>> an afghan soldier who is acting as their escort opened fire on american forces. the afghan soldier was tabbed to lead a convoy of delegates to high level talks when he turned on the u.s. delegation and opened fire. they'll say more when it has more information. >> developing at home, san jose are trying to find whoever shot and killed a woman. her body found in the middle of a busy street right next to a south bay high school. bob redell, do they think it's random? >> reporter: they don't. police say that this woman was shot while in a car that she knew her shooter. and this was not a random crime.

just one gunshot wound to the chest. she fell on the asphalt where she ended up dying on the street. tried to safe this woman who police say was 33 years old from the sacramento area but she didn't make it. a man who shot this woman. not clear if the man was the same man who was in that car. reporting live here in san jose, bob redell, "today in the bay." also developing this morning, a south carolina police officer is charged with murder for shooting and killing a man, and video of the shooting shows that man running away just

before the officer opens fire. the video you are about to see is graphic. a witness captured the whole shooting on camera saturday morning. you can see the victim running before eventually falling to the ground. the officer says scott tried to grab his stun gun. the video later shows slager picking up an object after the shooting, and then dropping it at scott's feet. officer slager was arrested less than an hour after that video was released to city and police officials. >> even if the suspect had taken the officer's stun gun, there wasn't that immediate need for the use of lethal force. and i think that video is the game-changer as to why the prosecution acted so quickly in charging the officer.

discovered in antilon garcia torres's car. he has pleaded not guilty. a judge denied the placement of 51 frazier smith into a home in fairfield. that home's proximity to solano college factored into the decision. he is a convicted rapist whose victims have mostly been teenage girls and young women. san jose city leaders are resurrecting a plan to honor its fellow honors. the mercury news reports that the mayor is considering a permanent memorial at city hall to honor police and firefighters who have died in the line of duty. the recent death of san jose police officer michael johnson rekindled that idea. it was brought up first in 2008 and council members green lighted a similar plan, but it was shelved because of financial cut bcss. happening today, the debate over vaccinations heating up in

sacramento. a controversial bill forcing kids to get vaccinated faces a big hurdle, its first hurdle. at the state capital. stephanie chuang joining us from berkley where city leaders have voiced their support and voted on their support for this plan. good morning. >> that's right, good morning to you. if what happened here in berkley is any indication, this really could have a shot at the state level. in fact, today, the berkley city council members are slated to send a letter to sacramento with the results that they do support vaccinations for all except for medical reasons. now, here last night, it was a packed house, as berkley city council members voted 7/1 to adopt a resolution supporting sb-277 that heads to the senate health committee today. it would ban the personal belief exemption and require that in order for kids to attend a school in california, they must first be immunized for diseases like whooping cough, measles, mumps, and chickenpox.

the reactions were split last night. >> this bill wreaks of the very worst knee jerk politics and fear mongering i've seen since 9/11. >> what i have a problem with is when one person's personal freedom encroaches on someone else's freedom. i think it's not a question about personal freedom. it is a question about public health and public safety. >> reporter: similar efforts in both washington and oregon recently failed. and here in california. ultimately, it has to get through both the state senate and assembly. today it does head to the nine-member senate health committee. a mercury news informal survey found that three of them said they would vote yes. one is leaning yes. one is voting no. and the four others are undecided. so you can see it's very close call at this first stage of the game. live in berkley, stephanie chuang, "today in the bay." >> should make for some spirited debate. thank you very much.

police looking for the person who shot and killed a woman late last night. her body was found in the middle of the street just about a block from delmar high school in san jose. a bill to ban california families from opting out of vaccinations for children gets its first real test today. that measure will be debated for the first time by legislators in sacramento. a police officer now charged with murder is being held without bail. that officer is accused in the shooting of a black man on a cell phone camera, running away from the officer. so the question this morning, one of the questions is can we trust law enforcement to use spy devices that track us? >> the sheriff's office, as you well know, in santa clara county asked for and got money and approval to buy a stingray. it's a machine put in the back of squad cars, it's really a fake cell phone tower. your cell phone connects to it and now law enforcement can track you.

not just talking about the bad guys. it tracks everybody's cell phone within range. the santa clara board of supervisors approved the idea, but only after the sheriff promised it will only be used in two cases. with court approval, or in the most extreme of emergencies. >> i think if we use it judiciously, which we plan to do and the people who will be ov overseeing it will, i think we'll be okay. we're dedicated to preserving people's rights. >> the aclu this morning has uncovered a case in new york state where a sheriff's office using the very same device, which also promised to use it with a court order, used the stingray 48 times and 47 of those times did not get a court order. didn't even tell anybody, in fact. now, obviously, we can't condemn santa clara county for something erie county in new york state did. but it is a cautionary tale. the people in erie county took the sheriff's word for it and granted the stingray request.

let's talk about something a little lighter, shall we? there's a new reality show in the works, based on the start-up school in san mateo called draper university. the show will be called "start-up u." you can find it on abc family. not the first time we've seen a silicon valley reality show. there was one called "silicon valley." it was universally panned. this one was a silicon valley that none of us had ever seen. one of the characters said silicon valley is like high school, but it's only the smart kids and everybody has a lot of money. >> fairly accurate. >> maybe it did exist, we just weren't invited. >> certainly not inviting you to the party. >> i've never been invited either. in order to tray to deal with the historic draught, state officials are considering punishing water wasters while rewarding the communities that are already conserving.

next month, the state board will vote on a new plan to save water and communities that aren't doing enough to conserve will have to cut back their water use by 35%. resourceful communities already doing the right thing would only have to cut back 10%. it was revealed in february that people only cut back their water use by about 3% statewide, far less than we were supposed to. >> certainly trying to raise the standards there. a much different picture in the sierra this morning. take a look, on the left side of your screen, video from last week when governor brown was touring the sierra. not a snowflake in sight. on the right, that same area, what it looks like this morning. close to two feet of fresh powder blanketing the meadow thanks to yesterday's storm. while the new snow won't do a whole lot to help the drought, it will keep some ski resorts running a little bit longer this season. squaw valley was planning to close on sunday, but this new round of snow means a couple more weeks of fun on the slopes. >> mother nature said, what? me? from snow in the sierras to

funnel clouds near sacramento, this funnel cloud spotted yesterday afternoon and was one of several reports across the state. the national weather services say that none of the funnel clouds actually touched down. let's get local now. time to check the microclimate forecast in san jose as we give you a live look outside this morning. some fog and clouds, but improving conditions from yesterday, and we are still looking at some light showers. >> yeah, just a little bit of activity this morning. you might actually have to use your windshield wipers for maybe five to ten minutes at a time. but you know what, two feet of snow and tahoe, that is a good scenario. we picked up over an inch of rain just about everywhere across the bay area. let me talk about some of the totals for you. hayward, .8 of an inch. over an inch in belmont. same for oakland. picked up over an inch and .3 in

navado. looking good in napa. the big winner was the santa cruz mountains at two inches. and just some light activity. there's nothing really on radar this morning. a little soupy out there. you might want to use your windshield wipers from time to time. i don't think you'll need to for more than ten minutes. temperatures mostly in the 40s and 50s to start. i just want to thank all of you who sent me your pictures yesterday, who gave me your updates. we did have that hailstorm. with about a dime-sized hail yesterday. and that was through the fair field area. as we head throughout the day today, tranquil conditions will persist later on. we'll be at 51 degrees to start in san francisco. into the upper 50s by lunchtime. and the mid 60s by 4:00 p.m., the warmest time of the day. so you have to love social media and how much it connects it. i'm always posting on my facebook and twitter page throughout the day, letting you know what your microclimate can expect. temperatures will be much warmer, back to the 70s for us

tracie potts is live in washington, d.c., and the victim's family says that they are thankful that a witness was there to catch the whole thing on video. >> exactly. they say it could have been a completely different situation. that officer sits in jail today, charged with murder, and we want to warn you that the video can be disturbing for some viewers. it is certainly graphic, depicting what you just described. the fbi and the justice department are now investigating. this is officer michael slager appearing via video at a court hearing. he's charged with murder. it happened saturday morning in north charleston, south carolina. a traffic stop, a brief scuffle, then this. walter scott shot at eight times as he was running away. >> he had some child support charges on him and i believe he didn't want to go to jail again and he just ran away. >> reporter: officer michael

slager says he felt threatened. >> shots fired. subject down. he grabbed my taser. >> reporter: the video shows the officer picking up an object after the shooting and dropped it at scott's feet. >> we've got 343 police officers in our department. this was a bad decision by one of those 343. >> we've all seen the video. if there wasn't a video, would we know the truth? >> reporter: scott's family is planning to file a civil rights lawsuit. and the family attorney says that the person who recorded that video was cooperating with authorities, and plans to speak out publicly about this sometime soon. >> so it seems like the disturbing part is not only that the man was running away from the officer, but that the officer was also seen almost planting evidence, it would appear. is anybody talking about that? >> people are talking about it, but we don't know what that was at this point, kris. you see him pick up something,

welcome back. that's a live look outside at the golden gate bridge, and a picture-perfect sunrise. always a good way to start out your day. this morning, investigators in los angeles are trying to figure out what sparked a massive fire at a commercial building not far from downtown l.a. firefighters used ladders to rescue two people from the upper floors of that six-story building. one person was burned but will be all right. that building was built in 1966 and did not have a build-in sprinkler system. the problem, tar balls. farther nor in pla-- north like

santa barbara. all those black blobs are catching people by surprise. >> first i thought it was some marine something. then i picked one up and i smelled it. and it was sticky and really bad smell. >> experts say this is a natural occurrence called seepage. the oil rises from the sea floor and then turns to tar as it degrades. talking about trying to keep things clean, a pilot program aimed at keeping the streets of san francisco cleaner is now drawing the attention of other u.s. cities. san francisco recently started bringing guarded mobile toilets into the tenderloin districts four days a week. since then streets have been cleaner. they're now trying to mimic san francisco's program. coming up, on the run no more. an escaped inmate from the bay area is caught thousands of miles away.

now, 15 minutes of continuous news, weather, and traffic on "today in the bay." >> 6:43 now, and an update to breaking news. one american soldier is dead and two others are hurt after an afghan soldier escorting them turned and opened fire. a u.s. official says the afghan soldier was leading a convoy of delegates to high level talks in kabul when he turned on the u.s. delegation and opened fire. u.s. troops returned fire, killing that shooter. the incident is under investigation. developing here at home, a woman is shot and killed and her body left in a south bay street. this happened near the corner of stoke street and south bascom avenue near delmar high school. that's where we find bob redell, who is live in san jose this morning. bob, police were out there all night long investigating. do we know what they uncovered? >> reporter: we're getting a better idea of what led up to this shooting. good morning to you.

as you can see behind me, the scene here is now clear, but we have been speaking with a man who witnessed at least part of the shooting last night. he said that he saw a white car that stopped here at this street corner around 10:00 last night. he heard about three gunshots from inside that car, and then a horrible sight as a woman exited the vehicle with at least one gunshot wound to her chest. a man and ott woman with a baby also came out to help the victim. the woman with the baby was screaming, identifying who pulled the trigger, which we're not going to do since the police have yet to make an arrest. the victim according to police was a 34-year-old woman from the sacramento area. she was declared dead on the scene. the driver of that car did stick around for a little bit after the shooting. then drove off. police have told us that they have since recovered that vehicle. they are processing it for evidence. investigators did interview the other people who were in the cars as well as at least one of the witnesses. sjpd confirms that this does not appear to be a random crime.

watch out for that, from fremont all the way up toward hayward. you may have the use your windshield wipers. otherwise we're going to see a nice sunny finish to the day. a few showers early, clearing out by about 10:00 to noon. once you make your way home from work, temperatures will still be cool. we're still under the influence of a cold front that came through, but really, not seeing any more shower activity. that's when everything will come to a close. let me take you through your forecast for today. cold to start. mid to upper 50s by lunchtime. then by 4:00 p.m., the warmest time of the day, temperatures are going to climb into the low to mid 60s. so a good five degrees warmer today than it was yesterday. let me show you what to expect as we head deeper into the week. which is finally, finally coming to a close as well after today. we want to help you get through the midsection. air quality looks good for today. tomorrow, in fact, all the way through the end of the week. and that's when we are expecting our warmest temperatures into the 70s for thursday and friday in the south bay.

always slows and it's already starting to slow. you can see what i'm talking about. there is the camera, but you can see what we were looking at. that slow down. it does start to improve, but this is always one of those spots that is slow this time of morning. let's hop over to the area we were concerned about. yesterday, 680 not looking at bad, but we just had an accident. it doesn't look like it's affecting traffic all that much. the one i'm really concerned about is on 880 this morning. this is always a slow spot. we had an accident right at lou ellen avenue. it continues to remain slow. we're just getting started with parts of rush hour. we're starting to see some slowing on the bay bridge, but it's not all that bad, especially considering yesterday when we had this part of the highway just -- littered. you can see cars are actually moving this morning, so that's some great news. but stop and go once you get towards the metering lights.

guys, back over to you. 6:49 right now. this morning, we will find out about how an escaped inmate ended up in mississippi. he escaped last month after attacking a deputy while he was at a check-up at santa clara valley medical center. at the time he was in custody on suspicion of child molestation. deputies will hold a news conference to reveal how he was caught and we'll have the latest details for you in our 11:00 a.m. newscast. we could learn more about the man accused of killing sierra lamar will be standing trial. a previous hearing was postponed until today. lamar disappeared three years ago while walking to his school bus stop. her body still has not been found, but prosecutors say her dna was discovered in his car. he has pleaded not guilty. the release of a convicted sexual predator to a neighborhood near solano college won't happen after all.

a judge denied the placement of frazier smith into a home in fair field. that home's proximity to solano college factored into that decision. residents held a passionate meeting to voice their concerns over the plan because smith is a convicted rapist whose victims have been mostly teenage girls and young women. a convicted felon will face new charges after investigators link him to two east bay cold cases. william huff, also known as wild bill, is accused of killing two women, one in 1987, the other in 1993. investigators say dna evidence linked huff to those murders. both victims were sexually assaulted and asphyxiated. huff is currently behind bars in vaccaville for auto theft. police in the south bay arrested a man in connection with a fiery crash on highway 101. investigators say this man was under the influence when he hit a car in san jose just after midnight yesterday. police say he slammed into that

car and then drove off. moments later, that car was hit by a truck. the car burst into flames, and the driver was killed. the suspect now faces several charges, including dui and view hi -- vehicular manslaughter. the mercury news reporting that the mayor is considering a permanent memorial at city hall to honor police and firefighters who died in the line of duty. the recent death of michael johnson rekindled that idea. back in 2008, council members green lighted a similar plan that was later shelved due to fiscal cutbacks. happening today, the debate over vaccinations is heating up in sacramento. a controversial bill forcing kids to get vaccinated faces a big hurdle at the state capital. stephanie chuang is live in berkley this morning where city leaders are backing that plan, which seems to go a bit contrary to what you might expect from berkley. >> reporter: that's right. good morning to you. maybe a little surprising for

some, but it was definitely a heated debate in berkley. is this an issue of a parent's right to decide for his or her own child, or is it a matter of public health? and berkley city council members last night voting for the latter 7-1 to support senate bill 277. authored by richard penn, a pediatrician from sacramento. this would require immunizations for diseases like chickenpox, mumps, measles, and whooping cough in order for a child to be admitted to a california school. stanford hoover institute expert phil whalen says he's not so sure it will pass here in california. >> here we have debate over vaccines, which is ultimately a debate over science. do you trust science to do the right thing for your children. it's not conservatives who have a problem with this, but actually progressives. >> similar efforts recently by washington and oregon fail edfa. today it hits the senate level.

orozco is short of the majority needed to win it outright. the race fielded ten candidates and the top two will meet in a runoff election on june 23rd. starting next year, bart riders are going to have to dig a little deeper into their pockets to catch a train. late yesterday, bart quietly announcing a 3.4% hike across the board effective january 1st. that increase is part of a gradual fare hike rolling out every other year through 2020. the hike is expected to generate $15 million in revenue for bart. bart is accepting public comment on that plan over the course of the next three weeks. want to get away to texas of all places? it just got easier to fly from the south bay to the lone star state. starting today, southwest launches nonstop service. love field is also southwest's major hub. to celebrate, southwest is hosting a texas-themed kickoff

"the wall street journal's" jeffrey fowler likes the new watch. he says it saves you time and effort because you're not constantly taking your cell phone out of your pocket all the time. he says if you can tolerate single-day battery life, half-baked apps and inevitable obsolescence, you can wear it on your wrist. another reviewer says for a digit call addict like me, getting updates on the watch are little hits of methadone, just enough to contact the digital world to whet my appetite.
