning commute at the bay bridge toll plaza. we'll look at your maps to show you the approach, upper east shore freeway no problems. eastbound 24 a crash over on the shoulder just before you get to

the caldecott tunnel. it might contribute to a little slowing just before 60 toward the orinda area. westbound 580 the commute direction toward the dublin interchange. you see a typical pattern slowing for 84 and a little build out of the altamont. live camera where the arrow is, a crash has been reported west 580 at tassahara. no construction and no crashes. traffic is moving smoothly. farther beyond that we have reports of a crash at foothill no, slowing there just past the dublin interchange and in the south bay live look northbound 101 just north of 680. the entire south bay about this volume, this is probably heavy for the rest of the south bay and silicon valley. back to you. >> 5:09. coming up, a bay area first. >> doctors are getting ready for surgery on 12 people, the largest kidney donation chain on the west coast. we'll have details next. let's take you out live to san jose. it's been a beautiful evening,

and a very happy thursday to you, as we look down into the city, and absolutely beautiful and clear out there. 5:12. rare kidney transplant procedure set to begin in the bay area in just a few hours. >> it is fascinating a six-way kidney donation chain taking place at the california medical center in san francisco. >> bob redell, this is an historic swap. >> reporter: very, very rare. good morning to you there, scott and laura. this will be taking place over the next couple of days at cpmc. six people receiving new kidneys from six donors, the largest kidney donation chain to take place on the west coast. started with a woman in sacramento who lost her husband and son to cancer. to ensure someone else wouldn't lose a loved one to a terminal disease she agreed to donate one of her kidneys to a stranger.

the stranger has a relative who wants to donate but incompatible. they agreed to donate to another stranger who wants a relative to donate, incompatible and the chain will continue on and on until six people received in kidneys the ultimate in pay it forward. >> i'm doing it because there might be someone out there who doesn't know they could do this too and help save other lives and improve people's lives. that was my big driver. >> it's being kicked off because one individual acted as an altruistic donor and wanted to donate a kidney but didn't have a recipient in particular to give a kidney to. >> reporter: there are 12 donors and recipients in all, this includes three parents, three children, two siblings and one brother and sister-in-law, but again all those on the receiving end will be relying on someone else's relatives, since their own loved one isn't compatible.

everyone is from the bay area and central valley except one from arizona. the transplants taking place over two days. we have three today, the remaining three tomorrow. reporting live in san francisco, bob redell, "today in the bay." >> just orchestrating all that is fascinating, thank you. now to an exclusive investigative unit report. washington, d.c., is taking notice after an investigative unit report we first exposed what an insider calls failures at the agency supposed to protect whistleblowers, workers who speak out in the name of public safety. we told you about daryl whitman, who works for osha. he's an investigator who works for osha. he was told to close cases quickly and meet quotas. after a show of support from workers who have already reported safety concerns and a call from the united states office of special counsel, whitman says the agency is now looking into his claims.

>> when we don't step up and do the right thing, it's not just us, it's not just our fellow worker, it's the public as a whole that them is at risk. >> reporter: we will show you the numbers behind whitman's claims. our full report airs tonight, we investigate at 11:00. hbo reportedly in talks with apple, google and others to be launch partners for its highly anticipated hbo now video streaming service. reports say the standalone service will cost 15 bucks a month, expected to launch next month to coincide with the premiere of the new season of "game of thrones." hbo now is aimed at tracking or keeping customers who are increasingly ditching expensive cable tv subscriptions. several major theater chains have decided not to show "beast of nations" an african war film that netflix bought the rights to this week. "variety" says netflix was going to release the film on the

streaming service at the same time it would have debuted in theaters. typically movies aren't released until at least 90 days after they open in theaters. let's get a check of the markets this morning. landon dowdy is live at cnbc world headquarter, good morning. >> good morning, scott mcgrew, talking to me twice in one day, this must be my lucky day. stocks fell for a second day in a row wednesday, investors reacting to a number of economic reports showing moderate growth in the labor market and services sector out of tomorrow's key monthly jobs report. look for data for new filings for unemployment, worker productivity and labor costs and factory orders. the dow dropping 106 points the first triple-digit loss since january to 18,096 the nasdaq falling 12 to 4967. >> landon, i'll do it again tomorrow. apple reportedly told suppliers to start mass production of a bigger ipad in the second half of this year

versus original plans for apparently this winter. this new ipad which will have a nearly 13 inch screen is aimed at business users. apple is considering adding usb ports that can quickly transfer data and connect a mouse and a keyboard and i got to be honest, that sounds like an microsoft sr. 5:18, a new study suggests staying fit during middle age may benefit the brain. researchers registered the fitness level of 1200 middle aged adults and followed up late we are cognitive testing. people who had a lower fitness level in their 40s had smaller brain tissue volume in their 60s and performed more poorly on test measuring making decisions. following a mediterranean diet cuts your risk of heart disease in half. people who most closely followed the diet were 47% less likely to develop heart disease in the next ten years. in fact, sticking to a diet rich

in fruits, vegetables, whole grains and fish was more protective than even physical activity. but i say you combine the two, you probably are going to be pretty healthy. >> yes. do fish sticks count? >> you sound like my husband. >> let's check in with the wonderful weather forecast. >> it's going to be great out there. not quite chowder weather if you want to head out to pushermen's wharf but we are going to see a return of winter as we get into next week, but for today, temperatures are going to be way above average. the average is about 63 degrees in san francisco this time of year. today we're going to hit the 70s, and even warmer weather coming your way as we get into the weekend. right now if you're headed outdoors, maybe just joining us starting your day, go ahead and layer up today. that's probably the best advice i can give you when it comes to picking that wardrobe because your lunch time temperatures will be in the upper 60s, that's when you can ditch that coat and then you won't need it at all getting into a nice, warm car if

you park outside later on. 73 degrees on the peninsula today, 72 for the tri valley and 70 degrees in the city by the bay. widespread 70s, widespread sunshine. we're going to see peak warmth for the weekend if you want to make beach plans beautiful conditions to do so, still in the offseason. as you know it gets jam packed at our local beaches late spring and summertime so take advantage if that's something that you like, a nice beach all to yourself. you can enjoy that for the next couple days and then things are going to change that rainy pattern moves in. let me show you your futurecast and give you an idea of what you can expect. mid-70s for the weekend, low 70s moving your way, as we get into monday, and then the rain moves in, so we stop the clock on your futurecast, tuesday starting to see temperatures drop off a little bit but then on wednesday at 8:00 a.m., showers arrive and we get into this pattern that will stick with us wednesday, thursday and friday. we're talking about potentially measuring up to half of an inch of rain. snow levels starting at about

7:00,000 feet, could pick up to a foot of snow above 7,000 feet, so that's the good news but it's another warm system so lake level snow not looking good at all. we'll have more coming up. over to you, mike. >> i'll keep that in mind if we are thinking about snow at the lake. san mateo bridge not a problem, this is good, looking west toward the peninsula, clear view of the high-rise. look at your map no delay across or on the peninsula. folks haven't made their way over yet. traffic will come over from 808, the nim et cetera freeway close to the limit. dumbarton a little bit of slowing. farther east hayward 880 off the castro valley area and looking over here toward the dublin interchange a clear drive but a crash reported at tassahara. i got a detail there and that may be blocking the slow lane. no slowing shows up yet. the tri valley commute is critical at this time. south bay san jose the rest of

plan designed to double the number of women pilots. in order to make the tough job more appealing pentagon leaders are offering incentives to women like expanding maternity leave. the government is also waiving a height requirement. pilot candidates used to have to be at least 5'4". only a quarter of air force applicants are women. a man cannot sue applebee's because he got burned bowing his head to pray over a skillet. >> he says the waitress didn't warn him. >> the man says he bowed his head to pray, the sizzling steak popped grease on his face, panicked, knocking the skillet on his lap causing more burns. ringling brothers, barnum &

>> those protests started after the town's mayor responded to the department of justice's report accusing the police department of racial discrimination. the report issued in the wake of course of the police shooting in the death of michael brown last august protesters gathered peacefully outside the police headquarters. some want the police department to disband. a southern california man accused of trying to fly overseas to join isis will head to trial. the "l.a. times" reports 21-year-old adam danidge faces a number of charges trying to provide a number of sources and materials to the group. he was arrested last july just before boarding a flight to turkey. he pleaded not guilty. police in virginia arrested a 17-year-old high school student accused of helping a classmate travel to syria to join isis. the teen will be charged as a juvenile. the man who traveled to syria is facing indictment but authorities have not said where he is. happening today, a second

day of testimony begins in a few hours in the trial of boston marathon bombing suspect dzhokhar tsarnaev. during opening statements prosecutors introduced new security video showing the moments after the deadly bombing. >> the defense attorney admits tsarnaev was under the influence of his older brother. jay gray joins us from boston with the latest on the high-profile case. good morning, jay. >> reporter: good morning, scott. good morning, laura. we expect to hear more emotional testimony from survivors here today, yesterday of the six witnesses first called, four were survivors with gripping tales of what happened, when the blasts occurred and the difficult task they've had to recover and try to come back in the two years since. you're right the defense with the bombshell to start this case early saying that in fact dzhokhar tsarnaev did take part in the bombings here but they tried to change the foe success shifting it to tamerlan tsarnaev, the older brother of dzhokhar saying he was a father

figure and that dzhokhar was a follower, not someone who planned or plotted this but following the wishes of his older brother. we expect to hear systtestimonym survivors and hear new images from the attacks. many too graphic to show you on television. this is a trial scheduled to last three to four months, that means it will likely be going on when this year's marathon runs on april 20th. scott, laura, back to you. >> jay, thank you. at 5:33, overnight dozens of people including an lapd officer held a prayer vigil for a homeless man killed by police officers over the weekend. it was not focused on politics. instead it focused on shared sadness so people could come, pray. the officer was apologetic over what happened even though he wasn't there. >> we came on the job to save

lives, not to take lives and unfortunately it's just a part of our job and i'm sorry, i'm sorry. >> police say they shot and killed the homeless man after he reached for an officer's gun. stanford is part of a growing list of universities under investigation for the handling of sexual assaults. that list includes 100 other universities across the country with more than 100 separate assault cases under investigation. the stanford investigation stems from a high profile assault last year, student leah francis says she was sexually assaulted offcampus by a student she had previously dated. she says that student was not punished enough and demanded change. today we will finally hear from the tech exec suing one of silicon valley's biggest venture capital firms. she's taking the stand in the sex discrimination lawsuit. >> "today in the bay's" stephanie chuang is live in san francisco. stephanie, the executive claims she was discriminated against because she's a woman. >> reporter: that's right, good morning, scott and laura. it's all happening at the trial anyway at civic center

courthouse behind me. this has taken center stage in silicon valley with a rare peek at the hottest firms that had investments in google and twitter to startups like uber and snapchat. john dohr was trying to hide behind staffers to avoid the cameras yesterday. he took the stand the last couple of days as the kleiner perkins partner who hired ellen pao in 2005 to be his chief of staff. pao left in 2012, the woman with a law degree and business degree from harvard and double e degree from princeton is interim kecet social media site readit. pao's attorneys say the firm promoted male peers with less tenure over pao while defense attorneys say management didn't trust her because she lacked the skills to work with others. the judge in this case made a rare decision allowing jurors to submit written questions to witnesses for clarification. one such question yesterday was, if you didn't trust ellen pao, why did you place her in a

'going to be a great weekend for outdoor plans, maybe you're someone who likes to play a little basketball, a little tennis, even golf. gorgeous conditions for all of those events. i can tell you as we get into the next couple days it's only going to get warmer and warmer. we're kicking off the day at 40 degrees in livermore, 43 degrees in san jose. temperature also warm rapidly after sunrise which will occur at 6:38 this morning. it will be chilly until about 10:00 a.m. today. you can ditch that jacket. we are on our way to widespread 70s, abun dan sun, clear skies. your sun sets at 6:0 and we meet back here next week sunset will occur just after 7:00 p.m. so things are going to start to change not just when it comes to the weather but we lose an hour on sunday. 70 degrees today in san francisco, 73 in the north bay, and 73 degrees right here in beautiful san jose, into the mid

day. ringling brother barnum & bailey circus will eliminate all elephant acts by 2016. they are feeling pressure from animal rights activists. if you ever went to a show they were always out there. >> reporter: i was going to say the exact same thing. if you stood outside in line for the sir cass at s.a.p. or oracle arena or any of the places where the circus shows up, you probably have been approached by a protester and probably have been handed some pretty graphic evidence of what they say is animal cruelty and it appears that ringling brothers is bowing to the pressure over its elephant act. just today the company announced it will end its elephant acts in its traveling circuses, that means the 13 el gants on tour with three different units will relocate to the ringling brothers center for elephant concentration. according to the company, they will join a herd of 40 other ringling elephants already

there. in a statement the chairman and ceo of the parent company of bar yum and bailey says no other institution has done or doing more to save the species from extinction, and that is something of which i and my family are extremely proud. this decision was not easy but it is in the best interests of our company, our elephants, and our customers. the company may say that it is really all about conservation. protesters would likely agree and backing them up, the usda did slap the circus with an unprecedented fine back in 2011. the parent company was fined $270,000 in what the usda, the regulating agency says was about sending a message. that fine came after an undercover investigation by peta was substantiated by the u.s. department of agriculture and the company again was fined for its treatment of its animals. we'll have more on this throughout the morning for you. for now from s.a.p. arena, kris
