he was taken into custody. nbc's kelly cobiella has the late good morning to you. >> reporter: matt, good morning. the man is a 24-year-old i.t. student and algerian national, his alleged targets two churches, sunday services. officials say he had a large stockpile of weapons and the attacks were imminent. the man reportedly staked out this church according to a french newspaper along with a second church in his neighborhood. the french interior minister they found handguns, bullet proof vests and detailed documents showing he planned to attack the churches on sunday. the man in custody is also suspected in the death of 32-year-old, a dancer and mother of a 5-year-old girl. the french woman was shot possibly during a botched carjacking terror experts say it fits the pattern of jihadists telling

followers to wage war at home. >> look, you are in france, you are in britain, in australia, do not come to syria. attack the homeland. attack our enemies within our cities >> reporter: france has been on high alert since january when islamist 34i8 i at that particular times aing taed the french magazine and a jewish store killing 17. the interior minister said this man talked about going to syria and police even checked up on him in 2014 and again at some point this year. police were able to stop this plot because the suspect allegedly called an ambulance sunday after mistakenly shooting himself in the leg. >> lucky about that. kelly, thanks very much. in the meantime, protests are growing larger in baltimore over the death of freddie gray who died after suffering a spinal injury while in police custody. now the u.s. justice department

is opening its own investigation. tom costello is at baltimore police headquarters again this morning. tom, what's the latest? >> reporter: as you know the department o investigation announced yesterday it comes as the baltimore police are conducting their own investigation, the trouble is many, many people here simply don't trust the police to investigate themselves. so, last night they again entered the streets, about 1,000 people marching from the exact spot the intersection where the arrest occurred down to the police station in west baltimore. it was a peaceful protest, a lot of families, parents holding children's hands telling me they don't want this thing to happen to their child. the question they have is how is it possible that freddie gray had his spinal cord nearly severed while in police custody? they want answers, accountability, last night the chief says he understands those concerns >> i think again they are sharing their thoughts, their concerns and i hear them and i understa and if i was a parent and that

was my child i lost i would be concerned and i want to know and our job is also to have balance and not to rush to a conclusion. >> reporter: the police commissioner my apology not the chief t commissioner and the chief both promising a transparent investigation, they should have it wrapped up the end of next week and hand the results over to the attorney t prosecuting attorney to determine whether charges will be filed. six officers now on paid leave, they include a lieutenant and a sergeant and three bicycle officers, some veterans, some rather new officers. the tension remains high. >> tom costello, thank you. sava to boston a day of emotional testimony expected at the penalty phase of the boston marathon bombing trial, this opened about gut wrenching accounts from survivors and families of the victims. we should warn you some troubling, even offensive im pete williams is in boston for us this morning.

good morning to you. >> reporter: prosecutors say the jury should impose the death sentence in part because the bombings were planned in advance to cause a maximum of death, pain and suffering, and they showed a picture of dzhokhar tsarnaev they say reveals a complete lack of remorse. prosecutors said dzhokhar tsarnaev's bombs killed three people on the streets who had time to feel pain but no time to say good-bye. he was determined they said to become america's worst nightmare. the jury was shown a photo of dzhokhar tsarnaev showing an offensive gesture taken in a holding cell at the court house as he awaited a court hearing three months after the bombing. a prosecutor said it showed he was unconcerned, unrepentant, uncaring and untouched by the grief and loss he caused. some jurors wept as victims told stories of suffering caused by the marathon bomb. some of the testimony from bill campbell, whose daughter crystal was one of three people killed

in the bombing. as his wife sobbed in the courtroom, he said he passed out in the hospital when he realized that the woman in surgery was not his daughter. crystal, the doctors told him, was dead. asked what he missed the most he said, i miss my hug every day. she never left the house without giving me a hug. defense lawyers haven't spoken they decided to give their opening statement next week when they begin presenting their case, arguing why dzhokhar tsarnaev should not be put to deat >> thank you. the sentencing phase of this case has a lot of similarity in the trial of zacarias moussaoui, the 9/11 co-conspirator who was tried for the death penalty but received a life in prison. good to see you. good morning. you have certainly been there before, you have an unsympathetic defendant, frankly, a heart wrenching crime, you have these terrible stories from victims and then this picture of the defendant that came out in court where

he's literally giving the middle finger to a security camera. what is the defense's argue snumt >> that certainly isn't helpful when he decided to make that ge you have to embrace everything that's happening as the lawyer and maintain your credibility. if the family story makes you cry, cry and be authentic and get ready to make your final argument to save his life. >> one of the most arguments in the moussaoui case he wanted to be a martyr. you argued he wants to die. that's his plan. don't give him what he wants. could a similar argument work in this c >> absolutely. all of the terrorists like this gentleman all want to die, that's what they really want to do. you can see just from the pictures of him bringing the bombs to the scene, and the way they reacted that everybody in the jury box is going to know he wants to die. so you have to figure out a subtle way to make that message. in moussaoui's case it wasn't >> his choice whether to testify, go before jurors and plead for his life.

if you are his lawyer would you suggest he do so? you think he could help himself? >> i don't think he could. if he testified and he acted like he wanted to live and he was tried to look repentant for what he did it would be -- everybody would see through it and undercut the defense that he wants to die which i think is his best chance that the jury won't give him what he wants. they haven't yet in a terrorism case in america. >> last thing dzhokhar tsarnaev is in supermax prison in colorado, expla in what that life is like because that's the alternative in this case for dzhokhar tsarnaev. >> we had a prison expert who testified, 23 hours a day in solitary confinement, it's a cell that doesn't even have natural light into it. as the judge told moussaoui he would never hear a bird sing again. he has one hour a day in a different solitary cell, it's just awful. >> we may hear more about it. governor to see you. thank you. thank you very much.

now a major shake-up in washington the wake of mounting pressure that the chief of the drug enforcement administration stepping down. over her handling of a sex scandal involving dea agents. nbc's kristen welker at the white house has more on this. >> reporter: good morning. mi michellee leonhart has bee the agency 35 years but resigning amid the cloud of controversy involving some of the very agents she led. she was a rising star in federal law enforcement, but now michele leonhart is stepping down after revelations at least ten dea agents had sex parties in colombia involving prostitutes some hired by drug cartels. >> this is all a national security issue when criminal cartels get that close to agents. >> the attorney general announced her resignation ones to, calling her a trail blazer for being the first woman named special agent in charge, and said she has devoted her life

thursday is aimed at a group of 10 doctors who sent a letter to columbia university where dr. oz is the vice chairman of the surgery department. those physicians claim dr. oz has exhibited an egregious lack of integrity promoting quack treatments and cures in the interest of personal financial gain. the group singles out opposition to gmo os. some treated them to make them more resistant. the letter alleges he possesses a baseless and relentless opposition to the genetic engineering of food crops. dr. oz addressed the topic repeatedly on his program. >> reality is my friend us are probably eating it today. should it be labeled, that's the question we have to answer this year. >> while supporters say gmo could help alleviate world hunger opponents question the safety behind the science. but the letter directly questions dr. oz's ethics and it's not the first time he's come under fire.

the moment where i lost her, what would i have wanted to have done? would i want to force her to be mia that one last day? and i think at that point my mind was made up. >> reporter: last june they showed jacob a video about another transgender little boy. what did you think when you saw that? >> i think being transgender wasn't so bad after all. >> reporter: after watching the video over and over again, they gave their 4-year-old a choice. >> i explained to him we can bring you to a new school and everyone will know you as a boy from the beginning. >> reporter: what did you say to your mom and dad? >> i want to be a boy. >> reporter: he was only 4 when you made the transition. some people will say that's really young. how can you be sure? how could he be sure? >> he'd already spent half of his life telling us that he was a boy. >> reporter: he hasn't had any medical procedures not on

hormones. >> no. >> reporter: way too soon for that. >> way too soon for that. >> the big place for gender is our brain, our heart, and our soul. identity. who we are. which isn't parts. >> reporter: pediatricians like this doctor who specialize in transgender kids are seeing more and more patients at a young age. how does a parent know it's not a phase? >> all kids experiment with gender roles. but gender nonconformity is different. it's persistent consistent, and insistent. >> reporter: what about people who think the parents should be in charge the kids shouldn't dictate. you've heard the is. >> yes, i hear it all the time. parents do need to be in charge. but when a kid is told i don't see you, i don't hear you, i don't love you just the way you are, that's a pretty powerful message. >> reporter: they say when they listen to their son, they realized there was no question

about their gender. >> you look handsome. are you ready for school? >> yeah. >> okay. >> ultimately jacob has made that choice in his mind in his heart. it's whether or not we accept it or not. >> that's right. i want him to know how proud i am of him, how brave i believe he is. and how no matter what i am in his corner. and i love him and i always because he's my son. >> i can only imagine how many pares are watching that. i have three kids. you've got one. that question you ask how do you know if it's a phase? do you embrace a phase like that or do you resist? how do you know? >> these are tough parenting calls. we asked the doctor about that. we asked many doctors about

that. you haertd the doctor say consistent persistent insistent. those are the hallmarks of someone who is really transgender. they're saying it over and over. they want to dress in all of the other gender's clothes. you heard some of the behaviors that jacob had. and his parents would tell you they were confused in the beginning. they thought maybe he was just a tomboy. but after awhile of him saying i'm a boy and my name is jacob, you know they had to talk to experts. and they did. they did a lot of homework. >> i think everybody who watches this is changed by it because you have to question what would you do what would i do what is the right thing to do. people are also curious. what does this mean. at 4 it means you change your name and wearing different clothes. what does it mean at 13 at 18? >> it changes as you get older. right now jacob doesn't have any medical interventions. still has the parts he was born with. but when you start approaching puberty, the questions get much more complicated.

good wednesday morning. i'm sam brock. a developing story in the east bay. a police officer, one of three people being treated for smoke inhalation after an apartment fire in san martinez. so far no word yet on what might have caused the blaze. another early morning fire elsewhere in contra costa county destroyed a house. that one happening in walnut creek at a house off ignacio valley road. this broke out around 4:00 a.m. firefighters do not believe anyone was inside the home at the time and nobody was injured. crews also managed to prevent those flames from spreading to other homes when you stepped outside today, did you feel the humidity? for more let's check in with christina loren. >> pleasanton right now showing

begun a civil rights investigation into the death of freddie gray, the man who suffered a fatal spinal cord injury while in custody of the police in baltimore. on tuesday hundreds of protesters gathered to remember him. one man said they will not rest until they get justice for gray. another demonstration is planned for today. today more testimony in the penalty phase for the convicted boston marathon bomber. on tuesday prosecutors said dzhokhar tsarnaev was determined to become america's worst nightmare and showed a photo of him making an obscene gesture in a holding cell three months after the bombing. the jury will ultimately decide whether he gets the death penalty or life in prison. geologists in oklahoma say recent small earthquakes in that state are very likely triggered by the underground disposal of waste water from oil and gas wells. a new report finds oklahoma is recording about two and a half earthquakes a day of a magnitude of 3 or more. a rate that is 70 times greater

you have battle scenes. you have epic scenes that are gorgeous of your home country of australia. did you ever think, okay have i bitten off more than i can chew here? >> it's one of those funny things. i was staring at it and thinking of all the complications. the fact it was an independent australian film. the language complications in between english and turkish. the fact we're shooting in different countries with war scenes storms. you know, i was just staring at the idea thinking this is impossible. and the next thought was when do we start? >> is that your nature? that's a big challenge, let's do that. >> little bit. i've had opportunities to direct in the past but there hasn't been that thing that virs ralscerally grabbed me. >> now do you have the bug? would you want to do it again? >> it's substantially more interesting being a director than an actor. it's the color, is the texture,

where music and silence is and all of those things. it's the deepest, satisfying thing i've ever done. >> how is it dealing with a late late -- the actor in this movie, russell crowe? >> i think he'll get by. >> i heard you gave tough love to the three gentlemen who play your sons in the movie and you put them through what is described as a boot camp on your farm in australia. why? >> not just the three boys who played the sons but a dozen of the actors. preparation is always the key when you're working on film. and, you know you've got a defined schedule and assets. i chose to use some of what i had to make sure they were going to be in the right pocket. what i'm doing is showing them how i do it. so this is the physical aspect emotional aspect. and it drives

>> juices and stuff or what? >> the whole thing. so their whole day is completely focused on this subject matter and their character. so you might take them on a 50 kilometer bike ride and then work with weapons of the time. and then three bullseyes before you have dinner. and at nighttime bring in university lecturers to talk about the history. if you do that you fill them full of stuff. all you ask them to do is to be consistent leading into the day when they're on the set. what you get from the actors then is complete preparation and a depth behind their eyes that goes back a mile. i'm trying to take boys from 2015 back a hundred years. >> they really internalized the role at that point. can i ask something off topic? >> yes. >> did michael jackson really call and prank you in hotel

rooms? i read that and thought it was bizarre. >> if you know michael, that's a real thing. it's something he liked to do. i never met him and shook his hand or anything. he would call me every now and then and put on funny voices. as soon as you'd get worried, he's go don't worry it's only michael. >> i tell you. that was quite the story. when i read it i had to ask you. congratulations on the movie. it's really an accomplishment and i'm sure we'll see more directing from you in the future. thank you. and by the way, russell is coming back with kathie lee and hoda a bit later on. buckle down for that one. it is earth day and hdtv's property brothers want to help you get a little greener. drew and jonathan scott are here with some great back yard upcycling ideas. guys with b good morning. >> good morning. >> upcycling is what? >> it's about taking items that are going to be tossed away and finding a new purpose for them. we do it all the time in design and our shows. but earth day is a perfect example. in the yard if you're looking for things to do don't buy an expensive set to do something. this is a prime example of what we've got here. this is made out of an old tire someone was going to discharge. >> go to a tire store or find this sitting somewhere. >> or steal it off someone's truck. >> no don't do that. >> but i used to work at a tire store, they'd just throw them away. >> you can get them clean them up. paint them with an exterior paint. and they make a good tub. >> and also they don't want this gigantic sandbox. this is portable.

throw some sand in here. obviously with this tire you need tiny children to fit in it. >> they can sit on the edge. >> exactly. and you actually just -- this is a pool noodle. >> it's not a litter box. >> but you use a pool noodle along the edge because it can be rough here. once it's cleaned up paint it up. the kids get involved in creating this. >> and if you live in a party of the country where it rains a lot, make a lid for it and cover it up. >> exactly. >> this is just plywood but you can treat it. >> this is a few hour project and it costs you just the price of the sand probably. all right. let's move on. this is one i hadn't thought of. this is a picnic table made out of old skateboards. >> everyone has four to six skateboards lying around the house. or if you're like my dad, he would hate when the kids would

skateboard on his lawn. steal those. >> you're talking about stealing twice so far. >> we're terrible people. if you go to craigslist or something like that you can find old ones. >> how much would you pay for that? >> if they're old and used people can give them away. you'll be amazed what you can get online for free. >> did you buy or build this frame? >> built that. that's something that will take maybe half an hour to an hour. the skateboards, everyone knows them for having cool designs. you can blend the different patterns and colors. we have a new contractor on our hands here. can i replace jonathan with you on the show? >> and this is about trying to find interesting ways. kids love the designs on a skateboard. this is meant for kids maybe under 5 years old. skateboards are meant for a lot of weight. that's a reason this is a cool idea. it can even take my weight. i'm not going to make you sit

here you might rip your pants. >> thank you very much. now we're going to recycle and upcycle an old shipping palette. >> yes. this another idea. you put it underneath. you get some potting soil to put in here so you can have vegetables. all you do is wrap the entire bottom with the landscape material. get it in place. nail it down. then you can actually clad the exterior of the box. nail it on. it's actually gorgeous. and you can put vegetables whatever you want. >> and this is something small for a patio. or you can cut it down and have wheels on the bottom if you want to move it around. >> that will hold the soil in place. >> exactly. >> you guys should do this for a living. you're good at this. all right, guys. thank you very much. if you want more from the property brothers they're here

patients. so this all started when an operating room assistant decided to wear a tutu over his scrubs for a child who was nervous, a little scared while heading into surgery. and quickly, of course, cheered the child up and put him as ease. but now the staff and all the departments including nutmeg their therapy dog there is wearing the tutu. you see by the bright smiles on the kids' faces and the staff too. i mean, that puts a smile on the staff's face too. that's great. i think more hospitals should think about something like that. >> well, a lot of them have great programs. the children's hospital in chicago they make it a point of making that environment as warm and as comfortable as possible. down to like the most awesome video games they provide for families. >> well, our favorite brothers, twin brothers, are here. the property brothers joining us this morning. they're showing us how to use items around the house so you can create family sized games

done all of their lectures in some of their physical prep and all that. they're standing there all dressed up and shaved, ready to go they're going to go out and meet the young ladies around, whatever. so i take them on a walk back through the building that they've been through, but the opposite opposite way they normally arrived. by the time they get to the end of the building there's a door there which they would have passed 50 times through the course of the week. >> yeah. >> but now it's open and there's a bar and there's bar maids and music. they're like this has been here all week? >> hiding from them. >> this is such an emotional movie. you need the kleenexs for this. there are scenes with you and your sons and this must have been -- i mean having children yourself. >> handsome. >> sons, must have changed just how you act in this movie i would imagine? >> not really but it definitely connected me. there's a cultural connection to parts of this story because i'm a new zealand born australian and the battle is often seen as

the moment wheres those young nations were forged. they had been to wars before but as an extension of the british empire. this is the first time they're fighting and it's a volunteer force. it's not like regular army or -- the britain called for volunteers to help defend itself and friends in europe and hundreds of thousands of young australians put up their hands. that's an important thing. the fact that it's a story about a man with three sons who go to war and don't come back and his grief as a father of two, as you said, that's going to hit me at a very essential level. there was also another opportunity that i could see in the script to reshape the way people perceived this. because quite often in war films and also in our remembrance of the sacrifice -- >> we pick a side, don't we? >> we pick a side and we actually -- it's not that we color the other side necessarily we just put them in such darkness. >> right. >> we don't know them. we dehumanize them. and, you know -- >> does the opposite of that.
