>> right now on nbc bay area grisly developments in the case of a missing sacramento girl. we have reaction from neighbors who are heartbroken by the news. plus the city of san francisco getting pushback from people who don't want to see another jail built. and from a superstar's concussion to a coach leaving the team we have the latest on the golden state warriors. good evening to you, i'm peggy bunker. >> the 6-year-old missing from sacramento is believed to have been murdered and tonight her mother's boyfriend is behind bars accused of the crime. kevin oliver has the latest. >> she was like my granddaughter. she was just like a grandchild to me. >> she can't believe her little neighbor is not coming home. sacramento county sheriff's investigators have determined the body found burning in a field in glen county more than 90 miles northwest of sacramento was the little girl. deputies arrested the boyfriend

of her mother 25-year-old juan rivera. investigators say rivera was supposed to be taking care of her here at the martin luther king jr. village, a supportive housing complex for disabled homeless. >> she was like a daughter to me. she took her ever where. i don't honestly believe he would do that. in my heart, i know he wouldn't do nothing like that. >> reporter: rivera reported the girl missing thursday after he claimed he suffered a seizure, came to and she was gone. >> he may not have been truthful. we're further looking into the development of the timeline. >> deputies said the child's mother was in medical treatment at the time of her disappearance and has been cooperating. >> this mother is not being looked at as a suspect in this case. the mother has had a legitimate reason for not being around. >> horrible. people, we weren't made like this. >> reporter: the death prompted questions about whether the little girl was getting proper

care to begin with. >> i believe the system really failed to protect this child. >> reporter: friends of the mother and her boyfriend were defending them both. >> i seen it in his eyes and body language he loved the little girl. >> kevin oliver reporting from sacramento. juan rivera is in sacramento county jail tonight. a new jail is in the works in san francisco, but is it really necessary? some certainly don't think so. their arguments, it's a waste of money. christie smith joining us live from san francisco. christie, what's going on here? >> reporter: well a lot of people don't think a replacement jail is necessary because of the number of people incarcerated in the county and what they are doing is pushing for alternative solutions. today, about 50 people gathered for a town hall meeting in san francisco and an update on what's happening with the proposed replacement facility, which is said to be not only seismically unsound, but outdated and in pretty rough shape.

critical resistance also released a report that describes the harms and wastefulness of the project. there's a declining jail population and, frankly, they say the funds would be better spent elsewhere. >> instead of building a new jail why don't we use just a fraction of that money to go to mental health programming and services that you know where we can actually reduce the jail population by diverting people inside as well as having prearrest programs. >> reporter: supporters have said it's very important to keep a good facility here in san francisco. that the jail population is complex. they have to serve those with psychiatric needs, to those with gang affiliations. we have reached out to the sheriff's department for comment. meantime organizers say they are mobilizing for a hearing coming up some time next month. reporting live in san francisco, christie smith, nbc bay area news. >> all right, christie thanks very much. well the race to represent

the south bay on capitol hill is shaping up to be a rematch. ro khanna launched another campaign to challenge congressman mike handa.hn honda. honda edged out khanna in december. today he explains why he's running again. >> for the first time there's anxiety that whether that american dream that my parents came to this country for, whether that dream is going to exist. >> rowe khanna has worked closely with san jose mayor sam liccardo. might see dollar signs attached to the race again. both candidates spent more than $3 million on their campaigns just last year. and turning now to decision 2016 yet another big name democrat kicking off his presidential campaign today. former maryland governor martin o'malley. nbc's chris pollone has the latest. >> reporter: taking aim at wall

street poverty, and the frontrunners in both parties. >> i declare that i am candidate for the president of the united states. >> reporter: o'malley is the third democrat with significant backing to jump into the race joining hillary clinton, the presumptive front-runner and vermont senator bernie sanders. o'malley is positioning himself as a more liberal alternative to clinton, a champion of the poor and middle class fighting against the influence of big banks. >> tell me how it is you can get pulled over in this country for having a broken taillight but if you wreck the nation's economy, you're absolutely untouchable. >> reporter: o'malley wasted no time slamming the candidates with the most established name recognition, clinton and jeb bush. >> i've got news for the bullies of wall street, the presidency is not a crown to be passed back and forth by you between two

royal families. >> reporter: his announcement capped a busy week on the trail. earlier in the week sanders officially kicked off his campaign former senator rick santorum is making his second bid for the white house and former new york governor george pataki also threw his hat into the race. chris pollone, nbc news new york. >> also expected this week lincoln mcchaffey is expected to kick off his campaign on wednesday. we've also just learned some very sad news for vice president joe biden, his son beau biden has passed away from brain cancer. this announcement coming in just a few hours ago. beau was hospitalized earlier this month. today the biden family released a statement saying beau battled his cancer with courage and strength. beau biden was a lawyer who also served as delaware's attorney general. beau biden was 46 years old. well lately we have seen a lot of this. grass fires burning across the bay area, some even raging close

to homes. doesn't help we're in the middle of a historic drought. a live look outside right now at sunol, close to 90 degrees today, but some relief on the way this weekend that will help put off the fire season a little bit. i think we should stress a little bit. anthony slaughter, is that right? >> yeah, temperatures today for some of us got back into the 80s, sunol 90 degrees, livermore 87. many of us in the 70s. san jose, santa cruz, but if you live close to the water, oakland, san francisco in the 60s for today. in fact right now temperatures falling to the as for many of us. san francisco 55 even santa rosa down to 57 degrees, and a strong marine layer pushing in tonight. expect fog and drizzle tomorrow morning. the winds are going to continue to remain strong but the thing that's different this weekend from last weekend is our winds. this weekend onshore, so that's a humid wind it's a moist wind and it's a cool wind. so we're not expecting any fires, at least in the

short-term of things and the best news of all, we're expecting some showers. storm system expected to move through, however you'll notice this orange that's dry air feeding into the storm system so we're not expecting a ton of moisture and that's really the unfortunate thing with all of these storm systems. we just haven't seen the bulk of it move over the bay area. once again, a passing blow from this storm system expect the first showers to arrive tomorrow night. we'll time the storm system coming up in my next report. back to you. >> any moisture is good news thank you so much for that. checking in with kate scott of comcast sportsnet. how are you doing, kate? >> yeah we're five days away from game one of the nba finals but the long break between the series has turned out to be a good thing for golden state. klay thompson took this knee to the head in last tuesday's win, thompson was diagnosed with a concussion and is not going to be allowed to play until league

mandated protocol but confident he's going to do that before thursday's opener. >> all is going very very well to this point. >> are you set with the game plan considering he might not be there? >> no no i'm anticipating he's going to be playing. >> if he's not there, who do you think it is? >> i haven't even thought about it. you know series is like, five weeks away. we got plenty of time to think about that. >> alvin gentry had time to meet with the pelicans and sources say he has agreed to become their new head coach. he's going to finish out the playoffs with the warriors. gentry previously coached the suns chiefs pistons, and clippers. great news for gentry, but more bad news for sean doolittle after an mri showed swelling in his shoulder blade. doolittle missed the first 48 games of the season with a strained rotator cuff. so we've got baseball going on right now and the a's and

more than 3,100 dollars, that's now the average price to rent a one-bedroom apartment in san francisco. so today, activists targeted a san francisco city leader pulling on him to make prices more affordable. about 50 people rallied at harvey milk plaza before marching to the home of supervisor mark weiner, who represents the part of the mission. marchers believe those neighbors need more homes for renters, not more condos. >> to protect our affordable rental stock, and by supporting measures that would limit low cause evictions. >> the same group planned a protest at tuesday's board of supervisors meeting. all right, hundreds of dogs and cats are being welcomed into new homes tonight all thanks to a program that waved the fee at many shelters today. marianne favro joining us live

from san jose animal care with a look at how one foundation is making a difference. you had a cute dog there, maryann, hoping he got adopted last we talked to you. >> yes, he was adopted by the end of the afternoon and we're so happy to hear that. we'll show you his picture in just a second but more than 150 dogs and cats left today with new families all thanks to a program. he's 12 and his tongue hangs out because he has no teeth. meet gumbo, one of only two dogs left for adoption this afternoon. hundreds of people descended on the shelter today to take advantage of free adoption. thanks to a donation from mattie's fund. >> we will have more animals out tomorrow. they are being spade and neutered today, so they'll be out tomorrow. >> reporter: by the end of the day, more than 150 dogs and cats were adjusting to new homes, the shelter even offered free adoption for other animals, including rabbits. after watching nbc bay area news

earlier this evening and seeing gumbo, chris and darlene rushed down to the shelter to adopt him. >> you know, nobody really wants an older dog, so we have the room for him, and we want to give him a last few years of his life. so gumbo kind of fits that description. >> reporter: now gumbo is going home with his new parents and new siblings smokey and cheddar, a recipe for a sweet life. we are glad to help out little gumbo, what a cute guy. in san martin as well they took advantage of the program and were able to adopt out 60 cats and dogs there. here's a shelter starting tomorrow morning at 11:00, about 25 dogs and cats available for free adoption. reporting live in san jose marianne favro, nbc bay area news. >> that is such great news. my hat's off to that family who ran down there to adopt gumbo, i'm so glad. if you're on the fence about adopting, you have a little more time to think about it. >> on august 15th, 25 different

organizations across the bay area are going to be offering reduced adoption rates called clear the shelter and it is sponsored by nbc bay area. all right. meteorologist anthony slaughter, that is a heck of a shot back there. that's looking good. >> i was just thinking the same thing. >> way to go anthony. >> oh man, got to love living in the bay area. in fact this here from belvedere looking out towards san francisco, there is the fog building, beautiful clear skies above it. man, really spectacular views this evening. san francisco, completely fogged in. gray skies already. east bay looking at clouds building, same for the peninsula and south bay, as well. temperatures were all over the place today, 80s for our warmest spots, close to 90 in livermore and expecting cooler conditions for tomorrow. no 80s for tomorrow. clouds building and even some showers in the north bay by the evening hours as our next system takes shape and starts to move in. expect showers by this time tomorrow night. we had the ridge of high pressure that's moved off towards the east in the rockies,

but still heavy rain falling, even at this hour across parts of texas. you may have heard about the historic flooding there. here at home storm system making its way in but the unfortunate thing, we don't have the atmospheric river tap that we like to talk about and that's what supplies the generous amounts of moisture. for us light shower activity as we head towards tomorrow night and monday morning. definitely be enough to get the ground wet for the monday morning commute and that could cause problems on the roadways. allow extra time for yourself throughout the next work week but you can see this is monday evening, storm moves out. a lot of that activity is going to hang out across northern parts of the state. for us a passing blow and maybe about a tenth of an inch of rain. here's the closer view on sunday waking up to showers from pacifica, half moon bay, north bay, light showers. then we'll clear out tomorrow afternoon. expect to see a good mix of sun and clouds. temperatures down a bit, but monday's the day to watch for showers, this is around midnight and from that point on 7:00

8:00 in the morning, light showers to the north bay, same for the east bay, and that includes the tri-valley. by the afternoon on monday we'll clear out once again. i think we'll hang on to the cloud cover and light shower activity into the afternoon. for tomorrow here we go. next wet day. we're not talking about a completely dry day for everybody. the south bay will see some sunshine and we'll stay dry, but in the peninsula, half moon bay expecting drizzle, 59 degrees for your high temperature tomorrow, san francisco same deal, gray skies, few peeks of sunshine and it's going to be chilly. definitely jacket weather with the drizzle on and off. north bay, you'll see some sunshine. showers for you don't arrive until tomorrow night after the sun goes down. oakland, gray skies for tomorrow, 65 for your high there. tri-valley, no 80s like today. livermore up to 87 tomorrow back to 78 degrees. we actually have a hurricane, our first hurricane has formed across the pacific. the first hurricane of the season, and, in fact the

construction on the bullet train that would connection san francisco and los angeles is set to start this summer but new opposition is mounting. the high speed rail journey would take about two and a half hours and you're looking at right there one of the possible routes from san francisco to l.a. this week the city of san fernando down in southern california decided to protest the project. people who live and work in the area worry that the train will cost the city money. they are also concerned that sound walls around the tracks will be very ugly. san fernando joins some bay area communities, as well as farmers, voicing concerns about the project. and a local business celebrated a grand reopening today with students from san jose university. s.u. students provided marketing and business expertise to the owners. students from cet provided construction skills to make over

the restaurant. organizers say it's a win-win collaboration. >> small business truly is like, the strength of the community and so glad that the university can be involved in promoting that and strengthening that and getting students of santa clara a real practical opportunity to share their knowledge and their learning at the school of business with others in the community. >> the students also worked with four other businesses in the washington alma neighborhood of santa clara. we've heard it for decades, some of music's greatest albums recorded here in the bay area, fleetwood mac, santana, john morrison but joe rosato jr. shows how one woman is trying to change that. ♪ ♪ >> reporter: sometimes the most beautiful music can come from the most unlikely places.

just off san francisco's gritty sixth street a melody leads down a side road to a recording studio. terry winstead founded this program 12 years ago. >> so we worked on a grammy winning album last year. we've worked on multiple projects with quartets. >> reporter: but in this studio the most unusual thing isn't who's in front of the mic, it's who's behind it. >> we're the only recording studio in the world built and run entirely by women and girls. >> reporter: after a career in music and electrical engineering, win ston brought armny to the male dominated world of recording artists. >> less than 5% women working on all the sounds you hear in your life. we use music and media to attract women and girls to science and technology. she's truly making a difference

in the world. she's trying to help encourage more girls and women to get into an industry that is incredibly male dominated. >> winton set out to teach women to give them voices in an industry that's been mostly silent for women. >> that means all the perspective, all the ideas, all those insights of women aren't being heard. >> i feel way more comfortable here. a bunch of women, like they are doing what i want to do. she drops little nuggets of knowledge here and there, and it's like yes, this is what i wanted. >> for today, we are going to look at women in the studio. >> reporter: the program trains women as young as middle school for recording careers. >> who wants to do music production? >> when you get middle school girls in this room in particular, you can't get them out of here. ♪ and she's just chugging away chop, chop chop teaching huge

no doubt it was a big earthquake. you can tell by the way eastern japan shook today. an 8.5 earthquake struck this

morning, shaking buildings and a lot of nerves. the epicenter near a group of islands south of tokyo. the quake did not trigger a tsunami warning. no reports so far of any problems at the fukushima daiichi nuclear plant either. damage from today's quake is minimal because of how deep the earthquake struck. the epicenter measured in about 370 miles deep. even so much of the country felt at least some shaking. here in the bay area all eyes are on the sky, like the beautiful sky you see behind me here. some rain is in the forecast. for more, let's check in with meteorologist anthony slaughter. >> yeah you know we have temperatures all over the place today. we had san francisco one of our coolest today at 60 degrees. one of our warmest, livermore, close to 90 degrees. almost a 30-degree spread across the entire bay area. microclimate is really living up to those names today. oakland, close to 70 degrees. right now, many of us falling through the 50s. 55 degrees, oakland, san carlos

even san francisco, completely fogged in this evening and expected to wake up to drizzle tomorrow across the entire bay area as our next storm system moves in. this thing expected sunday night, monday morning and is expected to leave damp roadways especially for that monday morning commute. the thing about it not going to be a big storm system for us maybe a few hundredths of an inch. even the evening, nothing on the doppler radar. same story for tomorrow tracking light showers and then monday morning we'll time out the time frame to your doorstep coming up. guys, back to you. >> thank you so much. oakland began enforcing a demonstration after dark rules over a week ago. this requires protesters to get a permit if they want to march after sunset. the goal is of course to curb sometimes violent demonstrations, but is this constitutional? that's a question sam brock tackles in tonight's edition of "reality check." >> reporter: by day, oakland's recent may day protest moved

right along. the picture of peace and principle. >> we have to speak out and we have to do demonstrations rallies such as this. >> reporter: but under the cover of night, a different story. the sounds of smashed glass pierced the air, vandals rail on cars, bust into businesses and roam the streets. the violence moved oakland mayor libby shaft to take another look calling for permits to march on city streets after dark. the reaction on twitter was swift. mary mad wondered how is a protest curfew even possible? dave described the pushback as peaceful marchers getting arrested now, #breakthecurfew. >> we're definitely prepared to enforce this in court. >> reporter: civil rights attorney co-wrote oakland's crowd control policy a decade ago. she says calling for nighttime permits violates a deal between

civil rights groups and the city and she says it violates the first amendment. >> not constitutional to stop people from demonstrating just because of the fact that on some past occasions some individuals have engaged in unlawful activity in conjunction with the demonstration. >> reporter: constitutional law professor says the city's history is absolutely relevant when you're talking about protecting public safety. >> i think the history is relevant to whether the city's asserted justification to prevent violence is indeed a reasonable one. >> reporter: if oakland establishes a real threat of violence the city can constitutionally require permits, but he emphasizes government has to make sure the rules apply to everyone, regardless of what is being protested. >> that's going to be constitutional as long as that limit nation is reasonable and doesn't draw distinctions based on what is being said by the participants. >> reporter: in other words, the city has the constitutional right to regulate where and when

protests occur if there's a real threat to public safety. it just can't say, oh you're protesting an officer-involved shooting, then you can't go at night, and you're protesting labor laws? go right ahead. the rules have to be the same for everyone. i'm sam brock, that's this edition of "reality check," back to you. plans for a new google complex may get the go ahead even though the city of mountain view nixed expansion plans earlier this year. according to the san jose mercury news the search engine giant planned for a building northeast of highway 101. it would be built on a piece of property that was not part of the original proposal submitted to the city. now, a 2007 lease agreement allowed google to build up to 595,000 square feet of office and commercial space on charleston road and north of shoreline boulevard. today in san jose several young musicians sharing their talents to help fight bullying in san jose. ♪

it's called "rock for a reason" and it raised money for the audrie pott foundation. audrie committed suicide after being cyber bullied in 2012. >> so the show is put on by the students of music is language to try to help with cyber bullying and abuse. kids face it every day and it's time they are finally saying hey, you know we want to do something to try to help. >> some of the students actually went to saratoga high school some of them knew audrie and have been very supportive of our foundation for the past couple of years. >> this year the young musicians sold tickets and donors matched their sales up to $2,500. all proceeds went to the audrie pott foundation. well coming up next an uptick in snakes slithering around dallas. >> i tried moving the snake with a woodchip and then it just bit me. >> oh boy, what is being blamed for this recent rise in

and a follow up now on the effects of the oil spill from santa barbara. a care center is now helping to rescue oil burrs. they are getting help from a seaworld expert who has extensive experience rescuing and treating oil birds. tomorrow she's heading to the los angeles oil bird care and education center to help treat brown pelicans. they are some of the many animals that were affected by the oil spill. >> and as the birds get the oil on to their feathers they'll preen, spend more time preening lose their water proofing and ability to stay warm and spend more time preening and not going out to feed. many times when we get the birds, they are at a critical stage where they are low weight need hydration and need to get stabilized. >> seaworld right now is also caring for more than a dozen oiled sea lions and elephant seals also rescued. three of the animals died

yesterday from the oil spill. a beloved member of the san francisco zoo has died. 32-year-old pika passed away this week because of a medical condition. the bear was born at the zoo in 1982 and was raised in staff when pika's mother was unable to care for her. her favorite activities eating napping, fishing, swimming, she was the fourth oldest polar bear in the united states. when flood waters rise people are not the only living things seeking higher ground. a little boy in texas found that out the hard way. snakes look for dry places too. ray villeda has the story. >> i looked closer it was a snake. i tried moving the snake with a woodchip and it just bit me. >> reporter: skylar's recess ruined after a bite from a copperhead snake. >> it started bleeding, i shaked my hand it made it worse. then i ran to my teacher and they made everyone get off the

playground. >> reporter: it happened thursday afternoon during recess. the louisville isd tells us it cancelled all outdoor activities as a result, adding the campus and the district will continue to monitor the weather and will evaluate if outdoor activities will continue during the remaining days of the school year. >> whenever the snake bit me it felt like a bee stinging. >> reporter: the third grader is among the half dozen snakebites seen in children's medical center in dallas in just the 12 days. on average, children's health sees a dozen bites per summer. >> i'm not too surprised by that just because of the increased rain and flooding we're experiencing. >> reporter: skylar's hand is starting to get back to normal after the swelling. >> it started from here and then here. then here. >> reporter: the pain is going away, too, but the 10 year old certainly isn't afraid of snakes. are you scared of them now? >> no not really. >> reporter: why not? >> now i know what those look like and i'm going to stay away from those. >> good idea. that was ray villeda reporting

from dallas. now to a movie about another kind of disaster earthquakes. san andreas has valuable tips for earthquake preparation. crowds gathered for a screening of the movie and an opportunity to ask what to do when a real earthquake strikes. >> get a communications plan because you want to be able to find your family. i think one thing that the movie gets right is we really are concerned about our families in an earthquake if we're separated. >> experts told the group you need the emergency kit ready, a two-liter bottle of clean water will come in handy. also the san andreas fault is not capable of creating a magnitude 9 earthquake as seen in the movie, so that's reassuring. >> yeah enjoy the special effects. it's a crazy movie, i guess. >> keep it contained. >> get out of it what you can. meteorologist anthony slaughter standing by with the microclimate forecast. last time we talked you were

mentioning raindrops. >> bringing the fog this evening and the cloud cover. you can see temperatures falling quite a bit back into the '50s. fog is building from san jose foothills, and every single microclimate expected to wake up to fog and drizzle kind of like this evening in san francisco, already back. we're going to see a strong marine layer at the coastline. tomorrow morning drizzle at the coast and clouds by the bay. exception is san francisco and the north bay, expecting to stay great tomorrow with just a few peeks of sunshine, then showers for you tomorrow evening. i think the south bay and the tri-valley will see the showers on monday. so a little bit of an appetizer for tomorrow if you will. we have a storm system the one i was talking about that's expected to bring those showers is still off the coastline by about 100 miles. at least the core of it but it's very unorganized. there's not a lot of moisture to work with. as it moves through, only light showers, at least for us. northern california is going to take the brunt of this storm system and they are expecting

moderate to heavy rain monday morning. for us monday around midnight at least the light to moderate stuff that would at least produce any accumulation other than that drizzle. monday morning, showers move through, then they are going to move out fairly quickly by monday afternoon, but it will still continue to rain across parts of oregon and california into tuesday. for us passing blow not expecting the big brunt from the storm system at least the main core is going to stay to the north. sunday evening, generally dry across most of the bay, with the exception of the coastline, but by monday morning, showers develop from the north bay, san francisco, down towards the peninsula, even the mountains. monday morning, this is the time frame, see if you have to do traveling outside, slick roads are expected from 7:30 to about 11:00. after that we'll clear out. monday afternoon, we'll see some shine and look at this, this is how you know we're in a drought. when we are talking about hundredths of an inch of rain. we get excited about it and call it a storm system. yeah at least for monday.

suspected shoplifters may not go to the police station if they get caught at one walmart. police and the district attorney have launched a pilot program to allow security guards to obtain the same information police would obtain before releasing them. san jose faces a shortage of police officers and the goal is to free up officers for higher
