dchd altidmont pass. just your typical overnight road crews throughout the bay. south bay police are trying to figure out what caused a car to flip over and land on the vta track killings two people on north capital avenue last night. police say there were five people in the car, two of them died. a vta train was not involved. this morning a deadly house fire in san jose under investigation. it is being treated as a crime scene. the fire started on jeanne avenue around 7:30 last night a few blocks away from mckinley elementary. this is a cell phone video of the smoke billowing out of the house. firefighters say when they got there fire and smokey just pouring out of the home.

a man told authorities he escaped. >> we searched all the rooms, as well as an active firefight that was in there. throughout the search they determined and found that the one person that was still inside the building was in the room of fire origin. >> firefighters found a body in the back bedroom. neighbors say the victim is not the man who owns the home. no word yet on who he is. this morning several bay area catholics are coming together issuing a joint complaint about the archbishop cordileone ask something pope john wito remove him. >> we'll find out more details today about a month-long operation to fight crime across the country including here in the bay area.

our cameras went were u.s. marb marshals and other local o law enforcement agencies as they conducted operation violence reduction. we'll found out how many they rounded up. u.s. attorney's office will offer more information later in oakland. we'll bring you the details tonight at 5:00 and of:00. a mystery in the south bay. a man severely beaten outside of his apartment complex. police say after months ever investigation they're at a dead end. it happened in san jose not far from the 280/17 interchange. this 36 years man had just finished watching the 49ers/bears game. he walked to a nearby store but didn't come back. next morning neighbors found him beaten and unconscious on the sidewalk. he can't remember what happened that night. he suffered brain damage and lost vision in his left eye. now he is learning to walk again. >> it's very hard for my son

who's in tuned in a body that's -- i'm sorry -- somewhat foreign to him. he knows he's not the same person and it's very depressing and it's hard. >> the victim's cell phone also stolen. . detectives have not been able to locate it. if you know or saw anything, call san jose police. all new this morning, it probably didn't wake you up but a small earthquake did hit overnight in the south bay. the 2.4 magnitude quake was centered just outside campbell a little after 1:00 this morning. so far noe injuries or damage t report. in san francisco overnight a minor traffic accident led to a major gusher. it happened at 11th and geary in the city's richmond district. fire crews say one car rear-ended another sending it head-on into the fire hydrant. two people suffered minor injuries. 75,000 gallons later firefighters were able to turn off the water. 4:35 right now. an emotional moment waiting on deck tonight for the san jose

giants home opener at municipal stadium. brian stowe, the fan brutally beaten outside dodgers stadium in 2011 will throw out the first pitch. two men pleaded guilty to that attack. stowe was in a coma for a long period of time and suffered permanent disability. tonight he plans to walk to the pitcher's mound to deliver the pitch. >> brian used to be an emt here at san jose a number of years back. and when he was injured down in los angeles, we made a commitment to his children that when he got well, that he could come back and throw out the first pitch. and that day has come. >> fans at tonight's game who contribute to the brian stowe fund will also receive two free tickets to a future san jose giants game. 4:36 right now. another east bay water district plans to hike rates and crackdown on water wasters. the contra costa water district will adopt new rules in order to

a very good thursday morning to you. taking a beautiful live look outside. pretty clear. you can see all lights glistening from a distance there atop san bruno mountain. legalization supporters may not think marijuana and heroin are the same type of drug but the federal government still does after the latest federal court ruling in sacramento. judge refused to take marijuana off the list of schedule 1 drugs which includes heroin, lsd and ecstasy. those drugs are considered to have a hypotension for abuse and no excepted use for medical treatment. the national organizations for the reform of marijuana laws plans to appeal yesterday's ruling. >> it doesn't comport with public opinion. it doesn't comport with

available evidence and it doesn't even comport with common sense. >> a group called citizens against legalizing marijuana says there's no scientific evidence for making a change in the federal status of marijuana. now to another divisive and controversial issue that hit a speed bump at the state capital yesterday. the senate education committee delayed a vote on senate bill 277. for those unfamiliar with the number, it would do away with the personal believe exemption for vaccinationvaccinations. the bill will be taken up again next week after the bill's author has a chance to talk to senators. it passed easily early month in the month. health officials say measles at disneyland will be declared over if no outbreak occur overnight. a popular website known for

lets users errs pay for an ite tapping the electronic reader at checkout. it will work at thousands of places nationwide but it will only work with american extress cards. >> thanks a lot. . bay area flyers can now get into the party spirit if they're op their way to houston, as in spirit airlines. the low-cost air carrier is launching new non-stop daily service between houston's bush international. oakland is 1 of 10 new destinations that spirit is rolling out this spring with the houston hub. southwest making a new move to make passengers feel a little more at home. it is introducing wider seats. these are the seats southwest selected for future planes. it will add about an inch of extra width for passengers. southwest says the change will give it the widest 737 seats available of any u.s. airline. the new coach seats debut in about a year. clear skies maybe. if you're taking a flight out there today, let's get a quick check of what's going onion

but by monday, coastal cooling, looking good for showers on the 21st and the 22nd. you can see that in your futurecast. expecting rich moisture to track to the bay area. you know what? we're going to get some noefl out of this as well. we'll have all the latest on this throughout the 5:00 hour. right now back to you, sam and laura. the man behind a wild stunt on the u.s. capitol lawn expected to land in court today. if you haven't seen the video, little bit unnerving. a 61-year-old florida postal worker piloted his gyrocopter landing next to the capital building. he called it a protest against campaign finance rules. but flying into such restricted airspace and landing at the capitol are both federal crimes. we don't know what caused the death of a sperm whale that washed up on a beach in pacifica. for now biologists are calling the cause of death a mystery but they don't believe a ship struck

it. it appears to have been eating. marine mammal center says it's been seven years since the last sperm whale washed ashore on a bay area beach. the voters' initial response to a shared l.a. stadium for the raiders -- it's good. organizers yesterday turned in well more than the minimum number of signatures to place the stadium project on a special election ballot. the stadium may house two tenants -- the raiders and the san diego chargers. it would sit in carson on the eastern end of los angeles. carson city council now has the choice to schedule and election or consider the plan without a vote. even if approved though, the nfl would need to give the raiders the thumbs up to actually move. a lot of men may be in mourning this morning. one of the most famous models just walked her last catwalk. brazilian super model gizelle bunchen retired last night. patriots husband tom brady was in the crowd for the final walk. bunchen wants to focus on her
