"early today" starts right now. good morning. i'm milissa rehberger. robert durst, the real estate heir and subject of the documentary series "the jinx" has been officially charged with

murder and could face the death penalty. accused of killing long time friend susan berman. her body was discovered in her california home back in 2000. at this hour durst is being held in louisiana without bail. he's awaiting extradition to los angeles. nbc has the latest. >> reporter: 70-year-old robert durst sat in criminal court at times with his eyes closed facing extradition to california for murder of his longtime friend susan berman in 2000. durst looked frail as he rose to speak to the judge indicating he did sign the waiver that will send him to los angeles to the trial. >> bob durst didn't kill susan berman, he's ready to end speculation and have a trial. >> reporter: durst has been the subject of the documentary series which takes a look at the disappearance of his wife kathy, a texas murder which he was charged and acquitted claiming

the killing was self-defense and the murder he was arrested for late saturday. the show's finale aired saturday night hours after they arrested him in a hotels. a letter addressed to berman and confronted him with it. the handwriting and spellings look similar to the letter sent to the police telling them where to find the body. durst goes into the bat room with his microphone still on and starts talking to himself. former westchester county district attorney investigated durst in 2000. >> susan berman was killed because she knew too much about kathleen durst. i believe that he murdered her to prevent her from talking to us. >> reporter: durst's lawyers advised him not to take part in "the jinx" saying his desire to talk may be the thing prosecutors have been looking for all along. nbc news. to an odd story out of the

middle east now. ruthless killers dressed down or dressed up really. the headline in the british newspaper "the mirror" jihadi jones isis fighters caught fleeing battle zones dressed as women. these are reportedly instagram pictures from iraqi forces who say they caught isis soldiers wearing drag as a disguise. some are wearing bras others forgot to shave their mustaches. nbc news has not been able to authenticate images. from current affairs to climate change president obama discussing it all. asked about 47 gop senators who sent a he letter to iran. >> i'm embarrassed for them because it's not how america does business. their basic argument to them is don't deal with our president because you can't trust him to follow through on an agreement. that's close to unprecedented. >> later the host tells

president obama the number one topic their readers wanted to talk about was marijuana legalization. the president said young people should focus on other matters. >> well first of all, it shouldn't be young people's biggest priority. let's put it in perspective, young people i understand this is important to you. you should be thinking about climate change the economy, jobs war and peace, maybe way at the bottom you should be thinking about marijuana. >> vice news posted entire interview online. star san francisco linebacker retiring from the nfl after one season because he's worried about the long-term effects of repetitive head trauma. the 24-year-old said concerns started during training camp and began to gather steam during rookie season. he's the fourth player age 30 or younger to announce his

retirement. they said while unexpected they respect his decision. he had team leading 108 tackles and earned multiple awards including defensive player of the week. we're learning more new dramatic details about what happened after the boston marathon pomming. in court on monday a police officer described eight minutes of complete chaos when authorities first confronted those suspects. members of the jury also got an up close look at a key piece of evidence. nbc justice correspondent pete williams has more. >> reporter: watertown police say they feared for their lives three days after the bombing. >> state police officer at the scene suggested there were two people that they had. >> reporter: when they caught up with the two marathon bombing suspects. police say the brothers jumped out of their cars in this quiet neighborhood and began shooting and throwing bombs. they say when police tackled tamerlan here dzhokhar jumped in his car and escaped running over his brother as he fled. police say during the shoot-out

the brothers used the carjacked suv as cover. one told nbc news a month after the bombing he came face-to-face with tamerlan. >> he was about six or eight feet away from me firing his pistol at me. i was firing at him. i had run out of ammunition. >> reporter: police say tamerlan ran out of bullets, took off running but was stopped in the street. >> i holstered up chased after him and tackled him. >> reporter: he said at one point, i was afraid i was going to be killed. police say dzhokhar tsarnaev got back in the suv at the end of the block. instead of driving straight head where no police were waiting, he turned around and drove toward him and his brother who was lying in the street. the day began a trip from the courthouse to see the riddled boat where dzhokhar tsarnaev hid after he escaped the shoot out. >> it's unusual to have a field trip outside the court with a criminal trial especially when there's security concerns as there is in this case. that said it's certainly not

unprecedented. >> that was nbc pete williams reporting. now to some spectacular video. an eagle films its own flight. the footage shows the bird's eye view as it descended 2,000 feet from the top of a dubai skyscraper. the eagle wore a 10 ounce camera on his back to capture this incredible scene. nbc meteorologist bill karins is here with us now. he flew down and landed right on his trainer's arm. >> looked so calm looking around. that's 2,000 feet. that's a tall building. that's crazy to be at the top of that anyways. yesterday was an unbelievably warm day across the nation. in los angeles we had our fourth 90 degree day in a row. we've never done that this early in the season. also central plains all-time hottest temperatures for this early in the year. you can see on the map the only cool spots in new england and right along the canadian border. these were highs yesterday, 90 l.a., 9 0 phoenix, warm-up in seattle. really central plains.
