"today in the bay's" stephanie chuang live in san francisco. lot of people are watching this trial closely. >> reporter: they are, good morning laura and scott and especially maybe today because ellen pao is set to testify at the civic center courthouse. in seeking $16 million in damages she has to prove she was discriminated against at kleiner perkins because of her gender. john dohr was hiding behind staffers before testifying last two days as he's approaching the courthouse anyway before testifying the last two days as the kleiner perkins partner who hired pao in 2005 to be his chief of staff. pao who holds a law and business degrees from harvard and double e degree from princeton left in 2012 as a junior partner. her attorneys say pao outperformed male peers with less tenure promoted to senior levels over her. on the other hand defense lawyers say management didn't trust pao because she lacked the skills to work with others. the judge made a rare decision allowing jurors to submit

written questions to witnesses for clarification. one question yesterday was why there were so few women in venture capital. dohr pointed to a babson college study released last year only 6% of partner level positions at 146 firms in 2013 women held those. that's worse than the rates in 1999 at 10%, and dohr says women make up 20% at kleiner perkins partner level positions. pao is right now the interim ceo of content said readit. kleiner perkins is trying to limit damages she can seek claiming she is compensated well at her current job. live in san francisco this morning, stephanie chuang, "today in the bay." >> it will be fascinating to see how it turns out. thank you, steph. stanford part of a growing list of universities under investigation for their handling of sexual assaults. that list includes 100 other universities across the country with more than 100 separate assault cases under

investigation. the stanford investigation stems from a high-profile assault last year. student leah francis says she was sexually assaulted off quamp us by a student she previously dated. she said the student was not punished enough and demands change. police are looking for those breaking into cars and stealing valuables in palo alto. tuesday night nine cars were burglarized near busy university avenue. the thieves were looking for electronics and targeted garages and rental cars because they know they often have valuables inside. >> they may look in windows and see an ipad or a laptop bag, that's all they need to see, they'll smash the window, grab items and they're gone quickly. >> overnight police arrested two men in a public garage. they found stolen property in their car. officers are not sure if the men are connected to the recent car burglaries. they say they're fed up with development. activists in san francisco are fighting a massive housing project in the mission.

protesters shut down a developer's community meeting last night. company called maximus tried to present plans for 1979 mission house en'retail development at 16th and mission. opponents shouted them down making clear they don't want what they call a monster development. >> they'll want to tear down the building i live in and put up more condos. >> this say compromise, we've gone beyond what other developers in the city have done and coming up with a new way. it's not just rental housing it's for sale middle class housing. >> maximus agreed to fund the creation of 90 affordable housing units and build a playground and nearby elementary school. the next few days to make or break the future of dance in san jose. they are kicking off a major fund-raising campaign, it needs $550,000 by march 14th in order to keep operating.

the money is needed for its performing company, school and educational outreach program. ringling brothers and barnum & bailey circus announced it will eliminate all elephant acts from the circus by 2018. the move is in response to growing public concern about how the elephants are treated, as they are phased out of the shows, ringling brothers say they will be moved to a conservation center in florida. developing right now the fda is encouraging extra disinfection procedures at hospitals after a deadly superbug discovered at another topicalical hospital. the bug was found at cedars-sinai medical center in los angeles. four patients are infected with the drug-resistant bacteria. another 71 patients were exposed. officials are linking the superbug to a distinct medical scope used to diagnose digestive issues. medical mystery in the bay area. handful of skilled surgeons will

carlson and cutting boulevard may slow down golden gate field. the bay bridge toll plaza metering lights are on. you saw the north bay no slowing out of novato through mill valley. typical pattern for the east bay and tri valley, dublin grade, 880 slows south hayward toward fremont typical boulevard. 87 shows a little slowing. north 101 there was a stall reported north of our live camera at alum rock but it has not backed up this far, just a quarter mile on the approach. they must have moved that stall. you talked about the lights at the bay bridge, overnight tonight is the last night could you see the glowing lights. >> it's beautiful. >> they have to maintain the cables, caltransdus and they'll be back in a year. >> takes a lot to maintain those. >> more important than the lights, okay, fine. >> how many people does it take to shall it -- all right. it 16:is 6:11.

here are the top stories this morning. the woman at the center of a high profile gender discrimination case will take the stand today. ellen pao says the silicon valley venture capital firm kleiner perkins did not promote her because she's a woman and fired her when she complained.

ringling brothers will phase its elephant acts by 2016. they will be retired to florida. doctors at the pacific medical center in san francisco will take kidneys from six healthy people and transplant them to six others in need. the chaos right after u.s. ambassador mark lippert was attacked by a man with a ten inch knife. you can see lippert rushed out here an event in seoul, south korea, his face and arm completely bloodied. moments before a korean nationalist suspect reported shout the south and north korea should be reunified. police arrested him right away. lippert was bandaged and rushed to a nearby hospital where he is recovering this morning. he has ties to the bay area, he actually earned a bachelors from stanford in political science in 1997 and masters in international policy studies the

following year. he became the ambassador to south korea last year. south korean conservative group gathered this morning to burn pictures of the 55-year-old suspect. police say he is a member of the group hosting the event, where the attack happened. just moments ago a second day of testimony began in the boston marathon bombing trial. nbc's jay gray is live in boston following the developments for us. what can we expect out of court this porng? >> reporter: hey there, scott. we expect testimony to begin within the next few minutes. waiting on the judge to enter the courtroom. sempbls in attendance. we should hear emotional testimony from survivors, some at the scene and helped those who were most injured. we expect nor images never before seen, some will be too graphic to show on television. all as the trial begins and the clear focus is not snes earl just dlins here.

the trial began with gripping emotional testimony, graphic evidence and a stunning admission from judy clark who announced during her opening statement "he did it," acknowledging dzhokhar tsarnaev's role in the deadly boston marathon bombing calling the misguided acts inexcusable but urging the jury to keep an opening mind saying older brother tamerlan was a father figure who pulled dzhokhar into his passion and plan. >> the best chance they have to generate sympathy is the relationship with his brother. >> reporter: prosecutors countered said he believed he was in a holy war against americans and telling the jury he planted a homemade bomb behind a row of children near the finish line. he pretended to be a spectatpes but had murder in his heart. rebecca gregory said "i thought that was the day i would die"

then cried as she remembered her friend crystal campbell, who did. tsarnaev stared straight ahead during all of the testimony showing no emotion and making no eye contact. his legal team chose not to cross-examine any of the survivors who took the stand. the judge now taking his spot in the courtroom, the jury expected to settle in as we begin day two. the latest live in boston, scott back to you. >> jay, thank you much. it is 6:18, time to check out the microclimate forecast this morning. let's take a peek outside, why don't we, from the south bay now this morning. temperatures, what, in about the mid-40s so far this morning, christina? >> yes, into the mid-40s. it's chilly out there, cold enough for that snow-making to occur in tahoe and it's looking really good out there right now. we have five feet of snowfall at the base in tahoe, looking good at squaw and alpine meadows. temperatures starting out in the upper 30s to low 40s, we're at

38 degrees in the north bay to kick off the day, looking nice and warm, 49 degrees in san francisco, later on today in the 70s but it's mild out there right now. you're starting out by the water with temps in the upper 40s. 65 degrees later on today, at lunch time, temperatures nice and comfortable for your outdoor plans and looking good to round out the day in the low to mid-70s so 75 degrees is the forecasted high in santa cruz. we're going to be just under that here in the south bay, 73 for the peninsula and 70 degrees straight up in san francisco. so maybe you did want to hit tahoe, alpine meadows or squaw as we get into this weekend. i can tell you it will be spectacular out there if you like the sunshine when you're going down the slopes. sunny and cool, highs in the upper 50s, lows in the 30s so they're still settling making that snow and that's great news, because we really need it out there. hour you can get it, and i have heard from people who went up there last weekend, it's actually pretty choice conditions especially compared to what we were dealing with

earlier in the season and there's more on the way so feel comfortable about it, enjoy the temperatures while they last. central coast could be in the 70s this weekended. mid-40s overnight. as we head through the next couple of days, temperatures stay nice and mild. an early taste of spring saturday into sunday and winter's grip takes hold, returns as we head throughout next week. want to remind you, spring forward, we lose an hour of sleep on sunday, remember to set your clocks ahead, only those clocks you manually have to do, all our digital gadgets tend to do so automatically. you want to check the batteries in your smoke detectors, a good way to keep you and your families safe and pets of course. throughout the morning your sun will rise at 6:38, that will change by sunday. we have to wait until 7:33 in the morning for the sunrise. let's talk about the rain and snow along the way, stop the clock at 9:00 a.m., this is next wednesday, that's when the heavy stuff starts to move in.

them over to congress and new this morning, the republican national committee is asking the inspector general at the state department to look into this. >> good morning. >> reporter: a new subpoena the state department says this morning they'll work fast but reviewing hillary clinton's personal e-mails will take time. in a late night tweet she urged them to turn over everything, saying "i want the public to see my e-mail." those e-mails may include inquiries about security in benghazi before the deadly 2012 attack. >> it's not clear what's in them. they still don't know. >> reporter: lawmakers may subpoena clinton, the e-mails stored on her server at home. >> we have to send a request to her specifically, directly and personally. >> reporter: the state department says employees can use private e-mail. >> it's not prohibited. >> reporter: clinton was required to turn her e-mail but there's no rule on when. >> it's important these e-mails

morning. >> what a beautiful place we get to call home. >> we're lucky. >> just gorgeous out there. temperatures are going to be really lovely out there for today, but i do want to give you an update as to what's happening in tahoe, because a lot of these systems, we've had some pretty good rainfall this year, here in the bay area, but they've been warm systems. the last one, though, was the coldest of the season so far, and as a result you've still got five feet of snowpack at the base. squaw valley, and alpine meadows. that's the good news. you want to head out there this weekend, temperatures comfortable. you won't need the chains but getting into the following weekend you likely will. our pattern will change entirely, not before we get the 40s and 30s to start on our way to the mid-60s by lunch time, rapid warming between noon and 3:00 p.m., we'll be into the 70s. spectacular conditions out there. no need for the heater or the ac. room temperature readings just about everywhere and things start to change.

list of universities under investigation for their handling of sexual assaults. that list includes 100 other universities across the country with more than 100 separate assault cases under investigation. the stanford investigation stems from a high profile assault last year. student leah francis says she was sexually assaulted offcampus by a student she previously dated. she says that student was not punished enough and demanded change. new this morning a major announcement that could change the circus forever. the ringling brothers and barnum & bailey circus is ending its iconic elephant acts. kris sanchez, the circus is feeling the pressure from animal rights activists for years now. >> reporter: the circus company, parent company of the circus says it is not bowing to public pressure, only that the public appetite for such acts has changed, and yet if you've ever been out here to s.a.p. center to see the circus or passed by

you know that protesters always show up here when the circus comes to town, often handing out very graphic descriptions and photos of the abuse the elephants suffer at the hands of their trainers. it seems the circus is going to cave to the pressure. the company announced it will phase out elephant acts in its travel circuses over the next three years. its herd of nearly 50 elephants will live at the ringling brothers center for elephant conservation. it wants to focus on conservation but faced several legal actions over its elephants. in 2011 the usda ordered the company to pay $270,000 in a settlement that the usda said was about sending a message how animals are to be treated. . 2014 the company won a $25 million settlement against several animal rights groups over what it called unproven allegations of mistreatment. in a statement, the chairman and ceo of parent company barnum & bailey said no other institution has done or doing more to save

this species from extinction, that is something of which i and eye family are extremely proud. this decision is not easy but it is in the best interest of our company, our elephants and our k customers." the elephants will be available to researchers at least in the beginning however, they would like to make sure that the public can see the elephants as well. ringling brothers barnum & bailey circus has come through town for this last tour, the next chance to see it will be in 2016, so lots of changes perhaps between now and then. in san jose, kris sanchez "today in the bay" >> huge announcement today, thank you very much, chris. activists in san francisco are fighting a massive housing project in the mission district. protesters actually shut down a developer's community meeting last night. they say they're fed up with development. company called maximus trying to

from sacramento named sully broussard who lost her husband and son to cancer. to ensure someone else wouldn't lose a loved one to a terminal disease she agreed to donate one of her kidneys to a complete stranger, she identified a stranger and this staininger has stranger has a relative who wants to donate their kidney to another stranger who has a relative who wants to donate but also incompatible and this chain will continue on and on until six people have received new kidneys, the ultimate in pay it forward. >> and i'm doing it because there might be someone out there who don't know they could do this, too, and they could help save other lives and improve other people's lives. so that was my big driver. >> it's being kicked off because one individual acted as an altruistic donor and she came to us and wanted to dough naught a kidney but didn't have a recipient in particular to give a kidney to.
