at auction, tuesday, may 12, 2015. from nbc news, this is "today," with matt lauer and savannah guthrie. live from studio 1a in rockefeller plaza. good morning, everyone. welcome to "today" on a tuesday morning. >> as we open this tuesday morning our thoughts and prayers go out to the people of nepal. >> can you imagine what they've been through and now another major earthquake has hit. breaking news out of nepal where this damaging new quake struck overnight causing deaths and injuries and causing buildings once again to collapse. nbc's katy tur, what do we know? >> there are buildings, mudslides and 42 people killed so far, but that number is only expected to rise. this was 7.3, centered on namche

and 51 miles from kathmandu which as you know is devastated from the april 25th 7.8 quake that killed 8,000 people. this one not as big, but still powerful and felt as far away as new delhi where buildings swayed for more than a minute. the usgs says today's 7.3 quake lasted more than a minute and the rattling captured. it was sending up clouds agust. >> this one seemed like it would never stop and eventually i ran down the stairs trying to get outside of the house as fast as i can. >> reporter: people rushing out into the streets and the shell shocked in a state of panic. >> i jumped up and thought i was having a nightmare and the room was really shaking and i was in the sixth floor. >> reporter: within an hour, four major aftershocks including one measuring 6.3.

a red cross worker based in kathmandu says the tremors were big enough to scare the living daylights out of everybody. so far there were reports of landslides and buildings going down and bodies. >> patients were dragged out of the hospital in their mattresses for fear the building would collapse around them. unlike the april quake which hit at lunchtime on a saturday, this one happened during the week when people were in schools and at offices and today's was even closer to closer to everest's base camp. the moment captured on camera. the climbing season was canceled after the april quake so no one should be on the mountain right now. now if there's any silver lining here is that this earthquake was smaller and deeper than the april one. the shallower quakes usually cause a lot more damage. it was also centered on a relatively unpopulated town. still, it's only been a few hours. there is a lot left to discover

and there is a warning that that death toll could rise sharply. >> here with breaking news. thank you. let's get more from kathmandu. we have donatella joining us via skype. good morning to you. i know you were on the fifth floor of a restaurant at the time. tell me what you experienced when this quake hit. >> i was in central kathmandu on a fifth-floor terrace overlooking the royal palace and initially everyone thought they were aftershocks and we've had so many aftershocks since the april 25th one and we all ignored it and the tables started moving and the whole building was situation back and forth forth. so everyone got up and tried to go toward the stairs. my husband grabbed my hand and said we're not going to the staircase. it's the worst place to be and we're staying here. it's very difficult to know how long it lasted because we've all been traumatized by so many aftershocks and the big

earthquake and when we did get down to the street and for miles afterwards because i drove to find my son at school afterward to pick him up and there were thousands of people on the streets and the medians and running to the only big park in central kathmandu. from my ride to my son's school which is on main avenue there was no sign of buildings collapsing, but that's not the -- the places where the buildings collapsed in kathmandu is very site specific, along new road, an old area of time where all of the migrant workers worked with a lot of buildings collapsed leaning one on top of each other and sinking into the ground. that's where the new casualties are. that's where further collapsed buildings have happened as well as in that eastern nepal in the district capitals of totara, i gather from friends of mine who are nepali search and rescue, that there are reports of many, many people buried in the houses where they opened their shops underneath leaning buildings and

many of those buildings have now collapsed on top of them. >> donatella, i mean, we are just beginning to take the toll there. thank you so much for your reporting this morning and as we mentioned it's the very moment so many people in nepal were starting to return to that normalcy. >> the last thing they need. no question about it. another major story this morning. we are talking about the hefty penalty being leveled against tom brady and the new england patriots for the deflategate scandal. nbc's peter alexander is here with their reaction to the story. >> good morning. talk about a big hit. this could cost tom brady close to $2 million. brady will miss a quarter of the nfl's upcoming regular season and it's the same punishment that a player would get for being caught using performance-enhancing drugs and they will appeal. >> first the punishment now the pushback. late monday tom brady's agent

teed off saying the discipline is ridiculous and has no legitimate basis. patriots owner robert kraft offered unconditional support for his marquee quarterback and the punishment far exceeded any reasonable expectations. >> brady's teammates weighed in, legarrette blount saying this is absolutely ridiculous. fans weighing in, too. >> four games is excessive. >> it's surprising. a quarter of the season. it's sizeable. >> other nfl athletes backed the stiff suspension. this from an arizona cardinals defensiveback. well done, nfl. and they super imposed an asterisk. brady first addressed the deflategate allegations just before the super bowl. >> is tom brady a cheater? >> i don't believe so. i feel like i've always played within the rules. i would never do anything to break the rules. >> on monday the league cited substantial and credible evidence that brady was probably

at least generally aware that two locker room attendants were deflating footballs and had faulted his failure to cooperate fully with the investigation. the nfl's message was clear. >> you are caught doing something you shouldn't be doing whether it relates to the integrity of the game or whether it doesn't there will be a significant punishment. >> reporter: the patriots will lose their first round draft pick in 2016 and fourth round pick in 2017 as well as facing a $1 million fine, the biggest team fine in nfl history. as for those locker room attendants including the self-proclaimed deflator both have been suspended indefinitely without pay. >> tom brady's agent says his client did cooperate with his investigators and braid's camp until this thursday to file that appeal. if the punishment stands, brady will be back in action on the sunday night, week six in indianapolis against the colts. that's the very team that blew

the whistle on him in the championship game that sparked the whole thing in the first place. >> thank you very much. look who's here, bob costas, host of nbc's "football night in america." a million dollar fine against the patriots and two draft picks. nobody can accuse roger goodell of going soft on a friend or a superstar. does the punishment fit the crime? >> the crime is part of it and when you look at it in the overall, a cleveland browns executive was sat down for text messaging during the game which is against league rules. this kind of fits in a certain pattern and also the context in which it happens is important. it's been a bad couple of years with the nfl, with bountygate, with the bullying scandal, with the domestic violence and child abuse and the way the nfl ruled in each of these cases were sometimes perceived as random and sometimes perceived as incompetent and roger goodell wanted to make sure that he got this right. >> bob, with regard to brady, if

you look at the nfl's reasoning it seems clear it's not just the alleged deflation of balls. it's also what the report says sorry is lack ever candor when he spoke to investigators and not turning over those electronic records like text messages. when you look at that, did brady mishandle it from the beginning? did he maker a mistake by circling the wagon? i think he mishandled it with the league and he mishandled it in the court of public opinion. >> look. we all look for an edge. i like the football at the lowest possible end of what's allowable. i communicated that to the equipment guys, if they went a bit overboard, i'm sorry. my bad. see you later. >> last night patriots' owner bob kraft issued a statement saying he was prepared to go along with whatever punishment was understand thatted down, but this punishment exceeded any reasonable expectation. are those the opening words of a long, protracted legal battle? >> there will be an appeal. no question about that and i think what could come out of

this is the players association will push for an independent arbitrator. in the nfl's bylaws that's up to goodell. goodell can say i'm judge and jury. i'll hear the appeal although he could say i'll agree with that and we'll name an independent arbitrator that we jointly agree to. in the long term it's in the nfl's best interest to have all these cases decided as baseball does by an independent arbitrator so there isn't this appearance of partiality. >> you can read this report as a patriots fan or non-patriots fan. do you think this tarnishes the golden boy image? >> tarnishes it a little bit. would have done what he did with inflated or deflated football. this is not barry bonds using steroids. >> let me put the image up. brady, number 12, the asterisk next to the number. is there an asterisk next to the championship of the patriots last year? >> i think it's in the minds of many.

officially there won't be. they didn't need it. this is what's so stupid about it. they didn't need it. when they adjusted the footballs against indy, the team that blew the whistle. they outscored them. they didn't need it. these are self-inflicted wounds. meantime, the weather is a big story again. severe weather firing up in parts of the south once again where at least five people died on monday. the town of van, texas, devastated by an ef-3 tornado and they're just beginning to pick up the pieces this morning. nbc's nbc's carey sanders. >> reporter: the wind speed topped out at 160 miles per hour. what a mess they have here. you can see the vast area that was affected. these pictures were taken from a drone that was launched by a team of rescuers and it was the minuteman disaster response and they were looking for folks who might still be buried under the debris. this morning we can tell you

everybody has been accounted for. two people did die. the national weather service says that the tornado looked as if it may have cut a path on and off which is about a mile long. the biggest area that was affected are the schools here that may have to be completely demolished and then rebuilt. meantime in arkansas, in nashville, arkansas, a sad story of parental love. a tornado that touched down there hit a mobile home and when the rescue arers went in they found a mother and father, husband and wife who were embracing each other and in between them they were sheltering an 18-month-old child. that 18-month-old child survived the tornado. really, a heart wrenching story and that child is now with family members who are going to take care of her. al, as you know better than most, the conditions in the last six days of 131 tornados and now there could be more tornadoes

come saturday. >> that's exactly right, kerry. >> we started the month slowly and we're pacing 50% above average for tornadoes. kerry sanders in van, texas, thank you very much. >> we shift to the south and there is a lot of heavy rain down south and we're watching this and it will just continue during the afternoon and on into tomorrow. as you can see, all this moisture, gulf moisture streaming up into oklahoma and on into kansas. we have flood watches and flash flood watch warnings from brownsville all of the way to oklahoma city. almost 24 million people, heavy rain. rainfall amounts anywhere from two to three inches and some areas five to six inches of rain and as kerry mentioned, loading up, gulf moisture and a big upper level low coming out and as you look on friday we have a risk of severe weather from texas all of the way into nebraska. 16 million people at risk with

business deal. >> it certainly is breaking this morning. telecom giant verizon saying it is buying aol for $4.4 billion. after the merger aol will become a wholly owned subsidiary of verizon. verizon says the deal will strengthen its mobile and add offerings. four men including two suspects are in the hospital after a shooting in isla vista, california, near the uc santa barbara campus. the violence came nearly a year after a deadly shooting and stabbing spree in isla vista left people dead and 14 others injured. it put the surrounding neighborhood under a temporary lockdown. one of the suspects was captured last night and the other surrendered today at a hospital. secretary of state john kerry is in the black sea resort of sochi today meeting with russian president vladimir putin. it's kerry's first visit to russia since the ukraine crisis began and u.s. officials say kerry plans to test putin's

willingness to push pro-russia separatists in ukraine to comply with a cease-fire. some dramatic moments on the side of the massachusetts turnpike on monday when a bus exploded into flames at the height of rush hour. the bolt bus was headed to boston from new york city. it had 47 passengers onboard when the driver started to notice the smoke and pulled over. people were evacuated and minutes later an explosion blew out the windows and panels and sent debris flying. no one was hurt in the incident, but traffic was backed up for miles and thank goodness for a fast-thinking driver. a painting by pablo picasso smashed a new world record sold in auction. this is the women of picasso and get this, it sold for $179 million monday night at christie's auction house here in new york. the buyer elected to remain anonymous. probable a good idea.

very good morning. it is 7:26. i'm la raur a garcia-cannon. san jose police say mohammed khaliqi followed a 13-year-old girl home pushed his way inside her house and started to sexually assault her. she managed to fight him off. the surveillance video made national news. police si khaliqi saved his head and altered his look shortly after the video was released. he's suspected in one other attack. meantime a teenager charge with kidnapping and rape of a pizza delivery woman is expected back in court today. miles assaulted a woman at gun point in antioch in february. miles is being charged as an adult. the bail is more than $6

the new england patriots were also fined a million dollars and were stripped of two draft picks. and officials in van, texas, now say everyone who was missing in the wake of a massive tornado there has now been accounted for. the ef-3 killed two people and damaged or destroyed 30% of the buildings in that town. let's start this half hour in florida where george zimmerman back in the headlines. this time for nearly getting shot in the head for a dispute with another driver. here's janet shamlian. >> reporter: george zimmerman is no stranger to run-ins with other people. on monday it happened once again. >> he reported he had just been involved in a shooting. >> reporter: zimmerman told police he was driving near orlando when someone shot him through his passenger side window just missing his head. he was taken to the hospital with minor injuries and released. at the same time police received a 911 call from a man saying he'd been involved in a shooting with zimmerman. police confirmed that man was matthew apperson.

the same man involved in a road rage incident with zimmerman last september. monday he wasn't answering questions. >> stop touching me. >> this is your opportunity to tell your side. >> this is your opportunity to get out of my face right now. no comment. >> we the jury find george zimmerman not guilty. >> reporter: since being acquitted of second degree murder and manslaughter in the death of trayvon martin, zimmerman has had a series of encounters. a confrontation with his ex-wife. >> i don't know what he's capable of. >> reporter: no charges were filed. another was his ex-girlfriend. >> i need the police right now. >> reporter: charges were dropped. and traffic stops that made headlines. >> what a coincidence. >> reporter: but no charges. his only violation of the law, a single speeding ticket. in this latest incident, police say zimmerman didn't fire any shots. his attorney says apperson was the instigator. >> george decided to get away and it wasn't enough for this guy.

good morning. it's 7:56. i'm sam brock. a live look right now outside the bay bridge and shaky cam. right now growing questions over the seismic safety. the bay area toll authority approved 4 million bucks for extensive new testing. the concern, steel rods that secure the bridge's main tower to the base on the new eastern span. caltrans test say the water from the bay might be seeping into the foundation and i'm packing the integrity of the rods. if true that could lead to major corrosion. serious and major water rationing in the south bay. the san jose water company announced a mandatory rationing for 1 million customers starting next month. that amounts to reductions of 30%. anyone exceeding their usage will be fined. the plan is expected to take effect in about 30 days. some rain on the way for later in the week.

the accident had left amy paralyzed from the waist down. but we've been following her struggle to prove life doesn't end when you have a spinal cord injury. and a man who spent the night on his boat in san diego woke up to find he had a new bunk mate. a baby sea lion. he said he heard sneezing and movement in the middle of the night so he figured maybe one of his friends decided to come down to the boat. few hours later, he woke up again and that's who he saw. 30 pound sea lion in the other bunk fast asleep. he grabbed his phone, shot video of the sea lion as he tried to coax him off the boat and back into the water. the sea lion just needed a good night's rest too. >> let him sleep. >> so the sea lion was there all night? >> he was sleeping next to him in the bunk next to him. >> the scent of sardines i think would have woken me up. >> good place for sure.
