this. good morning to you. >> reporter: good morning, matt. new developments from lufthansa saying they found correspondence between andreas lubitz and the school talking about severe depression being the reason for the gap. this is the first time officials confirmed he had severe depression and that being the reason for that gam. also, new video alleged video from a passenger's own cell phone purporting to show what it was like inthe side that plane during its final moments. lufthansa which owns germanwings discloses andreas lubitz underwent treatment for a previous episode of severe depression according to e-mail between the co-pilot and the flight training school in 2009. this morning at the site the ceo expressed his sorrow for the victims and gratitude to the recovery team. >> we know everybody lufthansa knows how hard this work has

been. sometimes dangerous, how the people climbed up and down the hills, how they had to leave the helicopters. we are very, very impressed and very, very grateful. >> reporter: but wouldn't comment on the airline's new medical revelation. >> thank you. thank you so much. >> sir, your employee crashed a plane. why are you refusing to take questions? >> reporter: lufthansa maintained that lubitz had no issues which they define after he earned his pilot's license. whether they followed up specifically with his mental health is unclear though the germanwings ceo told me last week mental evaluations are only done when the pilot is hired. >> it would have never imagined that a thing like this can happen. >> reporter: in germany like the u.s. doctors have an obligation to report patients who they believe are a threat to others.

the question is, did anyone really know? >> this man must have taken great precautions to hide his intentions. >> reporter: tabloids are reporting they viewed a video allegedly recovered from a victim's cell phone at the crash site from inside the cabin showing the horrific final moments of the flight. however, french authorities are disputing that report, calling the tape a fake. and more on that video in a little bit. we want to reiterate lufthansa has said they knew about a flight school break but could not kmemt on it because of medical confidentiality. unclear what they knew and whether or not they followed up appropriately, that is all up for debate. both in the public sphere but potentially later on in the courts, guys. >> katie, thank you. former ntsb investigator greg feist is keeping a close eye on this. good morning to you.

>> good morning, matt. >> one of the first pieces of information we knew about andreas lubitz was that he had taken a break in his flight training for undisclosed reasons. we now know that when he resumed his training, he told the flight school in conjunction with lufthansa, that he had severe depression. who should the airline have done with that information? >> that should have raised a big red flag that they should have done an evaluation of him, and then had a professional evaluation of his mental state to see what it was that was the basis for that depression, and whether or not he could continue. because if they put him on medication to control that, then there's an issue whether or not the medication was legal for him to continue his pilot activities. >> even if they decided he could continue his training and become a pilot, given what's at stake every time a pilot walks into a cockpit, shouldn't he have been

under some elevated level of scrutiny than other pilots? >> that's going to be a question that needs to be answered by lufthansa. the fact they now admitted that they knew about this, did they put him on an observation program? was he required to check in? was he required to have any kind of medical evaluation on a more frequent basis than all of the other pilots? those are going to be questions that need to have answers because if they trap lined him, if they knew about this and allowed him to continue in his program and they didn't have any kind of method, then unfortunately, they are going to have a lot of questions to answer in court as well. >> let me ask you about this other disturbing aspect of this story that's come up in that there possibly exists a piece of cell phone video taken by a passenger on that flight in the final moments before it crashed. investigators have said this is not true and if the video is out it's a fake. what's your take on this? is it possible?

>> i'm concerned with this kind of information. we saw it a lot in mh-370, all of a sudden this got leaked out and then proved to be not true a day, a week later. so, the big issue now is, i don't believe it's true. and of course the government officials who would be the ones that are the repository for information like that, have said that it's not true. i know that people want their 15 minutes of fame and of course the tabloids and that kind of thing need to fill the news media cycle, but this is really detrimental to the families and the credibility of the investigation. >> if it does exist you would hope someone would have the good taste to never have it see the light of day. greg, thank you. let's go to savannah. matt, thanks. the deputy editor of "paris match." thank you for being with us. >> good morning, savannah. >> my question is a simple one.

are you convijsed that this video is real? if you are, why are you convinced? >> well, i'm convinced this is real, i mean, we've checked and investigate and we are pretty positive about our source, which is close to the investigation team. so, there's no doubt that what we saw are the final seconds of what happened onboard of airbus 320 of germanwings. from what you know, what i saw of the video is the footage is very blurry but the sound is very -- no doubt that the passenger actually knew what was going on inside and knew what was going to happen. >> without revealing your source of course, what is that source's motivation for presumably getting this piece of evidence and instead of apparently giving it to the authorities, showing it to a reporter? >> i think that they showed it

to prove the existence of such material. it's you know, it's a piece, it's interesting for a number of people including the families, of course, of the victims. it's also very interesting for a number of people that fly today. now, the chance that this video actually appears that it was taken out of the rubble it's very slim. i can confirm you from all what we gathered and seen it's the true. >> very quickly, have any of the family members reached out to your publication wanting to see this video? >> not yet. not you know, under my knowledge at the moment i don't think so. >> thank you for your time. >> we don't have the video. >> right. right. i understand. >> thank you. >> sir, thank you for your time. a lot of us shaking our heads even if that video exists,

it's incredibly poor taste for someone to show it to a reporter, it can be painful for the families. >> in some way there is some investigative value to it still it should be seen by about four people total. it should never see the light of day. mr. roker tracking a real bad string of storms. >> this is a multiday event lasting into friday with pretty heavy rain and some snow with it as well. atlanta had pretty heavy thunderstorms move through, they are right now under less of a threat but they could fire up later on tonight. we're watching colder air behind this system, warm air ahead of it and so the clash of the systems we're looking for the risk of strong storms stretching from northern oklahoma into omaha, nebraska and parts of southern minnesota. this goes into tomorrow. little rock, indianapolis, looking at this threat of strong storms as well. in between, southern illinois, louisville, kentucky, columbus, ohio. and move ahead to friday, look at this. we expect from alexandra,

virginia, little rock, we're not looking at tornados but a lot of heavy wind, damaging rain and rainfall amounts up to 7 inches. we could see flash flooding in this system, and behind it, denver, colorado to the west we could be talking about 6 to 9 inches. some areas as much as a foot of snow. so winter not quite done yet. but we will see a warm-up as we head toward the end of the week. >> i was hoping you were going to say april fools. >> we were looking out the window, it was snowing like crazy. >> yes, it was. >> thank you. lawmakers in indiana are working to modify the state's new religious freedom law that critics say will allow discrimination. a fee point to arkansas legislature passing a similar measure now. gabe gutierrez is following all of these developments. >> reporter: good morning. lawmakers here at the state house in indiana are scrambling to clarify the language in the law ahead of the final four.

now another state is facing a growing backlash from corporate giant. this morning the country's latest religious freedom law passed by lawmakers in arkansas tuesday, is on its way to the governor's desk. >> my bill is to protect the people civil liberties when it comes to religion. >> reporter: the ceo of walmart is asking for a veto saying the bill threatens to undermine the spirit of inclusion present throughout the state of arkansas, and does not reflect the values we proudly uphold. >> i don't see that this has a thing to do with religious freedom. to me it's just a law to discriminate. >> not in our name. >> reporter: lawmakers are considering a similar bill in georgia. they say it protects religious freedom. critics say it allows businesses to deny services to gays and lesbians by citing religious belief. >> it's been a tough week.

>> reporter: after backlash indiana's governor says he hopes that lawmakers will tweak the new law to clarify its intent. >> this law does not give anyone a license to discriminate. >> i think it's a solution in search of a problem. >> reporter: indianapolis's republican mayor wants the law repealed unless protections for sexual orientation are added to state law. >> this is a completely self self-inflicted wound. >> reporter: small business owners worry about the long term impact. >> my greatest concern would be in the future that our sales don't go up each year, that they would start to decline with losing convention business. >> reporter: uconn says the men's basketball coach will not travel here for the final four this week abiding by a travel ban ordered by the connecticut governor balls of this law. we expect to hear from arkansas' governor. he has previously said he would sign this version of the bill. savannah.

>> gabe gutierrez, a rapidly changing story. thank you. boston, closing arguments scheduled for monday at the marathon bombing trial after what proved to be a brief presentation from the defense. nbc's justice correspondent is in boston. faster than people expected. >> very brief. the defense put on just four witnesses lasting barely five hours. dzhokhar tsarnaev's lawyers concede he took part in the bombing but insist it was his older brother who was in charge. an fbi analyst called by the defense told the jury when all of the fragments of the two bombs were checked, 500 pieces in all, the only finger prints found were from dzhokhar tsarnaev's brother tamerlan and discovered on two pieces, the back pack that held the second bomb and a mangled peels of cardboard from the first one. two of dzhokhar tsarnaev's finger primts were found on an

unexploded bomb in watertown but it had six of tamerlan's too. the brief defense testimony is over and the defendant did never take the stand. given that his own lawyers said he was involved in the bomb attacks calling lots of witnesses including him would have been surprising. >> even if it's on relatively nuanced topics i'm afraid the jury might look at i thought he said he was guilty, why is he putting on a defense. >> reporter: some questions unanswered. did tamerlan's wife know anything about the bomb plot? she has been questioned by the fbi but never charged. and she was not a witness during the trial. in fact, her name was barely even mentioned. the court is in recess until monday, that's when the lawyers give their closing arguments and the jury begins deliberating, a guilty verdict seems a certainty. after a brief pause a second trial begins on the penalty. >> pete williams in boston

covering the trial. thanks very much. now again monitoring developments in the nuclear talks with iran. >> the deadline came and went and secretary of state john kerry is extending his stay to try to hammer out a nuclear deal with iran, that midnight deadline passing without agreement. able dreeandrea mitchell remains in switzerland. any sign of progress here? >> reporter: some of the ministers did did say that there has been significant progress overnight. that before the secretary of state john kerry went in a meeting today. one on one with iran's foreign minister. officials tell me there are still details to be worked out, disagreements and the biggest is over sanctions when the sanctions would be lifted. and how much nuclear fuel the enriched uranium and equipment iran could keep during and after once the agreement is lifted

about ten years from now. benjamin netanyahu, israel's prime minister did not wait to see what the details are. they fired a preemptive shot giving a statement saying it would be unconscionable to negotiate a path to a bomb for a murderous regime like iran. his words of course. and president obama was briefed along with the vice president, secretary of defense, they have a videoconference last night with john kerry and the negotiators here. it was midnight here when that took place. he has been fully briefed on this. clearly the white house wants to know exactly what's in this deal because no matter what it is, when it may come out of these talks the president knows he's going to face a lot of criticism among the people on the hill who say the administration is conceding too much to iran and too eager to get a deal. they say there could be a breakthrough later today. >> i know you'll be watching it. thank you. major developments in iraq this morning, iraqi forces are raising national flags across parts of tikrit as they move to

try to column most of the city. iraqi generally said all government buildings are under iraqi control but that has not been confirmed. isis militants seized tikrit last summer and retaking it would be the biggest win for the baghdad shiite led government. an up date on a story on tuesday, a prisoner who escaped from a hospital in northern virginia has been captured in washington, d.c. police say 42-year-old wossen assaye wrestled a gun from a guard and fled and carjacked a vehicle. officers searched the area. they caught him after nine hours on the run. new york city police department is reviewing a video that shows a police detective berating an uber driver after an accident. a passenger in the car recorded the profanity-laced rant with his cell phone camera. at one point the officer appears to mock the driver's accent.

you're watching "today in the bay." >> a very good morning to you. it is 7:26. i'm laura garcia-cannon. so far, authorities are not identifying the woman arrested in the security breach last night at san jose's mineta international airport. authorities say the woman scaled a fence and wound up on the tarmac. this is the fifth security breach at san jose airport over the last year. the tsa and san jose police are both investigating. the city of san jose gets ready for what undoubtably will be an emotionally charged day. that is when they'll say farewell to fallen san jose police officer michael johnson. the 14-year veteran died in a shootout with a man who was drunk and despondent. it will begin at 10:00 a.m. happening today, the season's final snow survey in
