commissioner for not responding more quickly and letting this get so out of hand? do you feel their hands were tied? >> well, i really don't know what was happening at city hall or the police department. i do know that baltimoreans moved fervently to go on the front lines. what's not reported on the news is the bloods and krips came together and signed a peace treaty to stop fighting. the christian church and the nation of islam came together and began moving towards the streets to in fact, strike a peaceful cord and get ready to start the rebuilding process now. >> i read there was an agreement or at least a rumor among rival gangs to get together and go after police. did you hear anything about that? >> we did. all of that came out strangely and eerily while in the funeral. so this anonymous flyer that went on the purge yesterday but last night up into the wee hours

they've taken the police department that's out of control the wrong way. what you have to look at is not freddie gray in isolation but what the young people seen over the last 36 months. trayvon martin, george zimmerman walked free. tamia rice in cleveland, ohio. no indictment. you see what happened in staten island with eric garner, live on television, and no police officer held accountable. so these young people don't have much confidence in the legal system and so today, we're trying to put them back on course to let them know that violence and justice never go together in the same sentence. >> i know you've been out all night doing your part on the streets of the city you care so much about. thank you for your time this morning. i appreciate it. >> thank you for your interest. and we are covering another major story. the crisis unfolding in nepal in the wake of saturday's powerful earthquake. remarkably, a survivor was

pulled from the rubble overnight even as the death toll soars about 5,000 people. mig miguel is live. >> reporter: arrived on scene as the death toll skyrockets to some 5,000 now and also word 250 may be missing. more and more bodies found every day. this is the race against time. brick by brick, the desperate to find survivors. this morning, our cameras capturing the moment search teams find another victim. the lifeless body rushed to a nearby hospital. hope here is fading. today, we launched our drone for a look at the damage. this section of kathmandu in ruins and what's still standing is teetering on the brink of collapse. this is what rescue teams are sifting through now.

the marriage issue nationwide. the court answers two issues, can states refuse to issue licenses to same-sex couples and decline to recognize same-sex marriages legally granted somewhere else? how did we get here? 36 states now allow marriage for same-sex couples but 14 other states ban it including michigan where two nurses, april each adopted two children, some with special needs. they want to be married to be parents to all the children in case something should happen to either of them. >> that's what scared us the most. the possibility they could be ripped apart and not see each other again. >> reporter: states with gay marriage bans say only voters should decide such a fundamental issue but cannot write to be free from skrimgsdiscrimination. anthony kennedy likely to be the deciding vote. there's no live broadcasting from the supreme court but later

today, the audio recording of the argument will be released. the decision probably won't come until late june, natalie? >> i know you'll be listening in for us. pete williams outside of the supreme court house. thank you. jurors back for day two of the james holmes trial, accused of killing 12 people and wounding 70 inside a colorado movie theater. his opening statement, the lead prosecutor describes him as a sinister but sane killer. defense attorney said holmes suffers from schizophrenia and mental illness, runs through his family. a tragic accident, a nurse on a medical helicopter fell to her death. 46-year-old christie mclain part of a team conducting a rescue in the austin area. as the victim lifted to safety, mclain then fell from the helicopter. the ntsb now investigating. now to the frightening close call we showed you earlier on in the show.

missing school children about to board a bus in washington state. you can see the bus driver open the door, three kids start walking by toward it and then the suv speeds right past the bus on the right, missing the kids by just a few inches. the suv driver passed several other vehicles before then got behind the bus and then sped off. the police now searching for the driver of the suv, offering a $1,000 reward for any information leading to arrest. hopefully they can slow it down and piece who that is behind the wheel. >> so frightening. that's why the school buses have the stop sign, the arm that comes out. you have to stop. the right side of the bus, i can't imagine. >> shows you, a lot of people just ignore it. >> they ignore the stop sign, they keep going. >> nothing's worth a minute a life you might save. let's show you what's going on. hearts and prayers with

twitter, all of the social media platforms. the rioting sparked powerful response online. 2 million tweets about the city in the last 24 hours and many pleading for peace. one post has a lot of attention from david simon. he's a former reporter for the baltimore sun and the creator of hit hbo show set in baltimore, the wire. he took to social media and wrote this. there was real power and potential in the peaceful protests that spoke in mr. gray's name initially but this now in the streets is an affront to the man's memory. if you can't seek redress and demand reform without a brick in your hand, you risk losing this moment for all of us in baltimore. turn around, go home. please, and facebook started encouraging people of baltimore to come together and clean up the city this morning. this is the picture we got showing citizens already doing their part, pitching in and cleaning up the streets they call home, guys. >> all right.

i'm sam brock. >> despite a fiery crash all lanes of interstate 880 are once again running smoothly this morning. that crash in san leandro involved seven cars and forced the chp to shut down northbound lanes near san leandro a little bit after 3:00 a.m. crews had it cleared in time for the brunt of the morning commute, however. one driver suffered critical injuries in that crash. a bay area man is talking about surviving the deadly quake in nepal. dave gordon is from san francisco. helicopter team rescued him today from a popular hiking area 40 miles north of kathmandu. he says the cliffs crumbled around hip and he was watching as people died.

back now, 7:30 on tuesday morning. 28th of april. some of the devastating images out of baltimore this morning as people are picking up the pieces are rioting that happened overnight and making headlines this morning. the national guard is now on the scene as well. protesters took to the streets, calling the funeral of freddie gray who died in custody. some attacking police, burning buildings and looting stores. a state of emergency in effect and a daily citywide curfew starts at 10:00 tonight. officials in nepal are raising the death toll from saturday's massive earthquake to more than 5,000 people. but the country's prime minister is warning it could eventually

building, the courthouse building i should say here and down the street. that gives yo uu a sense of what we're dealing with. to say it was a difficult night would be a tremendous understatement. we had a volatile situation in baltimore last night with about, they say, 2 dozen arrests or more. that's surprisingly low, i would say, given the violence we saw with buildings looted and burned to the ground with police officers in pitch battles with street thugs, i would say, i would call them, in which they were throwing rocks and bottles at the officers. 1500 officers injured here, some in the hospital. we also have a complete chaos, this is largely in west baltimore with the police losing control of the situation and these running street battles. today, we've got hundreds and we may now be talking about thousands of police officers. coming into baltimore from all of maryland in addition to pennsylvania and the national guard. coming in to baltimore for the

this morning governor larry hogan gave this update on the situation going forward. >> this violence is not going to be tolerated. we are going to bring in all the assets and all the support we need to make sure the citizens of baltimore city are safe and that we bring peace back to the city. >> reporter: at least a dozen police officers were injured. several are still in the hospital. there were at least several dozen people who were arrested as well. today there will be -- schools will be closed. there will be a lot of young people out and about. and some trace the origins of these confrontations back to some high school students meeting police at a shopping mall after school yesterday. tonight there will be a curfew imposed from 10:00 p.m. to 5:00 a.m. in the morning to try to keep the streets calm. again, a lot of concern and worry about going forward here in baltimore today.

so the american of pediatrics position on this is head lice is not as contagious as we think it is. it's not just casual contact at school if you bump into a friend that it's easily transmissable. i get letters from the school all the time. you can't bring kids back if they have lice or eggs in the hair. this is something that could be practice changing. >> you never know how kids interact in school, whether they're wrestling or playing. i mean, how do kids get it then. what kind of close contact do you have to have to get it? >> i should say that most of the transmission occurs outside of the school. they make a strong point to say it's usually the household contact or in the community. we recommend not sharing hats, not sharing combs sharing brushes, headphones things like that. because lice don't jump. they actually crawl. so you can imagine that you have to be wrestling on the floor, so it is not that it can't happen in school but it is less likely to than i think most of us

but i think that's being human. >> reporter: and maria writes about the human side of her family claiming her father was abusive when she was a child. when somebody is public in a family the rest of the family isn't. did you ask their permission? >> everyone said from e begig write whatever you want. my family is just sort of like that. and i was so nervous about my dad reading the book. because there's a lot of painful things about him and abuse during our childhood and his mental illness and how he grew up. and when he read the book, he was the firstn that actually read the book. and i said dad, did you like it? he said i thought the part about me was right on. the only stuff i didn't like was all the sex stuff, that wasn't okay. >> reporter: today the two have worked through the past. so are you hoping that this book will make inroads into being a less judgmental society about sexuality, politics religion

all of these things that seem to really divide us? >> yes. i think that the whole idea is to get rid of the labels that make us feel judged or ashamed. it's like it's time to live louder. >> i think it's courageous when people write a memoir tell their story and open themselves up. absolutely. up next

the side -- >> i wonder if when they slow it down they can digitally enhance it. >> and look at other security cameras in the area. in fact jeff rossen is here on a different story. >> he is here. >> jeff, before we talk about the smartphone thing, talk about this school bus issue. you did a terrific report. >> yeah. >> a report on that. >> we did a "rossen reports" on this. and there are so many drivers caught on tape now that are flying by these school buses, and actually, there is new technology that a lot of districts are using. it's sort of like a red light camera, but for school buses. you know when the stop signs come out and the red lights go on? it starts recording and gets the license plate of the cars which would help. as a parent it's shocking -- >> you went out with the police with actual patrols to do this. >> we found within a couple hours all these cars speeding by buses. >> one woman had her kid in the car taking them to school. >> yes. it's absolutely crazy. they speed by because they're so busy on their texting or they think they're late for work and they almost hit kids. >> and it's not just school buses, but ice cream trucks that

have the stop signs. you have to pay attention to them as well. >> anywhere kids are. >> and construction trucks and construction zones. i mean, so many times you hear about fatalities of workers. >> and the thing with the cameras on school buses is you know kids are crossing the street, you know? they're not staying on the sidewalk. >> same thing with the ice cream trucks. they're running to the trucks. >> you did an amazing piece that i think a lot of people stood up and took notice. we want to talk about this about the tracking device on your phone that a lot of people don't know about. >> yes, smartphone snooping. if you have an iphone or an android device. you have an iphone. i know you do. all of you guys have iphones. i have an iphone too. basically, it is on androids or iphones. it is tracking your every move location to location down to the minute. it tells you the minute you were there. it's a deeply buried hidden setting that you can shut off. do you want me to show you how to do it? >> before you do that why are they tracking that? >> why is it st there? >> apple says they use it for potentialized services.

so, every once in a while, they'll say tamron we've determined it will take you 25 minutes to get home from work tonight. how do they know where your home is? because they recognize that you spend from 8:00 p.m. to 5:00 a.m. at this one location every night, so we know that's your home. and we know where you spend most of your days. it's pretty creepy. >> but what are they doing with it? >> they say they have personalized services. >> but the difference between the ios and android, android, you say that if you can hack into somebody's google account -- >> yes. so apple says that it stays on your phone, all that information is stored on your device only and not sent to apple, unless you consent. but experts say you likely consent when you hit "agree" on all those forms. >> you agree to everything. >> who reads that? i don't. you sit agree and so your stuff may be getting sent to apple. they say it's for personalized services. >> but google. >> so, google when you're on an android device -- samsung, lg any of those -- it goes to google and google takes it and you can actually -- if somebody hacks into your gmail account,

taking a look at the headlines, national guard troops are fanned out through baltimore this morning following violence that broke out after monday's funeral of freddie gray. the black man who died after being arrested by police earlier this month. at least 15 officers were hurt and at least two dozen people were arrested during a night of riots and fires. a 10:00 p.m. curfew goes into effect tonight. for the first time in more than 50 years the government is lowering the recommended amount of fluoride added to drinking water. health officials say some people are getting too much of the cavity fighter because it's also found in mouthwash, toothpaste, and other products and over-exposure can cause faint white marks on the teeth. and there's also evidence that
