contract employee here in the bay area in 2010 and 2011 when they were contracting with amtrak so bostian technically an amtrak employee there. he is based out of new york and has been an amtrak engineer for 4 1/2 years after spending 4 other years as an amtrak conductor. now, data from the black back suggests the train heading from washington to new york was traveling twice the posted speed limit when it went off the track. talking 106 miles per hour before hitting the curve in a 50-mile-per-hour zone. >> shortly after he hit the curve. >> slams on the brakes? >> slams on the brakes. >> then it's too late? >> well, the train dea littled at that point so i would say it was too late. >> reporter: the crash killed seven people and injured more than 200 others. philadelphia police saying they interviewed bostian. they've got a blood sample. his attorney saying his clipt has turned over his cellphone. federal investigators say they will likely interview him and

train crew today or tomorrow and will not assign blame until all investigation is complete, saying that mechanical issues could be to blame all together. live in san francisco, stephanie chuang, "today in the bay." >> we'll see what the findings end up proving. but in the meantime, the deadly derailment appearing to be yet another crash that did not have to happen. >> "today in the bay's" kris an chez with the crash avoiding technology that exists but the funding that may not. >> we have two train story lines coming out. on one hand congress gave amtrak until the end of this year to install positive train controls. a system to avoid human error. on the other hand, hours after that disaster in philadelphia, a house panel voted to cut amtrak's budget by more than half. looking live at the disaster scene in philadelphia from the air this morning you can see the work to repair the rail line there continues. president obama's budget earmarked more than $2 billion to improve amtrak's aging infrastructure proond vid fund
6:05 am
that would help amtrak meet that requirement to that so-called positive train control by the end of this year. let's talk about that system. it uses gps, wireless radio, and computer to track where the trains are in the system and could automatically brake if excessive speed or a possible collision is detected. something that stephanie chuang says was in the last crash. according the national transportation safety board, positive train control, ptc, could prevent 40% of train crashes that happen because of human error. that means 29 passenger and freight train crashes could have been avoided since 2004, according to the ntsb. >> this is exactly the type of incident that ptc is designed to prevent. so, we have seen this before and we will continue to see it again until ptc is installed. >> the budget argument on capitol hill falls along party lines with republicans voting to cut the funding but that's a house panel.
6:06 am
so it is not a done deal yet. we'll have to see what happens with the full house and the senate with these images fresh in the lawmakers' minds. by the way, caltrain tells us their ptc system is nearly up and running. sam? >> good to hear that close to home. thank you, kris. we're going to have updates from stephanie and kris coming up in our next half hour. for updates any time you can visit our website nbcbayarea.com. it is graduation season just around the corner and south bay high school students are dealing with this tragedy. three students killed in the late night crash in gilroy.
