>> why did you end up back here today? >> japanese arrested mcdonald on monday for assaulting a woman with a baby in her arms at an 579 he owns and yesterday for showing up at the apartment in violation of the restraining order a judge issued after monday's arrest. mcdonald's lawyer tells us the only reason he went back topt apartment was to let his investigator to look at a possible broken door that the investigator did confronted the woman was away in santa cruz at the time and mcdonald immediately left after police called him to let him know she had returned and seen his car at the apartment complex. mcdonald was arrested later in the day at a nearby togo sandwich shop. he posted bail last night and is out. the 49ers caught mcdonald for what they called, quote, a pattern of poor decision making. chicago bears cut him earlier this week after his arrest on monday. reporting live here in san jose,

bob redell, "today in the bay." >> bob, thank you very much. a suspect with a long rap sheet is behind bars after going on a wild crime spree taking hostages and eventually surrendering. today we could learn his identity. looking at police rushing in. here you go. guns drawn. as a man surrenders. all of it starting yesterday morning. hold on for the video. police say 35-year-old sus stole a car in walnut creek and carjacked a man in a business and led police on a long chase. officers eventually using spike strips to stop him in antioch and then he ran to a nearby gas station and took two hostages but not before he terrified a few witnesses along the way. after that ordeal played out hostage negotiators convinced the suspect to surrender. officers have yet to release his name because they say the investigation is on going. all right. after three years, a domestic violence case rocks san

francisco -- no. >> we are going to go to fifa. we're going to talk about fifa. new fallout of course this morning rocked by a massive bribery scandal. fifa's president canceled another appearance at the conference in switzerland. also fisa threatened to cut ties if steps are not made to eliminate corruption. 14 kek executives face charges in a u.s.-led corporation probe dating back decades. blader is not among those charges. he faces reelection tomorrow. a stunning admission by the u.s. military of a doiangerous mistake involving anthrax. >> the pentagon is saying instead of sending inactive samples somehow live anthrax went to nine states and overseas. "today in the bay's" kris sanchez is joining was the very latest. how does this mistake happen? >> we can tell you this morning the commander of the military site that shipped out the live anthrax says there is no danger to the public but believing that requires trust which is in short

supply this morning. california is one of nine states that got some of that live anthrax virus which was supposed to be inactive. here's how it happened, sam. the lab that sent out the samples in utah developed the strain more than a year ago. then radiated it to make it inactive and safe for research. but then last week a commercial lab in maryland discovered it was still live. now the fear is that all of those samples sent out in the last year from that same batch may also be live because, again, they come from the same batch. and that means labs in states, military and commercial, plus south korea, may have live virus. lab workers who worked with live virus have to be completely enclosed in protective gear with the inactive virus they just have to wear a simple face mask like your doctor or dentist might wear. the concern of infection for them is very real as is concern of infection by someone in transport. those samples, because they were inactive, were supposed to be inactive, were shipped via fedex

as ordinary packages. but the commander in charge says still there is no need to worry about that at this point. >> there's almost no known risk to the general public and there's no suspected or confirmed cases of anthrax infection at the potentially exposed lab workers in the states. >> so why, you ask, is the military shipping anthrax in the first place? it's where they develop ways to defend against biological and chemical weapons. in order to do that they have to have a strain of the virus. now, the centers for disease control and prevention are rounding up all of those samples. they are going to take them back to central location for further testing. but no one is sick at this point. and again, that commander says that there is little risk to the public. however, there was not supposed to be live anthrax in the mail, either. >> exactly. >> mistake they will probably not be repeating again. thank you, kris. let's look at what the weather has to hold for us in store today, rob.

for instance, if i sent you an e-mail saying, hey, we could go camping you might see ads on your yahoo! page for rei. federal judge who has been involved in all kinds of high tech cases has weighed in on this one, too. she's allowing a class action suit to go forward over claims users didn't know this was happening and did not agree. especially for e-mail users who are sending to e-mail yahoo! addresses and couldn't possibly have known. if you are saying to yourself right now, didn't g-mail do the same thing? it does do the same thing. and judge co thought about that one, too, but did not rule against google. why? i will be honest. i'm a little fuzzy on her reasoning. i'll try to figure it out. speaking of e-mails, a different judge has ruled another cache of hillary clinton's e-mails must be released by the end of the next month. and at the end of the month after that and the month after that and so on until all 30,000 are released. the timetable pretty much ensures clinton's e-mails are

53 degrees. misty skies again this morning. oracle arena looking nice. 53 right now and mid 50 nasdaq san jose. overcast skies. breaking out to the sunshine. probably between about 9:00 and 10:00 this morning. that marine layer pattern continues but the marine layer has been compressed down for about 2500 feet yesterday to closer to about 1200 feet today. it's compressed almost by 50% this morning. the net result of that hilltop location today really experiencing the warm-up. not so much around the peninsula or coast, but as you get over to saratoga and los galos, the temperatures are climbing up. 77 today in morgan hill. san francisco, temperatures close to 60 today with the giants taking on the braves. coming up at 7:15 today. game on nbc bay area tomorrow. temperatures in the 50s thereafter 7:00. now for the north bay, highs in the low to mid 70s. 80s around livermore and pl pleasanton and oakland. yankees coming to town. temperatures similar to at&t park at the coliseum numbers in

the 50s there as the game goes on. the temperature trend as we head into the weekend. south bay and peninsula temperatures, upper 70s for saturday. increasing clouds on sunday. for the north bay, tri-valley, you will see the weekend starts off warm but those numbers in the 80s, cooling as we head towards sunday as there is that chance still a slight chance of seeing a few showers approaching the north coast as we head into the weekend. that's the reason why temperatures will cool down. if that extra cloud cover as we approach sunday. mike? >> looking over here to some of that where you're talking about the weather. low clouds hovering around. right at the top of the tower. this is the bay bridge, view from emeryville. see the lights below it. smooth drive westbound as we pick up volume out of oakland and in towards san francisco. be prepared for fog across the span from time to time. look at your map though. this is not presenting a problem as far as the speeds go. we will look at your maps and the speed sensors and see a nice easy drive. fender bender in the north bay. south of that 580 off-ramp from 101 southbound. no major problems.

home or something? >> mcdonald clearly not interested in addressing the issue. this was his second time in jail this week. on monday deputies arrested him for allegedly assaulting a woman who had a baby in her arms at that time. that's when a judge issued a restraining order against mcdonald. mcdonald's attorney said his client did return to the apartment yesterday to let his investigator in to inspect a possible broken door. the investigator did reportedly make sure the woman was away at the time and mcdonald's lawyer says the client left after police alert i'd him she did return and saw his car out front. deputies arrested mcdonald later at a sandwich shop. >> he had came in looking a little bit distraught, a little bit angry, upset. >> reporter: san francisco 49ers cut mcdonald for what they called a, quote, pattern of poor decision making. the chicago bears cut him earlier this week after his arrest on monday. reporting live here at san jose,

bob redell, "today in the bay." >> all right. one more we'll continue to follow. 5:35. three years after domestic violence case rocked the city hall the scandal involving sheriff ross mirkarimi is resurfacing coming from his wife. lopez, a starring in a spanish language play she says tells her side of the story. called "what's the scandal." mirkarimi was accused of grabbing lopez hard enough to cause a bruise. he pleaded guilty to misdemeanor false imprisonment. lopez says, the couple stronger than ever. we're banking on the strength of more bay area weather here, especially as we get closer to the weekend. how are we feeling going into friday, saturday, sunday? >> valleys will start to see a warmup today. right now the bright screen b behind me, low clouds and fog around san francisco. 53 degrees. also 53 in oakland at oracle right now. you had misty skies nearby around the oakland airport and

san jose, 55 degrees all locationing at the low clouds except if you're atop mt. hamilton, down on the low clouds this morning. yesterday at this time, a lot of heels were covered in the clouds. marine layer is squished down closer to 1,000 feet thick this morning. as that compression continues these hilltop locations during the day today will have a chance of running into the upper 70s and low 80s. dry conditions and breezy at times for the afternoon. the other component for the warmup will be fire danger increasing. similar hilltops as we head into the weekend. meantime, low clouds and fog continue around san francisco and coast again today. we'll see cool temperatures closer to san francisco. highs near 60. low to mid 70s around san jose. but probably the biggest warmup we'll see today at the bottom of the screen. tri-valley climbing into the low 80s around pleasanton and sunol. north bay and the warming trend will continue and very likely peak on saturday. more clouds and cooling into sunday. san francisco staying in the mid

"today in the bay's" kris sanchez joins us with the very latest. >> it was shipped same way you and i might ship a present for our nephew or something. just this morning the commander of the military site that shipped that live anthrax says there's no danger to the public but believe that requires trust, which is clearly in short supply this morning. california's one of nine states that got some of that live

anthrax virus, the lab that sent the samples out developed a strain more than a year ago, then radiated it to make it inactive. then last week a commercial lab in maryland discovered it was still live. now the fear is that all of the samples sent out in last year may also be live because they all came from the same batch. that means labs in states, military and commercial, plus south korea, may all have live virus. lab workers who worked with live virus may have been completely -- must be completely enclosed in protective gear but with the inactive virus, just aware a face mask. so they could have been at risk. the concern for infection is real for them as is the concern for infection by anyone who was in transport. those samples were shipped via fedex as ordinary packages. the commander in charge says there is no need to worry about that at this point. >> there's also no known risk to the general public and there's

no suspected or confirmed cases of anthrax infection at the potentially exposed lab workers in the states. >> so why is the u.s. military shipping anthrax in the first place, you might wonder? dougway proving ground is where the u.s. military develops ways to defend against go biological and chemical weapons in order to do that they have to have a strain of the virus to work with. now the centers for disease control and prevention are rounding up the samples involved in this incident. they will be transferred to cdc laboratories for further testing but the positive news is that no one appears to be showing symptoms neither here nor in south korea. >> no doubt have to keep an eye on that. it's 5:46. arrest in connection to a massive too irin downtown l.a. you may remember the flames from december. the fire destroyed a seven-story complex under construction yesterday. officials arrested a 56-year-old man for arson. he could face life in prison.

bully and tease me again. >> the lawsuit was filed against the county, the school system, and the bus driver. that driver is now on leave. the head of the immigration court system calling on congress to fix a system he says is broken. for the first time the director of the nation's u.s. immigration court system sat down for an interview on television. he agreed to talk with our senior investigative reporter steven stock. he joins us with what the director says. >> director agrees that the current u.s. immigration court system is broken. but he says after years of budget neglect dating back for several administration, finally something is being down address these problems. now, director osu in,a sat down with me at his office in suburbs of washington, d.c. recently. he is head of the executive office for immigration review, a division of the u.s. justice department, a department that oversees and runs the nation's 58 u.s. immigration courts.

all over the country, including the one here in san francisco. right now though or just under half million undocumented immigrants backlogged in this system waiting on their day in court. some courts are now setting their calendars for the year 2019. the backlog is that great. director osuna says that's unacceptable and that it doesn't serve anyone justice with such a delay. he says his office has now hired 65 new judges and has budgeted to hire 55 more new judges, plus staff in the upcoming year. even so, director osuna says this broken immigration system won't truly be fixed until congress steps in and votes on immigration reform. he credits the current obama administration with pushing for that reform. now, if you want to see all of our stories on this interview or read more of our coverage on this immigration crisis in america, just go to our website, nbcbayarea.com. i back to you guys.
