shooter found dead on his balcony just hours ago. thank you for joining us. i'm laura garcia-cannon. >> and i'm sam brock. here's what we know right now at 6:00. within the past few hours, police confirm the suspect scott dunham is dead and they say he shot and killed san jose police officer michael johnson. johnson a 14-year veteran with the force. >> this all happened at an apartment complex on center road. kris sanchez has reaction from residents forced from their home. we begin with bob redell. he was there when the tense standoff finally came to an end. good morning, bob. >> reporter: good morning to you, laura and sam. police confirming around 3:20 that that suspect scott dunham was indeed dead, possibly dead during the entire standoff. i want to share with you first a moment that just took place here along center road in san jose. this was in the past ten minutes. a very heartbreaking scene, as around 40 or 50 squad cars of

the san jose police department, other agencies with their lights on in a silent discussion down the road as they escorted the body of officer michael johnson away from the scene to the coroner's office. he was shot and killed last night around 7:00. the call came in around that time, a 911 call from a family remember, reporting that the 57-year-old man was despondent, that he was intoxicated, that he had access to a high-powered rifle and he was threatening to not only hurt himself, but to oth hurt others. he apparently started firing from the second floor balcony with that rifle, hitting officer johnson. johnson was killed right there on the scene. he's a 14-year veteran with the force. his colleagues did return fire. it's not clear if it was their gunfire, the shots that actually killed dunham or perhaps a self-inflicted wound. they're still trying to figure

that out. officer johnson died on the scene, becoming the first san jose police officer to die in the line of duty in 14 years. the last officer to die was jeffrey fontana, one of johnson's classmates in the police academy. >> he was part of that academy class with jeffrey fontana. it's unfortunate for any of our officers to lose their lives, whether in that class or any class. it's something that we are aware of. and something that we need to at least address at some point. and understand what we can do, especially with those officers in that specific academy class. >> officer michael johnson is the ninth officer slain in the line of duty in the entire -- during the entire history of the san jose police department. reporting live in san jose, bob redell, "today in the bay." >> thank you, bob. the shootout between the gunman and the officers, it really

happened in a very busy neighborhood. >> a lot of people impacted. a man at a nearby convenience store when he caught the entire shooting on camera. shom of you may find this video disturbing.ome of you may find disturbing. what you heard there was two shots and officer returning fire. it appears the initial shots were fired from the balcony of scott dunham's apartment from behind a sliding glass door. >> as of this hour right now, people are forced to evacuate the neighborhood during that chaos. still waiting to see when they'll be allowed to return to their homes this morning. dozens spent the night outside waiting for hours at a nearby gas station. kris sanchez has been speaking with residents all morning long, a long night for everyone, chris. >> good morning, laura. good morning, sam. bob just showed you that procession, the officer's body being taken to the coroner's

office. that officer's body remained on the ground where he fell, and where he died. now that the officer has been taken away from the scene, and once the gunman has been taken away from the scene, they may be able to start going back home. but it's been a very long night for them as well. they were afraid that there was a gunman with a high-powered rifle in their neighborhood and they were also concerned for the officers. many of them spent the night in their cars at a gas station nearby where they were evacuated. san jose police chief larry esquivel also talked about the fact that there was tremendous cooperation from the community, and sympathy, not only from the neighbors in the area, but also officers from other departments. officer albert morales talks about when those folks might be able to return home. >> they were in the process of allowing them back into their -- they just needed to go ahead and kind of render some of the area safe. collect evidence. and then they were going to allow people back in.

>> reporter: larry esquivel says that officer michael johnson was a field training officer and just a coincidence that he didn't happen to have a recruit with him last night. many of the folks who spent the night out of their homes and in their cars, they will be able to start going back home this morning once the body of the gunman is removed, and once all of the evidence is collected. but the family of the officer has been notified. officer johnson has a wife, who happened to be out of town when this all happened, and the police department now doing what they can to make sure she can get back home to be with her husband as soon as possible. his family has also been notified, and the officers say that was one of the toughest jobs, telling the parents that they had lost their son. in san jose, kris sanchez, "today in the bay." >> i can't imagine. >> indescribable. thank you very much, kris. the last san jose police officer killed in the line of duty was jeffrey fontana. that was back in 2001. when a gunman shot and killed

him during a traffic stop. the man responsible was convicted in that shooting. fontana and michael johnson, the officer killed yesterday, graduated in the same police academy class. the story extends beyond san jose. other police departments flooding social media. sunnyvale police tweeted thoughts and prayers for our brothers and sisters from san jose pd, hoping for a quick and safe resolution. now we know how it ended. san mateo sheriff's office tweeted sending thoughts and prayers. the chp tweeting the men and women of the chp offer our thoughts, prayers, and condolences to the san jose pd. our hearts and thoughts are with you. there will be a lot more to the story in the hours and days to come. we're going to check in with both bob redell and kris sanchez throughout the morning. we are also updating our website at nbcbayarea.com. another major local story this morning. developing right now, searchers

spent much of the night combing the waters around mare island for any signs of a young woman who may have been kidnapped. stephanie chuang join us live from vallejo. that part of the search has been called off for now? >> reporter: that's right. good morning, sam. overnight, this was the focus, the waters off mare island. about a mile from where the 29-year-old woman was allegedly abducted. at one point, both sonar detection and search dogs hinted there might be a body here in the water. but after hours of search by the dive teams from both alameda and solano county, it turned up nothing. they called it off earlier this morning. the search is still on for denise huskins, a kaiser hospital physical therapist, whose boyfriend told police an intruder broke into his home around 3:00, took huskins by force demanding a ransom. it took them 11 hours to report that to police. huskins' father flew up from huntington beach to speak to investigators in person.

>> it's a nightmare that i can't wake up from. you know? this is not supposed to happen. >> reporter: investigators spent much of yesterday looking for clues, taking out bags of evidence from the mare island home. that's on the 500 block. police also found the call registered to the boyfriend in vallejo that was reportedly taken from the house. police are not calling him, nor anyone else, a person of interest. as for plans, police say there are no immediate plans to search mare island on foot, but they will play it by ear. live in vallejo this morning, stephanie chuang, "today in the bay." >> that search continues. thank you very much, stephanie. let's switch gears. it's been a rough news morning. we know you've got to get ready for day. taking a live look outside. going to make way for a nice spring afternoon. let's check the forecast with christina loren. >> good morning to you. near record warmth in the forecast for the next few days. mostly in the 40s and 50s.

as you're heading out, you want to think about grabbing a light sweater or jacket, something you can peel off by lunchtime, when temperatures climb into the mid 60s. we'll be at 66 degrees in the south bay at noon. 67 on the east shore. 67 degrees for today in the tri-valley. so, as you're getting ready this morning, temperatures are going to end up very warm, like i said, up to 79 degrees in the north bay. good idea to go ahead and close the shades in yur home. make sure that you do everything you can to combat this heat.our. make sure that you do everything you can to combat this heat. you might have to turn it on for the first time this season as high pressure really takes control of our forecast. we have a big-time warm-up headed your way. and we're actually expecting temperature records in livermore, san jose, concord, oakland, even hayward. look at this. livermore tomorrow, 88 degrees. that is the record. you are really going to blow past that record in hayward. we're forecasting 80 degrees. the old record 68. and then some showers on the way

and some snow up in tahoe. we'll have the latest for you on that in just moments. i want to check your drive and say good morning. >> we're talking about the traffic view first, as we give an overview of san jose and the entire silicon valley. south 280 across the middle of your screen, that's just a blip and it will be gone in a couple seconds. i'll double check. no incidents reported on the freeways. it is on the roadways where we have this concern. bob redell just showed you that emotional scene. closed between lewis and umbarger because of the continuing investigation of that overnight deadly shooting. you can use monterrey or mclaughlin as your alternates to the area. just like capital expressway, accessing both 101 and 87. as we move out of the south bay, we do show another incident at the bottom of your screen.

right around alvarado. earlier crashes. the last one to remain is on the shoulder. slowing a bit toward the dunbarton bridge. that's a typical pattern for the tri-valley as well. no big concerns across the san mateo bridge after the overnight construction cleared. there was a traffic break for a tire over toward foster city. but that has also cleared. toward the bay bridge, a smooth drive through the maze. slowing through 580. we will see the traffic backed up, of course, filling this toll plaza. no problems getting into san francisco there or from the north bay, where 101 moves smoothly at speeds as well. let's look at westbound 92. we had an earlier slowdown because of that tire being cleared from the high-rise, but i did watch that truck clear the roadway getting off foster city boulevard. so we have a smooth drive westbound once again over there. but the peninsula is going to see a lot more crowds. >> a lot more friends. >> more friends for the peninsula. >> hello, 101.

some of the top stories we're following this morning. two americans are reported to have been onboard the germanwings plane that crashed in the french alps yesterday. crews have recovered the black boxes from that crash site. no sign of a woman reportedly kidnapped for ransom in vallejo. crews spent the night searching

the waters for denise huskins. nothing turned out. a family will release a video of britney maynard supporting california's right to die bill. maynard lived in the east bay but moved to oregon where an assisted suicide is legal. update to breaking news. just received an image of the san jose police officer killed in the line of duty. this is michael johnson, a 14-year veteran of the force. johnson was shot and killed yesterday while responding to a welfare check call. his body was taken from the shooting scene less than an hour ago, escorted by dozens of police officers. around 4:00 this morning, police entered the home of the man accused of killing johnson. the body of scott dunham was on his balcony. police evacuated a number of homes in that area as they tried to capture dunham. officers say they need to collect evidence before letting people back in. bob redell is on the scene. he'll have a live report for us coming in up about 15 minutes.

>> business and tech news now. how much influence does google exert over washington? records show that google executives have visited the white house on average once a week every week since president obama took office. >> scott mcgrew, not evidence of any wrong doing, but certainly an influence. >> tremendous influence. keep in mind, google is lob big on all kinds of issues, from government spying on american citizens to drones, to high speed internet. but the reason this frequent visit comes up this morning is because we learned this week google was so very close to being slapped with an antitrust lawsuit similar to the suit brought against microsoft years ago. and google was able to convince leaders in washington not to go forward with that suit. the details of the antitrust case were actually accidentally given to "the wall street journal." they were asking for different documents. the previously secret documents show several of google's rivals were pushing the government to go after the search giant. google settled the matter with

the government and was able to avoid the antitrust suit. but the numbers you're talking about, there's no doubt access to the obama administration is important to goog, "the wall street journal" analyzed visitor records. found google employees made a total of 230 visits to the white house since president obama took office, and as you point out, that works out to an average of once a week. well, the f.a. conference is in san francisco. earlier this morning, i said it was over in the moscowny center and that mike would avoid you to use harrison street. mike says go ahead and use harrison street. because it's actually at ft. mason. i had forgotten. i wanted to bring up that important little error just in case you're a visitor to our fine city and you're getting a cab to the wrong place. >> good distinction to make there. >> and good team work, too. >> also, bring a sweater.

>> now you're just being a dad. >> state lawmakers are considering fast-tracking more than $1 billion in water spending if this drought continues. >> governor brown announced that plan last week. it would offer more than $100 million to help residents and wildlife impacted by the ongoing drought. the state senate is expected to vote as soon as this afternoon. the assembly would likely vote tomorrow. >> the drought is triggering a new round of extreme measures in the south bay. they planned to cut water use 30%, while the district cannot fine violators, leaders have suggested that law enforcement may help get major violators to comply with those rules. watering lawns will only also be allowed twice a week. >> some cities in the bay area, they're only allowing you to do it one day a week. and if it rains, don't do it at all. let's take a live look outside. beautiful bay bridge this morning. sun coming up over the bay area, making way for a nice day.

christina's got a look at the forecast. >> absolutely. bringing warmth today. >> before we get to that heat, let's talk about some good news. that is the fact that even though it's been such a terrible ski season up in tahoe, and yeah, i use the term terrible lightly, we still have some of our resorts, especially the ones that are located on the highest peaks, open for business. that leads us to our squaw valley alpine meadows report. they actually picked up seven inches of snow pack from that system that came through earlier this week. we're now at 42 inches at the summit. when it comes to their lists, they've got 16 of 29 still open. i know they want to try to stay open through mid april, but at least through easter weekend. i know a lot of people do make the tradition of heading up here for easter weekend. and the good news is, it's also cold enough in the morning hours to continuously make that snow. so that is the good news. although we do know that sugar bowl had to close early.

temperatures for us today, not going to be that cool at all. especially by lunchtime. clouds will make way for a pleasant afternoon. temperatures, though, about five to ten degrees warmer than where we ended up yesterday. 73 degrees for today on the peninsula. 73 -- that's not a bad day on the east shore. but take a look at some of your inland valley spots. the north bay at 79 degrees. 76 degrees right here in the silicon valley with some temperature changes even more so for the next couple days. temperatures hiking up, as high pressure is firmly in control. that's the story for thursday into friday. hot inland, coastal cooling by saturday. and then maybe a little bit of shower activity. not enough to where you want to turn your sprinklers off. but i do like to let you know about everything. there is a chance that this system could become more organized and take a little bit of a different track as we head throughout the next couple days. we are watching it closely for you. our next best chance for rain arrives. the tri-valley have the best

opportunity. friday into saturday, you'll notice those temperatures drop off just in time for the weekend. might want to make those outdoor plans. saturday is going to be the day to do so. not a lot of fog to talk about. here's mike. >> the 101 and 87 looking really good through downtown. that's good for downtown san jose. over here, this is a slow drive. you expect this for hayward for south 880, but farther south, we're looking at a crash somewhere between dakoto and thornton. causing more slowing from union city in toward fremont. expect that to be there for a while as the cars are starting to move to the shoulder, but that will kick off the early start to the slowdown through fremont. farther south, a camera just around mission where this yellow turns to green. just to the other side of the screen here. smooth drive coming down into

the south bay. that's the commute direction here. 87 also shows a little slowing. as we talked about that slowing has sorted itself out. this is one issue that continues to have a closure center between lewis and umbarger because of the overnight shooting. officer was shot and killed there. we also have the suspect who was killed overnight, and we're looking toward the recruit for monterrey and mclaughlin. there's capital expressway and tully there, getting on to the freeway. no disruption to that flow of service. we're looking toward the bay bridge. the east shore freeway no big problem. westbound highway 4 coming through concord. we do have a crash around willow pass. that's the slowdown. not so bad through walnut creek. and in the north bay, the map looks good. san rafael also looks good. the traffic really kicking in now southbound. >> thanks, mike. time right now 6:22. coming up next, the fight over fireplaces also heating up.

there was a standoff overnight. when police entered dunham's apartment earlier this morning around 3:20, they found him dead on the balcony with at least one gunshot wound. police say it's possible he was dead during the entire standoff. >> that was the only report of gunfire during this incident that we have. there was not any subsequent gunfire or officers shooting their weapons other than the initial call. it is unknown what the cause of death is at this point. >> officer michael johnson is the first san jose police officer to be killed in the line of duty in 14 years. reporting live, bob redell, "today in the bay." people forced to evacuate during the dangerous standoff are learning when they'll finally be allowed to return home. our own kris sanchez is out talking with him this morning. she'll join us with a live report in about ten minutes.

there's a slower drive. as it moves to the shoulder, we see things evening out back to at least a slower drive, not a completely stopped drive there. southbound 680. there's your tri-valley. nothing unusual about that flow of traffic. good news in toward fremont for 680. san jose, we do have that closure over at lewis because of the police activity and the investigation. bob and chris are both out there. the bay bridge approaches moving slowly down the freeway. slow off the maze. the metering lights are on there at the toll bridge plaza. you're getting some company now. 101 southbound with the headlights. no real delays for 101. >> good news. >> the temperatures rising right now. how about those markets? they've been open for a few minutes. >> let's check the numbers right

you're watching "today in the bay." >> one of the frat members in that notorious oklahoma university racist chant plans to break his silence today. the man in question is actually a former oklahoma student. he admits to participating in the chant with other members. today he plans to hold a news conference with black community leaders. he'll also meet privately with an oklahoma senator and religious members. >> investigators in massachusetts are trying to find the renters of a home wired to explode at the flip of a light switch. that home by the way is now for sale. an electrician found the mechanism during a presale inspection. police say that wires intricately snaked through several rooms and it was designed to cause significant destruction. took the bomb squad several hours to disarm the home and to declare it safe. take a look at this amazing video this morning. it's out of brazil. a bus actually fell through a large hole in a road, and then

it's so tragic. the shootout between the gunman and the officer, it happened in the middle of a very busy neighborhood. >> one man started recording the shooting on camera. we would like to warn you that some of this might find this video disturbing. >> what you heard there was two shots and officers returning fire. it appears the initial shots were fired from the balcony of scott dunham's apartment from behind a sliding glass door. >> right now, people forced to evacuate the neighborhood during that chaos are still waiting to see when they'll be allowed to return to their homes this morning. dozens spent the night outside waiting for hours at a nearby gas station. >> kris sanchez has been talking with residents all morning long. a long night for everyone, kris. >> yes, endeindeed. i just spoke with a mother of 6 who only slept about two hours last night. she has a 2-year-old all the way

up to 22-year-old. everybody's going to be impacted by this today because nobody got a lot of sleep. and she teaches -- she's a teacher's aid for fourth and fifth graders. she hopes that the kids are patient today. many of them still waiting in their cars, waiting to get back into the neighborhood. we have seen some of the officers checking i.d.s and letting a couple of folks in here and there. i suspect that there is a big stretch of center road that is still closed and the folks who are getting back in live a little farther from the apartment complex where all of this happened. but again, we have talked to folks who have been out of their homes all night. it is a long process to get them back home. >> they just needed to go ahead and render some of the area safe, collect evidence, and then allow people back in. >> remember that it wasn't until about 3:20 this morning that we knew that the suspect was no longer a danger to anyone, nor himself, because he was dead.

however, not until the coroner arrived to remove the gunman's body, and the officer's body could be cleared and officers began to collect the evidence. the officer's body had to remain here on the scene while there was a suspicion that there was an active shooter or a dangerous gunman on the loose. now folks are still waiting. they're optimistic that they will be able to go home. the mother of 6, she got about two hours of sleep at her sister-in-law's house. she probably won't even have time for a shower today. in san jose, kris sanchez, "today in the bay." >> the grief palpable. thank you very much, kris. >> the last san jose officer killed in the line of duty, it was jeffrey fontana. in 2001, a gunman shot and killed him during a traffic stop. the man responsible, deshawn campbell, was convicted in that shooting. fontana and michael johnson, the

at about 79 degrees for the north bay. the tri-valley also getting very warm. 78 degrees the average high. usually about 62 degrees. so definitely seeing temperatures exceeding those averages by quite a bit. cool start to the day. a few areas of clouds, although you just saw a golden gate bridge. nice and mostly clear to kick off the day. sunny by lunchtime, and then we'll warm you up by a good five to ten degrees with peak warmth expected tomorrow. your sun will set at 7:24. our days are getting longer. we're seeing the sunlight a little bit earlier. high pressure is going to keep us nice and warm for the next couple days. as we head throughout your thursday and your friday as well. and by saturday, high pressure backs off a little bit. it's going to be hot inland. you will notice considerable cooling and cloudiness at the coast. we get our next best chance for shower activity. and this really arrives as we head throughout the second half of your weekend. sunday night, we show you that future cast.

showers creeping up from the south. not expecting a lot, but hey, the system could actually take a different track. it's a really difficult system because it's what we call a cutoff low. at this point, we are bringing in shower activity to the south of the golden gate bridge and places on the east shore as far out as the tri-valley as we head throughout late sunday into monday. so we'll keep watching this for you and update you as to how much we expected. you'll notice it's going to pass right over tahoe, potentially providing more snowfall as we get into the end of the weekend. right now, let's check your drive. here's mike. >> all right, christina. we're looking toward oakland, where i saw a burst of traffic traveling north past the coliseum. looked like things were going to get to a sticking point, but it's moved out. we'll show you a smooth flow of traffic there, as well as 580. congestion from 580, as well as down the east shore freeway down the vertical curve. this is looking pretty good,

after an early turf start for many spots. the east shore freeway as well as the north bay. moved really smoothly right now. over here, this has been an issue. west highway 4 atwill low pass road. one in your second lane, another in the slow lane. a backup coming in through pittsburgh and bay point. things are now clearing. we'll see traffic heading down toward the walnut creek interchange. toward the tri-valley, things are gumming up. a lot of folks meeting there. down toward the earlier crashes in fremont, but fremont cleared up crashes. that will smooth out down in toward the mission boulevard area. just as your typical pattern would be. in the south bay, the northbound routes move smoothly, but i do want to point out the center is still closed between lewis and umbarger. the investigation continues. use monterrey, use mclaughlin, and if you're getting to 101 and

hoskins, the therapist whose boyfriend told police an intruder had broken into his home in vallejo. 1 1 hours later is when he reported this to police. they're holding on as best they can. >> we have all the questions, who is this boyfriend. why such a lapse in time between a 3:00 a.m. abduction and 1:00 p.m. reporting to the police. you know, that's curious. >> reporter: investigators spent much of yesterday focused on that boyfriend's home on the 500 block of kirkland avenue. police also found a car registered to the boyfriend somewhere in vallejo. it had been reportedly taken from the house as well, but they're not calling him nor anyone else a person of interest, adding they're also not ruling anything out just yet. live in vallejo, stephanie chuang, "today in the bay." >> okay, thank you very much, stephanie. this morning, we're learning

the martinez woman crushed to death by a gravel truck, she was pregnant with her second child. 32-year-old lindsay combs was killed monday. a worker with jjr construction had asked combs to back out of her driveway to make room for the truck. it then tipped over and crushed her. last night, the construction company announced it is suspending work for the rest of the week. happening today, a new push in sacramento to grant terminally ill patients in california the right to die. family of britney maynard will join state lawmakers to release a video that maynard recorded before her death last year. maynard lived in the east bay, but she moved to oregon before she died because assisted suicide is legal in that state. the video shows maynard expressing her support for sb-128, an assisted suicide bill. the state senate health committee is going to vote on that bill later today. san francisco's sheriff's department is reviewing its protocol following an escape in may. the inmate ran off while being escorted bay sheriff's deputy to

take out the jail trash. last seen in the south of market area monday night. alexander santiago gonzalez was initially arrested on drug, weapons, and immigration charges. some new video in this morning that you're going to want your kids to see. >> scott mcgrew, video from inside cars as teenagers text on their phone. they're putting on makeup, almost doing everything but driving. >> that's right. and then they get a crash. we're going to show you real video captured by cameras placed inside more than a thousand cars driven by teenagers. aaa says six out of ten crashes studied involve some sort of distraction. they captured hundreds of these on video. we're going to show you three. the first two are texting. the third is putting on makeup.
