a warming trend. more on that in just moments. i'm anthony slaughter in for mike inouye this morning. yesterday we had a very busy day with the rain. today, things a little bit different. we'll get you up to speed. a drier start to your wednesday morning, as we take a live look outside right now, the bay bridge all lit up. it is 5:00, wednesday, april 8th. and you are watching "today in the bay." >> from nbc bay area, this is "today in the bay." >> a very good morning. thank you for joining us. i'm sam brock. >> and i'm kris sanchez. laura garcia-cannon is off today. >> we begin with breaking news in afghanistan this morning. one american soldier is dead and two others hurt when an afghan soldier who was acting as their escort opened fire on american forces. that afghan soldier was tabbed to lead a convoy of delegates to high level talks when he turned on the u.s. dell inauguratiegat opened fire.

the pentagon says the incident is under investigation and will say more when it has more information. we begin with a developing scene at home. crime scene in a south bay neighborhood after a woman's body is found in the middle of a busy intersection and she had also been shot. "today in the bay's" bob redell is live in san jose, and bob, the coroner just left the scene about an hour ago. did that divulge any clues? >> reporter: good morning to you, kris. from what we've been able to gather from our conversation with a police officer here out on the scene, this does not appear to have been a random crime. it's not clear, though, why this person was shot and killed, a woman along bascom. that's where she was found, in front of a pool supply store. her body left lying in the street. she was still alive when paramedics arrived. they tried to save her, but she died on the scene. police do have at least one or two witnesses who they are

interviewing. it is our understanding that they were with the woman when she was shot. might have even known her. again, police are questioning those witnesses to try to identify the suspect who police believe is a man and to try to figure out what led up to her death. again, they are trying to find the suspect. no arrests as of yet. but a woman unfortunately shot and killed around 10:00 last night here in san jose on bascom near stokes. reporting live here in san jose, bob redell, "today in the bay." >> it's good to hear, though, that it doesn't appear that there's an imminent danger to the public. thanks, bob. the release of a convicted sexual predator into a neighborhood near salano college will not be happening after all. a judge yesterday denied the placement of 51-year-old frazier smith into a home in fair field. that home's proximity factored into the decision. last month, residents held a passionate meeting to voice their concerns over that plan. smith is a convicted rapist whose victims have mostly been teenage girls. a convicted felon will face new charges after investigators

linked him to two east bay cold cases. william huff also known as wild bill is accused of killing two women. one in 1987 and one in 1993. investigators say dna evidence linked huff to those murders. both victims were sexually assaulted and asphyxiated. huff is currently behind bars in vaccaville for auto theft. investigators are concerned he may be linked to more cases as well. >> police in the south bay have arrested a man in connection with a fiery crash on highway 101. investigators say this man was under the influence when he hit a car in san jose just after midnight yesterday. police say he slammed into a car, then drove off. moments later, that car was hit by a truck. the car burst into flames, killing the driver. the suspect now faces several charges, including dui and vehicular manslaughter. one person is in the hospital after a fire broke out at a peninsula home. this happened on helen drive near the green hills country club in milbury yesterday. you can see what's left of the

home as crews finally got the upper hand. investigators think the flames started in the garage. no word yet on the exact cause. happening today, a controversial bill requiring school children to get vaccinated faces a big hurdle at the state capital. "today in the bay's" stephanie chuang joining us live from berkley. locally, last night berkley city leaders voted to overwhelmingly support this plan. good morning. >> reporter: that's right. good morning to you, sam. if berkley is any indication, this may have a shot at the state level. it was last night that the city council here voted 7-1 in favor of vaccinations for all. except for medical reasons. berkley city council adopting a resolution supporting the state senate bill that heads to the nine-member house committee today. and that would ban the personal belief exemption. last night, it was a packed house, including a large group of people who wanted the city to vote against that and allow parents to ultimately decide whether to vaccinate their kids.

>> we ask that you oppose sb-277 for the simple reason that it is unnecessary. there is no overuse of personal belief exemptions if california. >> all of the credible science says that these vaccines are the most effective way to prevent these cities that we haven't seen for years from being spread from person to person. >> reporter: sb-277 would require that an order for children to be admitted to a california school, they must first be immunized for diseases like whooping cough, measles, muches, and chickenpox. this is california's first test. comesss -- coming in in our nex report, what a specialist thinks. the story ends here for tour

bus operators who narrate while they drive. supervisors unanimously approved a new ban, it prevents bus drivers from talking behind the wheel while they're on public streets. this comes a year after the death of a city worker who was struck and killed by a tour bus right in front of city hall. she was in the crosswalk. the bus driver was said to be distracted when that happened. the stanford blood center is giving you a little extra incentive to donate today. if you donate in the next ten days, you'll get a free movie ticket. the locations include hillview avenue in palo alto, burgess drive in menlo park, and south drive in mountain view. >> that is much better than the cookies you usually get. >> indeed. you may not want to be going inside, at least today. improving weather conditions after the drive. >> just some lingering activity out there right now. your rainfall totals very impressive. let's go ahead and load these things up for you. over two inches of rain. two inches of rain came down in

the santa cruz mountains. we picked up well over three quarters of an inch in santa clara. just about an monta vista. as we get into this afternoon, temperatures -- i've got to tell you, they're going on the on the cool side, but by tomorrow, we're back into the 70s. let me take you through your wednesday. cold start to the morning, lingering showers until at least lunchtime. as we head through your afternoon, clearing you out between noon and 6:00 p.m. mid 60s for today. grab that jacket. make sure you have it handy. as we head throughout this evening, areas of clouds, your sunset getting later and later as we get closer to summertime. 7:36 in the evening. temperatures chilly enough for a jacket. even in san francisco, you'll likely need it throughout the day. 62 degrees there. 66 in the tri-valley. 65 degrees for us in the south bay. the same goes for the peninsula. coming up, i can't wait to tell

you about what's happening this weekend, including the cherry blossom festival, so fstick around. also, quite a few other fun events for you in the family. but right now, temperatures are a little chilly. could see some frost in santa rosa. we do want to check on your drive. >> this morning, things are much more quiet than they were yesterday at this time. we're looking at the east shore freeway coming through emeryville. you can see traffic is starting to build, but it's pretty light, especially if you use this route very commonly you're used to seeing lots more traffic than this. let's switch to the maps and show you what you're looking at. also on the toll plaza, you can see how things are still light. lots of green there. coming in from the east shore freeway. even from 880, things looking pretty light. in san francisco, there was an accident on 101 northbound at airport boulevard. it's on the northbound side, so if you are using this route, just keep in mind it just happened and there is still some debris in the roadway as crews are trying to get to this. two cars and some debris.

crews are actually on their way to the scene of that. so we'll continue to follow that. down the peninsula, you'll notice lots of green marks down through the south bay. even over towards the east bay. this is where we had a huge accident. things looking pretty good, at least compared to how they were yesterday. >> i'd say enjoy your break. how the drought is driving california farmers to take drastic action. plus, tar balls wash up on the california beach. we'll tell you where they were spotted. new ways to get to hawaii this morning, and a new silicon valley reality show. we'll take a look coming up.

welcome back. in about an hour, jurors will have deliberations in the boston marathon bombing trial. this marks the second full day of deliberations. the jury is considering 30 charges against dzhokhar cz tsarnaev. meantime, the jury could decide whether former new england patriot aaron hernandez is guilty of murder.

hernandez and two co-defendants are accused of the 2013 shooting of odin lloyd. prosecutors say all three men were hanging out hours before lloyd died. hernandez's lawyers say he was in shock after witnessing the actual murder. virgin america says it will start flying to hawaii. though scott mcgrew says not for cheap. >> no, that's not virgin's strong point, kris. it's not a discount airline. it's a really nice airline. and that's been a real debate among airline experts. will passengers pay just a little bit more for a nice experience? virgin america will begin service to the islands next winter. there are some introductory fares, but in general, they're going to stick to their higher prices. the f.a. is upgrading india's aviation safety rating. that's beginning to allow more indian airlines to fly to the united states and to code share with american owned airlines. bottom line, more flights to and from india. let's check the markets, turn to landon dowdy live at

cnbc headquarters. good morning, landon. >> hey, scott, good morning to you. stocks look to open higher this morning after the markets started late in tuesday's session. oil prices are in focus, falling back today as they went to the highest level since december. the minutes from last month's fed meeting. investors also reacting to a mega merger, as shell is buying bg group for $70 billion. the dow slipping five points. the nasdaq down seven. as of this morning, you can watch hbo go without a cable subscription through apple devices. you may recall apple made that announcement with hbo a few weeks back. hbo will soon offer hbo go to anyone for about $15 a month, but it's starting with apple. so apple tv, ipads, iphones. that begins today in time for

"game of thrones." and tim draper will soon star in a reality show. it's called start up you. it focuses on draper's draper university in san mateo, an incink incuba incubator. >> you think this will be better received than the other silicon valley reality show? >> anything, kris, will be better received than that tv show. >> yeah, not my cup of tv. >> reality-ish. >> i don't even know where to go from that. one ripple effect from four years of drought is now leaving central coast farmers high and dry on the bottom line. an avocado farm is one of those casualties. last year, the 200-acre farm trucked in $2 million worth of water just to keep the fruit afloat. this year that same farm still needs more than a foot of rain. continuing problems are forcing the owners to sell.

>> we're just one story in thousands of california right now that's under the gun with lack of water. there's places adjacent that are for sale, you just don't see for sale signs. >> the current owner of the farm says it will take three or more years for the next owner to try to get those crops back on track, and just another sad story for farmers trying to deal with the effects of this drought. >> yeah, we love our avocado -- both are okay. potato, potato. burrito, burrato. >> no! she did. >> our hills are going to stay green the next couple weeks. i like to go hiking in the almadin valley. we're looking pretty good in the guadalupe reservoir as well, which is great news, because at this time last year, you could actually see some cars. they were highly visible at the bottom of that reservoir. at this point, it's looking okay

after yesterday's inch-plus rainfall we had. getting into the next couple months, the drought is going to be on the forefronts of everybody's mind as our rainy season comes to a close. this morning, already starting to see those showers come to a close. in san francisco, you're starting out at 50 degrees. we do have some light activity. 58 degrees in san francisco. by lunchtime, everybody all the way through noon. 62 degrees in san francisco. that's a nice comfortable day. right on average for this time of year in the city. so here we go. want to show you where the showers are and how much more we have to deal with throughout the day. just some light activity right now pushing over the santa cruz mountains. takes you into the 10:00 a.m. timeframe. starting to get more of that moisture passing through. as the area of low pressure clears out of the area. i've got to tell you, two feet

pass. this is where we had numerous accidents yesterday coming through 680, but not the case this morning 580 wide open. you can actually see what i'm talking about. 84 starting to slow down a little bit, but this is where we had 680 close yesterday. not the case for today. as we head up the peninsula, there is an accident the last 15 minutes on 101 northbound. you can see it's not really causing any slowdowns either on the northbound or southbound side, but crews are on the scene of that. balance and fire trucks are on the scene of that, so it looks like it will be a little bit of a time before they actually get that cleared again. 101 northbound right at the airport boulevard exit. back to you. this morning, investigators in los angeles are trying to figure out what sparked a massive fire at a commercial building not far from downtown

l.a. firefighters used ladders to rescue two people from the upper floors of that six-story building. one person was burned but is expected to survive. the building was built in 1966 and did not have a sprinkler system. a northern california cancer patient is back home from a family vacation just days after she was kicked off of her flight. elizabeth sedway put on a surgical mask before boarding her flight on monday. she was trying to avoid catching a cold. she told attendants that she felt weak and needed a little extra time to board. the airline told her she needed a doctor's note to fly. she used her cell phone to record the flight attendants who forced her and her family to leave the plane. even a text message from her oncologist failed to persuade the airline to let her fly. >> i was crying. my children were sitting there and we were being pulled off an airplane like we were criminals, or somebody with some contagious

disease. >> we are very sorry for the experience that our customer had today. we really regret the inconvenience. >> alaska airlines has refunded the family's airfare and paid for the overnight stay until the family could pay out, and it is apologizing for that incident. a natural phenomenon causing a big surf of visitors to san diego area beaches, not to mention some sticky feet. the problem, tar balls. they're not so used to seeing the tar wash ashore. all those black logs are catching some people by surprise. >> they were all over the place. first i thought it was some marine something. then i pick one up and i smelled it and it was sticky and really bad smell. >> experts say it is a natural occurrence called seepage. the oil rises from the sea floor and then turns to tar when it

degrades. when you get it on your feet, it is very hard to get off. >> i would imagine it would be. the warriors have had no problem getting their feet stuck in the sand so far this year burke they might need a little tuning up before the playoffs.

the dubs have four games left in the season. they play the trail blazers, also a big-time playoff contender tomorrow night. the warriors have already clenched the best record in the nba. >> christina loren has been watching that radar since yesterday, but boy, you didn't have to watch it like a hawk like you did yesterday. >> yeah, definitely not the case this morning. just some light showers rolling through. as we head throughout the next couple hours, that will be the story. and then everything will change as we get into this afternoon. trending drier and warmer. we're in the 50s. by lunchtime today into the

the issue of mandatory vaccines goes before sacramento lawmakers this morning. the controversial legislation stemming back from a recent outbreak of measles at disney land. how the recent death of a san jose police officer is spurring local lawmakers into action. >> and we are at the midway point of your workweek. cool showers starting to clear. the sun returns, warming trend. more on that in just moments. >> things pretty light compared to yesterday. we'll get you the door on time

and let you know what's happening. we want to look outside our window in san jose. twinkling lights there, sunrise still about an hour and a half off, but it is a nice start to this wednesday, april 8th. this is "today in the bay." >> from nbc bay area, this is "today in the bay." >> good morning. and thanks for joining us. i'm kris sanchez in for laura garcia-cannon. >> and i'm sam brock. we are working on a developing story this morning. a woman's body left in the middle of a busy south bay intersection. now police searching for the gunman. bob redell joining us live in san jose, where investigators are still on scene this morning. some crime scene technicians were out there. any idea what they turned up? >> they haven't given us much indication. good morning to you, sam. actually, most of the police have left the scene. what you have now is one officer guarding the remnants of the area where this woman was shot and killed. this around 10:00 last night. and that's unfortunately the spot where she died. we're along bascom at white

chuang is live in berkley. and berkley decided last night to overwhelmingly support that ban on personal exemptions, which is strange for berkley. >> yeah, some might say that. berkley with a lot of unknowns in terms of voting on these issues. but last night, a lot of support and today is california's first major hurdle on senate bill 277 requiring all kids to get vaccinated unless for medical reasons. parents say this takes away from their ability to decide for their own kids. council members voted 7-1 last night to support the bill. a pediatrician from sacramento would require immunizations in order for a child to attend a california school. stanford hoover institute expert bill whalen says he's not sure it will pass here in california. >> the debate over vaccines, which is a debate over science.

it's not conservatives who are having problems with this, but it's actually progressives. >> recent similar efforts failed in both washington and oregon, and this legislation would also require schools with immunization rates. it has to get through both the state and the state assembly and get the governor's stamp of approval. it hits the nine-member health committee at the senate level. there was an informal survey of these nine members to see how they would vote by a local paper. the other results coming up in about half an hour. this legislation was developed after the recent measles outbreak traced back to disney land. researchers determined that unvaccinated children fueled that outbreak. more than 140 people got sick from december's outbreak, according to the centers for disease control. we have more details about today's hearing on our website, nbcbayarea.com. and that's where you can also look at our database of vaccine opt-out rates at california

schools, see how yours fared. just search vaccine database. at 5:33 right now, we're going to find out more details this morning about just how an escaped inmate from santa clara county ended up all the way in mississippi. john l. carter escaped after attacking a deputy while at a check-up at santa clara valley medical center in san jose. at the time, he was in custody on suspicion of child molestation. deputies will hold a news conference to reveal how he was captured in mississippi. we'll have those details in our 11:00 a.m. newscast. the man accused of kidnapping and killing sierra lamar is going to be back in court today. garcia torres will be back to set a trial date. there was a previous hearing that ended up getting postponed until today. he disappeared three years ago while walking to a school bus stop. her body still has not been found, but prosecutors say her dna was discovered in garcia torres's car. he's pleaded not guilty. san jose city leaders are

resurrecting a plan to honor its fallen heroes. the mercury news reports that the mayor is considering a permanent memorial at city hall to honor police and firefighters who have died in the line of duty. the recent death of san jose police officer michael johnson rekindled that idea. back in 2008, council members did green light a similar plan, which was later shelved because of budget cuts. >> nice to hear that his memory will be honored. it was a very rainy start yesterday. not quite so much this morning. let's check in with christina loren. >> just some light showers out there. good morning to you. want to show you your microclimate forecast for today. temperatures mostly in the 40s and 50s. you might have to use your windshield wipers for maybe five to ten minutes at a time. not expecting much. nothing like yesterday. temperatures mostly in the 30s and 40s right now. a couple 50s out there. by noon today, rising into the

upper 50s. cool enough for a jacket just about all day long. you'll be at 62 in san francisco. 65 degrees in the south bay. 65 degrees on the peninsula. so here is what you can expect. a few showers to abundant sunshine today. getting into the end of your week, thursday and friday, temperatures jump into the 70s. and then by this weekend, we could see a little bit of shower activity. more clouds and certainly some drizzle as we have an unsettled pattern with that jet stream just to our north. we'll tell you what's happening right here in the bay area in my next report. right now, though, i want to say good morning to anthony slaughter and check that drive. >> yesterday, coming through the east bay was really treacherous. things this morning looking pretty good. it's slow, but we don't have any accidents coming through dublin. eastbound looking pretty good as well. let's switch to the maps and show you what i'm talking about.

now to a developing story this morning. a south carolina judge has ordered a police officer to be held in jail with bail for shooting and killing a man. video of that shooting shows the man running away before the officer opens fire and shooting eight times. "today in the bay's" tracie potts is live in washington, d.c., and the victim's family says it's thankful that a witness was there to catch the entire thing. good morning. >> reporter: exactly, sam. good morning, everyone. they say it could have been a completely different story without this video. and let me warn you, the video that we're about to show you is disturbing to so. it is certainly graphic in terms of what it detects. a man running away from an

officer firing his weapon. this is officer michael slager appearing via video at a court hearing. he's charged with murder. it happened saturday morning in north charleston, south carolina. a traffic stop, a brief scuffle, then this. walter scott shot at eight times as he was running away. >> he had some child support charges on him and i believe he didn't want to go to jail again and he just ran away. >> officer michael slager says he felt threatened. >> shots fired. suggest is down. he grabbed my taser. >> reporter: the video shows the officer picking up an object after the shooting and dropping it at scott's feet. >> we've got 343 police officers in our department. this was a bad decision by one of those 343. >> we've all seen the video. if there wasn't a video, would we know the truth?

>> scott's family is planning to file a civil rights lawsuit. and the family attorney says that the person who recorded that cell phone video was cooperating with authorities and will speak out at some point during this case, sam. >> meantime, the family, of course, grieving this morning. tracie potts live from washington. this story has all of the makings of a hollywood movie. russian hackers infiltrating white house computer systems. but cnn reports this actually happened. hackers gained access to information, including private details about president obama's schedule. they apparently penetrated through state department networks. investigators say the breach dates back to last year, but that no classified information was compromised. still, investigators are not certain that those hackers have stopped infiltrating the system. president obama still not talking about the most recent judge's ruling that keeps his

immigration plan from going into effect. a federal judge upheld the injunction. part of that plan protects some five million undocumented immigrants from deportation. 26 states, including texas, have sued to overturn the action. >> after the worst water conservation statistics in months, state water officials are now considering how to punish water wasters while rewarding those who are conserving. next month, the state board will vote on a new and more drastic plan. communities that aren't doing enough to conserve would have their water use cut by 35%. resourceful communities would only have to cut back 10%. just yesterday, water officials revealed that in february, californians only cut back their water use by about 3%. statewide, which as christina would say, is not worth it. an amazing sight in the sierra this morning.

some areas are reporting close to two feet of snow. while the snow is nice, it's too late too late for some ski resorts. sierra at tahoe closed down three weeks ago. operators say it would take more snow than they're getting to allow them to reopen. >> it was a tough one. >> for some other resorts, the snow means a couple more weeks of the ski season still to come. >> i said you would say that 3% cutback is not worth it. i mean, it's not cutting it. >> not cutting it. >> there we go. >> we all make mistakes. we're all human, sam brock. >> each and other day. >> some of us more human. >> that's right. 5:44 now. a little bit of light precipitation out there. we're going to see those resorts stay open all the way through mid april. that is such a great story to

this starts at about 10:00 a.m. it will go all day. you get out there on the waterfront, they're going to have free dragon boat rides, and temps will be comfortable. 65 degrees. another big event happening for the next couple weekends, the 48th annual cherry blossom festival. great time. a lot of people headed to japan town and temperatures will be comfortable saturday and sunday into the low to mid 60s. so that should be fun. just count on some additional traffic in the city as a lot of people like to flood the city when it comes to this weekend and it's a great event. have you ever been to the cherry blossom festival? >> i have not, but i was thinking about taking the train. >> we don't have any accidents here, but just a typical slowing that we usually see approaching

that is part of a gradual fare hikele roing out every year through 2020. it's expected to generate $15 million in revenue. bart is accepting public comments on this plan over the next three weeks. a key legal hearing may determine -- state supreme court justices will hear a legal challenge to san jose's ordinance called the inclusionary housing law. legal appeals have kept it on hold so far. the rule calls for developers to include small numbers of below market units with any new development project. other cities across the state have similar policies in place, but the housing industry calls the rules strong arm tactics. a pilot program aimed at keeping the streets of san francisco a bit cleaner is drawing the attention of other u.s. cities. san francisco recently started bringing in guard mobile toilets into the tenderloin district four days a week. and since then, the streets have been cleaner. for now, honolulu, portland, and

something industry. task rabbit started out this way. somebody go get me some dog food. the question is whether companies can make a profit this way. either you lose money on every transaction, or you charge so much for dog food, nobody is willing to buy it. case in point, i was on a trip recently. i was cooking dinner for the folks hosting me. they didn't have any garlic, i didn't have a car, i didn't know where the store was, i texted magic. give me some garlic. they said they could do it. it would cost $60. samsung this morning criticizing tests of its newest phones that show they bend and break somewhat easily. square trade did these tests. says the galaxy 6 will break at 110 pounds of pressure. that seems like a lot, but you put it in your pocket wrong, and you could theoretically do it. the issue, sam, is that samsung made an awful lot of fun of iphone with its bendy problem.
