descend on an earlier flight that very morning. kris sanchez joins us this morning. this seems to get more shocking. >> reporter: just when we thought it couldn't. one analyst says the changes in altitude made it seem like he was not only practicing the maneuver but trying to steal his resolve to pull it off. passengers on that out bound flight from germany are only finding out today that they were his test subjects. investigators say practiced the deadly descent not on a simulator but on that same day and on that same flight as it was out bound from germany. that was hours before he loktd the pilot out of the cockpit and crashed the plane into the french alps on the return trip to germany. let's show you the graph that the french aviation safety investigators released this morning. the solid line shows lubitz manually changing the altitude settings to crash hadding civil times in five-minutes time. the broken line is the actual descent of the plane. in is part of what the french civil aviation safety authority

revealed this morning. now, investigators added that lubitz went into a controlled minute long descent for which there was no aeronautical reason. the setting he manually input was 100 feet which is crash landing altitude. he did it while he was alone in the cockpit for about five minutes. now, on the deadly flight hours later air traffic controllers, the military defense personnel tried to contact the plane 14 times as it was descending because that time in addition to changing the altitude lubitz also increased the speed of the flight and changed the flight path 93 seconds before the crash. the black box reveals that he did not do the same on that outbound flight as he practiced that deadly descent. that time he only changed the at tutd and then quickly changed it back which may be why it didn't arouse suspicion. you can't help thinking about the folks on that germany to spain flight though who must be counting their blessings this morning. though they were sitting quietly likely reading a book or a magazine unknowing that he was practicing a deadly maneuver.

sam? >> maybe ignorance is bliss on that one as it's certainly going to give them pause for thought. thank you, kris. new this morning, more concerns over the new eastern span of the bay bridge. saltwater might be seeping into the foundation. according to the con call new caltrans test indicate water from the bay might be seeping into the new tower. if that's true it would jeopardize the integrity of hundreds of steel rods anchoring the structure. caltrans determined the same rods were sitting in rainwater for years from a bad ceiling job. saltwater damage could potentially make that situation far worse. 6:06. happening today, the race for the white house runs through the bay area. democratic presidential candidate hillary clinton is stopping by hoping to cash in. "today in the bay's" stephanie chuang joins us live from san francisco where clinton will attend two fund-raisers today. good morning, steph. >> that's right. good morning. it's not surprising the bay area of course popular stop for both republicans and democrats. now, hillary clinton's first

sperm whale was found last month. experts called the two dead whales so close together just a coincidence. >> a sad one at that. 6:09. it is time to cheer up, check that microclimate forecast. can you make it out of cloud cover hovering? >> interesting because we saw pretty clear shots earlier in our newscast. there you can see the cloud out there right now. what does the rest of the day have in store for us? >> good morning. the only place you're really going to find that cloud cover, san bruno mountain, right at the immediate coast and through the high elevation across the bay area. temperatures look fantastic for today. 50 degrees in san martin. 52 degrees in livermore. on our way to a comfortable afternoon. let me take you through your day park forecast. 62 at lunchtime in san francisco. that is a comfortable day shaping up for you. 63. as you break for lunch on the peninsula, if you're going to be having lunch outdoor, east bay, north bay, tri-valley lovely out there. mid 60s to low 70s roundsing out the day. 4:00, this is the warmest point

of the day. 69 for the peninsula today. 70 degrees on the east shore. basically a repeat performance of what we had out there yesterday. maybe just a smidge warmer in some bay area cities. not expecting it to be noticeable, though. this is what you might notice. higher pollen levels. this is courtesy of some wind that's going the intensify as we head throughout the day today. keep that in mind. you want to have that allergy medicine ready to go for you and the kids if you suffer from spring allergies here in the bay area. great news, showers on the way for tomorrow. that is going to drop those pollen levels really looking good. exponentially dropping in some parts of the bay area. as low pressure moves through brings us some showers. i stop that clock for you. at 4:00 p.m. tomorrow looking good for wide spread activity. across the bay area expecting a little bit of shower activity. we have a lovely mother's day weekend coming your way. remember your seven-day forecast scrolling here at the bottom of your screen. we're going to break this down for you in my next report and tell you what you and mom can expect this year.

no problems. we'll give you the live look in san jose with an easy drive right now. just going to see that secondary build, first real build of the commute kicking in 20 minutes. san mateo bridge as we take a live look here. crews have just about completely cleared from the eastbound direction. they will close this bridge because of maintenance starting friday night. full closure at 10:00 going through the weekend. we'll remind folks well in advance repeatedly through weekend. keep that in mind. just avoid the san mateo bridge for the weekend. today it's fine. >> okay. that is good news. >> friendly reminder. thank you very much. so many people we see that hit the roads but a lot of people take b.a.r.t. and no b.a.r.t. rider wants to experience another one again. today state lawmakers will hear a bill to keep b.a.r.t. riders on the job. >> 400,000 riders a day. bob, this has grabbed the attention of thousands of commuters asking for a long time to get this guarantee of no strikes. >> it's a guarantee if the

workers have a no strike clause. this is assembs a sem bill 528 would ban workers from striking again if they have a no strike clause. in other words, what this bill is going to be doing is enforcing something that the workers have already agreed to. this is being presented by assembly woman catherine baker of san ramon. she's trying to prevent what happened in 2013 when b.a.r.t. unions went on strike twice even though some, if not all the workers, did have a no strike clause in their contracts. those strikes inconvenienced thousands of commuters and according to thes s isthes a s woman, cost the economy $73 million a day. >> i think it's disruptive to our bay area. the cost is just phenomenal for the small number of people it would benefit from wages. i think they're paid pretty well already. >> reporter: that was one b.a.r.t. commuter we spoke with who was in favor of assembly bill 528. executive director to for one of the unions did tell the bay city

news service a couple months ago that this bill would be very damaging and would open up old wounds as management and the workers try to build better relationships. it should be noted this bill does not call for an out right ban on strikes. that bill was killed in committee earlier this year. this morning's bill ab 528 would allow workers to strike, again, as long as they do not have that no strike clause in their contracts. recording live from outside fremont, bob ridell, "today in the bay." >> b.a.r.t. riders would like that. thanks, bob. transportation issues aside, a lot of people envious of silicon valley. can europe create its own silicon valley? scott mcgrew, if you're going to beat an opponent, the first thing you need to do is act like a team. >> team work. europe is getting better at. it does have the european union. instead of german firms competing with french firms, et cetera, they're going to try to team up more. the first details of that effort from europe will come today. it is possible we will see tough new restrictions on silicon

valley internet companies but what we really expect are more broad guidelines and frameworks to help europe become more of an internet power house or even just a house. there's not a whole lot going on in europe in the internet compared to just santa clara county. so let's stay overseas and talk about the french. you rule the "charlie hebdo" shootings. the french parliament approved draconian new surveillance rules written just days after the attacks which would let the government monitor its own citizens and anyone else in france. new programs that are far more powerful than anything we have in america. more powerful than our own patriot act. back here in the america, important court case coming out of the deep south this morning involving a man accused in a series of robberies. police were able to tie him to those robberies by obtaining the cellphone records from metro pcs which showed he was in the area of every single robbery but they did so without a warrant.

11th circuit court said defendants should not expect the records of a cellphone company to be private because it's not their property. it's a major development in the battle over privacy and technology. though it doesn't have any affect here in the california because, guy, we're not covered be i the 11th circuit. what it does do is set up a potential conflict between the appellate courts. that means it could go to the supreme court likely something we will continue to track. >> maybe no expectations of privacy, scott, but reasonable cause of course has to be part of that discussion. >> there has to be some cause but they don't need a war rabbirabbint, at least in the 11th circuit, in the deep south, georgia, florida. 6:17. while we knew it was coming here it is. every home and business in the fwa area will be affected by new mandatory water restrictions. the state water resources control board approved the new cutbacks last night. depending on where you live you will have to cut back anywhere from 8 to 36%. the idea is to reward

communities already conserving water while punishing high water users. cities and water districts that do not meet their cutback rates could be fined up to $10,000 a day. the rules take effect june 1st. all right. we're trying to work our way to 20%, 25% conservation. that's a statewide effort right now. also a local effort to check out just the beauty we have here every single day. live look outside from san jose. that sun rise picturesque per usual. we have mother's day coming up. a lot of people might be out and about. hopefully you've taken care of it but if you haven't you should have another day to get out. >> have you? that's the big question. i'm going to do it online actually. i'm not worried about the weather. a lot of people will be going shopping. >> thank goodness for amazon prime. that's all i've got to say about that. 6:18. take you outdoors and show you what you can expect. for you and mom this year, maybe mom is coming to town. it's going to be just perfect out there. for outdoor activities.

we stop the clock for you as we head throughout thursday. 3:00 p.m. to 9:00 p.m. drizzle expected. a few light showers. areas on the east bay side of the bay area. especially the high elevations. also expecting some light activity up and down the peninsula and into the north bay between 5:00 p.m. and 11:00 p.m. tomorrow. then high pressure builds back in just in time for mother's day weekend. nice comfortable conditions as a result. we will see that nice cool breeze coming off the pacific ocean. and warm temperatures inland but not that bad. on sunday, in san jose, 73 degrees. 62 degrees in san francisco. looking good out there in the east bay as well. your valleys, mid 70s all weekend long. and up in wine country it will be a little bit in the warm side but bearable. 76 degrees this weekend there. both days, 76 in the tri-valley saturday. 77 degrees on sunday. so not a lot of major mike coclimate separation that usually takes place in the summertime. we will talk more about your thunderstorm chance coming up.

right now, your drive with mike inouye. >> tri-valley. the biggest volume of traffic is coming through west 580 to south 680. general push from everybody outside of the greater bay area coming here in toward the tri-valley. this is a standard pattern here. we will look at the new crash, the one i told you about north 680 through san ramon. around crook canyon road. vehicle stuck in the middle of the roadway. now it sounds like chp thought they could get it cleared quickly be we do see that slowing developing toward san ram ramon. reported to the scene but north you're okay in toward that walnut creek interchange. earlier crash over highway 4, it's on the shoulder. you have your typical build antioch and concord. another fender bender on through richmond. may be spectator slowing now. and toward the racetrack. the bay bridge toll plaza you have the most backup there on that portion of the bay. look at this spot. san rafael, at speed for the sensors. live look will show you things

new this morning. a heartless act in southern california. someone poisoned a pool full of rescued sea lyons and now police are trying to track them down. it happened at the pacific marine mammal center in laguna beach. investigators say last week someone intentionally dumped large amounts of chlorine in the pool. it had one day before the animals were set to be released back into the ocean. most of the 17 sea lions suffered chemical burns. they are expected to recover. >> nice to hear that. can you put a price on pride? manny pacquiao's injured shoulder we're now learning about is inflaming some fans. so much so they're suing. >> pacquiao and his handlers never talked about the torn

employees to honor no strike clauses even when their contract expires. hey, look who is in town. hillary clinton visiting the bay area today. she's going to attend two fund-raisers in san francisco. clinton is expected to spend some of her time talking about immigration reform. amazon's new drone delivery business is getting a second chance to take flight. today the faa is expected to announce changes to its strict rule of only allowing drones to fly within sight of the pilots. "today in the bay's" tracie potts is live in washington, d.c. this morning with the latest. good morning, tracie. >> good morning. what happens when that drone gets out of sight of the pilot? we know sometimes it crashes on the white house lawn but in most cases, businesses think they can do that safely and that's why they've been pushing the faa to take a look at it. two big announcements coming out of the drone conference happening in atlanta today. we expect that the faa will say they at least now want to study that. amazon is there. google is there. almost 600 other companies very

interested in the faa beginning to relax these rules or create a move so drones can operate safely and legally in this country. the proposed rules that are under way are separate from the announcement we will get today. they got over 4500,000 of public comments on that and the faa tells us those rules may be in place as early as this fall. >> all right, tracie potts live from washington, d.c. thank you very much. taking a live look outside this morning. overlooking san bruno mountain. christina was telling us earlier the higher elevations and by the coastline is where you're going the see some of the overhead clouds. >> we call it a microclimate forecast for a reason. there is, in fact, proof. good morning. >> good morning. yes, it definitely becomes evident over the summertime months. but right now actually looking uniform in terms of our temperature. you guys are right on point. that's where you will find the cloud cover, the coast, the higher elevations. although it is a shallow marine layer which means it will burn off by about 9:00, 10:00 a.m.

52 degrees. good morning, livermore. 51 degrees in san francisco. it is a little bit chilly up there in the north bay. 40 degrees. 49 for san jose. as we start out your wednesday. cool start making way to a very comfortable afternoon with temperatures that are enviable, especially if you live on the east coast. still chilly for them. we're talking about mid 60s as you break for lunch today. 63 degrees on the peninsula at noon. 63 degrees for the east shore and 70 degrees in the north bay at lunchtime. rounding out the day like this. 69 for the peninsula. highs come in, warmest point of the day is at 4:00 p.m. you will be at 75 in the tri-valley. 66 in san francisco. and 77 degrees in wine country with changes on the way as of tomorrow. expecting some showers. look at your future cast. wide spread activity anticipated. as with head throughout the second half of the day, tomorrow and into tomorrow evening. this is good news because it's doing to help us out with your pollen levels as we also though are expecting some

thunderstorms. we have dry air mass to the north and dry air in the south. the two collide. instability as a result. thunderstorms over the local mountains. best chance is on thursday but starting tonight all the way through friday expecting a few rumbles of thunder across the bay area. and, yeah, unfor hate lnately w had that thunder roaring last night at roar-acle arena but you've got to win some, you've got to lose some. are we winning in the traffic area? >> we don't have to lose some. but we did. over here, the bay bridge toll plaza. we are winning. look at that. bottom of the screen, despite the fact the lighting is made inconvenient. the left approach is lighter as it was yesterday. that's good for some of the folks approaching. look at your map and we don't see anything dramatic. that's winning as well. just off of 580. do have that spin there i told

you about reported. sounds like everything is off to the right shoulder. no extent waiting circumstances nothing on the roadway from what i can understand. we'll track that. meanwhile look at the wider shot. upper east shore freeway slows a bit from highway 4 and herk condoleezza and town toward richmond. the earlier crash there is now over on the shoulder as well. highway 4 shows the build through concord. we're going to zoom in toward north 680 through san ramon. the crash there looks like everything is just about cleared. cleared from the lanes. on the shoulder, may be little activity. minor slow for dublin and 680 and we have the tri-valley build. also 880 coming off of 238 and hayward. nothing unusual about this pattern except for the fact that it's looking really good right now and that's unusual to itself. south bay at the bottom of the screen, northbound build for 101. 87, 85. we'll look at palo alto, the live look shows you on easy drive for the peninsula right now. northbound heading away from us. and southbound with these head lights coming toward us with the sun in the screen, interesting

new this morning. one of the bigers names in bollywood has been sentenced to five years behind bars for actor kahn for a hit and run crash that killed a homeless man 12 years ago. conn argued his driver was behind the wheel at the time. the actor is appealing the sentence. we have a new video this morning of the emergency rescue of hiker in northern california. check this out. 18-year-old was airlifted out of alpine county nine hours after he sent a distress call from his cellphone. the teen was only 12 hours into a three-month hike to canada when he ran out of water and became dissorry ended. there was supposed to be water

sources along that trail. but they all dried out because of the drought. several children were hurt but amazingly will be okay after a large tree fell on top of them. the video is unbelievable. one minute the kids are playing there you see in the park in massachusetts. next, it just tumbles. and they are pinned under a 35-foot tree. a group of parents you see there rushing in to lift the trunk and several branches just to free them. 8-year-old boy needed three stitches, a toddler has a head injury. >> changed our lives. but that moment that tree fell, like a new world for me. >> the park is closed this morning as crews inspect each tree. they still don't know why this one suddenly just came crashing down. >> don't know if i've ever seen something like that happen before. >> of all places. a florida mom being held hostage at knife point called for help using a pizza delivery app. >> this is quick thinking. police say sheryl treadway's boyfriend was holding her

hostage but they didn't say why. treadway convinced him to let her use her phone to order a piz ska from pizza hut. through the company's app, she ordered a small pepperoni pizza but wrote 911 hostage, help, in the comment section. pizza hut called police and they managed to get treadway's boyfriend to give himself up. what a great way to notify and luckily no one was hurt. >> very clever. in fact, he was holding her hostage but still let her order pizza. >> she had to feed her kids. >> the stomach rules the day. 6:41. >> search for human remains turned out to be something much less sinister. >> police sent a difer down with a video camera to inspect that scene. here's what they found. two fake skeletons. how do you know they're fake? one of them was wearing aviator sunglasses. the other one was sitting in a lawn chair. the other was also holding a sign not quite legible but it looked like it said bernie on it

welcome back. chilling new information this morning about the copilot who intentionally crashed that germanwings flight into the french alps. a report released just hours ago shows andreas lubitz practiced the deadly descent on an earl i did tlith that very morning. kris sanchez is joining us now. this is a story that gets more odd and shocking. >> one analyst says the changes in the altitude make it seem that he was not only practicing e maneuver but perhaps also trying to steal his resolve to pull it off. passengers on andre yas lubitz we outbound fright willing are only finding out today they were the test subjects in that copilot's maneuver. investigators say lubitz practiced that deadly descent hours before he locked the pilot out of the cockpit and crashed

the plane into the french alps on that return trip to germany. this is part of what the french civil aviation authority revealed today. that solid line on your screen showing how many times lubitz manually changed the altitude settings to crash landing settings several times in five minutes. the broken line though shows the actual descent of the plane. likely the passengers didn't feel a thing. investigators added that lubitz went into a controlled minute long descent from which there was no aeronautical reason and the setting he manually input was 100 feet, again, generally used only for crash landings. he did it while alone in the cockpit. he was alone for about five minutes. on that deadly flight hours later air traffic controllers and military defense personnel tried to contact the plane 14 times as it was descending. their suspicion was aroused because in addition to changing the altitude lubitz also increased the speed of that flight and changed the path 93 seconds be fr the crash. the black box reveals that he did not do the same on that

practice run which is why it didn't arouse suspicion and if he hadn't crashed that plane later in the day, those maneuvers on the earlier flight would not have been discovered so it's possible perhaps he practiced before. final report expected in about a year. >> just the fact that he squeezed that all in while the other pilot was out of the cockpit. thank you for that report, kris. switching gears. taking a live look outside. beautiful sun rise across the bay area. this is up near the green, green hills there. let's welcome in meteorologist christina loren. she's got a look at that forecast for us. >> we have a spectacular day coming your way, especially if you're someone who doesn't suffer from allergies. but they will be an issue today. we've got increased pollen levels. temperatures, let me show you why. we're at 52 degrees in san francisco. 40 in the nor bay. so cool enough for a light jacket out there this morning. rounding out the day. your high temperatures are going to be very comfortable. another spectacular bay area afternoon. 77 degrees in the north bay.

75 in the tri-valley. and 70 degrees for today along the peninsula. let me give you an idea of what you can expect as we get into the day. and this is when it comes to your pollen levels. this is the weather story of the day. that wind which will increase as we head throughout the afternoon will lead to drifting pollen. you might find yourself out there sniffling, sneezing a little bit more than any other day this week. today, those levels will peak. i take you to your future cast. at 8:00 a.m., we have the reds moving in along the coastline. watch what happens as i take you deeper into the day. you will notice on the key, the warmer colors indicate this fiercest wind. we stop that clock by 5:00 p.m. getting gusty wind at the immediate coast. up and down the peninsula, the pollen is going to be a concern for today. not quite as windy in the south bay. you will notice on the key that's ten miles per hour sustain. the same out there in the tri-valley. keep in mind today is going to be kind of rough when it comes to the pollen levels with relief as of tomorrow.

so here's what you can expect. let me give you the forecast. show you your predominant offenders. juniper, all of oak and that wild grass growing because we have had a decent rainy season. that is one of the things causing you to sneeze. as we head throughout your thursday into friday, levels dropped. and then they will creep back up for saturday and drop back off again just in time for all the moms out there on mother's day. early gifts coming your way. as of sunday morning looking much better in that department. so for today, this is what you can expect. let me show you the over all trend. clearing skies as we head throughout the next couple of hours. expect a lot of sunshine today. by noon. then as we head through your thursday, showers move in between 3:00 p.m. and 9:00 p.m. this is for the east side of the bay area. few light showers. drizzle. we will see those isolated showers moving into the south bay and the peninsula as we head throughout about 11:00 p.m. that's when we're going to cut that chance off. looking good though. .05 of an inch across the board.

chicago's o'hare airport twice last month. authorities say both times she responded in a restricted area without a ticket. hartman gained national attention after attemptsing to sneak on to planes including a successful attempt at san jose international. hartman has now been arrested at sfo, lax, sky har bon international airport in phoenix, the jacksonville airport, and now twice at chicago o'hare. singing, chanting, and shouting, affordable housing activists shut down an oakland city council meeting last night. they're furious about a proposal to sell city land near lake merritt to a housing developer. the development would create luxury condos. after several unsuccessful attempts to continue the meeting they adjourned without making a decision. stopping a b.a.r.t. strike in its track.

bay area lawmaker is introducing a new bill in hoping of keeping b.a.r.t. workers on the job. bob ridell live at the fremont b.a.r.t. station. bob, this has the attention of thousands of commuters. >> reporter: good morning. we're talking about assembly bill 528 if passed it would prohibit b.a.r.t. workers from striking if their contracts expired. they're still getting paid. if they're expired contract had a no strike clause in it. this is being proposed by east bay assembly woman catherine baker of san a known. she is trying to prevent what happened back in 2013 when bath unions went on strike twice even though some, if not all their workers, had a no strike clause in their contracts. those strikes inconvenienced thousands of commuters and according to assembly woman cost the economy $73 million per day. >> i think it's disruptive to our bay area. the cost is just phenomenal for the small number of people it benefits from wages and i think they're paid pretty well already. >> i think everyone should have a right to strike. that's part of america. sure, it has an impact on us and

it's an impact i don't like. but it's their right. >> reporter: executive director for one of the unions did tell the bay city news service a couple months ago that this bill would be very damaging and would open up old wounds adds management and workers try to build better ril ete eter relat. the bill does not call for an out right ban on strikes. that bill was killed in committee earlier this year. this morning's bill ab 528 would allow workers to strike, again, as long as they did not have that no strike clause in their contract. the assembly woman is presenting this bill to committee a few hours from now at around 10:00 this morning in sacramento. reporting live outside fremont b.a.r.t., bob ridell, "today in the bay." it happened in the last hour but still a lot of people smiling this morning at spacex after another successful test of d dragon capsule. >> it's been to the space station but without astronauts. >> they need to make sure it's
