vote on an historic fine against pg&e for its involvement in the deadly explosion in san bruno. "today in the bay's" stephanie chuang live in san francisco this morning. steph, this fine could be $1.5 billion or more. >> reporter: that's right, good morning, scott and kris. it could be, although in a prepared statement obtained by the associated press ahead of this morning's hearing the commission president asked about the fine and whether it would be enough to impact pg&e, the state's largest power utility, which earns $1.6 billion last year alone. so $1.6 billion is the figure commission president michael picker is proposing as the fine against pg&e for the 2010 deadly san bruno explosion that killed eight people. picker's recommendation adds $200 million to what administrative law judges decided a few months ago with the other major change being hundreds of millions of dollars devoted specific dloi pipeline safety upgrades instead of the

safe general fund which could pay for anything. san bruno city leaders also want to establish a pipeline safety trust and an independent monitor. this especially after 65,000 e-mails came to light during this process that showed what may have been a cozy relationship between pg&e and the cpuc which is of course supposeded to regulate it. there are federal and state investigations into this right now. pg&e on the other hand says it has redoubled safety training, carried out 9 of 12 specific safety upgrades recommended by federal transportation officials and changed top executives, but the investigations have already impacted this morning's hearing because one commissioner, mike florio, accused himself after e-mails came to light showing private communication between him and pg&e. live in san francisco this morning, stephanie chuang, "today in the bay." >> we'll have updates all morning, thank you very much. 6:02 and a party bus owner is going to prison three years after a young woman fell out the door of a bus and died. yesterday a jury found john reno

st. james guilty of involuntaryminvoluntary manslaughter in the death of 25-year-old natasha nolan. the santa cruz woman fell out of a party bus door on highway 17 in los gatos back in 2012. jurors found the owner guilty because he knew about the door and ignored it. nolan's death led to a new law requiring i.d.s to be checked if alcohol is consumed on the bus. also new police believe the same man may be behind two strongarm robberies minutes apart near the uc berkeley campus. police say two men were mugged within a six-minute period before 1:00 a.m. yesterday. the first attack happened at parker and college avenue, the second at rrohring and parker. the victim was punched in the case. police say four men were involved in the attack. a policy change to fight sexual assault on campus. this fall any stanford student found responsible of sexual assault by the university will be expelled from the school.

"today in the bay's" bob redell is live on the stanford campus and bob, while many people are applauding this change, many students say they're surprised this rule was not already in place. >> reporter: right, but they're glad that the campus is finally doing something about this. stanford university, kris, becoming one of the first campuses nationwide to move forward with this expulsion policy, after criticism for, and a federal investigation into its past handling of sexual assaults. member task force made up of faculty, administration and students outlined the new rules in a report released yesterday, calls for students to be better educated about sexual assault, a streamlined investigative process and better resources for victims and a requirement that students now be expelled if a three-member panel finds them responsible for committing sexual assault. at least one student we spoke with was surprised. just can't believe this is just becoming policy now.

>> i thought it was in place in years past. i think it kind of blew up this past spring with the case that became a poster child case for the entire university. >> reporter: that poster child is leah francis, who says she was sexually assaulted by another student while both of them were back home over school break, school break last year. students protested when the university suspended that student for five quarters. that student, however, was never charged in court for lack of evidence. the feds have since placed stanford on a list of about 100 schools nationwide under investigation for the way they handle sexual assaults. since 2005 courts convicted nine stanford students of sexual assault. of the nine students the campus has only expelled one. this new expulsion policy goes into effect this fall. reporting live here at stanford, bob redell, "today in the bay." >> i would assume the burden of proof is a little different for

someone found responsible by a three-person committee versus going to court and being found guilty and heading to jail, right? >> reporter: we would imagine the burden of proof is not going to be beyond a reasonable doubt, as you would find in a criminal court, perhaps more like a civil court, preponderance of evidence. >> we'll see how that shakes out. thank you, bob. more trouble for the secret service, a top ranking member is under fire accused of sexually assaulting a female employee. secret service supervisor javier morales is accused of making unwanted advances on a co-worker, that included kissing her and trying to grab her at the agency's headquarters. secret service director joseph clancy says morales turned in his badge and gun and now on administrative leave. this is just the latest hit to the agency's already blemished reputation. secret service has been rocked by a series of high-profile security breaches as well as accusations of a drunk driving crash at the white house.

guilty on all counts, as early as next week, jurors could decide whether convicted boston marathon bomber dzhokhar tsarnaev will pay for his crimes with his life. the penalty phase of the trial could begin as early as monday. after nearly 12 hours of deliberations it took a jury 26 minutes to read its verdict yesterday. jurors found tsarnaev guilty of 30 counts, including conspiracy and deadly use of a weapon of mass destruction. 17 of those counts are punishable by death. now, for now the guilty verdict is a small victory for those affected by the terror attacks. >> i may be standing on one fake leg but i'm standing here stronger than ever, because someone tried to destroy me and he failed. >> for me, the mom of two boys that were hurt so bad and to see so many injuries that day andñy% see what they suffered and go eath penalty. suffered and go

>> the state of massachusetts has no death penalty,(kp but th trial is in the federal system. so if the jury decides that tsarnaev should be put to death that will happen in the federal government's lethal injection chamber in indiana. the other option, life in prison, most likely a penitentiary in colorado. nbc's pete williams has been covering this trial since it began. he'll have much more about what happens next coming up on the "today" show at 7:00 this morning. it is 6:08 right now. time to check that microclimate forecast. as we look out our window over the bay bridge, and this is one of the prettiest parts of the day as the sun starts to rise over the bay area. meteorologist christina loren is watching that and she's watching the radar which is not busy today. >> not busy today, which means an easier drive for everybody headed outdoors right now. kris, scott, everybody at home, good morning to you. temperatures are chilly to start. we have some high, thin clouds

explosion. californ california ic california's public utility will vote on the fine. dash cam video could be released today showing the moments before a south carolina police officer gunned down an unarmed black man. officer michael pfleger has been fired and is facing murder charges. stanford university overhauling its response to campus sexual assaults. yesterday the school's task force on sexual assault recommended expulsion for any student found responsible of sexual assault by a campus tribunal. a developing story for you, hackers claiming allegiance to isis seized control of a french television network for several hours last night. the hackers cut transmission of 11 channels and took other the network's websites and social media accounts. the network has restored its signal but can only broadcast recorded programs. this morning, the french cultural minister has called an urgent meeting of media groups to assess their vulnerability to

future attacks. for the first time rising radon levels are being tied to the process of fracking. radon is an odorless gas the second leading cause of lung cancer. it occurs naturally but researchers in pennsylvania say higher levels of radon have been found in homes where unconventional drilling has gone on nearby. recertainers have not yet found a direct link between fracking and higher radon levels but they are advising residents near fracking sites to be aware of the radon levels in their home. now to an exclusive investigative unit report, they're not paying taxes and san jose's mayor is turning up the heat. last month the nbc bay area investigative unit discovered more than $2 million in unpaid taxes by medical marijuana sellers in san jose. two of those facilities have not paid since opening several years ago. the city has responded sending cease and desist orders and issuing fines to landlords for

head throughout the next couple days. low 70s for your thursday into your friday here in the south bay. we'll be in the low to mid-70s in some of your inland valley spots on saturday and what you'll notice about monday, giants home opener day, temperatures are going to drop off. we'll get a little drizzle in the morning and then maybe a litt little bit of snowfall and rainfall on tuesday. we want to keep you up to date on the drought situation. this is kind of cool. this was the actual snow, all we had as of last saturday. let me show you what one storm can do here in the bay area and you can see quite a bit more, 55.8% covered at this time. so for us, we picked up over an inch and a half of rain in some spots, two inches in santa cruz mountains. three-quarters of anen inch to inch. if you're headed out to tahoe,

you don't need chains but you'll have decent skiing conditions and that will be the case for at least the next week. some resorts hoping to stay open until the 15th of this month. here is the reality check. we only climb from 5% to 8% of your april average. we need that snowpack desperately. we're at about 100% of average though here in the south bay, courtesy of that last storm system for this year. still digging out of four years of drought. the next best rain chance comes through throughout your tuesday at 6:00 a.m. you can see widespread activity, nothing heavy but definitely enough to keep our hillsides nice and green and that should hopefully prolong that fire season from kicking off, we need as many storms as possible. it could be a tough season if not. we'll keep you updated. here's slg slgt and your morning drive. >> keeping you updated on the drive. >> starting to see the slowing through the altamont pass no, accidents 580 or 680 at this hour. pleasanton starting to see

just an accident but not causing any slowdowns at least from our maps perspective. as we look down the east bay 880, things moving pretty good there, we did have one earlier accident on the dumbarton bridge, not causing any problems, off on the shoulder and things in the south bay looking good. we just had an accident into the chp on the 87 and 101 connector, already a slow spot as 87 turns into 101 and when you head down 101 talking the lawrence expressway keep in mind there was an earlier accident a car overturned on east arc head avenue. you may want to use the exit before or after. they have crews on the scene of that trying to get the overturned car right side up. >> thanks very much, anthony. let's take you out to the markets this morning, dow industrials gaining 52 points, further convincing that the fed may not raise interest rates any time soon. i want to take you back over to the nasdaq as well. did i mention the mets had a

president michael picker has a proposal that adds $200 million to what judges came up with last year, his plan would cut the payment into the state general fund from $950 million to $300 million but it would add $850 million to go directly to pipeline safety improvements and that is in addition to $400 million that would go in a refund back to rate payers as well as $50 million to implement more than 75 safety improvements. on top of the money, though, san bruno mayor jim ruane says there needs to be additional safety improvements, including a pipeline safety trust and independent monitor to ensure more oversight and to ensure that what happened in 2010 the deadly explosion won't happen again. especially after 65,000 e-mails came to light revealing what may have been a cozy relationship between the pg&e officials and the cpuc. in fact, one commissioner has recused himself from this morning's hearing because of e-mails showing private communication between him and pg&e. meantime, the utility says it already dedicated $2.8 billion

i want to switch over to fremont and show you what it's looking like there. slowing through the 880 southbound corridor. northbound moving good, just typical slowing. as we get into san jose this is what i want to show you on the maps, we are starting to find some accidents backing up. in fact around the 87 / 101 corridor, this is always a slow spot especially towards 7:00 and 8:00, so 87 right at the 101 connector there was an accident and actually on 101, so you can see the slowing continues back towards 101 and past that right at tremble, an exit after that another accident, a stall and as you make your way towards lawrence expressway another accident there, not on the highway but the lawrence expressway so if you are using lawrence expressway right at east arc head avenue an overturned car there. you want to avoid that. as we make our way towards 101 approaching the area we are already starting to see slowing outside as we take you to the camera there. not too bad. roads are wide open from this vantage point but as you get

past 280, approaching that scene i just showed you, it will be very slow this morning. back over to you guys. >> anthony, thank you. new this morning, police believe the same man may be behind two strongarm robberies, minutes apart, near the uc berkeley campus. berkeley police say two men were mugged within a six-minute period before 1:00 a.m. yesterday. the first attack happened on parker and college avenue. the second on warring and parker. in one case the victim was punched in the face. police say four men were involved in the attack. a college aims to fight sexual assault on camp us. any student found responsible of sexuality assault by the university will be expelled by the school. "today in the bay's" bob redell is live on the stanford campus this morning. bob, many people are applauding the change but many students say they're surprised this was not already a fact. >> reporter: yes, some students are surprised to hear that stanford university, kris, didn't have this expulsion policy in place for students who

commit a sexual assault. it just hasn't. you might recall a case of leah francis, a stanford student who said another student sexually assaulted her last year while both were home other break. there were protests when the university didn't expel, but instead suspended that student for five quarters. that student it must be noted was never charged in court because of lack of evidence. more recently a swimmer accused of sexual assault was not expelled but voluntarily left campus while his case is in the courts. yesterday an 18-member task force here on the campus made up of the administration, faculty and students did change campus policy. students will now be expelled from school of a three-member panel finds they committed a sexual assault. >> certainly i think there's precedent for this and over the next two, three years there's going to be big, big changes happening across the country. >> it's something that's very practical. i think it makes a lot of people feel safe. >> reporter: recently the

federal government added stanford university to a list of around 100 schools nationwide under investigation for the way they handle sexual assault. of the nine stanford students convicted of sexual assault since 2005, only one was been expelled. that's about to change with this new policy that goes into effect starting this fall. reporting live here at stanford, bob redell, "today in the bay." >> some folks are criticizing this, bob, saying it doesn't respect the process of law but this is different from a courtroom process. >> reporter: as we were mentioning earlier, if you look at a criminal court, you must be found guilty beyond a reasonable doubt. we expect with the three-member panel it will be more like a civil situation, where they're trying to find you responsible and that burden of proof is less, it's usually a preponderance of evidence. >> thank you very much, bob. more trouble for the secret service. a top ranking member is under fire accused of sexually assaulting a female employee. secret service supervisor javier morales is accused of making

unwanted advances on a co-worker who was actually one of his underlings. that included kissing her and trying to grab her at the agency's headquarters. secret service director joseph clancy says morales turned in his badge and gun and now on administrative leave. this is just the latest hit to the agency's already blemished reputation. secret service has been rocked by a series of high-profile security breaches as well as accusations of a drunk driving crash at the white house. guilty on all counts, as early as next week, jurors could decide whether convicted boston marathon bomber dzhokhar tsarnaev will pay for his crimes with his life. the penalty phase of the trial could begin as early as monday. after nearly 12 hours of deliberations it took a jury 26 minutes to read its verdict yesterday. jurors found tsarnaev guilty of 30 counts, including conspiracy and deadly use of a weapon of mass destruction.

17 of those counts are punishable by death. now, for now the guilty verdict is a small victory for those affected by the terror attacks. >> i may be standing on one fake leg but i'm standing here stronger than ever, because someone tried to destroy me and he failed. >> for me, the mom of two boys that were hurt so bad and to see so many injuries that day and see what they suffered and go through, i speak for myself, i want the death penalty. >> the state of massachusetts has no death penalty, but this trial is in the federal system. so if the jury decides that tsarnaev should be put to death that will happen in the federal government's lethal injection chamber in indiana. the other option, life in prison, most likely a penitentiary in colorado. nbc's pete williams has been covering this trial since it began. he'll have much more about what happens next coming up on the

"today" show. a party bus owner is going to prison three years after a young woman fell out of the door of a bus and died. yesterday a jury found john reno st. james guilty of involuntary manslaughter in the death of 25-year-old natasha nolan. the santa cruz woman fell out of a faulty party bus door on highway 17 in los gatos back in 2012. jurors found the owner guilty because he allegedly knew about the door and ignored it. nolan's death led to a new law requiring i.d.s to be checked if alcohol is going to be consumed on buses. this afternoon the chp will reveal new details about a deadly hit-and-run crash on the peninsula, in hopes someone can help officers track down the driver. motorcyclist was on highway 101 near 92 and san mateo last thursday when he hit a concrete barrier and flew off the on-ramp. witnesses say they saw an suv or

jeep stop, then head east on 92. officers say that vehicle may have been involved in the crash, and it may have damage to illustrates right side. the san jose police department plans to use a drone, getting closer to takeoff. "mercury news" reports the city's neighborhoods commission this week issued a report endorsing use of a drone as part of a one-year pilot program. the department acquired the drone last year through a homeland security grant. another committee must still  sign off on the plan and then it has to go before the full city council. they would need permission from the feds as well. sfo stepping up security following a string of breaches at bay area airports. last month a homeless woman managed to walk onto a runway at sfo with plans to stowaway on a plane headed to central america. this morning, airport managers are holding a news conference. they're going to talk about improvements to security around runways. they'll also give an overview of already completed security enhancements.

the meeting at sfo comes a little more than a week after a woman was stress pag the at mineta san jose. she scaled the fence and walked on to the air field marking the fifth security breach at that airport in less than a year. it includes several high profile incidents like a teenager who stowed away in a wheel well of a flight to hawaii, and breaches by serial stowaway marilyn hartman. airport officials currently reviewing their security as well. state lawmakers are getting closer to preventing the student fee hike now looming over the entire uc system. uc president janet napolitano and governor brown currently negotiating an increase approved by uc regents. it would raise tuition 5% a year over the next five years. yesterday a state senate committee unanimously approved a bill to give $150 million to uc and cal state schools to limit owe limb nate eliminate that hike.
