it's friday, may 1st. coming up on "early today," as a baltimore curfew in force for a third night, hundreds rally in philadelphia and things get tense. meanwhile major developments in the death of freddie gray while the second prisoner in the van with him speaks out. first round picks as the nfl draft gets under way. pope franc says even pontiffs can make mistakes. and why this sea lion pup was found wandering the streets of san francisco. "early today" starts right now. good morning everybody. more answers and many more questions. three major developments this morning in the death of freddie gray. a mysterious revelation about the van that was carrying him, a new report about what actually happened inside that van and finally the most important witness in the case so far

emerges. we start with this morning, nbc's jay gray. >> reporter: anger and emotion boiling over again in baltimore. to this point there's been no answer to their question and very little information. >> we have exhausted every lead at this point in time. >> reporter: as the task force investigating freddie gray's death turned over findings to state prosecutors, police acknowledge the van transported gray the day he was severely injured, made four stops on the way to the police substation, not three as they originally indicated. >> this new stop was discovered from a privately owned camera. >> reporter: a report in "the washington post" citing a sealed police document says a prisoner briefly in the van can gray heard him banging against the walls and he was intentionally trying to injure himself. donte allen was the man on the other side of the van wall. he said he never saw gray and

all he heard was. >> boom, boom, this little banging. he also denies ever trying to say gray was trying to heard himself. instead he implicates police. >> when i got to the police station, i heard them saying, well, i gave him a run for his money, basically saying they did something to him, man. >> reporter: as a curfew began for a third straight night, protesting clearing the streets but promising they won't go anywhere until all of their questions are answered. jay gray, nbc news, baltimore. >> those protests, they are spreading. in philadelphia yesterday police clashed with people marching in the streets. there were two arrests there. as we mentioned, while all that was happening, a major new report emerged back in maryland, local washington, d.c. station wjla citing anonymous law enforcement sources saying there is no evidence freddie gray's fatal injuries were caused during the videotaped arrest,

saying, quote, the medical examiner found gray's catastrophic injury was caused when he slammed into the back of the police transport van apparently breaking his neck. a head injury he sustained matches a bolt in the back of the van. as we mentioned earlier, the other man in the police vehicle with freddie gray is denying a "washington post" report that he told police gray was gray was intentionally trying to hurt himself. we want to show you what more of what he had to say with wbla's investigative reporter jayne miller. >> when i got in the van, it was nothing, a smooth ride. all i heard was a little banging for four seconds. i just heard little banging, just little, boom, boom, just little banging. >> reporter: did you tell the police you heard him banging his head against the van? >> i told homicide that. i don't work with police. i didn't tell the police nothing. when we got to the police station, he had no pulse or nothing. they calling his name, mr. gray, mr. gray.

he wasn't responsive. >> last night msnbc's chris hayes spoke with wbal's jayne miller in light of a revelation that a previously unreported stop by the van was made. all of that is leading to another big question. >> reporter: the question i would have of the van driver at that stop is why did you make that stop? did you make that stop because you heard something in the back of the van that maybe indicated something had gone wrong. the next thing he does is drive a little further and stop again and call for other officers to come and, quote, check on his prisoner. the police commanders have said at that point there should have been a call for a medic and there wasn't. i think that new stop we're talking about, if i were asking the right questions, and i am in this case, my question would be does that indicate that at that point that van driver knew something was wrong?

we are also hearing more dramatic testimony in the movie theater massacre trial out of colorado. in court yesterday some of the first officers on the scene describe the horrors they encountered. one officer was so shaken, she broke down on the stand. we also heard about the chilling moment police first spotted the gunman, james holmes, who has pleaded not guilty by reason of insanity. nbc's jacob rascon has the details. >> reporter: responding officers were ready for a gun battle. >> somebody is still shooting inside theater number nine. >> reporter: what they found was much worse. >> it was horrendous. it was a nightmare. >> reporter: patrol cars became ambulances for the most critically wounded. >> and i really thought she just died there in front of me. >> i physically helped at least ten probably. >> reporter: behind the theater officer jason oviatt saw what he thought was a s.w.a.t. officer

in full body armour and a gas mask. >> as i got closer to the car, i noticed everybody was urgently doing something. this person was just very relaxed standing by the car not really doing anything at all. >> reporter: it was james holmes who didn't resist and when asked if there were other shooters said, it's just me. >> did he cooperate with you? >> yes. >> did he answer questions that were asked? >> yes. >> did he seem confused about anything? >> not at all. he looked like he was sort of taking it all in. >> that was nbc's jacob rascon reporting. trial resumes on monday. a key figure in the 2013 new jersey bridge gate scandal could plead guilty to federal charges as early as today. david wildstein is a former top official at the port authority of new york and new jersey. he's also a former ally of new jersey governor chris christie. according to bloomberg he'll plead guilty to unspecified criminal charges. e-mails show wildstein ordered lane closures to, quote, create

traffic problems in ft. lee, new jersey. governor chris christie has denied he had anything to do with the closures and has not been implicated. ft. lee's mayor claims it was done as retribution because he did not endorse christie's re-election bid. nbc news learned that the barack obama presidential library will be built in chicago. columbia university in new york and honolulu offered bids for it. the library is expected to be connected to the university of chicago. the final site has yet to be decided. the 80th annual nfl draft took place in the windy city. the buccaneers chose florida state quarterback jameis winston. in 2013 he became the youngest player to win the heisman trophy, helped his team win the bcs national championship. winston celebrated the draft with his family in alabama. he could not resist poking a little fun at his past. he posted this image on instagram with a nice serving of crab legs with the caption, thanks, captain, for the legs.

likely a reference to when winston was cited for shoplifting crab legs from a supermarket last year. marcus mariota, the 2014 heisman trophy winner, was drafted second by the tennessee titans. he was first oregon player and hawaiian-born athlete to win the heisman trophy. the happiest man seemed to be cleveland brown's first pick, danny shelton from washington, the 12th overall pick in the nfl draft. he could not help himself. he had to give commissioner goodell a great big bear hug. so here we are this morning. a little bit of rain in mid-atlantic and this is as

the admission came after a schedule mixup. he thought a meeting with 7,000 members of a catholic group was friday instead of yesterday. the group is in rome celebrating their 50th anniversary. his holiness told the crowd, quote, even the pope has his faults. look at this, guys. he is in a park. >> in l.a. it was a she, not a he leading police on a wild chase. the 15-year-old tearing up grass and hitting sign posts. the chase then hit the streets but didn't last long. the teen crashed. she was quickly handcuffed and in san francisco, a wild sight. a sea lion pup wandering the streets. what's going on here? the pup, nicknamed rubbish, is a repeat offender. this is his second rescue. he's among 1,800 stranded pups along the coast thanks to a warming ocean and limited food supply. time now to get down to business. >> the s and p 500 drops
