>> i like that attitude let's check in with kristin aa rain on the way. temps this morning mostly in the 50s to start the new day, beautiful conditions temperaturewise. that wind has finally dropped off, which is great news. we're going to give you the timeline and tell you how much we're expecting showers where you live. just moments, say happy wednesday to mike inouye. >> we'll take you out towards fremont, an easy drive. it's still breezy out there, but we're looking at your maps, and we don't see any slowing southbound through fremont in towards the south bay. little blips here and there. we have construction, road crews typical for 580, you see over there on the hayward side of the san mateo bridge, the chp is going out there to give us more information. so far traffic is flowing

smoothly. mangled metal is all that's left of a car that went 20 feet down a ditch in the south bay. four people died while the driver is still in the hospital this morning with critical injuries. >> in bob redell is joining us from gilroy. investigators believe that speed likely played a role in this crash, but what else are they telling you? >> that's what they think, the driver of this black ford must tang, finally being pulled out of the ditch, they think the driver was speeding just before 11:00 last night with four passenger on board inside the car before they went off the road. this is as he hit the curve in the road here. this is not too far from new avenue. you can see his black ford mustang left the road, overturned and landed in this ditch off the road down about 20 feet into what was a dried-out creek according on to chp.

the driver is the only survivor. he's been taken to the hospital can with what the chp described as major injuries. they say the last they heard, he was still unconscious. it's not clear if he, the driver, tried to brake his car before going off the road. >> there are tire friction marks to show the vehicle was going through a curve in the road, left the curve in the road and exited the roadway before overturns. >> of the five people inside, chp say four were wearing seat belts. the officer did not indicate the person who was belted in. chp is still out here. they have already processed the scene. it's just a matter of processing -- they hope to have this section of the road open within the next hour. bob redell, "today in the bay."

>> such a tragic scene there now to a developing story. federal investigators combing through the wreckage of an am track train amtrak train. >> there was an update just about a half hour ago. the doctor in charge says several other people are not out of the woods yet. >> in critical conditions still. >> three went to the operating room last night immediately. >> meantime we are getting our first daytime look at the scene. the amtrak train was headed from washington, d.c. to new york when it went off the tracks at philadelphia. all seven cars flew off the rail, some passengers sea they felt something go wrong as that train entered a curve.

>> we just rolled and rolled. there were people screaming and bleeding. >> it is an absolute disastrous mess, never have seen anything like this in my life. >> in this passenger video, you can see others trying to help each other as others try to crawl out. investigators quickly flooded the crash scene, but it was dash. they were looking for more victims and clues. they don't believe terrorism was a factor, but there will be no train service between new york and philadelphia this week as investigators do their work. the ntsb team is scheduled to arrive a bit later this morning. we'll update you in the next half hour. >> sounds good. thank you very much. the coverage of this story continues across all our digital platforms. right now we are following another developing story this morning.

right now two u.s. helicopters are scouring the hillsides in nepal looking for a california-based marine helicopter that's been missing since yesterday. aboard there hell comment are six marines and two nepalese members n the marines have several pieces of emergency equipment like a satellite phone and gps device, but rugged terrain could make it difficult to use those devices. the helicopter is based in camp pendleton in san diego and one of the marines is stationed there as well. rescue crews are searching for survivors of the earthquake itself. many people spent the night outside. as soon as the sun came up, crews went to work digging in the rubble. 65 people were killed in yesterday's quake, at least that's the total so far.

vaccines that are children received may not be protecting them from the disease. the problem is a bad refrigerator. a refrigerator at a los gatos pediatric office has been keeping vaccines a couple degrees too cold, possibly making them not as effective. statistic found says it's been putting an action plan together for the children affected. >> are you concerned? >> this is big, like another -- >> there's nothing unsafe about a slightly cooler vaccine. the only question is whether it's as effective as we would have wanted. >> here are the vaccines possibly compromised. v-tap, d-tap. hepatitis, hpv, typhoid flu and tb. the organization is providing

meaning they spent more than a hundred grand. one caveat, insurers covered all by 2% of super spenders costs. the city of berkeley is not taking any chances. the city council voted yet to, it passed right to know legislation, requiring retailers to warn passengers about possible radioactivity exposure supporters say consumers need to know. the cell phone industry says it's an unnecessary warning. >> if they do hold them toed body, they're competing the federal exposure limit. >> this proposal is to warn consumers and questioning the safety of cell phones. >> the wireless association is expected to challenge that

that's us, from 59% in 2014. furthermore, only 2% of the companies survey -- good news for people looking for work, but one painful byproduct of the boom, soaring rents. you know it all too well. people will rally for more protections for tenants. the mayor is meeting with four council members to take about ways to expand rent control, provide more affordable housing and cut down on eviction rates. average rents in san jose have catapulted about $500 in just three years. ahead of that meeting, a renters' rights rally is being organi outside of city hall get ready for game 5. in oracle arena you can probably hear a pin drop tonight. tonight will be the opposite. it's the warriors' playoff series against the grizzlies. league mvp stef curry led the way with 33 points.

>> and to perform radiation experiments on animals. we have uncovered new e-mails from state regulators in an unprecedented move, the state health department reversed its decision to release 22 old buildings at hunters point. at first the state thought it had been tested and decline up, but new data says -- the state can't be sure that land is safe. we told you about tetratech with the $300 million contract to clean up radiation, whistle-blowers told us the company cut corners on safety in favor of profits. we also exposed an internal report where tetratech admitted it turned in fake soil samples as clean. the company had no comment. the navy says there's no rad logical contamination in the buildings that pose an unacceptable risk. our entire report is online right now at nbcbayarea.com until the "investigations" tab.
